A. ZONING CASE N�. 873 and 874. Request for a Zoning Code Amendment No. 2Q15-Q1 to amend the Rolling Hills Municipal Code, Section 17.18.070 to a11ow aviaries exceeding 20Q square feet with a Conditional Use Permit on lots tha�are Iess than 5 acres in size; and a request for a Conditional Use Permit to construct a 338 square foof aviaxy on a lot that is less than 5 acres in size at 20 Dutx�ider Road (Lot 170 -} Rolling Hills, (Rich}. The project has been determined to be categorically exempt pursuant �o the California Environmental Quality Act {CEQA). Planning Director Schwartz reviewed the applicant's request to construct a 33$ sq. ft. aviary with a solid roof on a small portion of the aviary and metal mesh on the sides on a Iot that is 3.88 acres in size, which is less than the 5 acres in size required. She stated that the Zoning Code allows aviaries of up to 200 sq. ft. on ariy size 1ot within the City without a Conditional Use Pexrnit as long as they meet the development standards, and any aviary over 200 sq.ft. require a Conditional Use Permif and may only be on Iots �hat are 5 acres or greater. She further stated that since the applicant is requesting a 338 sq. ft. avia�y on a Iot that is less �han 5 acres in size, a Zoning Code amenamerit is required in add�tion to a Conditiona� Use Pezmit. Greg George, the designer explained the project and the relationship to the existing outdoor amenities and the proposed koi pond. He also sfafed that the owners propase to keep small birds, such as Finches, indigenous to the area. Commissioner Kirkpatrick asked 'z£th��e was a reason behind the code requirement that aviaries over 200 sq. ft. are only allowed on lots over 5 acres in size. In response, Plai�ing Director Schwartz stated that when aviaries were added as an allowed use, staff worked with a resident that has aviaries and ather animal keeping facilities and the regulations were based on his recominendations. Minutes 1 Adjourned Regular Meeting In response to Chairman Che1f, Planning Director stated that prior to the last Planning Cornrnission meeting several neighbors, including a resident from RI'V, called and were concerned with the noise the birds inay cause. She stated that they were noticed about the field trip bu�have not contacted staff after the initial Planning Commission meeting. Mrs. John.son stated that although she does not think she would be impacted by the proJect, the neighbor in RPV rnight and that she would like to let him know that the Coxnmission is considering this case. Cha.irman Chelf asked if there are any county, sfate or federal guidelines for aviaries. Planning Dixector Schwartz stated that there aren t any for "sn�al.l birds", except for exotic birds and that she did some research to see how other cities r�gulate aviaries and the resulfs of that research is attached. She summarized some of the requirements. Mrs. Johnson asked how would the City regulate noise if it were objectionable to the neighbors. Pianning Director Schwartz stated that the City would enforce i� under the Nuisance Ordinance or that a stronger provision could be.included in the ordinance regarding noise from aviary uses. She read a provision from PVE regarding noise regulations. Mr. George stated that the specific requixement of the code have been met and he feels that the 5 acre requirement seems rather arbitrary and he feels that the proposaI is a nat�a.ral addition to the overall environment on�the property. There being no further discussxon on this project, the public hearing was con�inued to the evening meeting of the Planning Commission at 6:30pm.
