ROLL CALL PRESENT: Councilmen, Fay, Hesse, Klein, Sauer Mayor Nadal ABSENT: None ALSO PRESENT: Teena Clifton City Manager, William Rinloy City Attorney Marion Welch City Treasurer June Cunningham Secretary Mr. John Bennett Mr. James Barnard Mr. Jordan Dunaway Mr® & Mrs. Robert Merrill MINUTES Motion to accept the minutes of August 26, 1968 as presented was made by Councilman 'Hesse, seconded by Councilman Sauer and unani- mously carried® Motion to accept the minutes of September 11 1968 as pro- seated was made by Councilman Pay, seconded by Councilman Klein: and unanimously carried® PERSONAL APPEARANCES Mr© James Barnard Mayor Nadal reconized Mre James Barnard, 63 Crest Road East, who requested a clarification of the traffic ordinance in effort in Roll- ing Hills, and whether the radar owned by Rollin Rills Estates coup be used by Rolling Hills. Mr. Barnard said he had been told by a Sheriff '@ Deputy that when a citation: was given, it was somotimos hi®misged b the judge on the basis that the Rolling Rills ordinance is not applicable to the County Ordinance, Mr. William Rinley, attorney for the Cit of Rolling Rills, ad- vised Mr. Barnard that the Traffic Ordinance of the City had been. 0- written so that the sections aroe in number to the Count Ordinanco as there had been some confusionin the past caused by the dfferonce in numbering. Mr® Kinley said he had been: advised about the dismissal of one citation by a pro -tem judge® Mr. Kinley advised the Council that the Traffic Ordinance of the City of Rolling hills has been presented to the Sheriff for review and recommendations. He said that certain: sections of the Count Ordinance with regard to speed limit, weight limit, otcg would not appy to Rolling Hills, but in principal the County Ordinance had been adapted to the City of Rolling Hills Ordinance whereever possible, Mrs. Clifton, City Manager, advised Mr. Barnard that the City has an agreement with Rolling Hills Estates regarding the radar, and that it is presently used at all times in the city, She advised that the road striping and new signs recommended by the Los Angeles County Read D6part- ment had been instateled, and because the estimates from the Road Department 11 III September 23, 1968 for the recommended paving in the vicinity of La Cresta School were too high, and she had contacted -Vernon Paving, and it was expected that the work would be completed within one week. Mr. Jordan Dunaway, 38 Portuguese Bend Road, stated that he onsidered the road signs well done and very helpful. ROPOSED ORDINANCE - Control of Animals and Licensin,jzof Dogs, Mrs Dunaway advised the City Council that he had studied the proposed ordinance, and wished to recommend that the Council pass the :ordinance in its present forme He stated that he had experienced less trouble with menacing dogs since the residents became aware of the problem, and the impending action by the City Council, and he thought the ordinance as presented would provide an acceptable solution. Mayor Nadal opened discussion of the ordinance, and Mr. Robert Merrill, 3 Ringbit West, a newly appointed member of the Committee work- ing on the problem, read a Monority Report in opposition to the proposed ordinance. Mr. John Bennett, 3 Eastfield Drive, presented a petition con- taining eighteen names opposing the proposed ordinance, and the City Clerk accepted the petition as part of the record. He further stated that his objection to the ordinance was thepossible effect on: watchdogs, which he considers essential for some. homes in. the area. Ne also stated that his dog had been antagonized by the man: who collects his trash, and that he felt the animosity between, the man and the dog was caused by the man's actions, and he wished to protect his dog® ry, Mayor Nadal read three letters addressed to the Councii. letter dated September 2, 1968 from Gerald B. Stain:, M.D., 2 Crest Road est and a letter from James B. Gordon, 8 Ringbit Road opposed th@ pro- posed -ordinance, and a letter from James W. Bro�don 5 Maverick Lane supported the ordinance and urged passage and a ,opt�on. The lett@rs were received and filed. In the discussion that followed Councilman Rees@ stated that the action taken by the residents who signed the petition circulat@d by Mr. Bennett was constructive, as they were indicating int@r@st in th@ problem caused by the dogs in the City. He recomm@n:d@d that th@ sign@rs of the petition contact persons both in favor and oppos@d to th@ pro- posed ordinance, and stated that the City Council has mad@ it @1@ar in every discussion,of the ordinance that both sides of th@ qu@stion an. being considered, and although the Tactic@ has r@cult@d in prolon:g@d debate before the Council, the resu t is that th@y hav@ b@@n compl@t@ly informedi on 'both sides of the problem. Councilman Fay stated that he believed the Council should con- sider accepting the reports of the Committee who have work@d on th@ problem for many months and act on them, rather than rej@ctin them again. Councilman 'Hesse stated that the Council keeps rejecting the reports only in an effort to clarify the situation and arrive at a solution that would be acceptable to people who have expressed strong eelings, either pro or con. Councilman, Hasse said that there is a igh probability of misunderstanding on the subject, and a simple summary f the ordinance would be useful. City Attorney Kinley ex lained that Section C 01a had been added providing that the -Ordinance would not cover an intruder or trp.spasser who had been attacked by a dog guarding the owner's premises, and reliev- ing the property owner of responsibility of conforming with the ordinance in such a case. Mayor Nadal advised the Council that he would writ® a letter to all residents, summarizing the ordinance in, an effort to make it easily understood by all. Motion to strongly oppose the req,t .iast for re -zoning by Resolu- tion, was made by Councilman Fay., seconded by Councilman Hesse andun.