A RESOLUTION OF:,THE CITY COUNCIL OF THE CITY OF
ROLLING HILLS, CALIFORNIA, ADOPTED UNDER THE
DURESS OF CHAPTER 1852, STATUTES OF 1963, OF THE
STATE OF CALIFORNIA, ACCEPTING,THE IMPOSITION OF
ADDITIONAL HIGHWAY'USERS TAXES AND FEES, AND
SETTING FORTH THE DESIRE OF SAID COUNCIL THAT
APPORTIONMENT BE MADE TO THE CITY OF ROLLING
HILLS IN ACCORDANCE WITH THE PROVISIONS OF THE
LAW HEREINABOVE MENTIONED.
WHEREAS, Chapter 1852 of the Statutes of 1963 of the
State of California adds Section 186.1 to the Streets and
Highways Code, which section provides funds in an amount equal
to the net revenue derived from a one and four one -hundredths
cents ($0.0104) per gallon tax under the Motor Vehicle Fuel
License Tax Law for apportionment among counties and cities
for use exclusively for county road and city street purposes; and
C0 WHEREAS, Section 10.2 of said Chapter provides as follows:
"No apportionment shall be made to any City
or County pursuant to this Section unless it
has adopted a Resolution stating that it ap
proves the imposition of the additional high-
way users taxes and fees... and that it desires
such apportionments to be made to it and has
transmitted a copy of such Resolution to the
Department.";
and
WHEREAS, the City Council of the City of Rolling Hills
desires apportionment to be made to it in accordance with said
Act and is aware of the necessity of conforming to the matching
requirements prescribed by Section 14 of said Act; and
WHEREAS, the City Council of the City of Rolling Hills
disapproves of the legislative theory behind said Act requiring
approval of the imposition of taxes by the Legislature of the
State of California;
NOV. THEREFORE, BE IT RESOLVED, that for the purpose
and only for the purpose of complying with the requirements of
the Act hereinabove mentioned this Council, while disapproving
of the legislative theory involved, nevertheless approves the
imposition of the additional highway users taxes and fees pro-
vided for by said Act, and states that it desires such appor-
tionments as are provided for in said Act to be made to the
City of Rolling Hills; and
FURTHER, BE IT RESOLVED, that the City Clerk is directed
to forthwith send a properly certified copy of this Resolution to
the Department of Public Works at Sacramento, California.
