additional information reques�ed, the City Council should make a decision to either approve or deny the
request.
Discussion ensued conceming the need for the additipnal hydrology information. Councilmember Black
commented that he is concemed about effect of the subdivision on the downhill neighbors given the soil
stability issues and would nat be in favor of approving the subdivision without the additional hydrology
information requested. Mayar Pro Tem Dieringer expressed concern that there was no Envi�onmental
Impact Report(EIR) conducted and she is not willing to risk people's safety.
Following further discussion, Mayor Pro Tern Dieringer mo�+ed that the City Council direct staff to
prepare a Resolution of Denial in Zoning Case No. 869 at 23 Crest Road East. Councilmember Wilson
seconded the motion, which carried without objection.

SECOND READING, WAIVE FULL READING AND AD�PT ORDINANCE NO. 346 AN
ORDINANCE OF THE CITY OF ROLLING HILLS AMENDING TITLE 17 OF THE
ROLLING HILLS MUNICIPAL CODE RELATING TO 'V�W PRESERVATION, IN ZONING
CASE NO. S81 AND ZOI�TING CODE AMENDMENT NO. 2015-03. THE PROJECT HAS
BEEN DETERMINED TO BE CATEGORICALLY EXEMPT PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT{CEQA).
Mayar Pieper introduced the item stating that this is consideration of an Ordinance amending the City's
existing View Ordinance and does not relate to Measure B. He stated that the discussion regarding
Measure B interpretation is a separate item on the agenda and will be discussed later.
Mayor Pieper called for public comment.
Lynn Gill, 31 Chuckwagon Road addressed the City Council to suggest that the language in the Ordinance
regarding restorative actions be changed to eliminate the word "topping" and instead use words like
"crown reduction"to be consistent with the laxiguage that the Committee on Trees &Views uses.
In response to Mayor Pro Tem Daeringer, Pl�nning Director Schwartz confi�med that the Committee on
Trees and Views does not typically use the word"topping" in its resolutions.
In response to Mayor Pieper, City Attomey Jenkins stated that if the City Council makes axay changes
other than to correct typograpl�ical errors,the Ordinance wauld have to be reintroduced for first reading.
Following brief discussion, Councilrnember Black rnoved that the City Council waive fu11 reading and
adopt Ordin.ance No. 346 amending Title 17 of the Rolling Hills Municipal Code relating to View
Preservation as presented. Ma.yor Pieper seconded the motion.
Mayor Pro Tem Dieringer commented that she feels that the language regarding restorative action should
be changed as suggested by Dr. Gill. She further commented that she feels that the term informational
"document" should be further explained. She commented that she also feels that binding arbitration should
be offered to reduce litigation.

Kirt Behera, 12 Ringbit Road East staxed that he concurs with Dr. Gill.
Matt Seabern, 14 Poriuguese Bend Road stated that he concurs with City Attomey Jenkins that the issue
should be considered from a "property" perspecti�e and that using the "people" perspective w�ill cause
problems.
Howard Weinberg, Attorney(Nuccion) stated that he feels that ownership should be pegged to a monetary
hansaction and he believes the reference to property tax law should be removed.
� Mayor Pieper suggested again that the acquisition date should be when money changes hands. Mayor Pro
Tem Dieringer expressed concern that using that approach could create a dynasty through legal
dacuments. City Attorney 7er�kins stated that the City Council s�imply needs to determme what its
approach to the matter is. He stated that if the City Council is looking to rie the view to the value af the
property when it was last purchased, it is greatly simplified. He stated that looking at who lives there and
when that person took control of the properiy is the other way to look at it and the City Council needs to
rnake a decision as to the broad concep� whether its should be viewed fram a praperty or a persan
perspective. Following discussion, Councilmembe:rs Blacl�, Mirsch Wilson and Mayor Pieper indicated
that they are in favor of viewing the matter from the "property" perspective and directed City Attorney
Jenkins to draft language that canveys that sentiment for the City Council's consideration at the next
meeting.
"MA'�'[JRE"VERSUS "MATURING"TREES
Planning Director Schwartz reviewed the definrtions of "znahue" vs. "rnaturing" as suggested by the
Planning Commission. She stated that that the Planning Commission suggested using the Interna.tional
Society of Arboriculture's definition of "�naturiry height" as being the maximum height that a plant is
likely to reach if the conditions of the planting site are fa�orable and referencing Sunset Western Garden
Book as a reference for potential heights by species. She stated that the Pianning Commission further
recommended that a tree that had been previous3y cut should nat be considered mature because it never
reached its highest mature height.
Mayor Pro Tem Dieringer commented based on the correspondence fram Ruben Green that she fee�s that
height alone cannot be used to determine the maturity of a tree. She further stated that she feels that
Measure B requires that the definition has ta be based on industry standarcis predominantly used by
arboxists. She stated that she feels the City should ask for an independent opinion on what maturity means.
Mayor Pieper called for public comment on the issue of maturity.
Laura Gregorio, 45 Eastfield Drive/65 Saddleback Road addressed the City Council regarding the
provision in Measure B that allows a property owner to restore the view they had when they purchased
their property.
Mike Schoettle addressed the City council stating that he does not feel that a tree that has been previously
trimrned should be earempt from being considered mature.
Lynn Gi11 s#ated that he fee�s that S�nset Western Garden Book is a good resource #o use as a guide for
determining maacimum tree height but warned against using the maxim�.un height. He suggested getting an
opinion from a consulting arborist.
Harold Light, Attorney (Hassoldt} addressed the City Council to further explain the declaration he
