7/14/1969MINUTES OF'THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA July 14, 1969 A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor pro tempore Nadal at the Adminis- tration Building, 2 Portuguese Bend Road, Rolling Hills, California at 7:30 P.M. Monday, July 14, 1969. ROLL CALL PRESENT: Councilmen Fay, Klein, Sauer, Mayor pro tem Nadal ABSENT: Mayor Hesse ALSO PRESENT: MINUTES Teena Clifton William Kinley Marion Welch June Cunningham City Manager City Attorney City Treasurer Secretary Mayor pro tem Nadal ordered the corrected minutes of June 9th held for'Mayor Hesse's approval. Motion to approve the minutes of June 23, 1969 as presented was made by Councilman Fay, seconded by Councilman Klein and unani- mously carried. Regional Planning Commission Hearing re: Zoning Case 5487-(4) A notice of public hearing of Zoning Case No. 5487-(4) before the Regional Planning Commission on Wednesday, July 30, 1969 at 9:30 A.M. was presented to the Council by the City Manager. The petitioner has requested that the zone be changed from R -A-15,000 (Residential Agri- culture -15,000 Square feet required) to R -A-12,000 for an irregularly shaped 48.7 acre parcel located on thesouth side of Crest Road west of the junction of Highridge Road and Crest Road and extending on a frontage of approximately 2,800 feet, with a maximum depth of approx- imately 1;200 feet. Mayor Nadal stated that he is opposed to any reduction of required square feet until the petitioner advises why the request is necessary, and that if the reduction would simply allow for more homes he is opposed to the reduction. Councilman Fay said there was inade- quate information furnished to the Council to justify approval of the zone change, and requested the Manager to ask Regional Planning Com- mission for additional information. Subdivision Hearing, Tract 29793 Mrs. Clifton reported that she had been advised by telephone that a hearing was scheduled before the Subdivision Committee of Region- al Planning Commission on July 25, 1969 on a 17 acre tract of County territory, north of the Botanic Garden. The owner, Lincoln Property of Los Angeles has filed for a subdivision of ten lots. In addition, the owner has filed for a Zone Exception for nine lots for building and one common lot for access on which he wishes to build nine 3 -story apartments with sub-terranean parking. Hearing notices will be mailed prior to the August 13, 19.69 public hearing before the Regional Planning Commission. July .14, 1969 Councilman Klein moved that a letter be sent to Regional Plan- ning Commission opposing the Zone -Exception because multiple residential development would add to traffic congestion in the area. Motion was seconded by Councilman Nadal and unanimously carried. Regional Planning Commission re: Zone Exception Case 9140-(4) The City Manager presented a letter delivered on Monday, July 14, 1969 by Certified Mail— Return Requested. The letter, dated July 11, 1969 advised that the,Regional Planning Commission , by its action of July 8, 1969, granted Zone Exception Case No. 9140-(4) for 25 single family units on less than required area on the east.side of Crenshaw Blvd.o, south of Crest Road in Zone A-1-20,000 to Congre- gation Ner Tamid, for development and construction of 25 single family residences on lots with"an'average ... area of 7,000 square feet. The letter advised that during the fifteen day period following receipt of the letter the decision may be appealed to the Board of Supervisors. In the discussion that followed Mrs. Clifton advised the Coun- cil that she had attended the hearing before the Regional Planning Commission on June 18, 1969 as directed by the City Council on June 9th and had opposed any change of zone that would result in greater density than Del Cerro as undesireable, unnecessary and an, additional burden to the entire Peninsula and its facilities. There was no representative of Del Cerro present at the hearing.... -The City Manager said that she would request a copy of the Findings r,f the hearing from Regional Planning Commission whdn the final Zcidrfe Exception was granted. Councilman Fay moved that copies of all information from the Regional Planning Commission be forwarded to Mr. Gordon Curtis of the Palos Verdes Advisory Council. Motion was seconded by Councilman Nadal and unanimously carried, and the secretary was directed to reproduce copies of the information and forward it to Mr. Curtis. Los Angeles County Forester and Fire Warden re: Landscape Plan Mrs. Clifton presented a drawing of a landscape proposal for the City Park.- Riding Ring and an estimate of the cost, prepared by the assistant head deputy forester of Los Angeles County -Fire Department. The plan is for landscaping a 50' x 700' slope above the riding ring, and the recommendation is that four steps be followed: first, weed removal; second, installation of a.sprinkler system; third, land- scaping and fourth, chemical weed control. Sprinkler system plan was not included in the report. Councilman Sauer said that if extensive ,work was done above the ring he wished the Council to consider extending the plan to the area. below the ring, which he considers equally hazardous because of the dense growth of weeds. Mrs. Clifton advised that new ground covers have been devel-� oped, and that the South Coast Botanic Garden on Rolling Hills Road had been, most'cooperative in.recommen.ding the best planting for a particular area and problem, and she thought they should be consulted before any landscaping plan is approved. Following discussion Mayor Nadal said that advice should be sought from the Botanic Garden before any decision is made, and that members of the Council should visit the site of the proposed landsca- ping and inspect the area planned by the Fire Department and the area mentioned by Councilman Sauer. The matter was ordered held on the agenda. -2- July 14, 1969 City of Inglewood re: League of California Cities, July Meeting A letter from the City of Inglewood advising that the July meeting of the League of California Cities would be held