"A barn located five feet fram the south property line of Lot No . 1
as shown on the tentative map must also be removed in compliance
with Section 3.01 of Zoning Ordinance No. 33".
On April 24, 1967 Mr. Clark Leonard of Lanco Engineering
appeared before the Council and req�uested that Mr, Norris be allowed
to ppst a bond for the necessary paving and removal of structures ,
and that they remain intact until such time as the newly created lot
be sald, then be made a condition of the build3ng permit.
In the discussion that followed, Mrs . Clifton stated that
Mr. Norris ind3cated that his original intention was to sell I,ot 2
and �omply with the requirements ; however, Mr. Raymond wishes to
purcl�ase Lot 1 with the existing residence, and Mr. Norris will re-
tain ownership of Lot 2, but has no present plaris to improve it. �
Both Mr. Norris and Mr. Raymond wish to have the matter settled, so
that there will be no conditions or obligations passed to the new
owne� of Lot No. 1.
The final map was studied, and motion to deny the request
to allow the barn to remain, because it is a violation of Section 3.01
of Zoning Ordinance No. 33 was made by Council�man Klein, seconded by
Councilman Sauer and unanimously carried.
The City A�Ianager then advised the Council that the same �
requ�st had been presented to the Board of Directors of the Rolling
Hill� Cammunity Association on October 3, 1968 , and the request was
denied by that body also, because the barn would be in the easement
of the new drive when developed, and would therefore be in violation
of the Building Regulations of the Conmmunity Association. '

A letter from Peninsula Forum advising .that .a ;representative
from the office of Los Angeles County Assessor Philip `Watson; -author
of Propos�tion No. 9 will appear at Rolling Hills High Schofll on
October 17, 1968 to discuss the Propasition was received and noted.

Mayor Nadal appointed Councilman Klein acting Finance Officer
in the absence of Cammissioner Fay, who had been excused from October
ouncil meetings .

feet of paving . " Mrs . Clifton was directed to d�scuss the matter with
the City Attorney and determine to what extent Dr� Black would be re-
quired to improve the road. Mrs . Black was asked if she would allow
the subdivision to be held on the agenda and she consented.
Councilman Klein moved that the recommendations of the Plan-
ing Commission be accepted and the report of the Planning Advisor
pproved with the exception of Paragraph III , Roads, and that the sub-
-"-division be held on the agenda for clarification o the road require-
ments . Motion was seconded by Councilman Hesse and unanimously carried.
PROPOSED ORDINANCE
rov ng or Control of Animals and Licensing of Dogs
Mayor Nadal opened discussion on the proposed ordinance for
contzol of vicious dogs in the City of Rolling Hills .
The City Manager advised that a letter from Mayor Nada1 to
all residents in the City had been mailed on October 2 , 1968 , and that
letters in reply had been received from three residents , Dr. William F .
Andrew, 77 Eastfield Drive; Mr. James B. Gordon, 8 Ringbit Road East;
and Mr. Earle R. Hupp, 17 Wide Loop Road. The letters were read to
the Council by the City Manager.
In the discussion that followed Mr. James Gordon stated that
the names of owners of dogs creat.ing a problem should be a matter of
public record. Mr. James Millhauser of 2 Ringbit Road East asked the
City Attorney for a definition of trespasser, and Mr. Kinley stated
that it was any person on the property for an illegal purpose . Mr.
Millhauser asked whether posting of his property every fifty feet was
ufficient to warn against trespassing, and Mr. Kinley advised him
hat it would be advisable to fence his property as well as post signs .
r. Jordan Dunaway, 38 Portuguese Bend Road stated that it is not
reasonable to allow a dog three bites within a year, and he does not
think the ordinance, as proposed, offers adequate protection to a
resident menaced by dogs . Mr. James Brogdon, 5 Maverick Lane , said
that his son was bitten by two different dogs on two different occas-
ions while riding his bicycle on two dsfferent streets in the City,
and he would like some kind of protection against unprovoked attacks .
In both cases, he stated, he had been told that both of the dogs had
bitten other persons , and he felt that dogs that bite repeatedly with-
out provocation could be considered "vicious".
Mayor Nadal� asked members of the Council for comments on the
problem and the proposed ordinance . Councilman Klein said he had no
camment to make, and described his feelings with regard to the ordi-
nance as "lukewarm", Councilman Sauer stated that he agreed c�rith Mr.
Brogdon about the need for protection from knowr� "vicious" dogs .
Mayor Nadal said he had a reservation about whether the proposed
ordinance was tough enough, and Councilman Hesse answered that the
proposed ordinance was not intended to substitute for or replace Civil
Law, and residents should be advised that civil action is still avail-
able as a solution.

r. Kinley stated that several amendments had been added since the
ordinance was introduced on July 8 , 1968 , and he said it would be neces-
sary to introduce the entire document with all amendments for a first
reading . The City Attorney said he would have the entire document pre-
pared and sent to Council members prior to the next meeting of the City
Council on October 28 , 1968 .
Mayor Nadal ordered the matter held on the agenda .
