A RESOLUTION OF THE CITY OF ROLLING HILLS,
CALIFORNIA,'ESTABLISHING A FEE TO COVER THE
EXPENSES INCURRED BY SAID.CITY IN CONNECTION
WITH AN APPEAL TO THE GEOLOGY APPEALS BOARD
WHEREAS, the City Council for the'City of Rolling Hills,
California, 'on August "14,- 1967,. adopted Ordinance No. 70 entitled "An
Ordinance of the*City of Rolling Hills, California Establishing a
Geology Appeals Board" and
WHEREAS,-s&id Ordinance provides for the creation of a
geology appeals board to determine whether the'.decision of the City
Engineer as to whether or not, by reason of geologic conditionsa
building site is unsafe, or -proposed grading work is unsafe, or a
geologic report is required, shall be affirmed,.reversed or modified;
and no provision has been made in the budget of'the City of Rolling
Hills to defray certain costs and expenses in -processing and adminis-
tration of said appeals to sai.d appeals board,
NOW,- THEREFORE,`_BE .IT_ RESOLVED by the City Council. of
the City of Rolling Hills as follows:
(a) Each appellant, at -the time of ,filing a notice or
intention of appeal to said geology appeals board, shall -pay to the
city clerk of the City of Rolling Hills the sumdof $250.00 which is
to be used by the City of Rolling Hills to defray the costs and expenses
'incurred by said city in processing said appeal through saidgeology
appeals board. .. ..
(b)- Be it further =resolved that if said -City- -of Rolling
Hills in processing said appeal through said geology appeals board
,s.pends less than the $250.00 fee provided to be paid herein, then.the
amount of the.difference between the actual. costs and. -expenses incurred
by said city in processing said appeal and the sum of $250.00 shall be
returned' to -the ' appe.11an-t on demand. °
(c) Be it further resolved that if said City of Rolling
Hills in processing said appeal through said geology appeals board
spends more than the $250.00 fee provided to be paid herein, then the
amount of the difference between the actual costs and expenses incurred
by'said city in processing said appeal and the°sum of $250.00 shall be
paid by the appellant to the City on demand® 1___
