07361 RESOLUTION NO.736 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS ADOPTING THE NONDISPOSAL FACILITY ELEMENT REQUIRED BY THE CALIFORNIA INTEGRATED WASTE MANAGEMENT ACT AS AMENDED BY ASSEMBLY BILL 3001. THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY FIND AND RESOLVE: WHEREAS, California law [the California Integrated Waste Management Act (Act) as amended by AB 3 0 01 ] requires California cities and counties to prepare a Nondisposal Facility Element; WHEREAS, a nondisposal facility is defined by Public Resources Code Section 40151 as any solid waste facility required to obtain a state solid waste facility permit other than solid waste disposal and transformation facilities (i.e., transfer stations, materials recovery facilities (MRFs), and yard waste composting facilities); WHEREAS, the City of Rolling Hills intends to use existing and proposed nondisposal facilities to reach its mandated diversion goals; WHEREAS, the NDFE must include a description of new facilities and the expansion of existing facilities needed to implement the City's Source Reduction and Recycling Element (SRRE) and must reflect only information available to the City at the time the NDFE is prepared; WHEREAS, in order to further implement the NDFE, the City Council held a noticed public hearing on May 9, 1994 to receive comments on the NDFE in accordance with PRC Sections 417 3 0 , et seq.; and therefore, The City Council of the City of Rolling Hills resolves as follows: Section 1. The City has identified one or more new, existing, expanded, or proposed nondisposal facilities to use now or in the future to help it implement its SRRE. Section 2. The City has submitted its draft of the NDFE to the County of Los Angeles, Local Task Force, and has addressed the LTF's comments to the extent practicable. Section 3. The City intends to append the NDFE to the City's SRRE at the time of the five year revision. Section 4. The City Clerk shall certify the adoption of this Resolution and shall forward a copy of this Resolution to the COUNTY OF LOS ANGELES, LOCAL TASK FORCE and THECAL RNIA INTEGRATED WASTE MANAGEMENT BOARD.
