A regular meeting of the Planning Commissian of the City of Ro�ling Hills was called ta order by
Chairman Chelf at 6:33 p.m. on Tuesday, Juiy 18, 20�7 in the City Council Chamber, at City Hall, 2

RESOLUTIONS
RESOLUTION NO. 2017-10. A RES4LUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROLLING HILLS GRANTING APPROVAL OF VARIANCES TO RETAIN A
CHICKEN COOP IN THE REAR YARD SETBACK, RETAIN A SHED IN THE SIDE
SETBACK, RETAIN AN AS-BUILT FIRE PTT, TO EXCEED THE PREVIOUSLY
APPROVED LOT DISTURBANCE, CONSTRUCT A NEW SWTMMING POOL AND SPA
AND TO CONSTRUCT VARIDUS OUTDOOR AMENITIES, 1N ZONING CASE NO. 921,

Chairman Chelf introduced the item and asked for staf�s comments. Assistant Planner Stewart
reviewed the applicant's request in Zoning Case No. 921 at 26 Eastfield Drive. She stated that this lat is
a sub-standard size lot and most o�the development falls within the setback area.
Chauman Chelf called for public comment. Hearing none,he closed the public hearing.
Cammissioner Cardenas moved that the Planning Commission adopt Resolution No. 2017-10 granring
approval of #he appiicant's request in Zoning Case No. 921 at 26 Eastfield Drive as presented.
Coxr�missioner Seaburn seconded the motion, which carried withaut objection.
PUBLIC HEARINGS ON ITEMS CONTINUED FROM PREVIOUS MEETING
ZO1vING CASE NO. 922, (Request for a Site Plan Review to construct a new 4,859 square foot
residence and 1,232 square foot garage, a 560 square foot swimming pool and spa, with
additianal amenities such as a gatehouse and outdoor covered kitchen; and Conditional Use
Permit for 688 square foot guest house. The applicant is also requesfing Variances to allow for
partial constructian in the front yard area, for a privacy wall that exceeds 5' in height and to
exceed the previously approved d�sturbance of the lot. The subject property is located at 0 Poppy
Trail (Lot 40-B1-RH) Rolling Hills, CA, (Serpa). The praject has been determined to be
ca�.ego�ically exempt (Class 3- Section 1.5303) pursuant to the California Environmental Quality
Act(CEQA) Guidelines.
Chairman Chelf introduced the item and asked for staffls comments. Planning Director Schwartz
reviewed the applicant's request to construct a new residence and other amenities on a vacant tot in
Zoning Case No. 922 at 0 Poppy Trail and stated that the Planning Commission visited the site earlier in
the day. She reviewed the praposed grading which includes a total of 2,100 cu. yds. a portion of which
is proposed to level off the previausly created building pad which is currently at approxxmately 10%
slope. She furkher reviewed the variances being requested including a variance to exceed the previously
approved disturbance of the lot, which was discovered to be inaccurate when the engineering reports
wer� being completed for the current project. She commented that the CEQA documents are being
amended to be sure a11 rernediated areas are being considered and staff is preparing an amended
Mitigated Negative Declaration, which will b� presented to the Planning Commission at its August
meeting. She further reported that at the field trip earlier in the day, the Planning Commissian directed
staff to prepare a Resolution granting approval of the applicant's request in Zoning Case No. 922 at 0
Poppy Trai�with the standard findings of fact and con�itions of approval.

Mark Minkes, 44 Chuckwagon Road addressed the Planning Commission to inquire if le�+eling off the
building pad will create a drainage issue on the lot. In response to the inquiry, Chairman Chelf
comrnented that once the project is appraved, it wi11 be reviewed by County engineers.

Hearing no further public comment, the Planning Commission confirmed its previous directian to staff
to prepare a Resolution granting approval of the applicant's request.
ZONING CASE NO. 923. (REVISED). Request ta modify a previously approved project for a

