3/9/1970MINUTES OF THE REGUALR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA March 9, 1970 A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Hesse at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California at 7:30 P.M. Monday, March 9, 1970. ROLL CALL PRESENT: Councilmen Fay, Klein, Sauer, Mayor Hesse ABSENT: Councilman Nadal ALSO PRESENT: MINUTES Teena Clifton William Kinley Marion Welch June Cunningham Kenneth Schorr T. Heinsheimer R. Klein J. Langworthy Motion to approve the minutes of February 9, 1970 and the minutes of the February 19, 1970 was made by Councilman Klein and unanimously carried. PERSONAL APPEARANCES Tract 26769, J. H. Langworthy City Manager City Attorney City Treasurer Secretary Schorr Engineers Resident Resident Resident the regular meeting of adjourned meeting of Fay, seconded by Councilman The City Manager advised the Council that the final map for Tract 26769, J. H. Langworthy, had not yet been presented to the Council for approval, and she had been advised by the Los Angeles County Engineer that the time period for final approval would expire on March 11, 1970. She further stated that it would not be possible to record the final map before that date because all required bonds had not been presented. Mrs. Clifton explained that the tentative map had been approved by the City Council on September 11, 1968 and an additional extension of one year had been requested and granted. Mr. James Langworthy, owner of the property, advised the Council that a law suit against the property had been pending, and prevented his proceeding with the subdivision. However, he advised that the suit -had -been released on March 9, 1970, and he requested an additional extension for completion of the subdivision. Mr. William Kinley, City Attorney, advised that a two year extension may be granted in addition to the 18 month period following approval of the tentative map by the City Council. He advised, however, that it was the opinion of the County Council that only one extension could be granted, and because Mr. Schorr requested only one year, not two, the allotted time, including the extension, would expire on March 11, 1970. Mr. Lang- worthy stated that he felt it would be possible for him to comply with all requirements for bonds within a short time, possibly by the next regular meeting of the City Council, and he requested additional time to do so. Mr. Kinley advised that such extension could be granted only on the condition that Mr. Langworthy would not hold the City responsible for any refusal by the title company to record the map because of the expiration date, and further that Mr. Langworthy would write a letter holding the City of Rolling Hills harmless from any liability that might result if granted an additional year's extension in which to file a final map on the subdivision. Mr. Langworthy indi- cated that the conditions were satisfactory. 1 LJ 1 23 March 9, 1970 Following discussion, motion to grant'an extension of one year in which to present a final.map of Tract 26769, subjecto to receipt of a letter from Mr. Langworthy, was made by Councilman Fay, seconded by Councilman Sauer and unanimously carried. CORRESPONDENCE Women's Community Club The City Manager presented a letter dated February 23, 1970 from the Women "s Community Club of Rolling Hills, with reference to a proposed change in the Club's Constitutional'By-laws. When the By-laws were written a proposed community center building was under consideration, and the By-laws as they now read include money to be allocated toward the project. Mrs. Kay Heckman, first vice president, requested information regarding any decision or proposals with regard to the project. O Following a discussion of the matter, Mayor Hesse asked Mrs. Clifton to advise the Women is Community Club that the City Council has not given any consideration recently to erecting a Youth Center, and will maintain the existing facilities within the City. League of California Cities Binding Arbitration. Policemen -,and Firemen. A legislative bulletin dated March 3, 1970 from the League of California Cities was presented'by the City'Manager. Under Topic I, BindingArbitration, Policemen and Firemen, AB98 (Warren) was discussed. A bil provides that whenever local public agency representatives and the representatives of full-time policemen or firemen fail to reach agreement, the matter will be submitted to a 3 -man arbitration board. The League of California Cities urges oppo- sition to AB 98, because it would remove from councilmen and super- visors the right to determine salaries, working conditions, tax rate and budget. William Kinley, City Attorney, presented a copy of a letter dated March 6, 1970 that he had written to California State Assembly- men James A. Hayes and Robert Beverly objecting.to the proposed legis- lation of Assembly Bill No. 98. Under Topic II, Disclosure of Assets, AB 430, the bulletin advised that AB 430 is intended to clarify the provisions of the Unruh Disclosure of Assets legislation, and instead of requiring dis- closure of the total dollar assets of a public official, will require that the officer or employee disclose that he has an