A RESQLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING
HTLLS APPROVTNG A REQUEST FOR A CONDITION USE PERMIT FOR
COI�rSTRUCTION OF A 779 SQUARE FOOT STABLE, AND 3,290 SQUARE FOOT
CORRAL IN ZONING CASE NO. 926 AT 6 MEADOWLARK LANE, LOT 20-RH,
(DLTNLAP).
THE PLANN�I�iG COMMISSION DOES HEREBY FTND, RESOLVE AND ORDER AS FOLLOWS:
Sec�ion 1. An application was duly filed by Michael Dunlap with respect to r�al properry
located at 6 Meadowlark Lane, Ro�ling Hi11s (Lot 20-RH) requesting a Condition Use Permit for the
construction of a 779 square foot stable, including a loft, and a 3,290 square foot corral.
Sectaon 2. The Planning Cominission conducted duly noticed public hearings held on July
18, 2017, in the fiel�, and continued the meeting to the evening meeting, at which they directed staff ta
prepare a resolu�ion of approval. The resolution of appraval was reviewed an approved at the regt�lar
evening Planning Commission meeting on August 15, 2017.
Neighbors within 1,000-foot radius were notified of t.�e public hearings and a notice was published in
�he Penins2xla News on July 7, 2017. The applicants and their agents were notified of the public hearings
in writing by f�rst class mail and the applican�s and agents were in attendance at the hearings. Evidence
was heard and presented �tom all person interested in affecting said proposal, and from members of the
City s#aff.
�ection 3. The Planning Co�unission finds that the project is exempt from the California
Environmental Quality Act, (CEQA)pursuant to Class 3, Section 15303 of the CEQA guidelines.
Seetion 4. Conditional Use Permit. Sections 17.18A60 and 17.18.090 of the Rolling
�IiIIs Municipal Code permit approval of a stable over 20Q square feet and cor�ral over 550
square feet with a Conditional Use Permit. T'he proposed 779 square foot stable and 3,290
square foot eo�ral con�p�y wi�h a� requirem�nts of th�s� sec�ions. V'��ith respecf to this request
for a Conditional Use Permit, the Planning Commission finds as£ollows:
A. Conditionally permitted uses are not outright perxnitted by the Ralling Hi�Is
Municipal Code. The Planning Commission must consider applications for a Conditional Use
Permit and may, with such conditions as are deemed necessary, approve a condi�ianal use
which will not jeopardize, adversely affect, endanger or to otherwise constitute a menace ta
the public health, safety or general welfare or be materially detrimental to t�e property �f
other persons located in the vicinity of such use.
B. The gran�ing of a Conditional LTse Pernut for the stable and corral would be
consistent with the purposes and objectives of the Zoning Ordinance and General Plan
because the use is consistent with similar uses in the community, and meets alI the applicable
code development standards for sueh uses, and they are located in the areas on tlie property
that are adequately sized fo accommodate such uses. The praposed uses are appropriately
located in fihat they wi11 be sufficiently separated from nearby structures used for habitation or

containing sleeping quarters. The stable/corral wil� be constructed in furtherance of the
General Plan gaal of promoting and encouraging equestrian uses.
C. The nature, cond'ztion, and development of adjace�tt structures have been
considered, and the project will not adversely affect or be materially detrimental fo these
adjacent uses,buildings, or structu�res because the proposed st�able/cor�ral u�e is located mastly
in the middle of a 1.71 acre Iot and the generai location is of sufficient distance from nearby
residences so as to not impact the view or privacy of surrounding neighbors. The proposed
sfable is to be located adjacent to the corral and access roughened for equestrian uses that runs
from the stable to the road is separate£rom the other autdoor living areas on the property.
D. The project i.s ha:rmonious in scale and mass with the site, the natural terrain, and
surrounding residences because the proposed uses comply with the low pro#ile residential
development pattern of the community and will not give the property an over-bui�t look, and
areas will remain open and unobstructed. The lot is 1.�� acres net in size and is sufficient�y
large to accommodate the proposed uses.
The stable wi11 be compafible v�r�th the uses in the surrounding area because Rolling Hills is an
equestrian commuruty and stables are encouraged. The stable will laok like a stable and with
the corral will promote open space on the pad.
E. The proposed conditional use complies with a11 applicable development
standards of the zone district and requires Conditional Use Permits pursuant to Sections
17.18.060 and 17.18.090 af the Zoning Ordinance.
F. The proposed conditional uses are consis�ent with the portions of the Los
Angeles County Hazardaus Waste Management Plan relating to siting criteria for hazardous
waste facilities because the project site is not Iisted on the current State of California
Hazardous Waste and Substances Sites List.
Section 5. Based upon the toregoing findings, and the evidence in the record, the
1'Ianning Commission hereby approves Zoning Case No. 926 request for a Coa�diti.ona� Use
Permit for the construction of a 779 square �aot sta.bie, consisting of a 187 square foot loft and 592
square foot first level and a 3,29Q square foot corral, subject to the following condi�ions:
A. The Conditional Use Permit approval shall expire with�in two years from the
effective date of approval as defined in Section Z7.42.070, unless otherwise extended pursuant
to the requirements of this section.
B. �any condifion of this resolution is violated, the entitlement granted by this
resolution shall be suspended and fihe privileges granted hereunder shall Iapse and upon receipt
of written notice from the City, all constructian work being performed on fihe subject property
shall immediately cease, other than wark de�ermined by the Cify Manager or his/her designee
requared to cure the violation. The suspension and stop work order will be lifted once the
Applicant cures�he violation to the satisfaction of the Cify Manager or his/her designee. In the
evenfi that the Applicant disputes the City Manager or hzs/her designee's determination that a
violation exists or disputes how the violation must be cured, the Applicant may request a
hearing before the City Council. The hearing shall be scheduled at the next regular meeting of
the City Co�xncX�for which the agenda has not yet been posted; the

