Chairman Chelf introduced the item and asked £or staf�s comments. Assistant Planner Stewart reviewed the applicant's request to construct a new residence with a guesthouse, pool, spa, tennis court, stable and corral in Zoning Case No. 914 at 11 Upper Blackwater Canyon Road. She sta�ed that in response to discussion at the previous rneeting, the applicant has relocated the stable as requested and provided a landscaping plan to enhance screening around the guesthouse, tennis court arid stable. She re�iewed the concerns raised by neighbors including visibility and noise from the tennis court, dra.inage and visibility af the project in general from �agebrush Lane, including a correspondence received today conceming visibility from inside a neighboring property. She stated that the applicant has revised the project in an effort to addresses the concerns raised including preparing an enhanced landscaping plan and providing a rubberized. surface for the tennis court. She further stated that based on the rnodffications and previous direction from the Planning Commission, a resolution af approval was prepared for the Planning Commission's consideration. Cha.irman Chelf called for public comment. Tony Fan, 1 Sagebrush Lane addressed the Planning Commission to express concern regarding the tennis court. Judy Yamato, 5 Sagebrush Lane addressed the Planning Commission to express concern regarding visibi�ity af the tennis court and guest hause from f ve roams in tlzeir house. Bing Liu, 1 Appal.00sa Lane addressed the Planning Commission to express concern regarding the tennis court. Tony Fan, 1 Sagebrush Lane addressed ttie Planning Commission to express concern regarding the tennis court on behalf of Mar. Hao, 6 5agebrush Lane stating the he believes he also submitted an e-mail. Martin Waters, 9 Upper Blackwater Canyon Road addressed the Planning Commission ta express his appreciation to the applicant, their architect ar�d the Planning Commission for addressing the concerns he raised previously regarding the locatian of the stable. Louie Tomaro, Tomaro Design Group addressed the Planning Commission to further explain the project commenting that the pad far the tennis court is 200 ft. away from the neighboring properties. Alan McGregar, Landscape Archi#ect addressed the Planning Commission to further explain the landscape plan specifically xts purpose to provide adequate screening for the texmis court so the residents will basically see the enhanced landscaping and a view over the tennis court. Commissioner Cardenas commented that since the last m�eting and the fieid trip, efforts have been made to mitigate the concerns raised and these recent view concerns, are not new. He commented that � he believes the concerns have been sufficiently addressed. Vice Chairman Kirkpatrick and Comrnissioner Seaburn concurred. Following brief discussion, Cornmissioner Seaburn moved that the Planning Commissian adapt Resolutxon No. 2017-02 granting approval of the applicant's request :in Zaning Case No. 914 at 11 Upper Blackwater Canyon Road. Vice Chairrnan Kirkpatrick seconded the motion, which carried wi�thout obj ection. T`he project has been determined to be ca#egorically exempt pursuant to the California Environmental Quality Act(CEQA}, Section 15303. Commissioner Cardenas recused himself from consideration of this case due to the proximity of his property to the subject property and left the dais. Chairrnan Ch�If introduced the item and asked for staffs comments. Planning Director Schwartz reviewed tl�e applicant's request and stated that the PZanning Commission visited the site earlier in the day to view the proposed project. She stated that the app�icant proposes an addition to the residence, a new garage, reta�ining walls arid associated grading for a new stable and corral; and to legalize a pathway that was previously graded an the property, to widen an existing driveway and create a new dri�eway for access to the stable. She further reviewed the details of the projec# and�he variances requested. She stated that since the site visit this morning several concerns were xaised surrounding t1�e stable and corral and a letter was received from the property owzier at 17 Middleridge Lane North and the applicant has indicated that they would like to remove the stable access road fram consideration at this time. With regard to the proposed driveways, she stated that the Traffic Cammission wil� review bath items at its meeting later this month, and the Tra£fic Engineer is recommending ap�roval of the widening of the existing driveway apron but has expressed some concerns regardirig the driveway apron for the stabte access road. Chairman Chelf called for public comment. Tavisha Nxcholson, Bolton Engineering addressed the Plamning Commission to fiirther review the .