CA. (Wheeler), The project has been detErmined to be categorically exempt (Class 3, Section
15303)pursuant to the California Environmentai Quality Act(CEQA) Guidelines.
Chairman Chelf introduced the item and asked for staff's comments. Planning Director Schwartz
reviewed th� background and l�istory including the code enforcement process that resulted in the
applicant's request to modify a previausly approved project in Zoning Case No. 923 at 38 Portuguese
Bend Road. She stated that at its �ast meeting, after a site visi#, the Planning Commission reviewed the
proposal arFd asked the appiicant to further revise the request to hy to conforrn to the previously
approved buiIding pad. She reviewed the modification currently proposed as campared to the az�ginal
proposal as well as #he previous proposal stating that current proposal reduces the size of the covered
patio by 107 sq, ft and moves it siightly to the east; includes a reconfigured building pad; and proposes
to export 930 cu. yds. of the illegally imported dirt. She stated the revised proposal included a wall and
results in gentler slopes with fewer 1.5:1 slopes being created. She comznented that a correspondence
was recei�ved from a neighboring property expressi�tig concerri regarding the visibility of the project and
requesting that the project be screened from their view. Discussian ensued conceming the revised
proposal and resulting s�opes compared to what existed previously.
Chairman Chelf called for public comment.
Dan Bolton, Bolton Engineering addressed tl�e Planning Commission to further explain the project
including the grading and resulting slopes.
Commissioner Cardenas expressed cancern regarding the use of the illegally imported dirt to push the
pad toward the neighbor given that they have expressed concern about the project.
Commissioner Cooley concurred with Commissioner Cardenas and expressed coz�cem that the pad was
not reverted back to what was originally approved. Mr. Bo1�on further explained the revised rec�uest
stating that the scope of each aspect of the proposal was reduced slight�y based on the Planning
Commission's previous dir�ctioz�.
Commissioner Seaburn expressed concern regarding the covered patio and its impact an the neighboring
property. Cornrnissioner Cardenas commented that he believes the patio could be reduced in size and
accomrnodated on the original pad.
Following public comment and discussion, the Planning Commission asked the applicant to further
revise the propasal ta address the concems raised regarding the size of the covered patio as wel� as the
size and conf guration of the building pad. The public hearing was continued.
ZONING CASE NO. 924, Request for a Site Plan Review to construct approximately 920
square feet of residential additions, on a property with a restricted development condition. The
subject property is 7 Portuguese Bend Road (Lot 41-RH) Rolling Hills, CA, (Martin). The
project has been determined to b� categorically exempt under Class 1, Section 15301{3)pu;rsuant
to the Califarnia EnvironmentaI Quality Act(CEQA) Guidelines.
Commissioner Cardenas recused himself from consideration of this case due ta the proximity of his
property to the subject property and left the dais. Chairman Chelf introduced the item and asked for

residential additions in Zoning Case No. 924 at 7 Porluguese Bend Road. She further stated that this
matter is anly before the Planning Commission because there is a restricted develaprnent designation on
this property from a previous approval and the applzcant is rec�uesting that the designation be lifted
because the past approval for a much larger project was not constructed as originally approved. She
stated that at the field trip earlier in the day, the Planning Commission directed staff to prepare a

ZONING CASE NO. 926, Request for a Conditional Use Permit to construct a 779 squaxe foot
stable, which inc�udes a loft. The subject property is 6 Meac�owlark L�ne {Lot 20-RH) Rolling
Hills, CA, {D�lap). The project has been determined to he categorically exempt under Class 3,
Section 15303 pursuant to the California Environmental Quality Act(CEQA) Guidelines.
Chairman Chelf introduced the item and asked for staff's comments. Assistant Planner Stewart
reviewed the applicant's request to construct a stable and corral at b Meadwolark Lane. She reviewed
the dishzrbance stating that the pad was previausly graded and there is existing access to the pad �ia a
roughened pathway. She further reported that at the field h'ip earlier in the day, the Planning
Commission directed staff to prepare a Resolution granting approval of the applicant's request in Zoning
Case No. 926 at 6 Meadowlark Lane with the standard findings of fact and conditions of approval.

ZONING CASE NO. 908. Request for a Site Plan Review for grading to repair a failed slope, a

allow a structure constructed as a stable in 1980 to contin.ue to be used for recreation uses in

