W�REAS, Section 40�03 {l�) of ttze California Vehicle Code states �laat any prosecution for traffic enforcement�hat involves the use of radar or other electronic devices to measure the speed of moving objects shall not b�based on a speed trap;and WHEREAS, California Vehicle Code Section 40802 (c) provides, in pertinent part, that a "speed trap" is defined as a particular section of a highway with a speed limit that is not justified by a valid engineering and traffic survey: "(2)A"speed trap"is either of the following: {A) A particular section of a highway measured as to distance and �vith boundaries marked, designated, ar otherwise determined in order that the speed of a vehicle may be calculated by securing t�e time it talces the vehicle to travel the known distance. {B} (i) A particular section of a highway or state highway with a prima facie speed limit that is provided by this code ot by local ordinance under subparagraph(A)of paragraph(2)of subdivision (a) of Section 22352, or established under Section 22354, 22357, 22358, or 22358.3, if that prima facie speed limit is not justified by an engineering and trai�ic survey conducted within one of ttie following�e periods, prior to the date of the alleged vioIation, a.nd enforcement of the speed limit involves the use of radair or any other electronic device that measures the speed of mioving objects: (I)Except as specif�ed in subclause(II), seven years. (II} If an engineering and traffic swvey was conducted more than seven years prior to the date of the alleged violation, and a registered engineer evaluates the section of the highway and determines that no significant changes in roadway or traf�c conditions have occurred, including, but not �imited to, changes in adjoining property or lan.d use, roadway wicith, or traf�ic volume, 10 years"; and WHEREAS, the City CounciI of the City of Rolling Hills is autharized to establish speed limits on privately ovvned and maintained roads loca.ted within the boundaries of the City, as specified by Section l 0A 1.020 of the City of Rolling Hi11s Municipal Code;and WHEREAS,the City's Traffic Engineeri.ng Consultant is a registered engineer and has conducted an engineerirxg and trai�ic survey �hich presents recommendations for speed limits on eight (8) street segments in the City; and WHEREAS, the results of the City Traffic Engineex's 2018 survey are �ublished in the Engineering and Traffic Survey dated March 14, 2018. `The 2015 Study is atta.ched hereto as Ea�hibit "A," and incorporated by this reference as though fully set�orth herein;and WHEREAS, the City of Rollin.g Hills does not desire to increase the speed lirr�its on Saddleback Road and Eastfield Drive between Chuckwagon Road and Palos Verdes Drive East as presented in Table 1 of the si�udy based on the findings in the City Traffic Engineer's 2018 survey;and WHEREAS,the City of Roljing Hills does not desire to use radar, laser or other electronic devices to measure the speed of moving objec�s on Saddleback Road azad Eastfield I]rive between Chuckwagon Road a�ad Palos Verdes Drive East as prese�ted in Table 1 of the study based on the fmdings in the City Traff'ic Engineer's 2U 1 S swvey; and -� WHEREAS,the City of�olling Hil�s desires to continue the use o:f radar, laser and other electronic devices to measure the speed of moving objects for six out of the remaining eigh#streets or segments listed in Table 2 of the study (not including streets on Saddleback Road and Eastfeld Drive between Chuckwagon Road and Pa1os Verdes Drive East as presen�ted in Table 1 of the study}in ord�r to protect the lives an.d�roperiy of n�aotorists utilizing City streets and to improve enforcement of speed limits within the City of Rolling Hills. NOW, THEREFORE, BE IT 12ESOLVED tbat the City Council of the City of Rolling Hills does hereby fmd, determine and resolve as follows: SECTION 1. The City Council of the City of Rolling Hills approves and adopts the 2018 Engineering and Traffic Survey as prepared and submitted by Willdan Engineeri.ng, which is incorporated by reference as though fully set forth herein and attached hez�eto a.s E�ibit"A". Resolution No. 1227 �1- SECTION 2. Pursuant to the require�nents of s�bsection (c} of Vehicle Code section 40802, the 2018 Survey shall be effective for a period of seven