0312/�J RESOLUTION NO, 312 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA, REGARDING CONFLICT OF INTEREST WHEREAS, the City Council of the City of Rolling Hills believes that the residents of the City of Rolling Hills should be assured that all governmental decisions and actions should be impartially made and that the City's offices should not be used for, personal gain, other than the compensation ordered to be paid to each official by the City Council; and WHEREAS, it is the opinion of the City Council that special in- terests should be prevented from unduly influencing governmental decisions and policy, and that all such decisions and policies should reflect the interests of the residents of the City of Rolling Hills; and WHEREAS, it is in the best interests of the residents of the City of Rolling Hills to be informed of any personal economic interests which may present a conflict of interests between the City officials' public duty and trust and private gain; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rolling Hills as follows: 1. No City official shall have any economic interest or social or moral obligations which are in substantial conflict with the proper exercise of his official duties and powers; 2. No City official shall participate in, or in any way attempt to influence governmental action or decisions, within the responsibilities of his office, wherein he knows or has reason to believe that he or she has an economic inter- est or a social or moral obligation; 3. At such time or times designated by the Mayor of the City of Rolling Hills, each official of the City shall file with the City Clerk a statement which shall set forth in detail any economic interest he owns or controls, directly or indirectly, within the geographic limits of the City of Rolling Hills; 4. For the purposes of this Resolution "economic in-. terest" is defined as: (a) Real property having a value of more than $100. (b) Any source of income, loans or gifts received from a resident of the City of Rolling Hills or the owner of property in the City of Rolling Hills, or his agent or assignee; (c) Any source of income, loan or gift re- ceived from any business entity which has filed or has pending an application requesting permission to perform or conduct any discretionary or legislative act within the geographical limits of the City of Rolling Hills; 5. For the purposes of this Resolution "public offi- cial" means any officer, administrative or legal, who is appointed by the Mayor or the City Council of the City of Roll- ing Hills. 6. The District Attorney or any group of residents of this City may bring an action in Superior Court to enjoin viola- tion of -or compel compliance with,the provisions of this Reso- lution:. (a) Upona preliminary showing that there are reason- able grounds to believe that a violation of this resolution has occurred, the court may restrain the execution of .any decision, contract, order, permit, resolution or other, official act in relation to which a violation of this Resolution is alleged to have occurred, pending final adjudication, provided that any injury suffered by innocent persons does not out- weigh the public interest in a temporary stay of the act. If it is ultimately determined that a violation has occurred, the court may set aside as void any decision, order, permit, resolution, contract or other official action affected by the violation. (b) If it is determined that a violation of this resolution has occurred, and if the public official who committed the violation realized an economic benefit as a result of the action or decision., the court may impose a penalty against the public offi- cial of up to three (3) times the value of the benefit. (c) If it is determined that an interest which should have been disclosed in. the report required by Section 3 of this Resolution was omitted, the court may impose a penalty of up to three (3) times the value of the omitted interest.