�. proposed project and to confirm that the applicant would like to remove the stable, corral and stable access road from consideration at this time due to cancerns raised by the neighbors and a#the site visit. Steve Tilles, addressed the Planning Commission to confirm that the stable and corral, as well as the stab�e access xoad are being removed from consideration at this time. Cha.irman Chelf confirmed. Speed Fry, 6 Williamsburg Lane addressed the Planning Cammission expressing concern that the City does not have a rule to limit on the size of barns. Christopher Olsen, 77 Eastfield Drive addressed the Planning Commission to express concern regarding the size of the barn and concurring with Mr. Fry's comment. James Aichele, 14 Crest Road West addressed the Planning Commission in support of the project, including the stable. In response to Commissioner Seaburn, Planning Director Schwartz stated that the Planning Commission can consider just the remaining items in the application, �including the as graded pathway arid if appropriate, direct staff to retum with a resolution approving just those items and the stable, corral and stable access raad would be brought back as a separate project at a later date after the applicant has re�ised the proposal. . Commissioner Seabum comrnented that he is in support of the remairiing items. Vice Chairmari Kirkpatrick concurred, except that he did not see the as graded pathways so he believes that should be considered when the stable is considered. � In response to Chairman Che7f regarding Commissioner Kirkpatrick's comment that the Planning Commission did nat see the as graded path during the field trip, Planning Director Schwartz commented that the Planning Commission co�ild provide direction ta staff to prepare a Resolution af approval pending a site visit to observe the as-graded pathway or it could be considered in conjunction with the stable. Following further discussion, Commissioner Seaburn moved that the Planning Cornrnission direct staff to pre�are a Resolution granting approval of the applicant's request as revised to eliminate the sta.ble, corral,riding ring and sta,ble access driveway ir;Zoning Case No. 915 a� 1 Middleridge Lane North with the standard findings of fact and conditions af approval pending a site visit to observe the as-graded, unpermitted pathway. Vice Chairman Kirkpatrick seconded the motion,which carried witl�out objection. The applicant will return with a separate revised application for the stable, corral, riding ring and stable access driveway. Cammissioner Cardenas returned to the dais. ZOIVING CASE N0. 916. Request for a Site Plan Review and Variances to retain a partially excavated area for a proposed 1,322 square foot basement, a portion of which would be located in the front setback and to retain unpermitted patio with an outdoor barbeque area supported by a 5' high retaining wall; grading for dirt pathways that are buttressed by 3' high railroad tie walls and a 3'8" high concrete block retaining wall in the side and front setback. The applicant also requests a Site Plan Review and Variances for a new 76.3' long, 4'6" high retaining wall, a portion of which wou�d be located in the side setback, for retaining walls that do not average out to 2.5' in height and ta exceed the m�imum permitted disturbance (48.8%) of the net lot azea, including for the set aside area far a future stable and corral. Project is located at 5 El Concho Lane, (Lot 10-GF), Rolling Hilis, CA, (De Miranda). Project has been determined to be exempt from the California Environmental Quality Act, (CEQA). Chairman Chelf intxoduced the item and asked for staffls comments. Planning Director Schwartz reviewed the applicant's request stating that this project came before the City as the result af a code enforcemer;t case. She commented that at the last meeting, after a site visit to the project, the Planning Commission requested �hat an engineer be present at the next meeting to address the drain pipe failure issue that resulted in a failed slope to explain how that matter will be resolved. She sta.ted that a letter was just received from the applicant indicating that neither the applicant nor his agents are available to att�d tl�e meeting tonight. She further explained that the applicant has reques#ed that the Planning Commission consider the project in phases where the Planning Cornmission would first consider approval of the basement, bbq/patio area and the wall in the easement and then in a subsequent phases, the P�anning Commissian would consider the walls below and the fix of the drainage issue. Chairman Chelf called for public comrnent. Hearing none, he asked far camments form the members of the Planning Commission. Following brief discussion and given tha# there were no represeritatives present on behalf of the applicanf to address the issues raised at the previous meeting, the public hearing on this matter was continued. Minutes - Planning Commission Regular Meeting Q3-21-17 -4 - ZONING CASE NO. 917,Request far a Site Plan Review to construct a r��w residence addition of 2,065 square feet, a new 2,065 s.f. basement, a new 700 s.f. swzmming poo1, and grading of 31,920 cubic yards of dirt, (which includes excavation and compaction) and construction of various accessory structures; Conditional Use Permits