- animously carried. Mrs. Clifton advised, that she, planned to attend the hearing on. 'behalf of the City, Council to register, opposition, to the change in, zoning. South Bav Councilmen's Association Meetinn Notice Notice of a dinner meeting to be held at the Plush Horse on September 26, 1968 by the South Bay Councilmen's Association, was pre- sented to the Council. Councilman, Sauer said he would, attend and represent the City of Rolling Hills, League of California Cities - Annual Leasue, Confervnee Mrs. Clifton advised, that Los Ange],@s will be host city fo-r the Annual, Conference of the League of California Cities sclh@dul@d for October 13-16, 1968. The agenda had, not been, published, but she had received a request for the name of the voting representative and alternate from the City of Rolling Hills. Mayor Nadal indicated that he wished to attend the conference, and appointed Councilman, Sauer to act as alternate for any session that he mAight be unable to attend, SLAG Fall General Assembly The City Manager presented the notice of the Fall General Assembly Meeting of the Southern California Association of Govern- ments to be held on September 26, 1968 at The Proud Bird Inn® Councilman, Hesse indicated, that he wished to attend SCAG meetings, but would be unable to attend the Fall General Agombly, Mayor Nadal asked Councilman, Fay to attend the meson 1 and tour of International Airport as a representative of Rolling ills; and Councilman Fay agreed to do so. Southern California Rapid Transit District City Selection Committee A request for a certified copy of the City's appointment of a representative to replace former Councilman Tourtolot on, the City Selection Committee was presented to the Council Mayor Nadal appointed, Councilman, Fr@d,Sau.@r with Councilman Vernon M. Fay remaining as alternate. The City C1@YA was directed to send a certified copy of the appointment to the secretary of the Southern, California Rapid Transit District® Division of Highways re: Alternate Locations of Future Route 1/107 Notice of a public hearing on alternate locations under con- sideration for the future route of 1/107 Freeway to be built in the South Bay area to be held, in, Torrance High School at 10:00 A.Mon. Thursday, October 10, 1968 w4s"presented to the Council by the City 1.3- September 23, 1968 Manager. Mrs. Clifton displayed a map of the area with the five proposed ,-routes shown in color.* Mr. Marion Welch, City Treasurer, advised the Council that he ad attended an information meeting on the subject at Dapplegray School, nd learned that the freeway will not be built for approximately ten- ears, enears, but condemnation will begin in two years. Area G Civil Defense. and Disaster Planning Board Copies of the Count Operational Area Law Enforcement Development Special Operations Plan (SOP to be put into effect in case of emergencies .was presented to members of the Council by the City Manager. Mrs. Clifton said that the Council had inquired about such a plan several months ago, and she requested that the members study the information presented. Pacific Air 'Transport, Inc. n A communication requesting support of the application of Pacific Air'Transport, Inc. with the Public Utilities Commission requesting authority to establish air passenger service from Long Beach to the Bay area was presented by the City Manager. Mayor Nadal requested that Mr. Kinley look into the matter, try to learn the proposed flight pattern with respect to the City of Rolling Rills, and report to the Council. RESOLUTION NO. 233 De-annexation/Annexation,..-.Crenshaw.Boulevard at Silver Spur Road Councilman Hesse moved that Resolution No. 233 providing for De-annexation/Annexation of Certain Territory at the Intersection of Crenshaw Boulevard at Sliver Spur Road from. Rolling Hills to Rolling Hills Estates be adopted, and that reading in full be waived. Motion was seconded by Councilman Sauer and carried by the following roll call vote: AYES: Councilmen Fay, Hesse, Klein, Sauer, Mayor Nadal NOES: None ABSENT: None WORDING CHANGE - Building Permits, City of Rolling Hills Mrs. Clifton presented a copy of a letter to than Rolling Hills Community Association from Attorney William Kinley pertaining to the case of 'Weiner vs. City of Los Angelest°, in which permits were issued and work completed although the proposed location of the residence was in violation of the Setback Ordinance. As a result, new plans and speci- fications were required, and a retaining wall constructed at a cost of approximately $15,000 had to be removed. Mr. Finley recommended that all permits issued by the City of Rolling Hills, even though they may be on forms provided by the County of Los Angeles, should have stamped on the face of them the following: THE STAMPING OF THIS PLAN AND SPECIFICATIONS SHALL. Chace had been held in the Administration Building Monday afternoon, September 23, 1965, attended by the mayors of the three Peninsula cities and other officials. The purpose of the meeting was to protest Supervisor Chace's vote and a decision by the Board of Supervisors on a recent zone change on 76.5 acres of Chadwick School property. Watt, the developer of hairman - Planning Commission Crenshaw Boulevard, and a representative that they wished to look further into decision as final. Mayor Nadal further with trustees of Chadwick School and the re=zoned property. Mayor Nadal advised that in accordance with a request from the Council, he had contacted Dr. Godfrey Parnell, and Dr. Parnell had agreed to accept the chairmanship of the Planning Commission left vacant by the resignation of Mrs. Grace Hill. Excused. Absence from Council Councilman Vernon, Pay Councilman Fay requested that he 'be excused from attending Council meetings on October 14 and October 28, 1968, at which time he will be in Europe.
