0053.pdfRESOLUTION N0. 53 A RESOLU'T`ION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA AUTHORIZING THE MAYOR TO EXECUTE AN APPLICATION AND AGREEIENT FOR INCLUSION OF THE CITYIS EMPLOYEES IN THE CALIFORNIA STATE SOCIAL SECURITY AGREEMENT. VHEREAS, official form "Application and Agreement, Ret.-OASI 32A't containing the terms and conditions under which the State will effect such inclusion has been examined by this body: NOW, THEREFORE, BE IT RESOLVED that an Application and Agreement on said official form be executed on be- half of the Public Agency and submitted to the State to provide coverage under said California State Social Security Agreement as follows: A. Coverage Grouos: (Check only one part): 1. X -- All coverage groups, i.e., all eligible employees. B. Excluded Services: 1. All services excluded from coverage under the agreement by Section 218 of the Social Security Act; and 2. Services excluded by option of the Public Agency (Check only one part): X a. No Optional exclusions desired. b. C. Effective Date of Coverage Under Agreement: January 24, 1957; WHEREAS, a majority of the eligible employees for whom coverage is requested by the City of Rolling Hills, hereinafter designated "Public Agency," indicated at an election or elections* or by petition filed with the Public Agency that they favor the Public Agency making a formal application to the Board of Administration of the State Employees: Retirement System, hereinafter called "State," for inclusion of the said eligible employees of said Public Agency in the California State Social Security Agreement of March 99 1951, providing for the coverage of said eligible employees under the insurance system established by Title II of the Federal Social Security Act; and WHEREAS, the Public Agency desires to file such an .�° application with the State and to enter into an -agree- ment with the State for inclusion of said eligible em- ployees in said California State Social Security Agree- ment; and VHEREAS, official form "Application and Agreement, Ret.-OASI 32A't containing the terms and conditions under which the State will effect such inclusion has been examined by this body: NOW, THEREFORE, BE IT RESOLVED that an Application and Agreement on said official form be executed on be- half of the Public Agency and submitted to the State to provide coverage under said California State Social Security Agreement as follows: A. Goodman, Mayor of the City of Rolling Hills, 1 Portuguese Bend Road, Rolling Hills, be and he is hereby authorized and directed to execute said application and agreement on behalf of and as Authorized Agent of the Public Agency and to.forward same to the State for acceptance and further action; and BE IT FURTHER'RESOLVED, that authority hereafter to aot as Authorized Agent, and so to conduct all negotiations, conclude all arrangements, submit all reports, and sign all agreements and instruments which may be necessary to carry out the letter and intent of the aforesaid application and agreement, in conformity with all applicable Federal and State laws, rules and regulations, is vested in the position of Mayor. Public Agency shall contribute -to said. Retirement System as follows: Ret. Form 126.1 a. With respect to miscellaneous m the Public Agency shall oon- tr.ibute the following percentages of monthly salaries earned as miscellaneous =uabera of said System: (1) 0.60 percent until June 30, 2000 on account of the liability for prior service benefits. (2) 7.18 percent on account of the liability for current service benefits, said percentage being fixed by Section 20750 of the Retirement Law. b. A reasonable amount per annum, as fixed by Board to cover the costs of administering said System as it sf'teets the employees of Public Agawy, not including the costa of special valuations or the periodi- cal investigations and valuation required by lase. c. A reasonable amount as fixed by -the Board, payable in one installment as the ocoasione arise, to cover coats of special valuations on account of employees of Public Agencys and costs of the periodical investigation and valuation required by laws 6. Cointributions required of Public Agency and its employees shall be sub- ject to adjustment by Board on account of amendments to the Public Employees$ Retirement Law, and an account of the experience under the Retirement System as determined by the periodical investigation and valuation required by said Retirement Law. 7. Contributions required of Public Agency and its employeea shall be paid by Public Agency to the Retirement System witbin thirty days after the end of the period to which said contributions refer or as may be prescribed by Board negotiation. If more or less than the correct amount of contributions is paid for any period, proper adjustment shall be made in connection with subsequent remittences, or adjustments on account of errors In. contributions required of any employee may be made by direct cash payments between the employee and Board.