far a new, 1,1Q0 s.f. detached gaxage, 7,000 s.f. tennis court, 1,200 s.f. stable, 9,i50 s.f. corra� and a new second driveway; and a Variance to exceed the maximum permitted 40°/a disturbance of the lot to 47.2% and to grade more than 750 cubic yards of dirt and over 1Q,000 square feet surface area for the tennis court. The subject properiy is located at 5 Pine Tree Lane (Lot 94-RH) Rolli�ng Hi11s, CA, (Shamg}. The project has been determined to be categorically exempt (C1ass 3) pursuant to the Califomia Environmental Quality Act(CEQA} Guidelines, Section 15303. Chairman ChelFintroduced the item and asked for staffs comments. Assistant Planner Stewart reviewed the changes that have been made to the project noting that the pathway to the sta.ble has been changed to a 10 ft. wide decomposed granite pathway as compared to the 20 ft. wide paved driveway. She further reviewed the proposed option as suggested during the field trip and stated that the applicant's representative is present to fiirther rev�iew and explain fihe concephial changes. Tavisha Nicholson, BoIton Engineering reviewed the conceptual plans for the grading associated with the sfable and tennis co�.u�t designed to address the Planning Commission's concems but commented that it will require the import of a large amount of dirt. Brief discussion ensued concerning the revised proposal. Chairman Chelf called far public comment. Lauren Sharng, 5 Pine Tree Lane addressed the Planning Cornmission commenting that she believes bringing everything in closer to the house creates less af an impact on the neighbors and pravides far less visibility. Jol�n Resich, $ Outrider Road addressed the Planning Commission on behalf of the applicant stating that he believes the applicant and their representati�es can work with the City to achieve the applicant's �—' wishes and still meet the City's requirements. Discussion ensued concerning the impacf of the import of that amount of dirt. In response to Vic� Chairman Kirkpatrick, Ms. Nicholson commented that if importing sail is not the best option, they would like to move forward with the project as originally presented. Fo�lowirig discussion,the Planning Cornmxssion concurred that the ariginally proposed project provides a better solution than the conceptual revision,which in�alved the import of that amount of dirt. Commissioner Cardenas moved that the Planning Cammission direct staff to prepare a Resolution granting approval of the applicant's request in Zoning Case No. 917 at 5 Pine Tree Lane with the standard findings of fact and conditions of appraval and pending the Traffic Commission's review and recommendation regardang tl�e driveway apran for the stable access pathway. ZOIVING CASE NU. $96-R Request for a Major Modification to a previausly approved Zoning Case No. $96 requiring Site Plan Review, Conditionai Use Permit, and Varfances to reduce the grading to 8,026 cubic yards of dirt for a 13,860 square foot dressage axena and residential and garage improvements, including an 1,736 s.f. addition resulting in a 4,$OS s.f. residence, a 1,056 s.f. basement and a new 46$ s.f. attached garage and reconfigure and reduce in size to 971 s.f. exis#ing detached garage; #o construct a new 2,430 s.f. stable and wash area and an infinity pool, to exceed th� disturbed area to 50°/a of the net lot, to construct a not to exceed 5' high retaining _� wall in the side setback and to locate a portion of the dressage arena in the frant yard area of the 1ot. The project has been determined to be categorically exempt pursuant to the California En�ironmental Quality Act{CEQA), Section 15303. Chairman Chelf introduced the item and asked for staffs comments. Assistant Planner Stewart re�iewed the applicant's request to canstruct a 1,000 sq. ft. pool and spa in the front yard area of the property and stated that the Pianning Commission visited the site earlier in the day. She commented that it wasn't noted at the site visit,but the pool equipment area is also located in the front yard area. Chairman Chelf called for public comment. Leonardo Umansky, Architect addressed the Planning Commission to �urther explain�he project. Following brief discussion, Cammissioner Cardenas mo�ed that the Planning Commission direct staff to pr�pa�e a Resolution granting approval of the applicant's request in Zoning Case No. 919 at 7 Middleridge La�e South with the standard fmdings of fact and conditions of approval including a condition that the pool equipment be enclosed by walls on three sides and properly screened for visibility and sound; and pending proper noticing of the location pool equipment. Assistant Planner Stewart reported that the ad hoc committee heid its first meeting earlier this month and will be rn�eting again on Monday, March 27�'. City Cauncil direct�on for the continued review of the View Presenration Ordinance, (oral}. Planning Director Schwartz reported that the City Council has asked the Planning Commission to continue its discussion regarding amendments to the View Preservation Ordinance as previously directed.
