A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ROLLING HILLS PROCLAIMING THE EXISTENCE
OF A LOCAL EMERGENCY.
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY FIND,
ORDER AND RESOLVE AS FOLLOWS:
Section 1. Findines
A. On August 27-28, 2009, a major fire burned through portions of Rolling Hills
causing damage and leaving in its wake dangerous conditions. In response to
the emergency situation created by the fire, the Director of Emergency
Services proclaimed a local emergency on August 27, 2009, consistent with
the provisions of Article 2, Chapter 2.32 of the Municipal Code.
B. The Director of Emergency Services now requests the City Council ratify the
Director's proclamation of the existence of a local emergency and Emergency
Order No. 09-01 in accordance with Section 2.32.060.A.1 of the Municipal
Code.
C. Conditions of extreme peril to the safety of persons and property have arisen
within the City, caused by the fire commencing on or about August 27, 2009.
Although the fire has been determined by the fire department to be fully
contained, these conditions of peril — including denuded slopes susceptible to
mudslides and accumulations of fire charred debris -- warrant and necessitate
the proclamation of the existence of a local emergency until such time as
hazardous conditions have been fully identified and a recovery plan has been
implemented.
D. The City's local resources are inadequate to rectify the emergency situations
existing as a result of the fire.
Section 2. Ratification of Emeraencv. The Proclamation of Local Emergency and
Emergency Order No. 09 - 01 issued by the Director of Emergency Services are hereby
ratified.
Section 3. Proclamation of Emergencv. It is hereby proclaimed that a local emergency
now exists throughout the City. It is further proclaimed and ordered that during the existence
of this local emergency the powers, functions, and duties of the Director of Emergency
Services and the emergency organization of this City shall be those prescribed by State law
and by the ordinances and resolutions of this City.
Section 4. Duration. This local emergency shall be deemed to continue to exist until its
termination is proclaimed by the City Council. As required by law, the City Council shall
review the need to continue the state of emergency every 14 days until this resolution is
terminated.

Emergency Services' proclamation of the existence of a local emergency and
Emergency Order No. 09-01 in accordance with Section 2.32.060.A.1 of the
Municipal Code.
C. Conditions of extreme peril to the safety of persons and property have arisen
within the City, caused by the fire commencing on or about August 27, 2009.
Although the fire has been determined by the Fire Department to be fully
contained, these conditions of peril — including denuded slopes susceptible to
mudslides, accumulations of fire charred debris, and smoldering ashes and
debris -- warrant and necessitate an extension of the proclamation of the
existence of a local emergency until such time as hazardous conditions have
been fully identified and a recovery plan has been implemented.
D. The existing and continuing hazardous conditions may necessitate the exercise
of the Director's authority to enter and act on private property to mitigate the
threats posed by denuded slopes, accumulation of charred debris, and
smoldering ashes and debris.
E. The City's local resources are inadequate to rectify the emergency situations
existing as a result of the fire.
Section 2. Ratification of Emereencv. The Proclamation of Local Emergency and
Emergency Order No. 09 - 01 issued by the Director of Emergency Services are hereby
extended through September 28, 2009.
Section 3. Proclamation of Emergency. It is hereby proclaimed that a local emergency
continues to exist throughout the City. It .is further proclaimed and ordered that during the
existence of this local emergency the powers, functions, and duties of the Director of
Emergency Services and the emergency organization of this City shall be those prescribed by
State law and by the ordinances and resolutions of this City.
Section 4. Duration. This local emergency shall be deemed to continue for 14 additional
days. As required by law, the City Council shall review the need to continue the state of
emergency in 14 days if this resolution is to be extended further. _ I
