A RESOLUTION OF TIE CITY COUNCIL -OF THE
CITY OF ROLLING HILLS WAIVING THE PAYMENT
OF THE FILING FEE:REQUIRED BY ORDINANCE
NO. 33 OF THE CITY OF ROLLING HILLS FOR
VENARD E. KEMP, GEORGE A. MURRELL,
R.L. HILDOM AND L. GORDON LAWRENCE
WHEREAS, VENARD E. KEMP, GEORGE A. MURRELL, R. L. HILDOM
and L. GORDON LAWRENCE are the owners of certain real property
located in the City of Rolling Hills; and
WHEREAS, the above mentioned landowners have received
from the County of Los Angeles, acting as the City of Rolling
Hills Building Department, a permit to build and construct homes
on the real property owned by the above mentioned persons; and
WHEREAS, the County of Los Angeles in error failed tc
require the above mentioned individuals to provide the proper
side yards, front yards or rear yards in said building plans as
required by Ordinance.No. 33; and
WHEREAS, the aforementioned individuals have started
construction of their respective homes in accordance with.said
plans and specifications as approved by the County of Los Angeles,
and when so completed said houses,or homes will be in violation
of the provisions of Ordinance No. 33; and
WHEREAS, the failure of the:County of Los Angeles to
require compliance of the aforementioned individuals with the
provisions of Ordinance',No. 33 occurred through inadvertence
and mistake and not by reason of any fault or negligence of said
individuals;'and
WHEREAS, it is advisable and desirable that said houses
be built in accordance with the provisions of Ordinance No. 33,
and said ordinance provides for the paying of a $25.00 .filing
fee to the City of Rolling Hills for each and every application
for a variance of said ordinance; and
WHEREAS, the City Council of the City of Rolling Hills
deems that it would be fair and equitable to permit the above
mentioned individuals to file applications.for variance with the
Planning Commission of the City of Rolling Hills without the
necessity of paying the $25.00 filing fee required by said
Ordinance No. 33.
NOW, THEREFORE, BE IT RESOLVED that the City Clerk of
the City of Rolling Hills and the Planning Counission of the City
of Rolling Hills are authorized to accept the application for a
variance of Ordinance No. 33 for Venard E. Kemp on Lot 19 Chester-
field, George A. Murrell on Lot 31 Southfield, R. L. Hildom on
Lot 34 Georgeff,'and L. Gordon Lawrence on Lot 7 Southfield
wi•thbut the- pa:ymerit 'of ,a`• filing fee in the sum of $25.00 as re-
quired by said Ordinance"No. 33; and
BE IT FURTHER RESOLVED that the Planning Commission is
authorized to process and act on said applications when so filed
and to render a decision thereon without the payment of said filing fee.
