INCURRED IN ARBTTR.ATING A VIEW IMPAIRMENT COMPLAINT
UNDER CHAPTER 17.26 (VIEW PRESERVATION) OF THE ROLLING
HILLS MUNfCZPAL CODE.
T'l�e City Council of the City of Rolling Hills does find, order and resolve as follows:
Sec�ion 1, Pursuant to Section 17.2b.(}40 of Chapter 17.26 of Title 17 o#'the Rol�ing Hilis
Municipa.� Code, and in order to encourage private r�solution of view disputes as an a.lternative to the
expendi�ure of public resources associated with process�ing a view complaint, if the parties to a view
impairment complaint pursue resalution by vo2untarily entering into binding arbitra�ion at any tirne prior
to submittang an appeal to the City Council of the Committee an Trees and Views recammendations, the
City will reimburse the arbitrator's fee in an a�nount, a total of, whic� sha11 no# exceed five thousand
dol�ars ($5,OUp).
Section 2. The City will reimburse the parties at the conclusion o�arbitration following the
parties' snb�nittai to t��e City of an invoice and an executed agreement bindang both parties to the
arbitration award. Any amount in excess of$S,U00 owed by either parky towards the arbitrator's fee
sha�l be the sole responsibility o� the parties, as are the parties' respective attorney's fees and other
costs.
Section 3. This Resa�ution shall take effect upon the effective da.te of O�rdinance No. 35�4.
Section 4. The City Clerk shall certify ta the passage and adoption of this Resoiution.
