July 8, 1968
A regular meeting of the City Council of the City of Rolling
Hills was called to order by Mayor Nadal at the Administration Building
2 Portuguese Bend Road, Rolling Hills, California at 7:30 P.M. Monday,
July 8, 1968.

MINUTES
Councilman Fay moved that the minutes of th®,me®tin of
June 24, 1968 be approved as presented. Motion was seconded by'Council-
man Hesse and unanimously carried.
PERSONAL APPEARANCES

Mayor Nadal recognized Mr. Anton Weber, a resident of 53 Portu-
guese Bend Road, and Mr.,Weber presented Councilmen with copies of a
letter to the City of Rolling Hills, a letter to South Bay n ineerin
Corporation, and a surveyor's map and re quested that he and his neighbor,
Mr. L. J. Mokler of 2 Ranchero Road be given permission to exchange an
equal number of square feet of usable land on their properties. Mr.
Weber explained that the original owner of the property now owned by Mr.
Mokler had located his swimming pool only one foot from the property
line rather than the required 25 feet, and an exchange of equal footage
could result in the legal location of the pool, and further, that Mr.
Mosker was very agreea le to the exchange.
City Attorney William Kinl® was asked whether such an exchange
of property could be accomplished without each owner subdivising. Mr.
Kinley advised the Council that the division as described by Mr. Weber
would not require filing of subdivision maps, but could be accomplished
by having the properties re -surveyed, now boundaries defined and the new
maps recorded. The then sugested that the matter be referred to the
Board of Directors of the Rolling Hills Community Association for approval.
Mayor Nadal requested that members of the City Council make a
field trip to the properties before the next meeting of the City Council,
#nd requested that Mr. Weber appear before the City Council after receiv-
$ng the decision of the Board of Directors. Mr. Weber agreed, and thanked
the Council for their consideration.
Mayor Nadal ordered the matter held on the agenda.

Mr. Fred Fuld
Mr. Fred Fuld, .3 Crest Road East, advised the Council that
he wished to again request that he be allowed to retain his present
number on Crest Road East, and to support his request he had prepared a
collection of: papers which he then presented to the Council. Included
were a copy of the County Engineer's Map of.Lots 1 through 10, Flying
Triangle Tract (properties on south side of Crest Road East) and a
County Engineer's Map of Lots 192A-1, 192A-2, 192B'and portion of Misc-
ellaneous (properties on north side of Crest Road East) copies of ex=
cerpts from Zoning Ordinance No. 33 and Subdivision Ordinance No: 67,.
and copies of the County Assessor's Map for.the above.properties.
Mr. Fuld stated that after notification of the change of
address he had three alternatives: accept the new number, which he was
not willing to do; sue the City Council together and individually, sue
the City Manager, City Attorney, et al, at great expenditure of time
and money; or appeal to the City Council for granting of the same
consideration and benefits that have been granted to other property
owners. Mayor Nadal asked Mr. Fuld what benefits he was referring to
and he stated that the owner of Parcel 1, Dr. Paul Saffo, had sufficient
gross acreage to qualify under requirement of the City of Rolling Hills
Subdivision Ordinance to apply for permission to subdivide the property;
however, because of road easements, there was less net acreage in that
property than the net acreage of Mr. Fuld's property. Mr. Fuld felt
that if his neighbor had receive two numbers, he should have, too. The
City Attorney explained that eligibility to subdivide was established
on gross acreage, but that sufficient acreage in no way guarantees
,approval of a subdivision. The City Manager explained that no engineer-
ing decision was attempted, but the gross acreage was used as a base
on the recommendation of the County Engineer, who had served as advisor
on the renumbering project.
Mr. Fuld said that he felt he was paying more taxes than he
should, because it was his understanding that assessment of property
was based on net acreage, and his neighbor who enjoyed the benefits of
4.86 gross acres was taxed for only 2.69 net acres, and Mr. Fuld was
taxed for 2.89 net acres. Councilman Hesse said that the tax assessor
makes his assessment based on the highest and best use of the land at
the time of assessment, and that assignment of numbers is not relevant
to assessment.
Mayor Nadal asked Mr. Kinley to advise on the practices of
the assessor, and Mr. Kinley said that assessment of property is based
on fair market value of the property rather than on acreage. Mr. Kinley
also advised that it is the obligation of the City to name streets and
number houses.
Councilman Hesse said he had not voted on the issue by reason
of his absence from the meeting. Mr. Kinley said the matter could be
reconsidered if it was re -opened by a Councilman who had voted on the
matter. Mayor Nadal asked if any Councilman who had voted in favor of
Resolution No. 229 entitled A RESOLUTION OF THE CITY COUNCIL OF THE
,*CITY OF ROLLING HILLS, CALIFORNIA, PROVIDING FOR A SYSTEM OF NUMBERING
HOUSES ON CREST ROAD EAST wished to make a motion to re -open discussion
and take another vote; there was no action, so Mayor Nadal declared the
matter carried as resolved by the City Council on June 10, 1968.
CORRESPONDENCE
Southern California Rapid Transit District
A notice of a public hearing on the final report of the South-
ern California Rapid Transit District scheduled for July 18, 1968 was
presented to the Council. The notice was received and filed.

