0533RESOLUTION NO. 533 A RESOLUTION OF,THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA, DESIGNATING PERSONS AUTHORIZED TO RECEIVE SUMMARY CRIMINAL HISTORY INFORMATION THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1: Penal Code Sections. 11105 (b) (10) and 13300 (b). (10) authorize the City_of Rolling Hills to obtain state and local summary criminal history information for employment, licensing, or certification purposes. SECTION 2: Said Sections authorize such information to be given to the City to assist the City "in fulfilling employment, certification, or licensing duties, and when such access is specifically authorized by the... City Council when such criminal history information is required to implement a statute, ordinance, or regulation that expressly refers to specific criminal conduct applicable to the subject person of the summary criminal history information, and contains requirements or exclusions, or both, expressly based upon such specified criminal conduct." SECTION 3: Said Sections require the City Council to specify those City officers and employees who require summary criminal history information for employment, licensing, or certification purposes. SECTION 4: The City Manager and City Attorney are hereby authorized to receive summary criminal history infor- mation for employment, licensing, or certification purposes. SECTION 5: The City of Rolling Hills will not consider a person who has been convicted of a felony or a misdemeanor involving moral turpitude eligible for employment, licensing or certification. Such conviction may be disregarded if mitigating circumstances exist, or the conviction is not related to the employment or license in question.
