0913RESOLUTION NO. 913 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS GRANTING APPROVAL OF FINAL PARCEL MAP NO. 21486, SUBDIVISION NO. 84, A SUBDIVISION OF AN EXISTING 6.07 ACRE LOT INTO TWO RESIDENTIAL LOTS IN ZONING CASE NOS. 450 AND 647. THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, DETERMINE AND ORDER AS FOLLOWS: Section 1. On January 16, 1991, Dr. and Mrs. Ramon Cukingnan, the owners of property at Lot 81-RH, and currently.known as 16 Pine Tree Lane, Rolling Hills, submitted a complete application for Tentative Parcel Map No. 21486 for the subdivision of the subject 6.07 acre existing property, currently developed with one residential unit, into two single-family residential lots located along Pine Tree Lane. Section 2. The City Council approved Tentative Parcel Map No. 21486 by Resolution No. 733 on March 28, 1994 and extended the map for two years by Resolution No. 779 in March 1996. On February 8, 1998, by Resolution No. 833, the Council approved an extension of time to March 28, 2002, which included a one (1) year automatic extension pursuant to Government Code Section 66452.13 and a five (5) year discretionary extension pursuant to Government Code Section 66463.5(c) from the original expiration date of March 28, 1994. Section 3. On August 4, 1999, an application in Zoning Case No. 450 was submitted requesting to modify a condition of Tentative Parcel Map No. 21486 relative to a reduction in the roadway width of the extension of Pine Tree Lane, which the subdivider was required to construct. On September 21, 1999, based upon information and evidence submitted, the City Manager administratively approved modification to Tentative Parcel Map No. 21486 relating to the width of the extension of Pine Tree Lane to correspond to prior modification approved for the adjacent property in Zoning Case No. 555, TPM No. 21400. Section 4. On February 12, 2002, an application in Zoning Case No. 450 was submitted requesting modification of certain conditions of Tentative Parcel Map No. 21486 related to the width of easements and other roadway improvements. On March 25, 2002, based upon information and evidence submitted, the City Council adopted Resolution No. 912 approving modifications to Tentative Parcel Map No. 21486. These modifications related to road and easement width and related modifications to the Tentative Map conditions. Section 5. The City Council is now in receipt of a report from the City Engineer dated March 27, 2002 determining that Tentative Parcel Map No. 21486 is ready for City Council approval and acceptance and/or rejection of the dedications shown thereon. Section 6. Based upon the City Engineer's Report, the City Council finds as follows: a. Pursuant to Section 66474 (grounds for denial of a tentative map), Section 66474.1 (final or parcel map must be approved if in substantial compliance with approved tentative map), and Section 66474.6 (water quality standards) of the Subdivision Map Act, Final Parcel Map No. 21486 is in substantial compliance with previously approved Tentative Parcel Map No. 21486. b. The approval of Final Parcel Map No. 21486 will not violate any of the provisions of Sections 66474 (grounds for denial of tentative maps), 66474.1 (grounds for denial of a final parcel map) or 66474.6 (water quality standards) of the Subdivision Map Act. C. That Final Parcel Map No. 21486, together with the provisions for its design and improvement, is consistent with the Rolling Hills General Plan. d. That the development of the property as set forth on the final map will not unreasonably interfere with the free and complete exercise of any public entity and/or public utility rights of way and/or easements within the subject division of land, pursuant to sections 66436(a)(3A)(i-viii) (statement of record title of interest) and 66445(f) (separate statement of title) of the Subdivision Map Act. e. That the "Future" public easements shown on the Final Map are not required for present public use, since all required easements have been accepted by the Rolling Hills Community Association and other entities. Consequently, the City is able to reject any offers of dedication of public easements at this time based on the recognition that Resolution No. 913 -1- said offers remain open pursuant to Section 66477.2 (offers of dedication) of the Subdivision Map Act in case such "future" public easements are later needed for public use. f. The subdivider executed a Subdivision Agreement and posted a Subdivision Bond in the amount of $7,500.00 pursuant to Government Code Sections 66462 and 66499 to quarantee widening of the extension of Pine Tree Lane. The Agreement also provides for widening of the cul-de-sac, unless it is determined by the City and the Fire Department that the cul-de-sac is in substantial compliance with the Development Plan. Section 7. Based upon the findings contained above, and pursuant to the requirements of the California Subdivision Map Act and the City's Subdivision Ordinance, the City Council hereby approves Final Parcel Map No. 21486. Section 8. The City Council finds that all "future" public easements shown on said map are not required for present public use, and rejects the offers of dedication of said easements at this time, based on a recognition that these offers remain open pursuant to Section 66477.2 (offers of dedication) of the Subdivision Map Act in case such "future" public easements are later needed for public use. Section 9. The City Council hereby instructs the City Clerk to endorse on the face of Parcel Map No. 21486 the certificate which embodies the approval of the map and the rejection of the future public easements shown thereon.
