3/25/195724 MINUTES OF REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA The regular meeting of the City Council of the City of Rolling Hills was held at 7:30 p.m. Monday, 25 March 1957, in the City Hall of the City of Rolling Hills. The meeting was called to order at 7:40 by Mayor Goodman. ROLL CALL ' Present: 'Councilmen Allan F. Bullard Lawrence M. Weitzel and Mayor Owen F. Goodman Absent: Councilmen James L. Elliott Fred I. Tourtelot Also Present: City Attorney William Kinley City Clerk Gilbert Myers Mrs. Stockdale Mr. and Mrs. Roland Swaffield Dr. John Keys Mr. Arthur Chase (8:00) Mr. George Fenn (8:15) MINUTES The minutes of the meeting held 11 March 1957 having been distributed to all councilmen were corrected and approved as corrected. PERSONAL APPEARANCE_ - MR,,. R0.L.....AN..D ..SWAFFIELD ... .....,._ ..,. Mr. Swaffield said that he had heard a rumor that C est Road was to be widened and projected through Rolling Dills. Mayor Goodman replied that we had knowledge of a newspaper article having appeared in the Long Beach Press Telegram. He added that one of the reasons for incorporation was to place the community in a better position to resist such an event and that when the danger arose we would strive to avoid it.. PERSONAL APPEARANCE _ DR. JOHN KEYS Dr. Keys submitted a sketch of the culvert arrangements for his fill and dam which had been previously discussed. After considerable discussion, it was suggested that the City Clerk make arrangements with the County Engineer to act on behalf of the City and to meet with Dr. Keys to comment upon the engineering correctness of the details of the project. PERSONAL APPEARANCE,-. MRS ARTHUR CHASE Mr. Chase inquired as to the ownership of road easements on Crest Road with a view to better understanding the possi- bilities of County road extension through our precincts. He also reported that there appeared to be a more than average number of water leaks resulting from corrosion of plumbing systems. He raised the question as to whether or not there might be some change in the corrosive quality of water now furnished. 3 FRANCHISES The Mayor will undertake to bring some further report on franchises to a later meeting. MINUTE BOORS AND STATIONERY The City Clerk reported upon the bids from four printing concerns for stationery and from three stationers on minute books. It was moved by Councilman Bullard and seconded by Councilman Weitzel that the City Clerk be authorized to expend funds up to $150.00 to purchase 1,000 letterheads and 5,000 envelopes from the Economy Press and three minute books from the Anchor Press, both firms of San Pedro. The motion was unanimously carried. REAL ESTATE LICENSE FEE The City Clerk reported that a realtor had inquired regarding the establishment of a license fee for operating within the City limits. The Council requested the Clerk to inform the inquirer that as yet the matter had not arisen „--? ls: and that no action was immediately contemplated. to -T LANDSLIDE WAIVER _ The City Attorney presented a waiver to protect the City against suit in case of landslide or Dearth movement which might affect construction within the City. The City Clerk was directed to procure copies of the waiver and to have the County building authorities, acting on behalf of the City, get signatures on the form of waiver provided prior to the issuance of a building permit in this City. LOW-FLYING AIRCRAFT As Councilman Elliott was not present to report on the reference of the ordinance on low-flying aircraft to the Civil Aeronautics Board, action was deferred until the next meeting. INTRODUCTION OF LITTER AND REFUSE ORDINANCE Mayor Goodman introduced and read in full an ordinance entitled "An Ordinance Prohibiting the Dumping of Garbage and Refuse in the City of Rolling Hills, California." INTRODUCTION OF ORDINANCE ADOPTING FIRE PREVENTION CODE Mayor Goodman introduced and read the title of a proposed ordinance entitled "An Ordinance Adopting a Fire Prevention Code for the City of Rolling Hills, California," together with the title of the Los Angeles County Ordinance to be adopted. In accordance with the provisions of Government Code Section 50022.3 a public hearing was ordered held on the adoption of said ordinance at the second meeting of the City Council in April, on Monday, 22 April 1957. The City Clerk was directed to cause to be published a notice of the holding of said hearing in accordance with the provisions of said Section 50022.3 in a newspaper of general circulation in the City of Rolling Hills, one time.not less than fifteen (15) days before the date set for said hearing and a second time not less than eight (S) days before said hearing. 24 INTRODUCTION OF ORDINANCE ADOPTING ELECTRICAL CODE Mayor Goodman introduced and read the title of a proposed ordinance'entitled "An Ordinance Adopting an Electrical Code to Regulate the Installation, Arrangement, Alteration, Repair, Use and Operation of Electric Wiring, Connections, Fixtures and Other Electrical Appliances on Premises Within the City of Rolling Hills, California, t' together with the title of the Los Angeles County Ordinance to be adopted. In accordance with the provisions of Government Code Section 50022.°3 a public hearing was ordered held on the adoption of said ordinance at the second meeting of the City Council in April, on Monday, 22 April 1957. The City Clerk was directed to cause to be published a notice of the holding of -said hearing in accordance with the provisions of said Section 50022.3 in a newspaper of general circulation in the City of Rolling Hills, one time not less than fifteen 115) days before the date set for said hearing and a second time not less than eight (8) days before said hearing. In accordance with•the provisions of Government Code Section 50022.3 a public hearing was ordered held on the adoption of said ordinance at the "second meeting of the City Council in April, on Monday, 22 April 1957. The City Clerk was directed to cause to be published a notice of the holding of said hearing'in accordance with the provisions of said Section 50022.3 in a newspaper of general circulation in the City of Rolling