ROLLING HILLS, CAL�FORNIA ORDERiNG THE SUBMISSION TO
THE QUALIFIED ELECTORS OF THE CITY OF A CERTAIN
MEASURE RELATING TO AN ORDINANCE OF THE CITY OF
ROLLING HILLS REPEALING MEASURE B BY AMENDING
SUBSECTION (E} 4F SECTION 17.26.050 AND REPEALING
SECTION 17.2b.U90 OF THE ROLLING HILLS MUNICIPAL CODE

TUESDAY, MARCH 7, 2017, AS CALLED BY RESOLUTION NO.
1192.
WHEREAS, a General Municipal Elec�ion on Tuesday, March 7, 2Q 17 has been called by
Resolution No. 1192, adopted on October 24, 2016, and
WHEREAS, the City Council alsa desires to snbmit to the voters at the election a question
rela�ing to whether the provisions added to Chapter 17.26 (View Preservation) of the Roliing Hills
Municipal Code by Measure B in March 2013 should be repealed;
NOW, TI�REFORE, TF� CITY COUNCIL OF THE CITY QF ROLLING HILLS,
CALIFORNIA,DOES RESOLVE,DECLARE,DETERMINE AND 4RDER AS FOLLOWS:
SECTION 1. That the City Council, �ursuant to its right and authority, does order submitted
to the voters at the Generai Municipal Election the following question:
YES
"Shall an ordinance be adopted repealing the March
2Q13 amendments made to the City's View
Preservanon Ordinance by Measure B?"
NO
SECTTON 2. That the prapased measure submitted to the voters is whether to repeal Measure
B from Chapter 17.2b,the City of Rolling Hills View Preservation Ordinance. (attached as E�ibit A.)
SECTION 4. That in all particulars not recited in this resolution,the election s�iall be held and
conducted as provided by law for holding rnunicipal elections.
SECTION 5. That notice of the time and place of halding the election is given and the City
Clerk is autharized, instructed and directed ta give fizrth�r or additionaI natice of the election, in time,
form and manner as required by law.
SECTiON 6. That the City Clerk shall certify ta the passage and adoption o�this Resolution
and enter it into the book of origina�Resolutians.

MEASURE B BY AMENDING SUBSECTI�N (E) OF SECTION
17.26.050 AND REPEALING SECTION 17.26.090 O�' THE ROLL]IVG
HILLS MUNICIPAL CODE
The People af the City of Ralling Hills do orda.in as follows:
_. Section 1. Subsection (E} of Section �7.26.050 of the Rolling Hills Municipal Code is hereby amended
to read as follows:
17.26.050—He�ring procedure and fmdings.
E. Action. If the Committee makes finding subsection (D}{3) of tlzis section, it shall order
such restorative action as is necessary to abate the view impairment and to restore the
complainant's �iew, including, but not limited to, removal, pruning, topping, thinning ar
similar aiteration of the vegetation. c••�'- �-aM- � --���*��a��' *^ ^ ��*� � ^'��*-�,�*�-'
#�ee� The Committee may irnpose conditions as are necessary to prevent future view
impairments. In no event sha11 restorative action be required if such action would
adversely affect the environment or would unreasonably detract from the privacy or
enjoyment of the property on which the objectionable vegetation is located.
Section 2. Section I7.26.090 ("Preseivation of�iews defined") is hereby repealed in its ent�rety.
Section 3. The City Clerk shall certify to the passage of this ordinance and shall cause the sarne to
be published as required by law.