Chairman Chelf introduced the item and asked far staff's comments. Planning Director Schwartz
reviewed the applicant's request for grading to repair a failed slope, a variance to exceed the maximum
permitted disturbance af the lot and a Stable Use Permit to allow a structure constructed as a stable in
19$0 to continue to be used for recreation uses in Zoning Case No. 908 at 2950 Palos Verdes Drive
Narth. She stated that the Platming Commission visited the site earlier in the day. She further stated that
due to the urgent need to repair the slope, staff prepared a resolution, which was circulated with the staff
report, granting approval of the applicant's request far the Planning Commission's consideradon.
Chairman Chelf called far public comment. Hearing none, he asked for comments from the P�anning
Commission.
Commissioner Cardenas moved that the Planning Commission adopt Resolution No. 20i7-11 granting
approval of the applicant's request in Zoning Case No. 908 at 2950 Palos Verdes Drive North as
presented. Commissioner Caoley seconded the motion,which carried without objection.
NEW PUBLIC HEARINGS
ZONING CASE NO. 925, - ITEM TO BE CONTINUED. Request for a Site Plan Review to
construct a new approximately 93 S square foot residential addition and 982 square foot basement,
conversion of a 484 square foot garage to a new residential entry, new spa and S faot retaining
wall; and Conditional Use Permit for an approximately 352 square foot addition to an e�cisting
430 square foot pool house; and Variance to exceed the rnaximum permitted disturbance of the

lot. The subject property is located at 16 Pine Tree Lane (Lot 81-1-RH) Rolling Hi�ls, CA,
(Bharadia}. The project has been determined ta be categorically exempt under Class 1, Section
15301. pursuant to the California Envzroaunental Quality Act(CEQA) Guidelines.
Assistant Planner Stewart reported that due to an incomplete application, consideration of the matter wi11
be con�inued to the next regular meeting of the Planning Commissian scheduled for Tuesc�a.y, August 15,
2417. No discussion occurred and no action was taken.
ZONING CASE NO. 929. CONSIDERATION OF A DRAFT RESOLUTION FOR A ZONII�TG
� TEXT AMENDMENT TO THE ROLLING HILLS MUNIGIPAL CODE TO AMEND
SECTTON 17.12.220 OF CHAPTER 17.12 (DEFINITTONS) AND REPEAL AND REPLACE
CHAPTER 17.2b (VIEW PRESERVATIOIV) WITH A NEW ORDINANCE, TN ZONING CASE
NO. 929, ZOIVING TEXT AMENDMENT NO. 2Q17-01. The project has been determined to be
categoricaliy exempt pursuant to the Califomia Environmental Quality act (CEQA), Sections
15031(b)(3), 15Q60(c)(3), and 15061(b)(3).
Chairman Chelf introduced the item and stated for the record that after this s�aff report was distributed,
he had multiple conversations with Richard Colyear and exchanged e-mail messages with Ly�an Gi11 on
this matter. He then asked for staff s comments. Assistant City Attorney Karpe�es stated that two pieces
of correspondence were received after the staff report was distrib�xted and they have been placed on the
dais for the Planning Commission's consideration and made available to the public.
Assistant C�ty Attorney Karpeles presented the staff report on the praposed amendments to Rolling Hills
Municipal Code Chapter 17.26 (View Preservation.) She stated that the proposed amendments begin by
consolidating all of the definitions related to view preservation into the View Preservation ordinance
itself rather than being included in the broader zoning code. She stated that �he intent and purpose
portion of the ordinance has been amended ta include the goal of the City to recognize a balance
between the preser�ation of views and the preservation of trees. She then briefly reviewed the proposed
defmitions stating that with regard to the definition of"Establisned View," sta�f modified the term to
"Pre-Existing View" and included Ianguage to specify a. �0-year time limit in order to incorporate the
Planning Commission's direction to incorporate meaningful methods to preserve trees but that language
� can be modified or stricken at the Planning Commission's discretion along with any othez�of the DRAFT
definitions including the language defining "View Impairment" that specifies at 1,000 ft. distance
requirement; and a list of"accessory structures."
Assistant City Attorney Karpeles further reviewed the draft dispute resalution process which places the
City in an advisory role and is compartmentalized into four separate phases: {1) informal dispute
resolution between the neighbors; (2) mediation; (3) application to Committee on Trees and Views for
an advisory determination; and (4) optional binding arbitration �o be partially subsidized by the City.
She further reviewed the propased restorahve actions which are listed in hierarchy of order; the
considerations when applying the ordinance to help guide the process for a mediator, Cammittee on
Trees and Views or arbitrator; and protections far vegetation owners as weli as those seeking a view.
Lastly, she stated that since the City is renderiang advisory opinions, a section is ir�cluded that states that
the City will not be liable for recommendataons nar will the City be required to enforce any agreements
achieved by#he parties.
Chairman Chelf commezrted that this DRAFT ordinance is a work in progress and should be taken as�
such. He sta.ted that the Planning Commission will continue to tal�e and consider input from the public
as this document is considered and moved forward through the process.
Chairtnan Chelf called for public comment.
Lynn Gill, 31 Chuckwagon Road addressed the Planning Commission to xeview the correspondence he
submitted which was provided to the Planning Commission and lists the areas where he believes the
DRAFT ordinance is lacking including that it does not provide rights for the vege�ation ovvner and
weakens considerations of mitigating factors ie: a right to privacy, shade or other factars. He also
expressed concern that the explana�ory images were eliminated and that irnportant details were
eiiminated in an attempt to simplify the document.
John Nunn, 1 Crest Road West addressed the Planning Commission concernzng the allowance for views
from multiple viewing areas expressing concern that such a provision may allow for tbe clear cutting of

