RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING
HILLS SETTING FORTH FINDINGS WITH RESPECT TO LOCAL
CONDITIONS WITHIN THE CITY OF ROLLING HILLS WHICH
MAKE CERTAIN MODIFICATIONS AND CHANGES TO THE 1981
LOS ANGELES COUNTY BUILDING AND. FIRE CODES (1979 UBC;
1976 UFC) REASONABLY NECESSARY AS ESTABLISHED IN
ORDINANCES NO. 199 AND 200
The City Council of the City of Rolling Hills does hereby
resolve as follows:
Section 1. The California State Health and Safety Code,.
Section 17958, mandates that the City of Rolling Hills adopt ordi-
nances.or regulations imposing the same requirements as are contained
in the regulations adopted by the State pursuant to said Health and
Safety Code Section 17922.
Section 2. The State of California is mandated by Section
17922 of the Health and Safety Code to impose the same requirements
as are contained in the most recent edition of the Building and Fire
Codes of the International Conference of Building Officials and Western
Fire Chiefs' Association (herinafter referred to as Codes).
Section 3. The California State Health and Safety Code,
Section 17958.5, permits a.City to make such changes or modifications
to the Codes as are reasonably necessary because of local conditions,
and further, Section 17958.7 requires the City Council, before making
any changes or modifications, to make express findings that such
changes or modifications are needed.
Section 4. The City of Rolling Hills staff, upon.completion
of consultation with the County of Los Angeles Building and Safety
Division, who administered the Codes as an agent for the City, has
advised the City Council that changes and modifications to the Codes
are reasonably necessary due to local -conditions in the City of
Rolling Hills, and has further advised that the remainder of said
changes and modifications are of an administrative or procedural
nature due to the contract city nature of Rolling Hills in relation
with the County of Los Angeles, or concern themselves with subjects
not covered by the Code., or are reasonably necessary to safeguard
life and property within the City of Rolling Hills.
Section 5. The City Council herein accepts the staff
findings outlined in Section 4 and the administrative amendments
and findings pursuant.to the Health and Safety Code Section 17958.7
made by the Los Angeles County Board of Supervisors in enacting the
Codes, and further finds that local topographic conditions in the
City of Rolling Hills are such that extreme fire hazard conditions
exist, and moreover, the topographic conditions of the hillsides and
potential for landslides should grading not'be fully evaluated, and
lengthy private roads with extensive cul-de-sacs make the Fire.Depart-
ment access difficult in the event of fire,.necessitating clearances
from structures. These physical and topographic conditions make it'
necessary to require grading permits for earth movement and clearance
from structures.