Applicant shall be provided written notice of the hearing. The stop work order shall remain in
effect during the pendency of the hearing. The City Council shall rnake a determination as to
whether a violation of this Resolution has occurred. If the City Counci.i determines that a
violation has not occurred or has been cured by the time of�he hearing, the City Council wi�l lift
the suspension and the stop work order. If the City Council determines that a violation has
occurred and has not yet been cured, the City Council sha11 provide the Applicant with a
deadline to cure the violation;no cans�ruction work shall be performed on the praperty until
and unless the violation is cured by the deadline, other than work desi�ated by the City
Council to accomplish fihe cure. If fihe violation is not cu�red by the deadline, the City Council
may either extend the deadline at the Applicant's request or schedule a hearing for the
revocation of the entitlements granted by this Resolution pursuant to Chapter 17.58 of the
Rolling Hills Municipal Code {RHMC).
C. AII requirements of the. Building and Construction Ordinance, the Zoning
Ordinance, and of the zone in which the subjec� property is located must be complied with
uniess otherwise set forth in this permit, or shown otherwise on an approved plan.
D. The lot shall be developed and maintained in substantia� conformance with the site
plan on file received on July 11, 2Q17 excepf as othexwise provided in these conditions. The
worki.ng drawings submifted to the Department of Buildrng and Safety for p1an check review
shall conform to the approved development plan. All conditions of the Conditional Us� Permit
approval shall be incorporated 'znto the building permit working drawings, and where
applicable complied with prior to issuance of a grading or building permit from the building
department,
The conditions of approva� of this Resolution shall be printed onto building plans submitted to
the Building Department for review and shali be kept on si�te at all tunes.
Any modificat�ons and/or changes to the approved praject, including resul.ting from field
conditions, shall be discussed and approved by staff przo:r to implementing the changes.
E. Priar to submittal of �inal working drawings to Bui�ding and Safety Depax�ment
for issuance of building peranits, the plans for the project shall be submitted to City staff for
verification that the final plans are in compliance with the plans approved by the Planning
Con�unission.
F. A licensed professional preparing construction plans for this project for Building
Department review shall execute a Certificate af�i�ming thaf the plans conform in all respects to
this Resolution approving this project and all of the conditions set forth therein and the City's
Building Code and Zoning Ordinance.
Fux�he�r, the person obtaining a building and/or grading perxnit for this project shall
execute a Ce7rtzficate of Construction stating that the project will be consixucted according to this
Resolution and any plans approved therewith.
G. Struct�r.rai Iot coverage o£ the lot sha11 not exceed b,720 squa�e £eet {with
deductions) or 10.6% of the net lot area, in conformance with 1ot coverage Iimitations (2Q%
maximum).