trees. He furkher expressed suppart for the fact the City takes only an advisory role in the pracess in the
proposed DRAFT.
Mark Minkes, 44 Chuckwagon Road addressed the Planning Commission to suggest that the process be
siznplified. He further suggested that the City inquire as to what a majority of the residents want.
Commissianer Cardenas commented that the forum fox participation has been available and the Pianning
Commission has heard from people on both sides of this issue and the Planning Commission's objective
it ta find something that is cammon ground and represents a comprornise on both sides of the issue.
Norm Miller, 4 Chesterfield Road addressed the Planning Commission in support of the concep� that
"the view you bought is the view you get." He comxnen#ed that he believes the 1,OOQ ft. limit in the
definitions of "�iew impairment" and the 10-year lirnit in the definition of "Pre-existing View" are
arbitrary. He commented that he is not interested in finding balance but rather wauld support a view
ordinance that is objective and rnakes sense. He further commented that the City should not incur any
costs for arbitration or other znatters related to view disputes.
7ahn Blazevich, 1 Buggy Whip Drive addressed the Planning Commission in support of the concept that
one should only be entitled to the view they purchased. He commented that disputes should be handled
between the parties and not involve the City.
John Nunn, 1 Crest Road West further commented that he supports the proposed language that provides
for binding arbitration.
Fred Lorig, 1 Spur Lane addressed the Planning Commission to express concern that placing the City in
an advisory role in essence takes the City completely out of the view preservation process. He
commented that if a City has a law, it should enforce#he laws and the City cannot delegate its powers to
arbitration. He fixrther commented that the laws regarding view preservation should fairly balance trees
and�iews.
A# Chairman Chelfls �inquiry and in response to Mr. Lorig's comments, Assistant City Attorney
Karpeles commented that she does not bel:ieve that serving in an advisory role puts the City in a
vulnerable position.
Cammissioner Cardenas cornmented that the matter regarc}ing taking an advisory role as is done in the
Town of Tiburon was discussed at length; and in those discussions it was learned that the Tovvn of
Tiburon ordinance was litigated and upheld.
James Wald, 7 Qua.i.l Ridge Road South addressed the Planning Commission to inquire how the matter
of retroactivity wi11 be addressed in the DRAFT ordinance. Chairrnaxi Chelf commented that he also had
a conversation with Mr. Wald prior to the meeting. In response ta Mr. Wald's inquiry, Ms. Karpeles
commented that the existing draft is not retroactive.
Chairman Chelf called for a brief recess at 5:35 p.m. The rneet�ng was calied back to arder at 8:40 p.m.
Hearing no further public comment, Chairman Chelf stated that the Planning Commission would move
to reviewing the DRAFT ordinance.
Discussion ensued concerning the defmitions including the term "topping" and the inclusion of the
images suggested by Mr. Gill. In response to Cammissioner Coaley, Ms. Karpeies commented that
topping is included as a restorative action where appropriate. Following discussion, the Planning
Commissian concurred that the images should be included.
Discussian ensued concerning the definit�on of the terms "pre-ex�sting�iew" and`�riew impairment."
Pre-existing Yiew
Ms. I�arpeles reviewed the definition of "pre-existing view" as ariginally proposed by the Planning
Commission. Chairman Chelf commented that the definition should include a provision that a11ow for
restoration of a view in situations where the property owner worked with their neighbor to improve the
view since they purchased the property. Commission Cardenas commented that the language states the
view that existed "at any time," which provides for view resta:ration in those situations. He suggested

