A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ROLLING HILLS APPROVING
TENTATIVE TRACT MAP NO. 33871
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
The Council finds that the Environmental Impact
Report does not identify any significant environmental
impacts associated with the proposed access (generally known
as the southerly access) to the subdivision. As is set'
forth with greater specificity in the Report, the reasons why
the access results in no signif.iciant impact are that the
proposed street is fundamentally sound from a traffic.
engineering viewpoint and estimated to carry a minimal
traffic flow, resulting in an insignificant increase in the
number of noise events in the vicinity.
The Environmental Impact Report describes mitigation
measures which, when incorporated in the project, will
minimize the minor impacts created by the proposed access.
These mitigation measures include:

Section 1. An application was duly filed by
Chacksfield-Merit Homes with respect to real property
described .in Exhibit A attached hereto, requesting approval
of a tentative tract map for an eight lot single-family
residential subdivision. Public hearings.were duly held on
August 31 and December 13, 1982 in the Council Chambers,

City Hall, 2 Portuguese Bend Road, Rolling Hills, California

and a notice of the time, date, place and purpose of the
aforesaid hearing was duly given.

Section 2. Evidence, both written and oral, was
duly presented to and considered by the City Council at the
aforesaid public hearing.
Section 3. The City Council has reviewed and
considered the Initial Study and Negative Declaration
prepared for the project prior to making its decision
thereon. The Council finds that the proposed map will not
have a significant effect on the environment as indicated in
the Initial Study and Negative Declaration.
In addition, an Environmental Impact Report has
been prepared in connection with the means of access to the
subdivision proposed in the map by the applicant. The City
Council hereby certifies that said final Environmental
Impact Report was completed pursuant to the provisions and
requirements of the California Environmental Quality Act and
the Guidelines thereto, and that the Council has reviewed
and considered the contents of said Report prior to making
its decision whether to approve the tentative tract.

1. Modification of connection to Johns Canyon
Road to minimize the "semi -button hook" configuration now
indicated on the plan.
2. Modification of the gradient of the roadway at
Johns Canyon Road to provide a 50 foot landing with gradient
of no more than two percent.
3. Maintain the trees and shrubbery adjacent to
the roadway so as to ensure adequate sight distance from the
access to the south.
4. Landscaping with an automatic or drip irrigation
system is to be installed along the southerly boundary of
the tract adjacent to the access roadway, and is to be
completed or bonded for prior to recordation of the finale
map. Said landscaping is to be maintained weed and disease.

from date of installation. The landscaping materials,
gallonage and blossum coloring are to be approved by the.
staff of the city of Rolling Hills upon consultation with a
committee specializing in landscaping serving the Community .
Association of Rolling Hills. This landscaping plan is
intended for purposes of.screening adjacent residential uses
by bulk and height.
The City Council has considered alternative means
of access to the proposed subdivision in connection with its..
review of the Environmental Impact Report. As is in
in the Report, the access generally known as the "northerly
access", as with the southerly access, will not result in a
significant environmental impact. The Council determined to
utilize the northerly access for an equestrian trail and to
require the applicant to perform the necessary improvements
for construction of the trail. The Crenshaw Boulevard
alternative was rejected due to the potential safety hazards
and the excessively steep grade identified in the Report.
Section 4. The City Council finds, pursuant to
Section 66474 of the California Government Code and Section
16.12.150 of the Rolling Hills Municipal Code, that: .
1. The proposed map which will permit the residential
development of the subject property is consistent with the
General Plan which designates said property for low density
residential uses. The proposed access to the map is consistent
with the Circulation Element of the General Plan and utilizes
an existing easement which was dedicated for purposes.of
access to the site.
2. The design and improvement of the proposed
subdivision for residential uses is consistent with the
General Plan which designates the subject property for low
density residential uses. The proposed street improvements,
building sites, grading, drainage improvements, utility
system and overall physical layout meet city standards and
Municipal Code requirements.
3. The site is physically suitable for the single-

family residential development proposed. The approximately
twenty acre parcel easily accommodates eight single-family
lots and supporting infrastructure.
4. The site is physically suitable for the
proposed density, of development, in that the two -plus acre
lots are more than adequate for the proposed single-family
purposes.
5. The design of the subdivision and its proposed
improvements and development will not have a significant
effect on the environment as indicated in the Initial Study
and Negative Declaration and focused Environmental Impact.
Report prepared for the proposed project. Specifically, the
proposed southerly access will not have a significant effect
on the environment because of the minimal amount of traffic
to be generated by the proposed subdivision, the low frequency
of new noise events and the engineering of the roadway is
safe for vehicular traffic. Mitigation measures. have been
incorporated in the project which minimize even the insig-
nificant impacts which have been identified in the Report.
6. The design of the subdivision and its proposed
improvements and development will not cause serious public
healthproblems as the existing fire fighting facilities and
sewage system are adequate to meet the needs of the proposed
subdivision. Introduction of new noise events is well
within the parameters of a quiet, residential neighborhood,
as is set forth in the Enviromental Impact Report.
7. There are no easements acquired by the public
at large for access through or use of property within the
proposed subdivision.
8. The discharge of waste from the proposed
subdivision into the existing sewer system will not result
in the violation of the existing requirements prescribed by
the Regional Water Quality Control Board as the proposed
sewer system has adequate capacity to handle any discharge
of waste from the proposed subdivision.
Section 5. Based on the aforementioned findings,
the City Council hereby approves Tentative Tract Map No.
33871 with respect to the property described in Section 1
hereof subject to the conditions set forth in Exhibit "B"
attached hereto.

