Section 15.04.�10 of Titie I5, Chapter 15.04 (Building Code)of the Rolling Hills Municipai Code is amended to read as follows: 1SA4.010—Adoption af�uilding Codc. Except as hereinafter provzded, Title 26,Building Code, of the Los Angeles County Code, as amended and in effect on January 1, 2017, adopting the California Building Code, 2016 Edition(Part 2 of Title 24 of the California Code of Regulations}is incorparated herein by reference as if fully set forth below and shall be known and rnay be cited as the Building Code of the City of Rolling Hills. In the event of any conflict between provisions of the California Building Code,2016 Edition, Title 26 of the Los Angeles County Code, or any amendment to the Building Code contained in the Rolling Hills Municipal Cade,the provision contained in the later listed dacumen#shall control. Section 2. Section 15.08.01 Q of Title 1 S, Chapter 15.08 (Plumbing Code) of the Rolling Hills Municipal Code is amended to read as follows: 15.Q8.Q10 Adoption of Plumbing Code. Except as hereinafter provgded, Title 28,Plumbing Code, of the Los Angeles County Code, as arnended and in effect on January 1, 2Q17, adopting the California Plumbing Code, 2016 Edition{Part 5 of Title 24 of the California Code vf R�gulations}, is hereby incorpor�.ted herein by zeference as if fully set forth below, and shall be known and may be cited as the Plumbing Code af the City of Roiling Hills. Except as hereinafter provided, Title 27,Electrical Code, of the Los Angeles County Code, as amended and in effect on January 1,2Q17, adopting the California Electrical Cade, 201b Edition(Part 3 of Title 24 of the California Code of Regulations) is hereby incorporated herein by reference as if fully set forth below, and shall be known and may be cited as the Electrical Code of the City of Rolling Hills. In the e�ent of any conflict between provisions of the California Electrical Code, 2016 Edition, Title 27 af the Las Angeles County Code, or any amendment to the Electrical Code contained in the Rolling Hills Municipal Code,the provision contained in tl�e later listed document shall control. Section 15.18.010 of Title 15, Chapter 15.18 {Residential Code) of the Rolling Hills Municipal Code is amended to read as follows: 15.18.010 Adoption of Residential Code. Except as herein provided, Title 30,Residential Code, of the Las Angeles Caunty Code, as amended and in effect on January 1,2017, adopting Sections 102 through 119 of Chapter 1, Section 1207 of Chapter 12, Chapter 34, 67, 69, 98, 99 and Appendix J of Title 26 of the Los Angeles County Code and Chapters 2 through 10, Chapter 44, and Appendix H of that certain code l�own as and designated as the 2016 Ca�ifornia Residential Code is hereby incorporated herein by reference as if fully set forth below, and shall be known�he Residential Code of the City of Rolling Hills. In the event of any conflict between provisions of the Califamia Residential Code, 2Q16 Editian, Title 30 of the Los Angeles County Code, or any amendment to the Residential Code contained in the Rolling Hills Municipal Code,the provision contained in the later listed document shall control. This chapter shall be known as the "Existing Building Code of the City of Rolling Hills" and will be referred to herein as "this code." 15.24.03Q Def nitians. Notwithstanding the provisions of Section 15.24.0�Q,names or terms that are used in this code shall be deemed and construed to have the meaning ascribed to it in Section 15.04.040 of Title 15 of the Rolling Hills Municipal Code. 15.24.040 Amendment--Fees. Notwithstanding the provisions of Section 15.24.010, the fees set forth for this code shall be the same as the fess prescribed for the Building Code in Section 15.04A50 of Title 15 of the Rolling Hills Municipal Code. 15.24.050 Reserved. 15.24.U60 Violaiaons and penalty. A. It is unlawful for any person to erect, construct, eniaz�ge, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy or maintain any building or structure or perform any grading in the City of Rolling HilIs, or cause the same to be done, contrary fa or in violation of any of the provisions of this code. B. Penalty. Any person, firm or corporation violating any of the provisions of this code or any permit issuec� thereunder shall be deemed guilty of a misdemeanor, and each such person shall be Ordinance No. 350-U 3 deemed guilty of a separate offense for each and every da.y or portion thereof during which any violation of any of the provisions of this code is committed, continued or perfnitted, and upan conviction of any such violation such person shall be punishable by a fine of, not more than ane thousand dollars or by imprisonment in the County rail for a perioc� oF not more than six montl�s, or by both such fine and imprisonment. Section 8, Subsection(A) of Section 8.08.580 (Construction or demoiition was#e} of Article VII(Exclusions) of Chapter 8.08 (Solid Waste and Recyclable