April 13, 1970
A regular meeting of the City Council of the City of Rolling
Hills was called to order by Mayor Hesse at the Admistration Building,
2 Portuguese Bend Road, Rolling Hills, California at 7:30 P.M. Monday,
April 13, 1970.

MINUTES
Motion to approve the minutes of the regular meeting of
March 23, 1970 as presented was made by Councilman Nadal, seconded
by Councilman Sauer and unanimously carried.
CORRESPONDENCE
Regional Planning Commission - Commissioner Louis Kanaster
The City Manager presented a letter from Mr. Louis Kanaster
of Regional.Planning Commission thanking the City Council for their
invitation to attend the Council meeting on April 27th. Commissioner
Kanaster advised that he would be pleased to attend the meeting to
discuss planning and zoning procedures of the Regional Planning Com-
mission.
The letter was received and noted.
Palos Verdes Peninsula News
A letter dated March 31, 1970 from the Palos Verdes Penin-
sula News was presented. Advising that this year's anniversary
edition, Discover the Peninsula, will be published on June 10th, a
request for city support of the publication was made by Frederick F.
Stannard, publisher.
The City Manager advised that cost of a half -page ad had
been included in the budget. Motion to approve expenditure of $130
for a one:. -half page was made by Councilman Fay, seconded by Councilman
Sauer and carried by the following roll call vote:

South Bay Daily Breeze
A letter dated April 13, 1970 from the South Bay Daily Breeze
was presented by the Manager.
The annual Palos Verdes Panorama edition will be published in
May, and the City was asked to again participate by subscribing for
one-half page at a cost of $157.50. The Manager advised the Council
that this item had been included in the 1969-70 budget.

Motion to.approve the expenditure of $157.50 for one half
page of the Panorama edition was made by Councilman Nadal, seconded
by Councilman Klein and carried by the following roll call vote:

California Contract Cities Association
Mrs. Clifton presented a letter dated April 2, 1970 from
Robert W. Baker of the City of Lakewood, Chairman of the Nominating
Committee, presenting the list of candidates for office in California
Contract Cities Association for 1970-71.
A letter from Bill Cheek, vice -mayor of the City of Walnut,
also was presented. Mr. Cheek requested the support of the Council
for his nomination for treasurer of the Contract Cities Association.
Telegrams
The letters were received and filed.
The following telegrams were presented to the Council:
a. From Senator Lawrence.E. Walsh, 30th District, 3/25/70
"URGENT: The Los Angeles County Board of Supervisors has
requested that each city in the county go on record as opposing
SB38 (Walsh -Carrell Act) which in its present form gives the State
Highway Commission the authority to determine distribution of gas
tax funds. This is the only le islation since the inception of.t.he
North-South split (23 years ago to get out of the—northern domin-
ited_Senate Transportation Committee, that can and will be amended
on the.Senate floor. Amendments have long been prepared to delete
the highway commission as the agency to allocate these funds and
provides the ratio shall be 60 percent to the south and 40 percent
to the north. I feel certain the bill, in its amended form, will
have your full support and request that you delay any expression
of opposition to this measure until I have had the opportunity to
insure its passage with the necessary 21 Southern votes."
Mrs. Clifton reported that she would obtain a copy of
SB38 for review.
b. Harold Schultz, 4/3/70
"It is important that your City Councilmen watch KNBC TV
Channel editorial airing this evening during the 7 o'clock news
program supporting our Contract Cities position on Sheriff's cost
in that as many councilmen as possible write letters to.the station
thanking them for editorial support with copies of letters going to
all supervisors."
Mrs. Clifton reported that she had received a confirming
copy"of the telegram in the mail Monday, April 6th, indicating that
an attempt had been made to telephone the message to the office at
6:30 P..M. after the City office had closed.
The message was received and noted.
Bryan Hardwick Associates
The Manager presented a letter from Bryan Hardwick Assoc-
iates, advertising and public relations firm, advising that the
Palos Verdes Water Company is sponsoring a drug abuse contest de-
signed to point out the dangers in using drugs and narcotics.