years and shall ea�pire on the 10�`day of July 2025. SECTION 3. This Resotution replaces and supersedes Resolutian No. 1115, and all subsequent Engineering and Traff'ic Suiveys, establishing the prima facie{posted)speed limit. SECTION 4. The City Clerk shall attest to the passage of this resolution and it shall thereupon be in full force and effect. This E&T Survey pres�enfs recomm�nded speed limits for 8 street segments in the City of Rolling Hifls. E&T Surveys are required by the Stafe of CalEfomia to establish i�termediate speed limits an local stree#s and to enforce those limits using radar or other speed measuring devices. These surveys must be updated e�ery 5 or 7 years to ensure t�e speeds reflect current conditians as dictated by the Cafifornia Vehicle Code (CVC}, The CVC also requires that the surveys be conducted based an the methodology required by The Califor�ia Manual on Uniform Traffc Controf Devices{Cali#ornia MUTCD) da#ed A�ril 2017. The survey was requested by the City far the proper posting af speed limits and ta enable the Sheriff's Department to utilize radar or other electronic speed measuring de�ices for speed enforcement. CVC Sections 40801 and 40802 require E&T Surveys that verify the prima facie speed limit before er�forcement by such a de�ice is iegal.�The law further specifies that these s�arveys be conducted e�ery 5 years. Th�sur�eys can be extended to 7 years provided the City's police officer(s) ha�e com{�leted a 24-hour radar operator course[CVC 4�802(c}(2)(B)(i)(I)]. Additional[y, some surveys may be extended to 10 years if a traffic engineer certifies fhat no changes in raadway or traffic cor�ditions�ave occurred [CVC 40802 {c}(2}{B)(i){II)]. These provisions assure that postec� speed limits are kept reasonably current, The E&T Surveys far the City were conducted in accordance with procedures outlined fn fhe Califarnia MUTCD dated April 2017 and as required by Section 627 of th� CVG. The Code further dEscribes three elements of an enginesring and traffic survey: �. Measurement of pre�aifing speed; 2. Accident history; and 3. Roadway characteristics not readily apparent to the motorist. Posted speed limits are established primariiy to protect the g�neral public from the reckless and u��redictabie beha�ior of dangerous drivers. Tl�ey provide law enfarcement with a clearly understood method to identify and aPprehend violators of the basic speed�aw(CVC Section 22350). T�is law states that"Na person shafl d�ive a �ehicle on a highway at a speed greater than is reasonable or priaden# ha�ing due regarc! far weather, �isibility, the traffic on, and the surface and width of tF�e highway, and in no event at a speed which endangers the safety of persons or property." The posted speed limit gives motorists a clear warning af the basic speed that is reasonable and prudent �nder typical driving conditions. , � � ��I�IiP�� 2098 Engineerrng and Tra�c Survey � Cify of Rolling Hills Resolutian No. 1227 -8- The basic f�ndamentals#or es:ablish�ng speed limits recognize that the majority of dri�ers behave in a safe and reasonable manner, and ,therefore, the normal�y caref�l and comp�tent actions of a reasonable dri�er should be considered legal: Speed limits established on these fundamentais conform to the consensus #hat thase who drive the highway d�termine what speed is reasonabie anci safe, not an the judgment of o�e or a few individuais. A radar speed study is �sua�ly used ta record the prevailing speed of r�asonable dri�ers. Speed limits are alsa estabfished to ad�ise dri�rers of conditions which may not be readily �--- ap�aren� ta a reasonable driv��. For this reason, accident history, roadway canditions, traffic characteristics, an�land use must also be analyzed befare determining speed�imits. Speed limit changes are usually made in coordination with physical cha�ges in roadway conditions ar roadside developmer�ts. Unusually short zones of iess than one-half mile in length shaufd be avoided to reduce dri�er confusion. Rdditionally, it is generafly accepted that speed limits cannof be successfully enforced without�oluntary compiiance by a majority of drivers. Conseq�ently,only the driverwhose behavior is cfearly out of lir�e wifh #he normal flow o# traffic is usually targeted for enforc�me�t. ELEMENTS OF THE