interest which is more than or less than $5,000. Flood Control District re: 1970 Proposed Bond Issue Mrs. Clifton advised the Council that in response to corres- pondence from the Los Angeles County 7 ldod Control District, she had written a letter requesting inclusion in the proposed 1970 Storm Drain Bond Issue for an extension of Line B, Project 660.1 (1964 Storm.Drain Bond Issue). Confirmation of the request had'not been received, she advised. The matter was ordered held on the agenda. -2- 24"' ... March 9, 1970 Local Agency Formation Commission re: Fourth City A letter dated Feburary_y 10,_,._.1970 form the Local Agency Forma- tion Commission of Los Angeles County was presented. Ruth Benell, Deputy Executive Officer, advised that a hearing on the application for incorporation of Rancho Palos Verdes was set for March 25, 1970 at 9:00 A.M.,.and requested comments from the City of Rolling Hills, and the names of persons who would be present to represent Roiling Hills at the bearing. The Manager reported that a letter had been sent advising that the Rolling Hills City Council strongly supports the Rancho Palos Verdes application for incorporation, and their endorsement was indi- cated by Resolution.Number 242 passed on November 14, 1969, copy of which was attached to the correspondence to LAFCO. She advised that Mayor F. W. Hesse would represent the City of Rolling Hills at the hearing. Los Angeles County Citizens Economy and Efficiency Committee A letter dated March 3, 1970 from Los Angeles County Citizens Economy and Efficiency Committee on the subject of Contract.Law En- forcement Charges was presented to the Council. The Chairman urged that both independent and contract cities participate jointly in a study of law enforcement charges and that the contract cities continue the present formula plus any adjustments in the current cost of providing the services until the study has been completed. The City Manager said she planned to attend a hearing before the Board of Supervisors on the issue of new contractual costs for Sheriff's services on March 17, 1970 at 9 A.M. Los Angeles County Health Department re: Well Standards A letter from Los Angeles County Health Department on the subject of Well Standards was referred to the City Attorney for study. South Bay Councilman's Associat%on.Resolution No. 16 A resolution of the South Bay Councilmen's Association pro- claiming the year 1970 as South Bay Conservation Year and urging cities in the South Bay area to unite in action to abate and control environ- mental pollutants was presented to the Council. The resolution was received and filed. City of Hidden .Hills Mrs. Clifton presented a letter of appreciation from the City of Hidden.Hills. Because of action initiated by the City Manager of Rolling Hills, dues for membership in the California Contract Cities Association was reduced from $300 to $150. The letter was received and filed. Chief Ware had also advised the Manager that there will be con- tinued effort to work with the Water Company for improvements in fire flow. AGENDA ITEMS HELD OVER Palos Verdes Water Co. Mayor Hesse suggested that the letter be referred to Councilman Sauer, coordinator of matters kelated to utilities, for his approval before sending. The matter has ordered held on the agenda. Zoning Case No. 5536-(4), Special Permit Case 1967-(4) Zoning Case No. 5487-(4), Crest and Highridge Roads Mrs. Clifton advised the Council that according to a story in the Los Angeles Times on March 1, 1970, decision on a request for a zone change from R -A-15,000 to R -A-12,000 had been delayed because of objections of the cities of Rolling Hills, Rolling Hills Estates and Palos Verdes Estates, and owners of surrounding properties. Two re- quests on the same property had been filed with Regional Planning Com- mission; Zoning Case No. 5536 and Special Permit Case 1967-(4), and Zoning Case No. 5487-(4), both requesting change from R -A-15,000 to R -A-12,000 for an irregularly shaped 48.7 acre parcel south of Crest Road and Highridge Road. The Manager reported that she had asked Mr. Knapp of Regional Planning to advise her of any scheduled hearings on the -zone change. The matter was ordered held on the agenda. Zoning Case No. 9124-(4), Congregation Ner Tamid The Manager reported that in a recent telephone conversation with Regional Planning staff she was advised that the case is still under submission and no decision had been reached on the request for a change of zoning to permit construction of 25 single family resi= :�=dences on lots with an average area. of 7,000 square feet. The matter was ordered held on the agenda. Correspondence - Regional Planning Commission Mayor Hesse asked the Paonessa and advise him that Planning Commission has been be sent to the communications Traffic and Speed Control City Attorney to telephone Judge Alfred none of the correspondence to Regional acknowledged, and request that answers from the City of Rolling Hills. Mrs. Clifton reported that she had contacted Mr. Charles Sutton of the Traffic and Safety Division of Los Angeles County Road Department with reference to a letter from a resident about southbound traffic on Eastfield