at the Hollywood Park Turf Club was presented. The letter was received and noted. ORDINANCE N0, 82 Mayor Nadal moved that Ordinance No. 82 entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS, CALIFORNIA AMENDING ORDINANCE NO. 33 PROVIDING FOR ZONING IN SAID CITY be adopted, and that reading in full be waived. Motion was seconded by Councilman Klein and carried by the following roll call vote: AYES: Councilmen Fay, Klein, Sauer, Mayor pro tem Nadal NOES: None ABSENT: Mayor Hesse PROPOSED BUDGET - Fiscal Year 1969-70 The City Manager presented the proposed budget for fiscal 1969-70, and Mayor pro tem Nadal opened discussion of the budget. Councilman Sauer, finance officer, said he felt that the budget was in order, and since all salary proposals had been approved, any_ additional questions could be answered by Councilmen, so that a Resolution approving and adopting the budget could be prepared for the next meeting. In the discussion that followed Councilman Sauer requested that consideration be given to increasing the allocation to Los Caballeros by $500. -..Councilman Sauer stated that Los Caballeros pays most of the maintenance at the ring, which is a city park, and it was his opinion that the $1,000 allocation is inadequate, but that $1;500 would be sufficient to cover normal maintenance costs. The Council agreed with the recommendation that the allocation to Los Caballeros be increased to $1,500. Following discussion Mayor pro tem Nadal ordered preparation of the resolution after the Manager has a final consultation with Mayor Hesse and receives his concurrence. REPORTS OF CITY DEPARTMENTS Fire Department The Fire Department Activity Report for the month of June 1969 was presented by the City Manager. The -report was received and filed. Palos Verdes Water Company Mrs. Clifton reported that there have been two breaks in the 30" water main on Crest Road within the past week; the first on Crest Road East on July 2nd, and the second on July 7th on Crest Road West. In the first break the damage was limited to the roadway and water service to the residents was affected during the late night and early morning hours on July 2nd and July 3rd. However, the second break did considerable damage to the road and an'undetermined amount of damage to the William Mize residence. Mrs. Clifton said that the break was reported - by employees of General Telephone Company working in the area, -3- 1 1 1 ti n j July 14, 1969 and that the.Mize residence was saved by -.members of Engine Company 56 and employees of General Telephone Company, who diverted water flowing toward the house and barn. At one time, she said, water at the side of°the house was 14" -deep,, and bricks were removed froma retaining wall and plywood was used to divert water that otherwise would have gone through the garage and home. Mr. Kinley reported that the most recent break was the third major break in the line in the past six months, that there have been ten breaks in the line since it was installed in 1956, and that he had written to the Palos Verdes Water Company about adequate safety measures. In his letter dated July 14; 1969, Mr. Kinley suggested that the excavations resulting from the Breaks be patrolled period- ically during the night-time hours in order to prevent any possibliliy of injury or property damage to motorists using Crest Road. Replacement Plans The City Manager advised the Council that a new 8" water line to replace an existing 4" line on Portuguese bend Road South will be installed by Palos Verdes Water Company. An. excavation permit was submitted, and materials have been delivered to the site; work will commence as soon as the matter of easements is clarified and the exca- vation permit signed. Mrs. Clifton reported -that no additional information about other improvements in the City had been received from the Palos Verdes Water Company. The matter was ordered held on the agenda. Southern California Rapid Transit District The matter was ordered held on. the agenda. Division of Highways - Classification. of All Existing Highways, Roads and Streets in California The matter was ordered held on the agenda. MATTERS FROM CITY OFFICERS Preliminary General Plan, Land Use Standards The City Manager presented copies of the Preliminary General Plan Land Use Standards, Palos Verdes Peninsula Community Study to members of the Council for study and review. Resolution - Additional Superior Court Judges City Attorney William Kinley said that at the last meeting of the City Council he had recommended that a Resolution supporting the addition of Superior Court Judges be sent to the attention of officials of the State of California who are responsible for the administration of Justice, and requested that the matter be held on the agenda:until the resolution is prepared. Mayor pro tem Nadal so ordered. Flying Triangle Extension Mr, Kinley advised the Council that he had been contacted by the attorneys for Palos Verdes Properties with reference to the pos- sibility of annexation of the property known as the Flying Triangle Extension to the City of Rolling Hills. Mr. Kinley said he forwarded copies of the Zoning Ordinance, No. 33 and Subdivision Ordinance, No. 67 to the attorneys, and after studying the ordinances they have indicated that they would like to proceed with annexation. In answer to questions of the Council, Mr. Kinley explained that Palos Verdes Properties has an agreement with the Rolling Hills Community Association whereby they could become part of the Associ- ation. Their option must be exercised before January 1, 1970, and although the Association has not taken any action, they have been notified by Palos Verdes Properties of their desire to exercise the option. Although annexation to the City would not be mandatory if the property became part of the Association, Mr. Kinley recommended it as a logical step, so that the City could exercise zoning control over the properties that would be developed. He said it was his under- standing that they wished to come in as one piece of property, and subdivide at a later date.
