7/12/1965461 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA .July 12, 1965 A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Tourtelot at 7:30 P.M. on Monday, July 12, 1965 at the City Office. ROLL CALL Present: Councilmen.Fay, Goodman, Klein, Van Note and Mayor Tourtelot Absent: None Others O Present: Teena Clifton City Manager William Kinley City Attorney Marion Welch City Treasurer, Ruth A. Carley Secretary APPROVAL OF MINUTES It was moved by Councilman Van Note, seconded by Councilman Goodman and unanimously carried that the minutes of the meeting of June 14, 1965 be approved as corrected. It was moved by Councilman -Goodman, seconded by Councilman Van Note and unanimously carried that the minutes of the meeting of June 28, 1965 be approved as corrected. CORRESPONDENCE a) Notice of strategy meeting on July 13, 1965 from Redondo Beach Chamber of Commerce re South Bay -College Site. Mayor Tourtelot stated that he could not attend and i directed the Manager to be present to represent the City. b) Letter from League of California Cities, together with .letter from League of Women Voters asking endorsement of proposal to have local firemen become deputy registrars. Following discussion, Councilman Goodman moved, seconded by Councilman Klein and unanimously carried that the City of Rolling Hills support such a program. c) . Letter from Board of Supervisors approving the City's request for the renewal of the General Services Agreement. The matter was ordered received and filed. d) Letter from -Tom Carrell, Chairman, Assembly Committee on Transportation and Commerce requesting comments and .suggestions reflecting the transportation needs of the community. It was ordered received and filed. e) Letter dated July 2, 1965 from G. F. von Mueffling requesting investigation of a patch on Portuguese Bend Road at #14 which needs repair work. Councilman. -Goodman suggested that the City Manager be directed to inform the author of the letter that the City has no right or authority to repair roads and that the Council is forward- ing his letter to the Association. The Mayor so ordered. REPORTS. OF CITY DEPARTMENTS Fines and ForEfeiture.s . . The Manager presented the Analysis and Distribution of Fines and Forfeitures in the amount of $66.75. It was ordered received and filed. July- 12, 1965. , �,Sherif f ,Uepartmerit The monthly report of the Sheriff Department for the month of May 1965 was presented. It was ordered received and filed. 11 City -Treasurer TheReportof City Treasurer presented. It.was moved by Councilman Note and unanimously carried that the PAYMENT OF BILLS for the month'of June 1965 was Klein, seconded by Councilman%Van1 above report be approved and filed. The City -Manager -presented the register of bills -to be allowed for payment. ABSENT: None E BUDGET 1965-66 It was moved by Councilman Klein, the City Finance Officer, to :approve the 1965-66 budget as presented. Councilman Van -Note stated that the amount of $19,000 in reserves for contingencies added to $14,000 surplus at theend of the fiscal year 1964-65 brings the total to $31,000 and it was his I opinion that it was good business on the part of the City to have one half of the year's budget in.reserve and that next year -the City may approach that amount. He continued the Council desires to raise $119,000 from the General Fund for the new fiscal year and he stated he thought that was adequate. Councilman Van.Note seconded the motion. Mayor Tourtelot stated that the City had received a letter from the Office of the County Assessor with estimated assesed value totals of the 1965 LOCAL ROLL,, BEFORE EQUALIZATION for the City of Rolling Hills, the assessed values' of the unsecured roll being $106,793.10 and stated ,a so July 12, 1965 that public utilities would add approximately $400,000, and that in view of improvements being considered for the City properties the -Council should take a.long look at next year if it is; -.going to be frugal. Councilman Goodman opposed the adoption of a budget at the present time as the Council adopts a budget when it determines he amount necessary to raise;�from property taxes and pauses a resolution fXxing the tax rat . He further stated that he was against the budget as it does not show cath as of .July 1st and unless the City has a right to build up a surplus, the . surplus should be transferred to a capital account. He continued the City may Want to hire someone to give the Council ideas on civic improvements and if the Council adopts a budget it is tying.its hands...Councilman Goodman moved to table the motion, seconded by Councilman Van Note and unanimously carried. Councilman Van Note said that the Council only needs an operating budget and.a balance sheet. Hr further stated that in the past the finan- ciallfigures received by the Council were inadequate and it is fortunate that Mrs. Arrieta, the bookkeeper, and Mrs. Clifton.have come up with suggestions and the City has gained by that type of financial reporting. Mrs. Clifton stated.that the Special Deposit Fund has been carried over from.before she came to the'City and she had kept it there because the County is very late in their billing on subdivision fees. The amount is left over from the subdivision on Buggy Whip and Mrs. Clifton stated that she would discuss the matter with Mr. Logan Cotten when he comes in for -the audit. Councilman Goodman suggested that perhaps the amount should go back to the subdivider and Mrs. Clifton.agreed to check in detail the administration costs. Councilman. Goodman stated that the City should have a fixed fee for administration work on subdivisions in the City Office and suggested that the matter be discussed with the City Attorney and then the Manager bring a recommendation. to the Council. Councilman Goodman inquired about the figure on insurance and bonds and Mrs. Clifton stated that she would recheck the amount but felt that it was correct. Councilman Goodman stated that he would like to see ,..