November 12, 1968
A regular meeting of the City Council of the City of Rolling
Hills was called to order by Mayor Nadal at the Administration Building
2 Portuguese Bend Road, Rolling Hills, California at 7:30 P.M. Novem-
ber 12, 1968.

Motion to accept the minutes of October 28, 1968 as presented
was made by Councilman Hesse, seconded by Councilman Klein and unani-
mously carried.
CORRESPONDENCE
Southern California Association of Governments
The City Manager presented a letter dated September 26, 1968
from the Southern California Association of Governments with reference
to amending the agreement creating SCAG, and designating the Treasurer
of one of the contracting parties as the d®p®sitary and custodian of
the funds of the Association.
The matter was referred to the City Attorney, who recommended
adoption of a Resolution approving and agreeing to certain change® in
the agreement.
RESOLUTION N0. 235
Councilman Klein moved for adoption of Resolution No. 233
entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS
APPROVING AND AGREEING TO CERTAIN CHANGES IN THE AGREEMENT ESTABLISHING
THE SOUTHERN CALIFORNIA ASSOCIATION OF GOVERNMENTS, and that reading
in full be waived. The motion was seconded by Councilman Sauer and
carried by the following roll call vote:

South Bay Engineering re: Tract No. 22042
A letter dated October 31 1968 from South Ba En inserin
Corporation requesting an eighteen month extension of time n which
file the Final Map of Tract No. 22042, T. B. Roach Jr., was presented.
Motion to grant the extension as requested was made b Coun-
cilman Klein, seconded by Councilman Sauer and unanimously carried.

The report of the Sheriff's Department for the month of
September 1968 was presented. The report was received and filed.

Councilman Klein moved that Demands No. 922 through 934
be paid from the General Fund; Demand No. 935 be aid from the
Traffic Safety Fund, and Demand No. 936 be paid fprom the Motor
Vehicle Act in Lieu Fund.

ZONING VIOLATION - Dr. H. A. Burnett
Councilman Hesse presented a letter sent to him as a member
of the Board of Directors of the Rolling Hills Community Association
by Dr. H. A. Burnett, 5 Round Up Road, with reference to violation
of a City Ordinance.

At the meeting of September 23, 1968 the City Manager advised
the Council that Dr. Burnett began construction of a stable without
first obtaining a building permit. After being notified that a permit
was required, Dr. Burnett submitted plans and obtaindd a permit; how-
ever, he did not locate the stable as shown on the approved plans.
She further reported that Dr. Burnett was summoned by the District
Attorney to appear before him on Friday, September 27, 1968 for an
office conference prior to possible filing of a criminal complaint
for failure to comply with Ordinance No. 33 of the City of Rolling
Hills, which requires that all stables or shelter for housing animals
be at least 25 feet from the exterior boundaries of the property on
which situated. Dr. Burnett's barn is 11'6" from the property line.
In his letter to Mr. Hesse, Dr. Burnett stated that he needed
the barn space, and the present location is the only one available on
the lot; that three commercial movers told him that the barn could not
be moved, and he wished a "conditional use permit" to allow for the
storage of hay in the area closest to the property line, rather than
house animals in that section closest to the property line. He stated
further that he felt that another appearance 'before the Board of Dir-
ectors would be fruitless and was appealing to Mr. Hesse as his last
recourse before going back to the District Attorney, who had indicated
in a previous meeting that unless a solution could be arrived at he
had no alternative other than to prosecute.
In the discussion that followed Councilman Klein asked the
Manager whether, in any other case within the City, permission had
been granted to build a barn closer than 25 feet from the property
line. Mrs. Clifton stated that without researching variances issued
before she came to Rolling Hills, she knew of only one other, applicant
who had been granted a variance. .Judge George Perkovich had been
granted a variance to erect a stable 22 feet from the Open Brand Road
boundary of his property, and 23 feet from the Eastfield Drive bound-
ary, because his property is a three -sided lot, bordered by Eastfield
Drive and Open Brand Roads. Mrs. Clifton said that the Architectural
Committee had not recommended approval of the barn.
In answer to questions regarding the position of the Commun-
ity Association, Mrs. Clifton advised the Council that the barn on
Dr. Burnett's property is 11'6" from the property line, and that the
Board of Directors had agreed to reduce his easement from 25 feet to
10 feet. She further explained that a condition of the Board of
Directors' agreement to the quit -claim of the easement was that Dr.
Burnett move his barn or cut off enough to comply with the regulations
of the Association. and the City. Councilman. Hesse asked at what stage
of completion Dr. Burnett had been notified of the violation, and Mrs.
Clifton stated and Councilman agreed that the barn was approximately
two-thirds complete when Dr. Burnett was notified that he was in vio-
lation and must cease work. Dr. Burnett completed the structure,
however.
Councilman Hesse moved that Dr. Burnett be required to take
any action necessary to comply with the City Ordinance, whether it
meant cutting off sufficient footage to make the 25 foot requirement
of Zoning Ordinance No. 33, or if that is not feasible, that he re-
move the barn, and that the Manager advise Dr.. Burnett of the decision.
Motion was seconded by Councilman Sauer and unanimously carried.
Progress Report from Palos Verdes Water Co. and Fire Department
Councilman Hesse asked about the progress being made in up-
grading service by the Palos Verdes Water Co. to meet the requirements
for fire flow in the city established by the Los Angeles County Fire
Department.

The City Manager advised that new water mains and 32 new
hydrants had been installed in the City. She reviewd with the Council
a map showing the areas that have been improved, and said that she
would ask for a current report from the Water Company and Fire Department.
MATTERS FROM CITY OFFICERS
Safe Loading Area - La Cresta School
Mrs. Clifton advised that a meeting had been held at the La
Cresta School stairway access area on Crest Road, attended by Mayor
Nadal, Councilman Sauer, Mr. Charles Sutton of the Los Angeles County
Road Department and the City Manager. After touring the area and
discussing the problems of providing a safe area in which to deposit
and pick up school children, it was recommended that an area six feet
from the roadway be paved for 150 feet, equidistant from the stairway
in the center to allow for the cars carrying the children to pull off
the road for safety. Because there is an existing horse trail in the
same location, sufficient room for horses to walk single file would
be left. Enlargement of the paving at the intersection of Buggy Whip
Drive with Crest Road West would also be accomplished for an. adequate
"U" turn area, Mrs. Clifton reported.
Councilman Hesse moved that a crossing guard 'be hired at a
cost not to exceed $100:00 per week to assist parents and children
to properly utilize the new facilities. The motion was seconded by
Councilman Sauer and carried 'by the following roll call vote:

ADJOURNMENT
There being no further business to come before the Council,
a motion for adjournment was made at 9:35 P.M. by Councilman Hesse,
seconded by Councilman Klein and unanimously carried.