Mr. Robert E. Davis, Vice President, Public Relations, re-
quested that the City Council of Rolling Hills draft a letter of
commendation acknowledging the water company's efforts and voicing
its approval of the drug contest.
Mr. Nadal stated that he thought the request should be re-
viewed by the Narcotics Administrative Committee, since it came from
a public relations firm and not from the Palos Verdes Water Company.
Mayor Hesse directed that.,Councilman Nadal or Mrs. Clifton
bring the matter to the attention of Mr, Ted Bear and the Narcotics
Coordinating Commission.
Claim by Richard Rav Claytor re; Use of Gate Pass
The City Manager presented copies of a document from Mr.
Richard Ray Claytor, Claimant, to the Clerk of the City of Rolling
Hills for Claim for Twenty Five Thousand ($25,000.00) Dollars, for
alleged tortuous conduct by public officials of Rolling Hills.
In,a memo to the City Council and Board of Directors dated
April 2, 1970, the Manager explained that she had received a letter
dated August 6, 1969 from Mr. Claytor regarding use of a resident
sticker f1073 issued to the Federal Aviation Administration so their
personnel could go through Rolling. -Hills to the main post office in
the Peninsula Center for security mail. Mrs. Clifton explained that
the pass was issued several years ago, before the temporary pass pro-
cedure now in use had been initiated, and with the understanding that
the sticker would be used on an FAA vehicle only. Mr. Claytor said
the gate pass had been issued to Mr. Robert Barrows, a non-resident,
and was contrary to the stated policy of non-discrimination among
residents living outside City boundaries.
Mrs. Clifton contacted Mr. Harold Eugene Erceg, named by
Mr. Claytor as Chief of Federal Aviation Administration Subsector
#18651 (3860 Crest Road East), and he said that the Rolling Hills
sticker had been mounted on Mr. Barrows' car because he lives in the
proximity of the Post Office and was called on to pick up security
mail at many different hours of the day. Mrs. Clifton explained the
provision that the sticker must be mounted on an FAA vehicle, and
also explained the new temporary pass procedure, and Mr. Erceg came
to the office the following day with pieces of sticker #1073 which
had been scraped from the windshield of Mr. Barrows' car. On that
date Mr. Erceg filled out a request for temporary road use permits
and Mrs. Clifton gave him a temporary pass.
Nothing further was heard until March 30, 1970 when Mr.
Claytor filed his claim,,stating that public officials of Rolling
Hills had committed a tortuous act by publishingto the Federal
Aviation Administration without his permission is letter dated
August 6, 1969, and that his opportunity for promotion had been
materially reduced as a direct result of said tortuous conduct.
The Manager explained that she had showed Mr. Claytor's
letter to Mr. Erceg, and because it was addressed to the City of
Rolling Hills it was a matter of public information. The letter
had not been 'published".
Followingg discussion of the matter Councilman Klein moved
on advice of,legal counsel, that the claim to denied because it was
not filed within 100 days of the date of the original letter. Motion
was seconded by Councilman Fay and unanimously carried.
Palos Verdes Water Co. - Department of Public Health
Copjes of correspondence from the Department of Public Health
dated March 24, 1970 and the Palos Verdes Water Company dated April 3�
were distributed to members of the Council.

Mr. W. J. MacPherson, Senior Sanitary Egnineer for the State
Department of Public Health advised Mr. Glade Cookus, vice president
of Palos Verdes Water Com?any, that an engineer' -from his office in-.
spected the water company s boosting station No. 14 located off East-
field Drive north of Wideloop Road and found that horse manure had
been placed on top of land udder which pipelines to the station are
situated.
Since some of these mains are suction lines, the Department
of Public Health strongly urged that the manure be removed and that
future depositions of manure on this area be prohibited by the water
company to protect the water system from contamination.
Mr. Cookus sent a copy of the letter to Mr. David M. Turner,
76 Eastfield Drive and requested that the situation be corrected im-
mediately, but there had been no action. Councilman. Sauer stated that
he knows Mr. Turner and would be willing to approach him on the matter.
Mayor Hesse ordered the matter held on the agenda for further
information.
RESOLUTION N.O. 249
A motion to adopt Resolution No. 249 entitled A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS ORDERING THE CANVASS
OF THE GENERAL MUNICIPAL ELECTION TO BE HELD ON THE 14TH DAY OF APRIL,
1970 TO BE MADE BY THE CITY CLERK OF THE CITY OF ROLLING HILLS, and to
waive reading in full was made by Councilman Sauer, seconded by Coun-
cilman Nadal and carried by the following roll call vote:
AYES: Councilmen. Fay, Klein, Nadal, Sauer, Mayor Hesse

ORDINANCE N0. 84
Councilman Klein moved that Ordinance No. 84 entitled AN
ORDINANCE.OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA,
AMENDING ORDINANCE NO. 16 ENTITLED "AN ORDINANCE OF THE CITY OF ROLL-
ING HILLS, CALIFORNIA, REGULATING TRAFFIC WITHIN SAID"CITY'AND"^REPEAL-
.INGIORDINANCE NO. 1 AND ALL OTHER ORDINANCES IN CONFLICT. THEREWITH" be
adopted, and that reading in full be waived. The Ordinance as amended
describes locations of stop signs in the City, under Section 14.02:

INTRODUCTION OF ORDINANCES
City Attorney William Kinley reported that he had prepared
two ordinances for controlling motorcycles and motorbikes within the
City of Rolling Hills.
Councilman Klein moved that AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ROLLING HILLS -ESTABLISHING REGULATIONS OF MOTOR VEHICLES
NOT RELATING TO TRAFFIC be introduced, and that reading in full be
waived. The motion was seconded.by Councilman Sauer and.unannimously
carried.

