Dr. A. Wilcox A letter dated July 31, 1968 from the Division,Fire Chief, "Research and Planning, of Los Angeles County Fire Department was read .�;. ,+, ° by the Deputy City Clerk. At the meeting of the City Council on July.22, 1968, Dr. Alex Wilcox, subdivider of Tract 24669, 6 Johns Canyon Road, had r@- quested that the requirements of 1250 gallons per minute fire flow over and above domestic demands be reduced to 850 gallons. Chief Victor Petroff advised that the original requirements had been recon- sidered and found to be reasonable and valid and recommend@d that the subdivider be required to make arrangements for providing the facilities and flows as required. s. Dr. Ruthella Wilcox advised the Council that they had received a copy of the letter and were agreeable to meeting the requirements of the Fire Department. Mr. Fred Boettcher, South Bay °En ine@ring said that he would have the final map ready for the meeting o August 26, and Mayor Fay ordered the matter held on the agenda until that time. ROPOSED ORDINANCE - Vicious Doug. City Attorney William Kinley advised the Council that a .meeting had been held with the City Manager and Mr. Manley Linvill@ of the Department of Animal Control. The proposed ordinance had been r@ - viewed, and several changes were recommend@d by Mr. Linvill@. After enumeration of the chan@a by Mr. Kinl@y, Mayor Fay opened discussion of the ordinance by t@ Council. Mayor Fay asked whether consideration had been given to requiring a @n or f@nc@ rather -�. than a leash for a dog that had bitten, Councilman K @in stated that an adequate enclosure would be hard to d@lin@. Councilman Hesse said that in his opinion the language of the ordinance is clear, and no further description is necessary. Councilman Sauer qu@stion@d the p@nalt ,,--requiring destruction of the dog, and Mr. Kinl@ advised that s@ cion 6.06 containing the provision had boon d@l@t@d from the propos@d ordinanc@.' Mayor Fay then opened the discussion to residents Who had indicated a wish to be heard. ".. Mrs. Richard Slocum, 22 Southfield Drive, asked whether the ordinance applied to animals other than do s; Mr. Robert Morrill, 5 ., Ringbit West, aaic1he thought any case of itin or attack should be :c:ssary; kn up with the owner of the do and that such an ordinance was not Mr. James Millhauser, Ringbit East, said he f@lt,th@ ordi- Nance was vague in the definition of attack, and there was norotection or the owner of the animal. Mr. John Bennett, 3 Eastfi@ld Drive, said that laws arise from the need, and if there is a need in Rollin Hills "t,...,.the complaints should be made known. It was Mr. B@nn@tt'a opinion that ,.. anyone could swear out a warrant whether j ustifi@d or not, and he r@ - quested thatla rural community like Rolling Hills avoid conformity and proceed slowly in adopting ordinance or laws. Mrs. Homer Simpson, 2 Ringbit West, asked why the ordinance would require confining an offending dog in a kennel, when the county ordinance requires onlythat a dog be confined on the property. Mrs. James Gordon, 8 Ringbit ast, August 12, 1968 asked whose word would be believed in swearin an affidavit. She said that recently her dog, normally very docile hadrowled at a: member of the Weed Abatement crew, frightening him badly; however, she does not consider the dog vicious and felt that the manis fear had been transmitted to the dog, causing him to react. Mayor Fay then closed the discussion, saying that there had been pros and cons in the many meetings at which the -ordinance was discussed. Following the discussion Councilman Hesse moved that the ordinance entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS, CALI- FORNIA, PROVIDING FOR THE CONTROL OF ANIMALS AND THE LICENSING OF DOGS be introduced as amended, and that reading in full be waived. Motion was seconded by Councilman Klein and a discussion followed. Councilman Hesse made the followingcomments: The -problem of vicious dogs is a subject for concern, ancitizens should have a full opportunity to discuss the problem and the pros and cons of the proposed ordinance; non-domestic animals constitute a loophole; author- ship of the ordinance was questioned by Mr. Millhauser a resident, and persons who feel that they or members of their families have been menaced by vicious do s should present their side of the question to the people who feel tat the law is not necessary; a few of those present referred to the possibility of a loosely drawn, affidavit