Mayor Pro-tem Dieringer called the meeting to order at 5:45 p.m.at 15 Portuguese Send Road.
All present wallced to the south partion of the property to view t,}ie project, Planning Director Schwartz
reviewed the applzcanYs request for a Variance to encroach with 61 square feet of a mostly complefed
300 squate foot addition and a 3' high retaining wall iato the side yard setback, atad to provide 2'-wide
ramp like walkway arounid the addition. She stated fhat the encroachment vaty from 0 feet to 7.5 feet
into the setback in a triangular configurataon. She stated that the 300 square foot side addition was
administrativeIy approved based on a site plan snbmitted hy the applicants.The applicants informed staff
that the plot pIan submitted for administrative approval was taken from several old but verified surveys
and ti�at the properky line in the area of the addition was staked correctly in the fteld.�'k�e applicants ha�e
obtained a building permit based on the City's approvai of tt►e plans and commenced construction.
She explained that during construction a residex�t iaquired of staff if the applicant is encroaching into the
setback. Staff requested that all work stop and t�tat a certified survey be provided, '11te survey revealed
that a portion of the addition encroaches into the side setback.
Gary Wynn, applicants' engineer reiterated that the applicant submitted pIans to the City based on old
surveys and showed the surveys to khe attendees.He stated�at there was an inadvertent mistake made.
Membezs of the City Council viewed and discussed at lengtl� the proposed 2'-wide ramp like access
around the add�ition. Planning Director Schwartz stated that the Fire Deparirnent provided two emails to
stat�'stating that the proposed access would be adequate for emergency purposes. Councilmember Black
stated tltat the two-fovt access with the eaves projecting from the house over the access would impede
emergency service and that such access is not acceptable.He stated that a normal height person could not
fit in such a passage. The engineer explained that in order to provide a flat area around the south most
comer of the addztion,a much higher wall would need to be constructed further back in the setback. Staff
stated that if the wall needs to he in the easement,approval from RHCA would be required.
All present walked to the rear of the addition. Discussion ensued regarding t]ie width of the area in the
zear of the addition, where the slope retums at 90-degree angIe to the house addition. Counci.lmembezs
requeste.�that this angle of the sIope be widened to provide for greater rear yard area. Councilmember
Black noted that there is a 7arge Pine Tree laoming precariously on the slvpe and stated that this tree
should be remo�ed. Commissioner Mirsch stated t}tat this tree is dangerous and if it were to fal�,it would
cause great damage.
Coancilmember Mirsch asked where is the addition in the rear that was not on the plan when staff
approved the 300 square foot addition, Planning Director Schwartz pointed to the additian.

Councilmember Mirsch also questioned why the applicants did not realize when they started construction
that they would not be able to provide an open area between the addition and the slope.
Mr.Hassoldt requested that the City Council allow him to complete the roof before the rains start.
Discussion further ensued regarding the need for a high wal� and encroachment into the Association
easement,if a wider than 2-foot wa3kway were to be provided. Councilmember Black reiterated that the
City requires a 4'-wide minimum walkway fox safety reasons.

6:20 P.M.to a regular meeting of the City Council to be held on Monday,October 26,2015 beginning at
7:30 P.M.,at City Hall,Roliing Hills California.