ENGINE�RING AND TRAFFIC SURVEY The California MUTCD dated April 2017 speci�es the methodology ta be used for corr�pleting E&T 5ur�eys. This methodofogy includes an evaluation of current �ehicle speeds, accident history and conditions not readily apparent to motorists. The basic elements of t�he Engineerir�g and Traffic Survey are discussed in more detail as follows: Speed Sampling Existit�g �ehicle speeds are surveyed by a certifred radar o�erator with a ealibrated radar unit in an unmarked vehicle. Speed samples are taken far each segment representing a statisfically significant sample of current traffic. This data is then evaluated to identify the distribution of speeds. A key �lement ir� fhe evaluafion is the identi�ication of th� 85th percentile speed. The 85"' percentiie speed is the speed at or befow which 85 percenf of the #raffic traveis. This threshold represents what is historicaily found to b�a safe and reasanable speed for most �rivers �ased or� comman roadway conditions. Therefore, a speed limit is estabfished at the nearest 5-mile per hour {mph} increment to th� 85th percentile speed, except as sho�m in the two options below. Options: 1. T�e posted speed may be reduced by 5 mph from fhe nearest 5 mph increment of the 85th-percentile speed, in compliance wi#h CVC Section 627 and 22358.5. 2. Far cases in which the nearest 5 mph increment of the 85�"-percentile speed would require a rounding up, then the speed iim�t may be rounded down to the nearest 5 mph increment below the 85t" percentile speed, if no further reduction is �sed Refer to CVC Section 21400(b}. 2098 Engineerrng and Tra�c Su�vey 2 City of Rolling Hi115 Resolution No. 1227 -9- If the speed limit to be posted has had t�e 5 mph reduction applied, then an E&T Survey shall document in writing the conditions and justi�ication for the lower speed limit. The reasons for the lower speed limit shall be in compiiance wifh CVC Section 627 and 22358.5 The following examples are pro�ided to explain the appfication of these speed limit criteria: A. Using Optian 1 a�o�e and first step is ta round down: If the 85t"percentile speed in a speed survey for a location was 37 mph, then the speea limit would be established at 35 mph since it is the closest 5 mph increment to the 37 mph speed. As indicated by the option, this 35 mph established speed limit could be retluced by 5 mph to 30 mph if conditions and justificatior� for using this lower speed limit are documented in the E&T Survey. B. Using Opfian 1 above and firs#step is to round up: If the 85� percer�tile speed in a speed survey for a location was 33 mph, then the speed limit would be established at 35 mph since it is the closes# 5 mph increment to the 33 mph speed. As indicated by the option, this 35 mph speed limit could be reduced by 5 mph to 30 mph if the condifions and justification for using fh�s lower speed limit are documer�#ed in the E&T Survey. C. Using Option 2 above and first step is to round up: If the 85'" percentile speed in a speed survey for a locatian was 33 mph, instead of raunding up to 35 mph, the speed limit can be estabiished at 30 mph, but no further reduct�on can be applied. Collision History Reported coliisions are reviewed for each street segment to determine if t�ere is a higher than average rate of collisions. A segment that has an abo�e-a�erage callisian rate typically suggests conditions that ar� not readily appa�ent to motarists. A summary af the collision rates for the S surveyed street segments is provided in Table 2. Conditions Not R�adily Apparent To Mo#orists Each street segment is fiefd ins�ected to identify roadway co�ditians t�at may nat be readily apparent to motorists. A determination is made whe#her any conditions are significant and warrant the recommencfation of the speed limit 5 mph or more below the basic speed limit. �t is important to note that the California MUTCD dated April 2Q97 recommends exercising great care when establishing speed �imits 5 tnph or more below the basic speed limit. 2018 Engineering and Traff'rc Survey 3 City of Rolling Hills Resolution No. 1227 -10- SURVEY COIVDITIORlS SURVEY LOCATIONS The�racedures described below describe the criteria and methods�sed to survey selected streets within the City of Rolling Hills. The specific location af the radar speed survey for each street segment was selected after considering the follawing: 1. Minimum stop sign and traffic signal infl�ence. 2. Minimum �isibiliiy �estrictions. 