sworn by excited or emotional people, therefore a provision should be made for the,:protection of the owner and stopping of an affidavit signed under these conditions. Mr. Kinley said that a section with reference to the Penal;-Code,in the event of perjury dould be inserted after Section 6.01 of the ordinance. Councilman Klein asked whether the affidavit could be filed by anyone bitten in the City,'whether or not a resident, and wh@th@r I City Clerk must accept an: affidavit filed. He also asked whether it would be ppractical to elim nat@ the requirement that the dog b@ taken to a'kennel, and confine it to the owners premises in®t@ad. Mr. Kinley said that the proposed ordinance had no provision for redress by the owner, and in case of a false affidavit p@rjury would have to be charged in a counter statement by the owner. H@ stated that the proposed ordinance follows the County ordinane@ @x@@pt with regard to wild animals and dogs running at larg@, and that in r@ - writing the ordinance sections on perjury and @nforc@m@nt @ould b@ add@d. Councilman Hesse su gested that a n m@ @w committ@@ b@ ford, consisting of persons who fee that the ordinance should b@ pamd, and persons opposed to adoption of the ordinan@@. Mayor Fay then called for a vote on the motion whi@h was carried by the following roll call vote. AYES: Councilman Hesse, Klein, Sau@r, Mayor Fay NOES: None ABSENT: Mayor Nadal PROPOSED ORDINANCE - Traffic City Attorney William Kinley presented copies of the proposed Traffic Ordinance to members of the Council for study. Mayor Fay ordered the matter held on the agenda for review at the next meeting. AGREEMENT - Special Services Narcotics Officer The second draft of the AGREEMENT ® SPECIAL SERVICES NARCOTICS COORDINATOR dated July 23, 1968, and a letter dated August 29 1968 from -3- August 12, 1968 George R. Nash, Chairman of the Peninsula Council for Youth were pre- sented to the Council. Motion to authorize execution of the a reement by the Mayor was made by Councilman Hesse, seconded by Councilman Sauer and unani- -mously carried by the following roll call vote:. AYES: Councilmen Hesse, Klein, Sauer, Mayor Fay NOES: None ABSENT: Mayor Nadal, RESOLUTION NO. 231 ` Moti.on for approval of a resolution authorizing the Deputy City Clerk, the Mayor and the City Treasurer,. -to ne otiato with Gateway National Bank for�-a loan of $20,000.00 for a pBrio of 90 days, interest not to exceed 3 3/4% was made by Councilman Klein, seconded by Council- man Sauer and carried by the following roll call vote: AYES: Councilmen NOES: None ABSENT: Mayor Nadal Hesse, Klein, Sauer, Mayor Fay SUBDIVISION NO. 39, TentativeTract No. 281.72. Albert Pinamonti The Deputy City Clerk advised that new maps ehowin @.Common access for both lots on the subdivision had been r@c@iv@d kni w@r@,r@- ferred to the Board of Directors for consideration at th@ m@@ting on August 15, and to the Architectural Committee for th@ m@@ting of Aug- ust 19, and that Mr. Leonard, engineer for Mr. Pinamonti had re u@et@d that the matter be held on the agenda until August 26 for a d@c®ion. The Mayor so ordered. AGENDA ITEMS HELD OVER Traffic Safety Commitee Mrs. Cunningham advised th@ Council that work authoriz@d by them had been started on the main roads in Rollin Hill®, that th@ advisory signs and traffic delineator® recomm@nd@d by Mr. Charl@® Sutton of the Los Angeles County Road D@partm@nt had b@@n in®tall@d, and that the safe loading zone in th@ vicinity of La Cr@eta School would be completed in time for the op@ning of school. MATTERS FROM MEMBERS OF THE C0UN.CIL Trophy Case - Los Caballeros Mayor Fay called attention to th@ trophy case that had b@@n placed in the rear of the Community Room by Los Caball@roe to display their trophies, and asked Councilman Sauer to convey th@ appr@ciation of the City Council to the Caballeros. Los Angeles County Fire Department Mayor Fay directed that the secretaryrepar@ a l@tt@r for his signature commending Chief Keith Klinger, Chief Ralph Russ@ll and Captain Wary Nansel for the efforts of the Los Angeles County Fire Department in fighting the fire that burned thirty acres of brush on August 11, and theirieffectivenoss in keeping the fir@ away from Rolling Hills and other residential areas. -4- August 12, 1966 ADJOURNMENT There being no further business to come before the meeting, motion for adjournment at 9:20 P.M. was made by Councilman Hesse, seconded by Councilman Klein and unanimously carried.