Hills, one time not less than fifteen (15) days before the date set for said hearing and a second time not less than eight (8) days before said hearing. INTRODUCTION OF ORDINANCE ADOPTING PLUMBING CODE Mayor Goodman introduced and read�the title of a proposed ordinance entitled "An Ordinance Adopting a Plumbing Code to Regulate Sanitary Plumbing and Drainage Systems, House Sewers, and Private Sewage Disposal Systems in the City of Rolling Hills, California," together with the title of the Los Angeles County Ordinance to be adopted. In accordance with the. provisions of Government Code Section :: 7 50022.3 a public hearing was ordered held on the adoption of said ordinance at the second meeting'of the City Council in April, on Monday, 22 April, 1957. The City Clerk was directed to cause to be•published a notice of the holding of said hearing in accordance with the provisions of said Section $0022.3 in a newspaper of general circulation in the City of Rolling Hulls, one time not less than fifteen (15) days before the date set for said hearing and a second time not less than eight (8)'days�before said hearing. 2.5, DETERMINATION OF NEWSPAPERS OF GENERAL CIRCULATION IN THE CITY OF ROLLING,HILLS AND�DIRECTION-TO CLERK TO SECURE PUBLICATION NOTICEOFHEARING THEREIN On Friday., 22 March 1957. a summons was delivered to the City Clerk directing the City to appear as a defendant in a suit by a cabinet makers association against thirty-two cities in the County of Los Angeles. The Council determined to take no action with respect to this matter inasmuch as no valid service of summons was had on the City and inasmuch as this City had no ordinance of the type complained of. PROMISSORY NOTE TO ROLLING HILLS COMMUNITY ASSOCIATION Mr. Kinley produced a promissory note from the City of Rolling Hills to the Rolling Hills Community Association for a loan of two thousand dollars without interest. In accordance with Resolution No. 16, the Mayor and City Clerk signed the note. The City Clerk was directed to deliver the note to the Association in exchange for $2,000.00. After considerable discussion it was, on motion of Councilman Bullard, seconded by Councilman Weitzel unanimously determined that the Rollinr Hills Herati was the legal only newspaper havIng.generai.circuiation In the City of Rolling Hills, The Clerk was thereupon directed to publish notice of the hearing oh the a46p- tion of the four ordinances above mentioned in the Rollina Hills Herald. POSSESSION OF FIREARMS BY MINORS Mayor Goodman proposed enactment of an urgency ordinance entitled An Ordinance of the City of Rolling Hills$ California Prohibiting the Possession of Firearms arid Other Devices by Minors Under the Age of Eighteen Years." The Mayor explainedthatthis.ordinance was proposed as an urgency measure to satisfy the request of Captain Karney of the Sheriff's Office. After to extensive discussion, consideration of said proposed ordinance was laid over until the next meeting. POUND ORDINANCE Councilman Bullard introduced and read the title of a proposed ordinance entitled "An Ordinance of the City.of Rolling Hills, California, Providing for A Poundmaster, far the Licensing of Dogs and for the Impounding of Dogs and Other Animals." On m6tion'of Councilman Bullard, seconded by Councilman Weitzel, reading of the ordinance in full was unanimously waived. The Mayor was requested to send a copy of the ordinance to the County Poundmaster for checking. COUNTY HEALTH ORDINANCE The County Health Ordinance was examined and referred to the Mayor for further study. The City Clerk was directed to deliver the note to the Association in exchange for $2,000.00. 2 LEAGUE OF CALIFORNIA CITIES The City Clerk read a letter dated 21 March 1957 from the League of California Cities welcoming Rolling Hills into membership. All 337 cities of California were represented as being members. GATEHOUSE PARCELS AND BUILDINGS The City Clerk read a letter from the Capital Company of 21 March 1957 placing.a price of $40,000.00 upon land parcels and buildings at the gates of the City. This letter will be referred to the Rolling Hills Community Association. TAX RELIEF The City Clerk read a letter dated 18 March 1957 from the County Tax Assessor acknowledging receipt of the Resolution from the City Council and inviting the representatives of the City to meet with representatives of the Assessor to discuss tax matters. POST OFFICE The City Clerk reported upon the post office situation. He was directed to determine what would.happen when the present contract with Miss Rubenstein expires in June and to report again to the Council. REQUEST OF MR., PRESCOTT A request from Mr. Prescott was .presented by the City Clerk. This involved the sale. of an acre of land from Lot 11 of Chesterfield to become a park for the, residents of a new subdivision adjacent to the boundary of Rolling Hills now being developed by Mr. Prescott. The City Clerk was directed to inform Mr. Prescott that it was not felt that there was any practicable way to remove land from the City of Rolling Hills and that a public park under the jurisdiction of another governmental body would not be desirable within our boundaries. ESTABLISHMENT OF BOOKS FOR THE CITY OF ROLLING. HILLS The City Clerk requested the Council to authorize him to enter into an arrangement with Messrs. Cotton and Francisco, Certified Public Accountants, at 106 Emerald Street, Redondo Beach, to set up and examine books and procedures for handling money for the City. This concern specializes in the handling of municipal accounts and is available to audit such accounts. Councilman Bullard asked that the City Clerk investigate the services and forms made available by the Royal McBee Office Equipment Firm. The City Clerk was authorized to so proceed but not to commit the City'for over $100.00 for books and supplies and not more than another $100.00 for professional services which were quoted at $6.50 per hour. There being no further business to come before the meeting, it was moved by Councilman Bullard, seconded by Councilman Weitzel, and unanimously carried that the meeting be adjourned at 10:50 p.m. APPROVED: City.Cler