3. Non-congested traffic flow away from intersections and driveways. 4. Minimum inffuence from curves or other roadway conditions thafiwould affect the normal opera#ian of a vehicle. DATA COLLECTION Data o# existing cor�ditions was obtained including prevailing speed of vehicles, traffic COIII510t15, visibility restrictions, and roadway conditions within the community. Speed data and feld reviews were conduc�ed at 8 locations during the month af No�ember 2017 Speed Data Radar speed measurements were conducted at 8 lacations dunng the month of November 2017. The radar speed distribution fo�ms are in Appendix B. Ail surveys were conduc#ed in good weather conditions, during off-peak hours an weekdays. The radar unit was operated from an unmarked vehicle to minimiz� any influence on driver behavior. Typically, a minimum sample size of 1 QO�ehicles or the#ota! samples during a maximum period�of 2 hours were obtained for each segment. Traffic speeds in both directions were recorded for indi�idual segmer�ts. 2078 Engineering and Traf�ic Sunrey 4 City of Rolling Hills Reso�ution No. 1227 -11- Calfision Data Collisian data was ob#ained firam Los Angeies County's SherifPs Department's Coilision Summary Report. For this study, collision data was used from the latest 4 years of reported accidents from January 1, 2013 to December 31, 2016. The coflision rates for #he 8 segments are ex�ressed in accidents per millian vehicle miles{AIMVM).To caEculate these rates,24-hour traffic�olumes were collectec!for each street segment.This infarmation was then entered into the following farmula to determine fihe collis�on rate: ��ooa,oao R= ' tx365 d�� xlxv year A = Number of midblock collisior�s o�er t�me period R= Collision Rafe (accidentslmillior� �ehicle miles) t= Time Period Co�ered (in years} 1= Length af Segment (miles) v= Traffic Volume (average daily traffic) The segment collisian rate was then campared to the average statewide collision rate.The a�erage statewide collision rates were obtained frorn 2014 Callision Data on California State Highways published by Caltrans. Field Review Data A field re�iew was conducted for each af the sefected street segmen#s in the City wifh consideration for the following factors: �. Street width and alignment (design speed); 2. Pedestrian acfiivity and traffic flow characteristics; 3. Number of lanes and other channelization and striping patterns; 4. Frequency of intersections, dri�eways, and on-street parking; 5. Location o�stop signs and other regulatory traffic co�trol dev�ces; 6. Visibility obstructions; 7. Land use and proximity to schoa�s; 8. Pedestrian and bicycle usage; 9. Unifarmity with existing speed zanes and fhose in adjacent jurisdictions;and 1 D. Any other unusual condition not readily apparent to the driver. 2018 Engineering and Tr��c Survey 5 Cify of Rolling Hills Resalution No. 1227 -12- A�lALYSIS CRITERIA Survey data was compiled ar�d analyzed to determine the recommended speed fimit in accordance with sev�ral criteria contained �n the California MUTCD dated April 2017. Some of the criteria used are. -- A. The crRticaf speed or ��th percentile speed is fhat speed af or below which 85 perce�t of the traffic i� moving. This speed is the baseline value in determining what#he majority of dri��ers befie�e is safe and reasanable. Speed limi#s set higher than th� critical speed are not cansidered reasonable and safe. Speed limits set lower than the criticaE sE�eed make a large number ofi reasonable dri�ers"unlaw��l," and do no#facifitate the orderly flow of traffic. The"basic speed limit" is the nearest 5 mph increment to the 85th percentile speed. B. The 10 rnile �er hour(mp�) pace speed is the 10 mph increment that contains#he highest percentage of r�eh�cles. It is a measure of the dispersion of speeds across �he range of the sampies surveyed. An accspted practice is to kee�the speed limit within the 10 mph pac�while cansidering the critical speed and other factors that might require a speed i�wer than the criticaf s�eed. C. The collisian rate for e<�ch street segment is compared to average coilision rates that can be reasanably expected to