5/27/1957S6 MINUTES OF REGULAR MEETING OF TAE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA The regular meeting of the City Council of the City of Rolling Hills was held at 7:30 p.m. Monday, 27 May 1957, in the City Hall. The meeting was called to order at 7:30 by Mayor Goodman. ROLL CALL Present: Councilmen Bullard,,Elliott, Tourtelot and Weitzel and Mayor Goodman Also Present: City Clerk Gilbert Myers, Deputy City Clerk Phyllis Stockdale, City Attorney William Kinley, Mr. John Knezevich, Dr. William Riddell, Owen Goodman, Jr., Michael Walters and Dr. Godfrey Pernell. MINUTES - MEETING OF 13 MAY 1957. It was'moved by Councilman Tourtelot and seconded by Councilman Elliott that the minutes be approved as written. The motion was carried. LANDSLIDE WAIVER After discussion it was moved by Councilman Tourtelot that the City's request for landslide waivers be rescinded, excepting areas shown as landslide areas on Plate 1 of Professional Paper 207 of the Geological Survey dated. 1946. The motion was seconded by Councilman Elliott and was carried. POUND ORDINANCE Dr. Riddell presented his comments upon the proposed ordinance and a discussion followed. It was moved by Councilman Tourtelot that the ordinance as heretofore introduced be amended. The motion was seconded by Councilman Weitzel and carried. The ordinance was further amended to be an emergency ordinance. On motion of Councilman Tourtelot, seconded by Councilman Weitzel, the amendment was carried. It was moved by Mayor Goodman that the reading of the ordinance in full be waived. The motion was seconded'by Councilman Weitzel and carried. Mayor Goodman moved the adoption of Ordinance No. U-8 entitled "An Ordinance of the City of Rolling Hills, California, Providing for a Poundmaster, for the Licensing of,Dogs, and for the Impounding of Dogs and Other Animals." The motion was seconded by Councilman Bullard and, on roll call vote by the City Clerk, said Ordinance No. U-8 was unanimously adopted. Said Ordinance is set forth in full in the Book of Ordinances. RESOLUTION NO. 27 Thereupon, after discussion in which all Councilmen participated, and after approval by the City Attorney, Resolution No. 27 entitled "A Resolution of the City Council of the City of Rolling Hills, California, Authorizing Execution of an Agreement with the County of Los Angeles for the Provision of Pound and Poundmaster 1. 1 M Services for the City of Rolling Hills" was, on motion made by Mayor Goodman, seconded by Councilman Elliott, and on roll call vote by the City Clerk unanimously adopted. Said resolution is set forth in full in the Book of Resolutions. LETTER - 25 APRIL. LOS ANGELES COUNTY HEALTH DEPARTMENT The City Clerk read a letter from the Health Department concerning the enforcement of Ordinance No. 3 of the City of Rolling Hills. RESOLUTION NO., 28 Thereupon, after discussion in which all Councilmen The City Clerk -read a letter of April 30, 1957 from the State Highway Engineer regarding gas tax funds allocated to the City of Rolling Hills amounting to $1,555.57• The Mayor reported visiting the Department of Public Works during his recent trip to Sacramento and explained that this money is now on deposit in the State Treasury and will be kept there, increasing each year, until the City of Rolling Hills is legally able to spend it. LETTER - LOS ANGELES COUNTY ROAD DEPARTMENT The City Clerk read a letter dated May 2, 1957 from the County Road Commissioner regarding a drainage easement west of Martingale Avenue that extends within the City of Rolling Hills. The matter was referred to Mr. Friend and Mr. La Torre to be reported on at the next Council meeting. LETTER - BOARD OF SUPERVISORS The City Clerk read a letter dated May 14, 1957 from the Property Management Division of the Board of Supervisors of Los Angeles County regarding a road deed executed by John Y. Maeno for the widening of Crenshaw Boulevard. After discussion it was moved by Mayor Goodman that the deed be returned unaccepted with the request that if the County desires this participated, and, after approval by the City Attorney, Resolution No. 28 entitled "A Resolution of the City Council of the City of Rolling Hills, California Re Enforcement of Ordinance No. 3" was, on motion made by Councilman Bullard, seconded by Councilman Weitzel, and on roll call vote by the City Clerk unanimously adopted. Said resolution is set forth in full in the Book of Resolutions. 'LETTER - COUNTY ENGINEER The City Clerk read a letter of April 29, 1957 from the Department of the County Engineer regarding the excess of fees collected for building, electrical and plumbing permits over the County's expenses for rendering building inspection services in the amount of $?57.90 for the period January 10 1957 to March 31, 1957. The City Clerk reported receipt of said $757.60. The City does not desire at'this time to acquire any easement for public roads. The motion was seconded by Councilman Tourtelot and unanimously carried. LETTER - ST. FRANCIS EPISCOPAL CHURCH The City Clerk read a letter dated May 14, 1957 from Rev. Robert Tourigney expressing appreciation for the part Rolling Hills played in the success of the, Homes Tour. LETTER _ BOARD OF SUPERVISORS The City Clerk read a letter dated May 149 1957 from the Chief Administrative Officer regarding the rate per inspection or visit in connection with -our Agreement for Health Services which will be $3.63 for the next fiscal year. REPORT OF MAYOR RE TRIP TO SACRAMENTO Mayor Goodman reported that the bill regarding law enforcement on private roads was passed by the State Senate on May 22, 1957 and is now on the desk of the Governor. This bill states as follows: "Private