The total Iot coverage proposed, including structures anci flatwork, shall not exceed
13,219 square feet (with deductions} or 20.6%, of the net lot area, in conformance with lot
coverage limitations {35°� max).
H. There shall be no grading for this project. The dxs�urbed area of the lot, including
�he approved stable and carral shaFl not exceed the existing 4�%.
I. The stable pad exists at 4,245 square feet and shall not exceed 779 square feet of
coverage or 18.4% with allowed deductions.
J. The 1$7 square foot Ioft may be used as a tack roorn, and shall not exceed 24% of
the size of the structure. The agricultural uses shall not be less than 76% of the size of the
structure. The stable uses and interior and exterior deszgn are subject to the requxrements of
Section 17.18.060 of the Zoning Ordinance. The surface of the corral, paddock and areas adjacent
to the agricultural portion of the stable shall remain permeable at aIl times, and may not be
paved.
K. Access to the stable and to t?tle corral silall be roughened material.
L. A min;mum of five-foot Ievel path and/or wallcway, which does not have to be
paved, shall be provided around the entire perimeter of the proposed structure.
M. At any time there are harses on the property, Best Management Pract�ces {BMPs)
shall be applied for manure contral, including but nof be limited to removal of the manure on a
daily basis ar provision of a receptacle with a tight closing lid that is constructed of brick, stone,
concrete, metal or wood lined with metal or othe:r sound material and that is safeguarded
against access by flies. The contents of said receptacles shall be removed once a week. It is
prohibited to dispose of manure or any animal waste in�o the Municipal Separate Storm Sewer
System (1VIS4),into natural drainage course or spread on the propex�fy.
N. '1'he appYicanf shall comp�y with all requirements of the Lighting Ordinance of the
City of Rolling Hills {RHMC 17.1b.7.90 E), pertaisting to Iighting on said property, roofing and
material requirements of propertzEs in the Very High Fire Hazard Severity Zone.
O. AII u�ility Iines to the stable shall be placed undergxound, subject to all applicable
standards and requirements.
P. A drainage glan, i£ rcquired liy the Building Department, may he prepared and
approved by City Staff prior to issuance of a construction permit. Such plan would be subject to
LA County Code requirements.
Q. A landscaping p1an shall be submitted to the City in conformance with Fire
Departrnent F�ei Modification requirements if required by LA County. If a landscaping plan is
required, prior to finaling the project, trees and shrubs shall be planted to screen the project
from the neighbors. The landscaping shall not foxm a hedge like screen but be offset. The height
of a�y new trees and shrubs are to be planted in conformance with the landscaping plans for

this project. The landscaping plan shall utilize to the maximum extent feasible, plants that are
native to the area, are water-wise and are consistent with the rural character of�he community.
R. Any new Iandscaping shall be subject to the requirements af the City's VlTater
E£ficienf Landscape Ordinance, {Chapter�3.180£the RHMC).
S. The setback lines and roadway easemen� lines in the vacinity of the construction
for this proJect shall remain marked throughout the construction. A construcfion fence rnay be
requi�red.
T. Perimeter easements, including roadway easements and trails, zf any, shall remain
free and clear of any improvements including, but not be limited to fences-including
eonstrruction fEnces, any hardscape, driveways, landscaping, irrigation and drai.nage devices,
except as otherwise approved by the Rolling Hills Community Association.
U. Minimum of 65% of any construction materials must be recycled or diverted from
Iandfills. The hauler of the materials shall obtain City's Construction and Demolition permits for
waste hauling prior to start of work and provide proper documentation to the City.
V. During construction, conformance wi�i the air quali�y management district
requirements, starmwater pollution prevention practices, county and Iocal ordinances and
engineering practices so that peop�e or property are not exposed to undue vehicle trips, noise,
d�st, and obJec�ionable odors shall be required.
W. During conshuction, all parking shall take place on the project site and, if necessary,
any overflow parking shall take place as much as possible within the unimproved roadway
easements on Meadowlark Lane adjacent to project site onl.y, and shall not obstruct neighboring
driveways. During construction, to the maximum extent feasible, employees of the contractor
sha11 car-pool into the City.
X. During canstruction, the property owners shall be required to schedule and regulafe
construction and related traffic noise throughout the day between the hours of 7 A1VI and 6 �'M,
Monday through Saturday only, when construction and mechanical equipment noise is
permitted, so as not to inferfere with the quiet residential environment of the City of Rolling
Hills.
Y. The contractor shall not use tools that cou�d produce a spark, including for
clearing and grubbing, during red flag warning conditions. Weather conditions can be �ound at:

t11e sole responsibility of the property owner and/or his/her contractor to monitor the red flag
warning condi�ions. Should a red flag warning be decla�red and if work is to be cond�zcted on the
property,the contractor shall have readily avai�able fire distinguxsher.
Z. The property owners shall be required to conform wi�.i the Regional Water
Quality Control Board and County Public Works Department Best Management Practices
(BMP's) requirements related to solid waste, drainage and storm water drainage facilities
managemenf). Fur�her the property owners shall be required to conforxn to the County Health
Departxnent requirements for a septic system�f a new system is required.

AA. Prior to finaling of the•project an "as constructed" set of plans and cex�ifications,
inc�uding certifications of ridgelines o£ the sixucture, shall be pravided to the Planning
Departrnent arid t11� Building Department to ascertain that the completed project i.s in
compliance with �the approved plans. In addition, any modifications nlade to the project during
canstruction, shall be depicted on the"as built" plan.
AB. '�'he applicant shall execute an Affidavit of Acceptance of all conditions of this
permit pursuant fo Zoning Ordinance, or the approval sha1l not be effec�ive. The affidavit sha11
be reco:rded together with the resolution.