occur on s4re�ts and highways in o�her jurisdictions, in proporti�n to the vafume af trafFc �er lane mile. These average collisian rates ha�e been developed by the State of Califorr�ia and are considered reasonable for use in ths City of RoRing Hilfs. RESULTS AND RECOMMENf)ATIONS The E&T Survey Forms, presented in Appenclix A, illustrate resuits of a thorough e�aluation of the avaiiable data and recommend a speed limit for eact� street segment --LL surveyed. A complete summ�ry af all recommendations is showrt in Table 2. In each case, the recommended spe�d limit was consistent with the prevailing behavior as demonstrafed by the radar sp€:ed measurements. Typically, a speed limit in the upper range of the 'f 0-mile pace was selecfed unless a collision rate significantly higher than expected was discavered or r�adway co�ditions not readiEy appa�ent to the dri�er were identified. Any segments with recommended s�eed limits 5 mph or more below the basic speed limit are fully exp�ained later in this report. The Legislature, in adopting Sectian 22358,5 of tY�e CVC, has made it clear that physical conditions, such as width, curvature, grade and surface conditions, or a�y other condition readily apparen# to a dri�er, in the absence of other factors, would not be th� basis fo� special downward speed zoning. � !n these cases, the basic speed iaw (CVC Section 22350} is sufficien#to regula#e :�uc� conditions. The recommendations cantaine� in this Report are intended tn establish p�ima facie speed limits. The are not intended to be absolute for afl revailPn condifions. Afl prima facie 2018 Engineering and Traffic Survey � City of Rolling Hills Resol�tion No. 1227 -13- speed viofations are actuaily�ialations of the basic speed law(CVC 5ection 22350). This statute states that a person shall not drive a vehicle at a speed greater than is safe havir�g regard for traffic, roadway, and weather cor�ditio�s. A prima facie limit is intended to establish a maximum safe speed under norma[ candEtions. Upon one side of the highway, within a distance of a quarter of a mife, the conti�uous property fronting thereon is �occupied by 13 or more separate dwe�ling houses of business structures. b. This subdivision does nat apply in the case of any railway grade crossing where a human flagman is on duty or a cfear�y visible electrical or mechanical railway crossing signal de�ice is instaffed but does not then indicate the immediate approach of a railway train ar car. (2) When tra�ersing any intersection of highways, if during the last 700 feet ot the driver's approach to the inters�ction, the driver does not have a clear and unobstructed view of the intersecfion and af any traffc upon afl of the higf�ways entering the intersection for a distance of 100 feet aiong all those highways,except at an intersection protected by stop signs or yield right-of-way signs or controlled by official traffic contro!signais. (3) On any alley, (E�) Twer�ty-five miles per haur: (1) On any highway other than a state highway, in any business or residence district unless a different speed is determined by locaf authority under procedures set forth in this code. (2) When approaching or passing a school building or the grounds thereflf, contiguous to a highway and posted with a standard"SCHOOL"warning sign,while children are going #o or leaving the school either during school hours or during #he noon recess period, The �rima facie limit shall also apply when appraaching or passing any school grounds which are nat separated from the highway by a fe�ce, gate or o#her physical harrier while the grounds are in use by children and the highway is �osted with a standard "SCHOO�" warning sign. The declar�d prima facie or maximum speed iimit shall be efFective when appropriate signs gi�ing nvfice#hereo�are erected upon the street and shal! not ther�after be revised except upon the basis of an engineenng and traffic survey. This section cfoes not apply to any 25 mile per hour prima facie limit, which is applicable when passing a schoo! bUilding or the grounds thereof or when passing a seniar center ar other facifity primarily �sed by seniar citizens. (b) T�is section shall become operative on the date specified in subdivision (c) of Sec#ion 22366. Downward Speed Zoning - Section 22358,5. It is the intent