RESOLUTION OF THE CITY OF ROLLING HILLS, CALIFORNIA
AUTHORIZING SAID CITY TO EXECUTE A WRITTEN AGREEMENT
FOR THE PURCHASE OF GASOLINE
THIS CONTRACT, made and entered into this 14th day of April, 1969,
by and between the CITY OF ROLLING HILLS, a municipal corporation, herein-
after referred to as "City" and the
CONSOLIDATED FIRE PROTECTION DISTRICT, a body corporate and
politic, hereinafter referred to as "District".
WITNESSETH:
WHEREAS, Title 1, Division 7, Chapter V, Article 1, of the
Goverment Code of the State of California establishes a procedure for
the exercise of powers, to thecontractingparties, where those parties
are within the definition of the term "public agency"; and
WHEREAS, the City and District desire to enter into a joint
powers agreement -for the purpose of providing City -owned vehicles with
gasoline; and
WHEREAS, the City and District have deemed that it will be in
the best interest of the citizens of their respective communities to
provide such services by jointly cooperating therein;
NOW, THEREFORE, in consideration.of the mutual covenants and
conditions hereinafter set forth, the parties and each of them do here-
by agree as follows:
1. The District agrees to supply gasoline to the City to be
used in City -owned vehicles.
2. Said gasoline shall be furnished at the District's Fire
Station located at 12 Crest Road West, Rolling Hills, California.
3. At the time of execution of this contract the total price
of gasoline supplied to City pursuant to this agreement shall be $.24
per gallon, including current overhead charges.
4. City agrees to pay a reasonable amount to be determined by
the Auditor of the County of Los Angeles for overhead in the transport-
ation, storage, maintenance, and delivery of the gasoline to be furnished
under this contract.
5. District agrees to give prompt notice to City of any change
in, the total cost per gallon, and the City agrees to pay District for
all gasoline supplied at the rate of $ ,24 per gallon or at such re-
vised rate as may later be determined by the County Auditor -Controller
to adequately cover District's cost of supplying gasoline pursuant to
this agreement.
6. It is specifically understood that City shall use the
gasoline .furnished under this contract only in City -owned vehicles.
7o It is specifically understood that District will supply
such gasoline as may be available depending upon any.emergency con-
ditions and requirements which may arise.
80 This agreement shall have an operative and effective date
of April 145 1969, even though later executed and shall continue in.
effect from year to year unless either party hereto gives written
notice of termination not less than 60 days prior to the annual
termination date.
9. The District, its officers, and employees shall not be
deemed to assume any liability for unintentional or negligent acts of
said City'or of any officer or employee thereof.
10. The District agrees to bill the City on a quarterly
basis for service performed under'thi.s contract.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement the day and year above written.
