0682RESOLUTION NO. 682x: ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA APPROVING THE APPLICATION FOR GRANT. FUNDS UNDER THE ROBERTI-Z'BERG-HARRIS URBAN OPEN SPACE AND RECREATION PROGRAM FOR INTERPRETIVE SIGNAGE FOR GEORGE F. CANYON. THE CITY COUNCIL OF THE CITY,'OF ROLLING HILLS DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Legislature of the State of California has enacted the Roberti-Z'berg -Harris Urban Open Space and Recreation Program, which provides funds to certain political subdivisions of the State of California for acquiring lands and for developing facilities to meet urban recreation needs; and WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility for the administration of the program, setting up necessary 'procedures governing application by local agencies under the program; and WHEREAS, said procedures established by the State Department of Parks and r i Recreation require the applicant to certify by resolution the approval of applications prior LIT to submission of said applications to the State; and m Q WHEREAS, said applications contain a certification that the applicant; will comply with all federal, state and local environmental, public .health, relocation, affirmative action, and clearinghouse requirements and all other appropriate codes, laws and regulations prior to the expenditure of the grant funds; and WHEREAS, the project applied for under this program must be of a high priority and satisfy the most urgent park and recreation needs, with emphasis on unmet needs in the most heavily population areas; and WHEREAS, a Joint Exercise of Power Agreement between the City of Rolling Hills and the City of Rolling Hills Estates approved and adopted on June 8, 1992, this City did declare its intent to authorize its grant funds under the Roberti-Z'berg-Harris Urban Open Space and Recreation Program to be utilized by the City of Rolling Hills Estates; and WHEREAS, the City of Rolling Hills Estates has agreed to utilize the funds from the City of Rolling Hills for interpretive signage for George F. Canyon, which will be utilized by the City of Rolling Hills' citizens; and WHEREAS, the applicant will enter into an agreement with the State of California for acquisition or development of the project. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: Approves the filing of an application for the Roberti-Z'berg-Harris Urban Open Space and Recreation Program; and 2. Certifies that said agency understands the general provisions of the agreement, and 3. Certifies that the City of Rolling Hills Estates has or will have sufficient funds to operate and maintain the project funded under this program; and 4. Certifies that said agency has or will have available, prior to commencement of any work on the project included in this application, the required match; and 5. Certifies that the project included in this application conform to the recreation element of any applicable city or county general plan; and 6. Appoints the Community Services Director as agent of the City of Rolling Hills Estates, to conduct all negotiations and execute and submit all documents including, but not limited to, applications, agreements, amendments, payment requests, and so on that may be necessary for the completion of the aforementioned project; and 7. Appoints the City Attorney for Rolling Hills. Estates as legal counsel for said agency with authorization to sign the certification on Page 1 of the application. CANYON. was approved and adopted at a regular meeting of the City Council on June 8, 1992 by the following roll call vote: AYES: Councilmember Heinsheimer, Mayor Pro Tem Murdock and Mayor Swanson, NOES: None. ABSENT: Councilmembers Leeuwenburgh and Pernell. ABSTAIN: None Deputyity Clerk This is a JOINT EXERCISE OF POWER AGREEMENT entered into this 26th day of May, 1992, by and between the CITY OF ROLLING HILLS ESTATES, hereinafter referred to as "CITY" and the CITY OF ROLLING HILLS, hereinafter referred to as "APPLICANT CITY." WHEREAS, the CITY agrees to install interpretive signage in George F. Canyon; and WHEREAS, the APPLICANT CITY has an allocation of $7.67.00 from the grant program under the Roberti -Z'Berg -Harris Urban Open Space and Recreation Program, which the APPLICANT CITY wishes to be transferred to the CITY for development of said open space; and WHEREAS, the State of California is willing that said funds be used for the construction of interpretive signage at said open space upon the APPLICANT CITY signifying its approval for said use and making the certification and appointment as set forth in that certain Resolution No. 682, authorizing its grant under the Roberti-Z'Berg-Harris Urban Open Space and Recreation Program to be utilized by the CITY; and WHEREAS, in order to effectuate said fund use, the State of California wall require the CITY and its City Manager to execute Project Agreement in form. NOW, THEREFORE, IT IS AGREED: 1) That in consideration of APPLICANT CITY adopting Resolution No. 682 authorizing the use of said Roberti-Z'Berg-Harris funds for the improvements of George F. Canyon, the CIT'i does covenant and agree as follows: (a) That said funds will- be used by CITY for the improvements at George F. Canyon; (b) That CITY will indemnify, hold harmless and defend APPLICANT CITY, its officers, agents and employees against any and all claims, demands, damages, costs, expenses or liability to the State of California on account of the receipt, use and disbursement of said funds and resulting from CITY's breach, if any, of the Project Agreement or the CITY's failure, if any, to comply with the agreements, covenants and conditions met forth in said Project Agreement, IN WITNESS WHEREOF, the APPLICANT CITY and the CITY Lave caused this Joint Exercise of Powers Agreement to be executed by their duly authorized officers the day and year hereinafter set forth.