Exhibit "B"
Stipulations/Conditions, Tentative Tract 33871
The Subdivider shall comply with the following
1. Provide a private street as shown as "Street " A"
on Tentative Tract Map 33871, which.shall be twenty two (221)
feet in width, commencing at.the westerly edge of the easement
line of Johns Canyon Road and continuing westerly to the easter-
ly boundary of .Tract No. 33871. Increase the width of Street A
to thirty feet (301) from the easterly boundary to the terminus
of said private street.
2. Show lot lines to the centerline of Street "A".
3. Show bridle trail and utility easements on the
final map of the tract, in accordance with Section 11-2.227
of the Subdivision Ordinance of the City of Rolling Hills.
4. Provide underground utilities in accordance with
f" Section 11-2.224 of said Subdivision Ordinance.
Z5. Provide grading and drainage structures to the
V satisfaction of the City Road Department.

6. No more than two lots shall front on the turning
area at the end of any cul-de-sac and the abutting footage of
each lot fronting on such turning area shall be substantially
the same in accordance with Section 11-2.155 of said Subdivision
Ordinance.
7. Because of the terrain and characteristics of the
property to be subdivided, and title limitations, lot width re-
quirements required by Section 11-2.154(b) are.modified and the
proposed lot widths shown on said tentative map are approved.
8. By reason.of the rough terrain, contours.of the
land and title limitations, the depth..requirements for.the lots
in the tract as required by Section 11-2.154(d) of the Subdi-
vision Ordinance are modified, and the proposed depth require-
ments shown on said tract are approved.
9. Subdivider shall provide improvements on Street A,
a private street, to,the satisfaction of the Road Department
.of the City of Rolling Hills, in' accordance with Sections 11-
2.205 and 11-2.203 of the Subdivision Ordinance.
10. Subdivider shall provide a.radius for the bulb
of the cul-de-sac of no less.than thirty-two (32') feet.
11. Subdivider shall provide standard property line
returns in accordance.with Section 11-2.165 of said Subdivision
Ordinance.
12. Subdivider shall provide proof of access to the
tract to the satisfaction of the City Engineer.
13. Subdivider shall offer Street A as a private
street, in accordance. with Section 11-2.160 of said Subdivision
Ordinance.
.14. Subdivider shall improve the entrance angle of
Street A, at its intersection with Johns Canyon.Road, to the
satisfaction of the Road Department of the City of Rolling
Hills, and as noted herein as a mitigation contained in .the
Environmental Impact Report.
15. Subdivider shall provide a drainage system as
required and to the satisfaction of the Road Department of
the City of Rolling Hills.
16. Because of the rough terrain and title limitations,
footage requirements of the lots along the street easement line as
required by Section 11-2154(a) of'said Subdivision Ordinance are
modified, and the lot footages along the street easement line as
shown on said tentative tract map are approved.
17. Subdivider shall pay his proportionate share,of the
cost of improving Johns Canyon Road from the intersection of the
proposed access road southerly to Crest Road, such share to be
determined by the City Manager of the City of Rolling Hills after
consultation with the City Council.
18. Subdivider shall offer equestrian trail easements with
graded improvements along the northerly boundary of the tract, to the -
satisfaction of the City of Rolling Hills.
19. Compliance with Section 66473.1 of the State of California
Government Code relating to natural cooling and passive solar usage is
to occur when structural placement is considered. This is to be an
extension of the reviewing process after lot configuration and designs
are set, since the proposed parcels are generally two acres in size, and
substantial space is available for solar, wind and element usage evalu-
ation when development occurs.
20. Modify connection to Johns Canyon Road to minimize the
"s,mi-button hook" configuration now indicated on the plan.(EIR miti-
gation).
21. Modify the gradient of the roadway at Johns Canyon Road
to provide a fifty (50') foot landing with gradient of no more than
two (270) percent (EIR mitigation).
22. Maintain the trees and shrubbery adjacent.to the roadway
so as to ensure adequate sight distance from the a..:cess to the south
(EIR mitigation).
23. Landscaping with an automatic or drip irrigation system
is to be installed along or near the southerly boundary of the tract
adjacent to the access roadway, and is to becompleted, or secured by
cash or bonding, prior to recordation of the final map. Said land..
scaping is to be maintained weed and disease free by the property
owner for a period of twenty-four (24) months from date of installa-
tion. The landscaping material, gallonage and blossum coloring are
to be approved by the staff of the City of Rolling Hills upon consult-
ation with a committee specializing in landscaping serving the Community
Association of Rolling Hills. This landscaping plan is intended for,
purposes of screening adjacent residential uses by bulk and height,.
24. Drainage plans for the access roadway (Morgan Lane) and
westerly thereof are to be prepared and approved by the City Engineer.
25. A themed white rail fencing plan along all sides of the
private bridle trails along specified portions of the perimeter of the,.-.
subdivision is to be prepared by the applicant or owner, and,approvdd
by the City Council and installed or provisions made for installation
(bonding) prior to recordation of the final map for Tract 33871. This
fencing is to include; but not be limited to, the bridle trail along
the northerly roadway easement obtained via approval and recordation
of Tract 30605, the easterly portion of the subdivision connecting with
the trail from the Crestridge area, the area adjacent the.flood control
easement and along the tract boundary whic'i fronts on Crenshaw Boule-
vard to the first angle point or height differential starting up to
the plateau.
26. Northerly roadway easement obtained via approval of
Tract 30605 is to be opened, cleared and fenced to a width of fifteen
(15') feet, and used as a private community roadway which is to include
a bridle trail and availability for potential vehicular and emergency..
access. The roadway may meander throughout the existing sixty (60')
foot easement and shall be constructed in a manner as to minimize the
destruction of trees. This is to be done by the developer at no ex-
pense to the City of Rolling Hills. The improvements are.to be com-
pleted prior to final recordation of Tract 33871.