Drive in the area of Chuckwagon and Open Brand Roads. Mr. Sutton advised Mrs. Clifton that he had inspected the sites and would submit a report in writing with his recommendations. Mayor Hesse ordered the matter held on the agenda. Motorbikes and Motorcycles Within the City of Rolling Hills Councilman Klein reported that he had met with a committee ap- pointed to study whether motorcycles and motorbikes should be prohibi- ted within the City of Rolling Hills as requested by members of the Rolling Hills Community Association at the annual meeting on Janu- ary 21, 1970. Councilman Klein submitted minutes of the meeting held on February 18, 1970. -5- 1 FI C� The committee agreed on -February -18 that it was not practical nor desireabl.e to prohibit the riding of licensed.motorcycles and motor- bikes in the City of Rolling Hills, but submitted several recommendations for regulating the use -within the City. They recommended that use should be restricted to licensed vehicles operated by city residents, a current 'rule enforced at the gates. In addition, all licensed vehicles should carry a Rolling Hills sticker, which sticker should be limited to li- censed:vehicles,operated by licensed operators, and the penalties for operating,unl.icensed vehicles should be strongly emphasized. Since many objections are caused by the noise factor, the California Motor Vehicle Codefshould be quoted with regard to mufflers. The penalties for.breaking'the'law with regard,to use of any motorized vehicle except emergency vehicles"on the trails'should be emphasized, and residents should be urged to cooperate in the program to reduce the noise"factor and to!p revent„the possibility of injury on the trails. Further, the Committee recommended that a newsletter signed by both the 'Mayor and the.President of the Board of Directors be+sent to all residents, ad- vising the recommendations of the committee to regulate`the operation of motorcycles and, motorbikes in the City.1' b u�� Mr. Klein asked the manager to send copies tee of tBhe minutes of the Februar ` i8t mee'tin to all members of the commit'for'''d piry comments before the'Newsletter"is written, and further, asked that the tekt!of the Newsletter be given to Mr. Klein for review before being mailed. The City Manager asked the..Council whether the City Attorney could review the present trespas.s ordinance to see whether it is suf- ficient for the Sheriff's Department to cite under if they stopped a rider and determined that he did not live in the city but had come in by way of the trails, because of the restriction that only residents can be admitted at the gates on motorcycles and motorbikes. After discussion the Mayor directed Mr. Kinley to review the ordinance, and if the existing ordinance is not sufficient to cover this area, to prepare a new one. The matter was ordered held on the agenda. Miraleste High School Pool Proposal Mrs. Clifton reported that the proposal requesting the City of }tolling Hills to sponsor the summer program for Miraleste High School Swimming Pool had not been submitted in writing, but the com- mittee had advised her that they would do so as soon as it has been prepared by their attorney. Groundbreaking ceremonies are scheduled for April 2nd, and the opening of the. pool is scheduled for July 4th. The matter was held on the agenda. MATTERS FROM MEMBERS OF THE COUNCIL Replacement - Narcotics Administrative Committee The City Manager advised the Council that Councilman Robert Nadal, whose term expires in April, has not filed election pepers, thereby indicating his intention to retire from the Council, and he has asked that a replacement be named to fill his position on the Narcotics Administrative Committee. In the discussion that followed Mayor City Manager to contact Mr. Ted Bear and ask position as the City's representative on the Committee. Hesse directed the if he would fill the Narcotics Administrative 27 March 9, 1970 MATTERS FROM CITY OFFICERS Flying Triangle Extension City Attorney William Kinley requested permission to hire an engineer to draw the maps and legal description for the Flying Triangle Extension which the City of Rolling dills wishes to annexe Motion to grant the permission was made by Councilman Klein, seconded by Councilman Fay and unanimously carried. Flood Insurance Program A letter to the Mayor and members of the City Council from Assemblyman Robert Go Beverly on the subject of Flood Insurance was presented by the Manager. Recent amendments to the Federal Flood Insurance Program make it possible for California cities to qualify residents for Federal Flood Insurance, and expand the protection program by including loss from landslides as an additional insurable risk. Cities wishing to participate must indicate interest in the program by Resolution adop- ted before December 31, 1971. The Manager said she would obtain applications from the Fed- eral Insurance Administration and bring the matter back to the Council. The matter was held on the agenda. ADJOURNMENT There being no further business to come before the meeting, motion for adjournment was made at 10:05 by Councilman Klein, seconded by Councilman Fay and unanimously carried.
