0841RESOLUTION NO. 841 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS APPROVING A SECOND MODIFICATION TO TENTATIVE PARCEL MAP NO. 21400, SUBDIVISION NO. 82, A PREVIOUSLY APPROVED SUBDIVISION OF A 7.826 ACRE LOT ::INTO THREE SINGLE-FAMILY RESIDENTIAL LOTS FRONTING THE WESTERN SIDE OF PINE TREE LANE IN ZONING CASE NO. 566. THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. A. An application was duly filed by Mr. and Mrs. William Hassoldt with respect to real property at Lot 85-RH, and currently, known as 10 Pine Tree Lane, Rolling Hills, requesting to modify certain conditions of approval of Tentative Parcel Map No. 21400 relating to roadway improvements. B. Tentative Parcel Map No. 21400 was originally approved by the City Council by Resolution No. 748 on August 22, 1994. This tentative parcel map involves the subdivision of a 7.826 acre existing lot that has one residential unit into three single-family residential lots fronting the western side of Pine Tree Lane. C. On August 11, 1997, a modification (Modification No. 1) of Tentative Parcel Map No. 21400 was approved by the City Council by Resolution No. 825. The tentative map was modified to construct a cul-de-sac bulb at the terminus of Pine Tree Lane on Parcel 3 of the subject property as an alternative to constructing that bulb on property that is not the subject of this Parcel Map located at 16 Pine Tree Lane (Lot 81-RH). That modification also included an extension of the tentative map by five (5) years to August 22, 2002 (includes a one (1) year automatic extension pursuant to Government Code Section 66452.13 and a five (5) year discretionary extension pursuant to Government Code Section 66463.5(c) from the original expiration date of August 22, 1996). D. The conditions of approval now proposed for modification (Modification No. -2)-relate -to-the _required _roadway. imp rove ments _along .Pine .Tree _Lane. _Specifically, _the applicants have requested modification of Condition No. 32 which requires the subdividers to reconstruct the entire length of Pine Tree Lane to 20 feet in width with an additional four foot decomposed granite pathway. The applicants are requesting the condition be modified to allow the roadway to be reconstructed to 18 feet in width with an additional 8 foot wide decomposed granite pathway and fire safety area alongside of the. pavement at each of four of the five fire hydrants on Pine Tree Lane. The fifth fire hydrant is located at the cul-de-sac terminus of Pine Tree Lane. In response to the applicants' proposed modification, the City referred the matter to the Los Angeles County Fire Department for its review. Section 3. On February 17, 1998, the Planning Commission approved Resolution No. 98-3 recommending that the City Council approve modifications to the previously approved subdivision. The Planning Commission considered this item at a public hearing on November 18, 1997, December 16, 1997, January 20, 1998, and February 17, 1998, and at a field trip visit on February 7, 1998. During the hearing process, information was presented indicating the intent of the applicants to modify the currently required roadway widening improvements of Pine Tree Lane. Section 4. The City Council considered this item at a public hearing on April 13, 1998 and April 27, 1998, and at a field trip visit on April 23, 1998. Section 5. Following the City Council public hearings on this matter and in further consultation with the Fire Department, the applicants modified their request to show Pine Tree Lane with a minimum of eighteen (18) feet in roadway width and four sections totaling 200 feet where the roadway would be widened to include an eight (8) foot decomposed granite pathway that would meet County Fire Department all weather access standards. The City was advised by representatives of the County Fire Department, at the City Council's meeting on April 27, 1998, that the roadway, as modified, would satisfy the Fire Department's standards. Resolution No. 841 -1- Section 6. Pursuant to Section 16.12.150 of the Rolling Hills Municipal Code, a tentative map shall be rejected under certain conditions. Based upon substantial evidence presented to the City Council of the City of Rolling Hills regarding the proposed modifications during the public hearings referenced in Section 4 and 5, including public testimony and written and oral staff reports, the City Council finds as follows: A. The proposed subdivision map and the design and improvement of the proposed subdivision as modified is consistent with the applicable General Plan, including but not limited to, the following goals and policies of the General Plan: 1. Maintain Rolling Hills' distinctive rural residential character. (Land Use Element, p. 15.) 2. Accommodate development which is compatible with and complements existing land uses. (Land Use Element, p. 15.) 3. Accommodate development that is sensitive to the natural environment and accounts for environmental hazards. (Land Use Element, p. 16.) 4. Provide for housing which meets the needs of existing and future Rolling Hills residents. (Housing Element, p. 44) 5. Maintain and enhance the quality of residential neighborhoods in Rolling Hills. (Housing Element, p. 44) 6. Promote housing opportunities for all persons regardless of race, religion, sex, marital status, ancestry, national origin or color. (Housing Element, p. 45.) 