of the Legislature that physical conditinns such as width,curvature,grade arod surtacE: conditions,or any vt�er condition readily apparent to a dr�ver, in the absence of other factors,would not req�ire speciaf downward speed zoning, as the basic rule of Sectio� 22350 is sufficient regulation as to such conditions. Boandary Line Streets Sectifln 22359. With respect to boundary fine streets and hig�ways wf�ere portions thereof are within different jurisdiction5, r�o ordinance adopted under S�ctions 22357 and 22358 shall be ef�ecti�e as ta any such portion untif all authorities having jurisdic#ion of the portions of the street concemed have approved the same. This sectian shali not apply in the case of bo�ndary line streets consisfing of separate roadways within different jurisdictions. 5peed Trap prohibifion Section 40801. 2018 Engineering and Tra�c Survey 14 City of Rolling HiNs Resolutioz�No. 1227 -21- No peace officer or other person shail use a speedtrap in arresting, or participating or assis#ing in the arrest o�, any person for any alleged violation of this code nor shall any speed trap be used in s�curing evidence as to tf�e speed of any�ehicle for the purpose of an arrest or prosecution under this code. Speed Trap Section 40$02. (a) A"speed trap" is either of the following: (1) A particular section of a highway measured as to dista�ce and with boundaries marked, designated, o�otherwise determined in order thafi the speed of a vehicle may be calculated by securing the time it takes tF�e vehicle to travel the known distance. (2) A particular section of a highway with a prima facie speed lirnit that is provided by this code or by local ordinance under subparagraph {A) of paragraph (2)of subdivision (a)of Sectian 22352,or estabfished under Section 22354,22357,22358,or 22358.3, if that prima facie speed limit is not justified hy an engineering and #raffic sur�ey conducted within five years prior to the date af the alleged violation,and enforcement of the speed limit involves the use ot radar or any other electronic d�vice tha# measures the speed af mo�ing object. This paragraph does not apply to a iocal street, road, or school zone. (b)(1) �or purposes of this section, a locaf street or road is one that is functionally classified as "localU on the "California Road System Maps," that are approved by#he Federal Highway Administra#ion and maintained by the Departmenf of 7ransportation.When a str�et or road does not appear on the"California Road System Maps,"it may t�e defned as a"focal street or road"if it primarily provides access to abutting residential praper#y and meets the following three conditions: (A) Roadway width of not rnore than 40 feet. {B) Not more than one-haif of a mile of unin#errupted fength. Interruptions shall incfude official traffic controi signals as defined in 5ection 445. (C} Nat more than one traific lane in each direction. (2) 4�or purposes of this section"schoof zone"means that area approaching or passing a school buiiding or the grounds thereof that is contiguous to a highway and on which is pos#ed a standard "SCHOOL"warning sign, while children are going to or leaving the school either during school hours orduring the noon recass period. The prosecution proved that, prior to the o�cer issUing the notice to appear, the arresting officer established that the radar, faser, or other efectronic device conformed to the reauirements of sub�aragra�h (D}. (ii) The prosecution praved the speed of the accused was unsate for the canditipns present at the time of alleged viofatio� unless the citation was for a violation of Section 22349, 22356, or 22406. (D) The radar, laser, or ather efectronic device used to measure the speed af the accused meets or exceeds the minimal operational standards of the National Traffic HigF�way Safety Administration,and has been cafibrated within the three years prior to the date af the alleged violation by an independent certified iaser or radar repair and testing or calibration facility. (2) A "speed trap" is either of the following: (A} A particular section of a highway measur�d as to dis#ance and with boundaries marked, designated, or otherwise deter�nined in order that the speed of a vehicle may be calcuiated by securing the time it takes the vehicle to travel the known distance.