��.. the Association assessment reduced to nothing. A discussion was held regarding proposed real property acquisi- tion and the figure of $1,000 was suggested as a.budget item for legal con- demnation expense. The proposed -new form for the monthly report was presented and the.Manager was directed to reproduce it for study by Councilmen and to be presented at the next meeting. ADMINISTRATION BUILDING Mayor Tourtelot stated that he had nothing to report at this time. UNDERGROUND UTILITIES Mr. Kinley reported that the problem.of putting utilities. underground had only arisen on two occasions where the utility and governmental agency were both using a public street and because of the requirement to use.the street it was necessary to relocate its lines and the governmental agency suggested that they go underground. The courts have sustained the cit.y's right to do this._ When utilities have done it voluntarily, it is because it was cheaper to go underground. Where lines -- are overhead and a governmental agency wants utilities to go underground, the public utility commission has allowAd them to surcharge the expense. This surcharge was added to the regular cost. -3- July 12, 1965 Councilman Goodman.suggested that the report Mr. Kinley had from 11dwin L. Mayor Tourtelot so ordereC Mr. Kinley stated that the court has not allowed a city. -to quire undergrounding of utilities on an esthetic basis only. Council - an suggested that the City Attorney be directed to draft an ordlaWce on replacement lines and on new lines going underground and ®sed the thought that the City of Rolling Hills would have a.bette chance to require undergrounding on the basis of esthetics because of the private roads within the City. Mayor Tourtelot stated that he had asked the City Attorney if he could draw up an amendment to the building orrdinance to`require underground utilities for single lots. Mayor Tourtelot asked if any member of the Council would object to extending the requirement for the undergrounding of utilities for single lots. Councilman Goodman stated that he would advise that the amendment be on all new construction, which have a Lead from a utility pole, go underground. Mrs. Clifton stated that the question has been acted upon .by the Planning Commission and it felt there were so few single lots re- mfinin.g in the City that it did not want to make a recommendation to the Curacil in that regard. instead, the Planning Commission recommends that t e Council look into the feasibility on a cost basis of -having the whole c ty have underground utilities. In one instance, Mrs. Clifton further s ated, she suggested to a man.who was going to 'build on one of the .. single lots, that perhaps he ",ht like to underground his utilities but a ter loo�ing,at all the lines lready in the area which he would have t look at, he decided to go overhead. t Mayor Tourtelot stated that he felt having single lots in® 61ude-A would be the first step in having all utilities go underground in t�e City. Councilman Goodman.suggested that the Council amend the ordinance Eo include the extension of undergrounding of utilities for new residences, and on existing residences relating to improvements � at all be required to have -undergrounding of service leads. The City forme was - instructed .to draw an _amendment to - the ordinance for the Councils consideration. DtCLARATION NO. 150 Coucilman Goodman asked what happened at the Board meeting regarding Car Allen.'s proposal and Mrs. Clifton. stated that the Board took no action. Mr. Kinley stated that Mr. Allen.claims he has 70% of owners signed and that he is now getting the mortgagees. Councilman Goodman suggested that if Mr. Allen gets his petition signed and if the Association signs, the Council should consider some review of the 5 -acre zning ® not down to 1 -acre but possibly down to 22 or 3 -acres, that he d d not want to be faced with considering each and every parcel.as a Tiance and further suggested that the City should get an aerial photo the.RAS®5 area and have the Planning Commission study it. Mayor Tourtelot stated that he had discussed the same subject with the City Attorney several days before the meeting and he felt the City should hold up until the Association has decided on what it is going t@ dpi:=:eouf Q::ation agreement. f: Councilman Va-'..Note stated that he felt it would be most imm portant to follow through on.the suggestion regarding a map. He said he felt using an overlay of property lines on an aerial map would have great significance concerning ,future subdivisions. The Council con- curred that Councilman Van Note investigate the costs of such.a map and report to the .Council. Mrs,. Clifton stated that she had recently talked -4- 465 July 12, 1965 to Mr: Edward Pearson.who has been making. an aerial map of the area as per his contract for Flood Control work in.Rolling Hills.- She agreed to ask Mr. Pearson to get in touch with Councilman Van Note on.the matter. The Council. concurred that Councilman Van.Note investigate the costs of such a map and.report to the Council. ADJOURNMENT There being no further businoss to come before the meeting.it was moved by Councilman Klein, seconded by Councilman Van Note and unan- imously carried that the meeting be adjourned at 9:20 P.M.