Roads. The provisions of this code shall not prevent any city within the reasonable exercise of its police power from adopting rules and regulations by ordinance or resolution, regulating vehicular traffic on privately owned and maintained roads located within theboundaryof such city, except that no such ordinance or resolution shall be effective until signs giving notice thereof are posted on the roads affected. The provisions of this section shall not apply to any city in which there are publicly maintained city streets.' Mayor Goodman presented his expense account. for 070.99 in connection with the trip. It was moved by Councilman Tourtelot that payment be authorized. The motion was seconded by Councilman Elliott. All Councilmen voted aye except the Mayor who declined to vote. After a discussion of traffic problems, Councilman Elliott was appointed chairman of a committee to draw up a vehicle code for the'city. A REPORT FROM THE CITY COUNCIL A draft form of this report was presented by the Mayor. It was decided to,mail out revised copies to all property owners of Rolling Hills with the next Newsletter. RESOLUTION NO. 29 Thereupon, after discussion in which all Councilmen participated, and, after approval by the City Attorney, Resolution No. 29 entitled "A Resolution of the City Council of the City of Rolling Hills, California, Requesting Approval of the Los Angeles County "Board of Supervisors L 1 1 of Proposed Annexation No. 24-57, Territory Located within the City of Rolling Hills, to the Consolidated County Fire Protection District" was, on motion made by Councilman Bullard, seconded -by Councilman Tourtelot and on roll call vote by the City Clerk unanimously adopted. Said resolution is set forth in full in the Book of Resolutions. COUNTY ORDINANCE NO. 7101 - POOL FENCES It was moved by Mayor Goodman that the City Manager inform the County Building Department that this city does,not intend at this time to amend its Building Code in regard to the fencing of swimming pools. The motion was seconded by Councilman Bullard and unanimously carried. .CITY BILLS The City Clerk read the register of bills to be allowed. Mayor Goodman moved that Councilman Tourtelot L^ be designated Finance Officer to attest by signing his rr: approval for payments. Councilman Elliott seconded the motion which carried unanimously. It was moved by Councilman Weitzel, seconded by Councilman Elliott, �= and unanimously carried that Demands 1 through 8 as audited and approved by the City Manager be paid as follows: Demand No. 1 Demand No. 2 Demand No. 3 Demand No. 4 Demand No. 5 Demand No. 6 Demand No. 7 Demand No. 8 - Anchor Press - The Economy Press - OBrion, Russell and Co. - Los Angeles County Health Dept. - State Compensation Insurance Fund - John Lawson, Treasurer - Redondo Office Supply - Palos Verdes Publishing Co. It. was moved by Mayor Goodman, seconded by Councilman Tourtelot and unanimously carried that the City Clerk be authorized to purchase a minute index book for approximately $100.00 and some law books for the City. CITY SEAL Mayor Goodman reported that a desk model seal bearing the red horse emblem would cost $45.00. He was authorized to order the seal, 39 073.01 1102.18 30.00 $4.00 $15.00 17.50 8.92 33.20 4283 , bl GATES A discussion followed on the advisability of the City taking over the management of the gates. 1957-58 BUDGET - Mayor Goodman suggested that the City present a budget to its citizens at the Association -budget meeting and asked Councilman Bullard to assist him in its preparation. ON F FIREARMS BY MINORS POSSESSION OFIEAS .. .. _ _... ..._ .. Councilman Bullard read some amendments to the proposed ordinance. Councilman Tourtelot moved that the ordinance be amended to read minors under the age of sixteen (16) years. The motion was seconded by Councilman Bullard and unanimously carried. Councilman Bullard moved that the ordinance as amended be further amended to exclude persons going to a rifle range or on a hunting trip. The motion was seconded by Councilman Tourtelot and was defeated. WATER CORROSION Councilman Bullard reported that he had received a letter from Mr. Ashline of the Los Angeles Water and Power Department and that he would have a talk with him and perhaps ask him to appear before the Council. COUNTY ORDINANCE N0. 106 GRADING City Attorney Kinley discussed the ordinance and its applications. Mayor Goodman agreed to -prepare a form of ordinance adopting the County ordinance for introduction at the next meeting. FRANCHISES Mayor Goodman told of an appointment he had made with reppesentatives of the gas companies to discuss franchises. SHERIFFS PROTECTION.CONTRACT Mayor Goodman reported that a -talk with Mr. Robert Andersen had indicated that it would be possible to contract for one hour out of eight for sheriffs s pro- tection, at a cost of'approximately ten thousand dollars per year. He was asked to continue negotiations. MAYORBS EXPENSES Mayor Goodman presented bills for $8.51 for blueprints and $20.28 for three copies of.Los_ Angeles Count. Building L�aw�s. It was moved by Councilman VVe tzel secon ed"by Councilman Tourtelot and carried that the Mayor be reimbursed. All Councilmen voted aye except the Mayor who declined to vote. NOTARY PUBLIC FOR CITY OFFICE It was moved by Mayor Goodman that sufficient funds be appropriated for Mrs. Stockdale-ss appointment as a Notary Public. The motion was seconded by Councilman Tourtelot and carried. ADJOURNMENT There being no further business to come before the meeting, it was moved by Councilman Elliott, seconded by Mayor Goodman, and unanimously carried that the meeting be adjourned at 11:05 p.m. gWA APPROVED: City CCler'�_�.