PAYMENT OF BILLS
Councilman Fay moved that Demands No. 787 through 806 be
paid from the General Fund, and No. 807 be paid from the Traffic
Safety Fund.

Councilman Fay moved that an ordinance entitled 0°An Ordinance of
the City of Rolling hills, California, Providing For the Control of
Animals and the Licensing of Dogs" be introduced, and that reading in
full be waived. Motion was seconded by Councilman Hesse and carried
by the following roll call vote:

PUBLIC HEARING - Ordinance No. 75, Electrical Code
Mayor Nadal opened a public hearing on adoption of Ordinance No. 75

Hills, Adopting the Los Angeles County Electrical Code by Reference".
The City Clerk advised that notice of the public hearing had been pub-
lished, and that no communication, written or oral, had been received.
Mayor Nadal asked whether there was anyone present who wished to speak
for or against adoption of the ordinance; there was none, and the mayor
closed the public hearing.
Councilman.Fay moved that Ordinance No. 75 be adopted, and that
readin in full be waived. Motion was seconded by Councilman Hesse and

PUBLIC HEARING - Ordinance No. 76, Building Code
Mayor Nadal opened a public hearing on adoption of Ordinance -No. 76
entitled "An Ordinance Amending Ordinance No. 6 of the City of Rolling
Hills, Adopting the Los Angeles County Building Code by Reference".
The City Clerk advised that notice of the public hearing had been pub-
lished, and that no communication, written or oral, had been received.
Mayor Nadal asked whether there was anyone present who wished to speak
-for or against adoption of the ordinance; there was none, and the mayor
closed the public hearing.
Councilman Hesse moved that Ordinance No. 76 be adopted, and that
reading in full be waived. Motion was seconded by Councilman Fay and

Hills, Adopting the Los Angeles County Plumbing Code by Reference".
The City Clerk advised that nitice.of the public hearinghad been duly
published, and that no communication, written or oral, ad been received.

for or against adoption of the ordinance; there was none, and the mayor
closed the public hearing.
Councilman Fay moved that Ordinance No. 77 be adopted and that

been received. Mayor Nadal asked whether there was anyone present who
wished to speak for or against adoption of the ordinance; there was none,
and the mayor closed the public hearing.

PROPOSED BUDGET ® Fiscal Year 1968 _ 1969
The City Manager presented the Proposed Budget for Fiscal 1968-69.
After general discussion, Mayor Nadal ordered the Proposed Budget
held on the agenda.
AGENDA ITEMS HELD OVER
SUBDIVISION -NO. 31, Tract 26769, J. H. Langworthy
Mrs. Clifton advised the Council -that Mr. Kenneth Schorr, engineer
for Mr. J. H."Langworthy, had requested that the subdivisiop be held on
the agenda .. -
The Mayor so ordered'.
Eastfield Gate
The City Manager advised the Council that she had received the final
plans of the new gatehouse fpr the Eastfield Gate area from the architect
Mr., Corwin Eberting, and they had been submitted to and approved by the
Architectural Committee. She said that a Newsletter had been sent to all
.residents advising them :that the work on the Eastfield Gate would com®
mence.in July.

The matter was removed from the agenda.
F ike Hydrants F ire . F lows
Mrs. Clifton advised that an additional section of water main had
been installed by the Palos Verdes Water Company on.Eastfield Drive-, and
that a new hydrant had been installed outside of the City of Rolling
Hills on its southern boundaries, and that -its location would be bene-
ficial to the City if it were necessary to combat any fire from that
direction.
Traffic Safety Committee
Mrs. Clifton informed the Council that Mr. Charles Sutton of the
Los'Angeles County Road Department had telephoned to advise the cost
of improvements recommended in the Traffic Report of June 19, 1968,.
presented to the City Council and adopted at the meeting on June 24, 1968.
Sutton advised that the .s'afe loading area on Crest Road West,
in the vicinity of the'stairway leading to La Cresta School would cost
$800.00, an amount in excess of the $3.000.,00 previously approved.
Councilman Hesse moved that the approved expenditure be raised to
a, sum not to exceed $3,800.00 to include the loading area. Motion was
seconded by Councilman Fay and carried by the following roll call vote:

Speed Control Bumps
Councilman Fay moved that in view of the recommendation by Mr.
Charles Sutton of the Los Angeles County Road Departmfnt�that speed.
bumps not be considered for the City of Rolling Hills because they
create a greater accident potential than now exists, the Rolling hills
Community Association be asked to remove the bumps at the Main Gate

area and the intersection of Saddleback and Portuguese Bend Road.
The motion was seconded by Councilman Hesse and unanimously carried.
ADJOURNMENT
There being no further business to come before the Council,
Mayor Nadal adjourned the meeting to a personnel session at 11:00 PM.
The meeting reconvened at 11:50 P.M. and was adjourned at 11:55 P.M.
on the motion of Councilman Fay, seconded by Councilman Hesse and
unanimously carried.