7. Conserve and enhance the City's natural resources, facilitating development in a manner which reflects the characteristics, sensitivities and constraints of these resources. (Open Space and Conservation Element, p. 15.) B. The site is physically suitable for the proposed density and type of development. The proposed use, density, and proposed subdivision improvements as modified are permitted in the RA -S-2 zone. Parcel 1 is 2.07 acres net, Parcel 2 is 2.07 acres net, and Parcel 3 is 2.01 acres net. All proposed lots exceed the minimum 2 -acre lot size of the RA -S-2 zone. C. The design of the subdivision and proposed modifications are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat, because the property is within an area of the City, designated for development. The initial study prepared for the project did not identify the site as containing unique or sensitive environmental qualities and no threatened, rare or endangered plant or animal species were identified during review of the project. D. The design of the subdivision or type of improvements as modified are not likely to cause serious public health problems because conditions of approval have been applied to the project to require compliance with applicable codes and ordinances designed to protect public health and safety. E. The design of the subdivision or type of improvements as modified will not conflict with easements acquired by the public at large for access through or use of property within the proposed subdivision. This is because existing roadway easements will be maintained or expanded by this project and adequate access will be provided to these parcels and adjacent parcels. In addition, the parcels will contain perimeter easements providing access for roads, trails, and public utilities. As a condition of approval, these easements will be recorded in deeds prior to approval of the final map. F. The proposed subdivision as modified will not adversely affect the housing needs of the region. G. The proposed use as modified will be in substantial compliance with the provisions of the Residential Development Standards in the Rolling Hills Zoning Ordinance. Resolution No. 841 -2- H. The proposed use as modified will be compatible with other existing residential development in the immediate area. I. The tentative map_ design as modified provides,,:for future .passive or natural heating or cooling opportunities in the subdivision to the extent feasible because the project is designed with lots of adequate dimensions to maximize the opportunities for passive and natural heating and cooling. J. The tentative map as modified does not propose to divide land which is subject to a contract entered into pursuant to the California Land Conservation Act of 1965, because the property in question has not been included in any such contract. K. Pursuant to Section 66474.6 of the Subdivision Map Act, the discharge of waste from the proposed subdivision as modified into proposed septic systems will not result in violation of existing requirements prescribed by the California Regional Water Quality Control Board, because the applicant is required to comply with all Conditions of Approval regarding waste disposal contained in Section 11 of Resolution No. 748. L. Pursuant to the Rolling Hills Municipal Code Section 16.12.155, this Tentative Parcel Map as modified is consistent with, and does not impact, the County of Los Angeles Hazardous Waste Management Plan. Section 7. Based on the findings contained in Section 5 and all other evidence in this matter, including a field trip visit to Pine Tree Lane and the determination and comments made by the County Fire Department, the City Council finds that the proposed design of Pine Tree Lane is reasonable and that it will provide adequate access during emergencies for the ingress and egress of vehicles for residents and fire safety personnel. This determination takes into account the specific topography of the area, the configuration of the existing roadway, the number of homes served by the roadway, the size and location of each of the proposed areas of the roadway to be widened, and all other relevant factors. Section 8. Based upon the information and evidence submitted and the findings specified in Section 5, 6, and 7, the City Council approves the following modifications to Tentative Parcel Map No. 21400, approved by City Council Resolution No. 748, dated August 22, 1994: A. Paragraph 32 of Section 13 of Resolution No. 748 is amended as follows: "32. The subdivider shall reconstruct the base and pavement of the entire length of Pine Tree Lane from Portuguese Bend Road to and including a new cul-de-sac on Parcel 3 of the subdivider's property. The reconstructed roadway shall be eighteen (18) feet in width for the entire length of Pine Tree Lane except that it shall be widened at four (4) specific fire hydrant locations totaling 200 feet of roadway length, as shown on Exhibit A to this approval. The first fire hydrant on Pine Tree Lane measured down from Portuguese Bend Road shall be relocated twenty-five (25) feet uphill (south) from its existing location. The second fire hydrant on Pine Tree Lane measured down from Portuguese Bend Road shall be relocated sixty-five (65) feet downhill (north) from its existing location. Minor adjustments to the locations of the fire hydrants may be permitted upon approval of the Fire Department. The first widening of Pine Tree Lane shall commence 396 feet from Portuguese Bend Road and shall continue for fifty (50) feet. The second widening of Pine Tree Lane shall commence 990 feet from Portuguese Bend Road and continue for fifty (50) feet. The third widening of Pine Tree Lane shall commence 1,468 feet from Portuguese Bend Road and shall continue for fifty (50) feet. The fourth widening of Pine Tree Lane shall commence 1,896 feet from Portuguese Bend Road and shall continue for fifty (50) feet. The locations of these widened areas shall be shown on Exhibit A. At these four (4) sections of the roadway where there is a fire hydrant, the width of the asphalt cement pavement shall be ,eighteen (18) feet with an additional eight (8) foot wide decomposed granite pathway and fire safety area alongside the pavement. The pathway and fire safety areas shall be constructed to the Los Angeles County Fire Resolution No. 841 -3- Department Fire Protection Engineering all weather access standards. The material separating the roadway pavement from the pathway and fire safety areas shall be a series of 2" x 3" redwood headers set flush to the ground surface. There shall be no rail or fence separating the pathways and fire safety areas on the paved road. The construction of the paved area of the roadway shall include a minimum of two inches of Asphalt Cement (A.C.) over a six (6) inch crushed aggregate base. Along the sides of the roadway without the required eight (8) feet of decomposed granite pathway and fire safety area, the roadway shall be constructed with inverted shoulder pavement. Roadway design shall also maintain access to the Community Association's trail system." Section 9. All other provisions of Resolution No. 748, Resolution No. 825, and Tentative Parcel Map No. 21400 shall continue to be in full force and effect.