Material}af Title 8 (Health and Safety) of the RoIling Hills Municipal Code is hereby amended to read as follows: A. Minimum Construction ar Demolition Waste Diversion Rec�uirements. Every cavered pro�ect shall divert at least sixty-�ve (65}percent,measured by weight, of all construction or dernolition waste generated by the covered proj ect. Section 9. All inconsistencies between the Buildir�g Code, Electrical Code,Mechanicat Code,Plumbing Code, Residential Code, Green Building Standards Cade and Existing Building Code as adopted by this ordinance and Parts 2, 2.5, 3, 4, 5, 9 and 11 af the California Code af Regula#ions axe changes, rnodifications, amendments, additions or deletions thereto authorized by Califomia Health and Safety Cade Sections 17958 and 18941.5. Section 10. Justification for Modification. The Council hereby finds that the changes and modifications to the California Building Code, Plumbing Code, Mechanical Code, Electrical Code, Residendal Code, Green Building Standards Code and Existing Building Code that have been enacted by this ordinance axe reasonably necessary because af the City's local climate, characterized by hot, dry summers, often resulting in drought conditions, �ollowed by strong Santa Ana winds, aften resulting in hazardous fire conditions, and heavy winter rains, often resulting in expansive soil condi�ions; the City's geological characteristics in that the area is charac�erized by geological instability; location in Southern California; and the relatively hilly topography af the City. The City Council hereby finds that tlie modifications to the State Building Cade in Title 26 of the Los Angeles County Code are reasonably necessary because of the �ocal climatic, geological, and topographical canditions indicated above. The City Council hereby finds that the modifications to the California Buildi.ng Code in Title 26, Title 27, Title 28, Title 29, Title 30, Title 3I and the additian of Title 33 of the Los Angeles County Codes are administrative in nature and are necessary to allow the uniform application of the codes by procedures suited to the size and nature of the City's staff and administrative agencies by means suited to �the City's experience with local climatic, geological, and topographical conditions and to provide sufficient staff support for the time-consuming inspections and analysis required by the City's fire and geological hazards. These factors require specific and greater protection than what is afforded by the County Building Code. Accartlingly, the City Council finds the modifications in this Ordinance to the City's Title 15 Buildings and Construction to be necessary for the protection of the of the public health, sa�ety, and welfare. Section 11. Statemer�t of Urgency. This ordinance shall take effect immediately upon its adoption,pursuant to Government Code sectian 3b967. The City Cauncil declares that it is necessary to the public peace, safety and welfare that this ordinance be adopted as an urgency measure. It is essential that the City have iti effect on that date codes that comport with state law and contain those modifications necessitated by unique topographic, geologic and climatic conditions. In the absence of immediate effectiveness,the provisior�s of the Building, Electrical,Mechanical,Plumbing,Residential, Green Building and Existing Building Codes unique to the City's special circumstances wi11 not be in place and this wili have a detrimentaZ effect on the public,hea�th, safety and welfare. Section 12. To the extent the provisions of this ordinance are substantially the same as previous provisions of the Rolling Hi�ls Municipal Cade,these provisions shall be construed as cor�tinuations of those provisions and not as nevv enactments. Secdon 13. The provisions of the Building, Electrical,Plumbing, Mechanical,Residential and Green Building Standards Codes in effect prior to the effective date of this Ordinance shall continue to govern construction for projects for which�lans w�re submitted far plan check prior to the effective date of this Ordinance, and for which the initial permit is issued not later than thirty{30}days after said effective date. Ordinance No. 350-U 4 Section 14. This Ordinance has been determined to be exempt from the California Environmental Quality Act purs�aant to State Guidelines Section 15061 (b)(3)because it is not a project that has the poten�ial for causing a significant effect on the environment, Section I5. This ordinance shal�be effective upon adoptian and shall become operative as of January O1, 2017. Section 16. Notice. The City Clerk shall certify as to the adoption of this ordinance and post a certified copy of this ardinance, including the vote for and against the same, in the office af the City C1erk, in accordance with Govemment Code Section 3b993 and shall file a certified copy of this Ordinance with the CaliFornia Build.ing Standards Camznission.
