0316RESOLUTION NO.. 316 RESOLUTION OF THE CITY COUNCIL OFTHE CITY OF ROLLING HILLS, CALIFORNIA, PROVIDING FOR FUNCTIONS AND SERVICES FOR RESIDENTS OF SAID CITY AND FOR THE FINANCING THEREOF WHEREAS, there are -two governmental bodies in the City of Rolling Hills whose geographical boundaries are substantially in all respects co -terminus; one .is,the City of Rolling Hills, a municipal corporation (hereinafter "City") and the second is Rolling Hills Community Association of Rancho Palos Verdes, a non-profit corporation (hereafter "Association"); and WHEREAS, the Association derives its power and authority to carry out certain governmental functions by,virtue of numerous declarations of restrictions which are recorded in the County Recorder's Office of Los Angeles'County and which affect each and every parcel of property under the jurisdiction of said Association; and WHEREAS, the Association has other powers and duties and is enjoined to perform certain obligations for and on'behalf of each and every member of said Association, which duties and obligations are set forth in the Articles of Incorporation and in the By -Laws of said Association;. and WHEREAS, the City of Rolling Hills is a general law city and its powers, duties and obligations are set forth in the Government Code of the State of California and in other related Codes of said State, and the Ordinances.and Resolutions adopted by the City Council of said City of Rolling Hills, pursuant to the authority of the Government Code of the State of California; and WHEREAS, the City of Rolling Hills is required and enjoined by the Government Code and the Ordinances of the City to provide certain services and governmental functions; and WHEREAS, the City and the Association each act independently of the other and both have the authority to tax and raise funds for the purpose of carrying out their respective duties, obligations and func- tions; and WHEREAS, the Association, since its incorporation in 1936, has consistently maintained in the area under its jurisdiction a community which is rural in character and remotely isolated from the urban areas surrounding it; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: la That the Association shall, in accordance with its Arti- cles of Incorporation,Declarations of Restrictions, and its By -Laws, be responsible for the control, operation and maintenance of all gates and gate houses at the entrances to the City of Rolling Hills; the maintenance, construction and repairing of all roads and road- ways officially designated by said Association as part of the Associations road System; the maintenance and construction of all bridle trails in the City; the management and control of all recrea- tional facilities; the control and regulation of all architectural design of new residences or additions to existing residences, and the ,subdivisions of divisions of land which create additional building sites. 20 It shall be the obligation of the Association to provide funds for the cost of performing the above services and functiong, including the administrative expenses required -to enforce the Declarations of Restrictions, from taxes assessed and levied upon its members in accordance with the powers given to it by the Declarations of Restrictions and its Articles of Incorporation. 3. That the City shall cooperate with the.Association in all respects to further the Associations- efforts,.and ,polibi.eg,,-to main- tain the rural character and privacy of 'the area °within the' dity °g.. boundaries, and shall perform and carry;out.,all municipal and govern- mental functions which are not performed'by the`Assoclation, and which the City is required to perform or provide by the Government Code of the State of California and other Codes relating thereto. 4. The City shall levy and collect ad valorem taxes on each parcel of land in the City and other fees and charges authorized by law for that purpose, f 5. The City shall not receive or expend any funds which may be allocated or offered to be distributed to it by any governmental agency for the maintenance, repair or construction of any of the roads or roadways in the City of Rolling Hills. 6. The City shall provide law enforcement, drainage, and other matters which relate to the public health, safety and welfare of the residents of the City, including the maintenance of public areas and spaces other than those which are used for recreational facilities, gate houses, roads or roadways, and expenses incurred in the administration and the operation of said City. 7. The Association may, by written agreement, contract with the City for administrative personnel and facilities to perform its administrative duties and obligations, as set forth in this agreement, at a cost to be agreed upon by the City and the Association. 8. All recreational facilities now owned, maintained and operated by the City shall be leased by the Association at a rental which shall be based on the fair market value of the facilities so leased and thereafter said facilities shall be operated and maintained' -by the Association for the exclusive use of its members and the residents of the City of Rolling Hills.