striking the language that was added "but not more than 10 years." Following further discussion, the
Planning Commiss�on concurred that the language regarding the 10-year limit shau�d be eliminated.
View Impaarment
With regard to the definitian of"view impairment,"Chairman Chelf commented that he does not believe
the "I,000 ft. distance Iimit" is necessary. Discussion ensued conceming the distance limit with the
Planning Commissian concuming that the distance limit should be eliminated.
Mr. Gi�l commented that a defmition for the term "pre-existing vegetation" should alsa be included.
Discussion ensued concerning the concept of creating a right to "existing vegeta�on." Chairman Chelf
com�nented that he spoke to staff and ask�d that the matter be further researched.
Mr. Lorig inquired as ta the �nforcement mechanisms that will be part of �he ordinance inc�uding
litigataon. Jn response to Mr. Lorig's inquiry,Ms. Karpe�es commented that the parties can litigate at any
time. She further commented that language can be added to state that the parties can litigate; but since
the City is not enforcing the ordinance, it is not really necessary. Commissioner Coo�ey suggested
including such information in the"guide book"that wil�be prepared for reference by property owners.
Viewirag Point
With regard to the defmition of"Viewing Point," Ms. Karpeles asked for direction from the Planning
Commission as ta what areas to incIude or not include based on the list provided in the staff report.
Discussion ensued concerning including stabies as a "viewing point." Fo�lowing discussion, the
Planning Commission concurred that stables shou�d not be included and agreed on the language
proposed in the staff report.
In response to Chairman Chelf with regard to "pre-existing vegetation," Ms. Karpeles commented that
she will further research whether ox not having a tree is a police power of the City to protect as a right.
Discussian ensued concerning the amount to set for the City's contribution toward arbitration. Ms.
Karpeles commented that the amo�xnt wi11 be established by Resolution of the City Counci2 whicl� could
be modif ed as necessary and language to that affect can be added to the ardinance. Further discussion
ensued cancerning what rde the City will play in paying for and/or selecting the mediator. Following
discussion, the Planning Commission concurred not to contrib�xte toward mediation bnt rather pravide
the parties with a list of inediators.
Discussion ensued concerning the dispute resalution process.
Mr. Gill suggested that the provisions on page S of the DRAFT ordinance prepared by Mr. Karpf be
included. Ms. I�arpeles commented that the provisions are very similar to the criteria in the draft

ordinance. Discussion ensued concerning adding a provision to tnclude"shade" as a benefit provided by
trees. The Planning Commissian concurred that"shade" should be added.
Commissioner Cardenas commented that in reviewing his notes from the speakers at tonight's rneeting,
it appears that the majority of the issues have been addressed. He noted one additianal comment in the e-
mail correspondence received that suggested notifying realtors stating that the matter was previously
discussed and it was suggested that a brochure be created to that affect.
Restorative Action
� Discussion ensued concerning the hierarchy or restarative action which in order of most preferred to
least preferred, pmvides for iacing, crown raising, crown reductian, heading back, topping and removal.
The Planning Cornmission concurred that topping may be appropriate in some situations given that the
species of the free will be taken into considerataon before determining the restorative action.
Discussion ensued concerning retroactivity. The Plan�ning Cammission concurred that no provision
should be inciuded regarding retroactivity.

Following public comment and discussion, s�aff was directed to amend the DRAFT ordinance per the
Planning Commission's direction for considera�ion at the August 15, 2017 meeting of the Planning
Commission.

The Ptanning Commission scheduled a field trip to the following properties to be held on Tuesday,
August 15, 20I7 beginning at 7:30 a.m.

City Manager Cruz reported that City Clerk Luce wi11 be lea�ing the City on August 3`�to take a position
as City Clerk in Rolling Hills Estates.
ITEMS FROM THE PLANNING COMMISSION
Commissioner Seaburn commented that he will not be available to attend the Planning Commission
meeting on August 15, 2017.
Chairman Chelf asked that future items be agendized to discuss stable pad size and automatically
eliminating the "no furkher development" condition or other praject specific conditions if an entitlement
expires.
ADJOURNMENT
Hearing no further business before the Planning Commission, Chauman Chelf adjourned the meeting at
9;30 p.m. to an adjourned regular meeting of the Planning Cammission scheduled to be held on Tuesday,
August I5, 2017 beginning at 7:30 a.m. far the purpose of conducting a site visit to 19 Middleridge Lane
Nor�h and 7 Middleridge Lane South. 'The next regular meeting of the Planning Commission is
scheduled to be held on Tuesday, August 15, 2017 beginning at b:30 p.m. in the City Cauncil Chamber,
Rolling Hills City Hall, 2 Portuguese Bend Road,Rolling Hills, California.