Councilman Nadal moved that AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ROLLING HILLS, CALIFORNIA, AMENDING ORDINANCE NO. 16
ENTITLED "AN ORDINANCE OF THE CITY OF ROLLING HILLS, CALIFORNIA, RE-
GULATING -TRAFFIC WITHIN.SAID CITY AND REPEALING ORDINANCE NO. 1 AND
ALL OTHER ORDINANCES IN CONFLICT THEREWITH" be introduced, and that
reading in full be waived. The ordinance amends Ordinance No. 16 by
incorporation Sections 12.10 and 12.11 pertaining to operation of
motorcycles and motorbikes in Rolling Hills. Motion was seconded by
Councilman Fay and unanimously carried.
Mayor Hesse ordered both ordinances held on the agenda.
PROPOSED ORDINANCE
Mr. Kinley distributed copies -of AN ORDINANCE OF THE CITY
OF ROLLING HILLS, CALIFORNIA CONTROLLING THE KEEPING, STABLING, PAS-
TURING AND RAISING OF HORSES AND CATTLE IN THE CITY OF ROLLING HILLS,
CALIFORNIA to members of the Council for study.
Mayor Hesse ordered the matter held on the agenda.
FINANCIAL STATEMENTS
The Report of the City Treasurer for the month of Febtuary
1970 and the Statement of Receipts and Expenditures for the month of
February 1970, held over from the previous meeting, were again pre-
sented with the following explanation: 'T ming March $18,633.61 was
disbursed leaving a balance of $4,348 due to the Sheriff's Department
(payment pending rec6ipt of Motor Vehicle License Fees) and $8,395
due Rolling Hills Community Association to be paid at the next City
Council meeting. The city at present has investments of U.S. Treas-
ury Bills in the face value of $30,000 that will mature 7/9/70 at
7.6798 interest rate.
The projected expenses for the period 3/1/70 to 5/1/70
(at which time the balance of property taxes will be received) is
$46,680 and the income is estimated at $10,500. By law the City is
restricted in its investment of public funds.
95% of the income projected for the fiscal year has already
been received by the Association, and although the city is relatively
current in its reimbursement to the RHCA, some reserve funds should
be kept liquid in order to advance emergency funds for the coverage
of payroll. (Leplly a separate bank account should be kept for
employee wages.)'
Following presentation of the explanation, Councilman Sauer
moved that the Financial Statements for the month of February 1970
be approved. Motion was seconded by Councilman Fay and unanimously
carried.
The Report of the City Treasurer for the month of March 1970
and the Statement of Receipts and Expenditures for the month of March
1970 were presented with the following explanation: "The Treasurer's
Report shows a cash balance in the General Fund of $16,693.32 of which
$9,598.65 is to be deducted after approval for payment of this even-
ing's demands, leaving a total of $7,094.67. A Los Angeles County
Sheriff's invoice for $4,348, city employees and reimbursement to the
Association should be paid at the next Council meeting. $9;000 should
arrive any day for the city's apportionment of the Motor Vehicle Li-
cense Fees."
Motion to approve the Financial Statements for the month of
March 1970 was made by Councilman Nadal, seconded by Councilman Klein
and unanimously carried.

PAYMENT OF BILLS
Councilman Sauer moved that Demands No. 1478 through 1487
and 1489 through 1498 be paid from the General Fund, and Demand No.
1488 be paid from the Traffic Safety Fund.

Sheriff's Department
The report of the Sheriff's Department for the month of
January 1970 was presented. The report was received and filed.
AGENDA ITEMS HELD OVER
Palos Verdes Water Co.
Councilman Sauer reported that he had written to Mr. Ralph
Lindberg, president of California Water Service Company, new owner
of the Palos Verdes Water Company, requesting attention on the prob-
lems of water pressures and fire flows in the City of Rolling Hills.
Councilman Sauer said he had a telephone call from Mr. Lindberg ad-
vising that approval of the acquisition by the Public Utilities Com-
mission was expected by July 1, 1970, and additional funds to permit
attention to the problems in Rolling Hills would follow at the earli-
est possible date.
Mrs. Clifton reported that she had received a copy of the
Annual Report of California Water Service Company, containing the
names of the directors and executive officers, which had been request-
ed by Mayor Hesse.

Zoning Case No.. 5487-(4), Crest & Highridge Road
A Notice of Public Hearing before the Board of Supervisors on
Zoning Case No. 5487-(4) scheduled for Thursday, May 21, 1970 was pre-
sented by the Manager. Westwood Tillage Development Company has re-
quested a change of zone from R -A-15,000 to R -A-12,000 for 48.7 acres
south of Crest Road and Highridge Road.
Mayor Hesse ordered the matter held on the agenda.
Zoning Case No. 9124-(4), Congregation Ner Tamid
Mrs. Clifton advised the Council that she had been advised
by Regional Planning Commission that Zoning Case No. 9124-(4) is
being held under submission and that the City will be advised before
any action is taken.
The matter was held on the agenda.
Zoning Case No. 5545-(4), Via Campesina
The Manager reported that she had contacted Mr. Robert Vollmer,
City Manager_of the City of Palos Verdes Estates to ask what action
that city had taken with regard to the request for a change of zoning
on property on Via Campesina, which is contiguous to the City of Palos
Verdes Estates. Mr. Vollmer reported that no action had been taken
by that City.
On March 303 1970 the Regional Planning Commission recommended
to the Board of Supervisors that the request for a change of zoning from
R -A-1 1/2 to R -A-20,000 be granted. A hearing date before the Board of
Supervi*drs has not been scheduled.
The matter was ordered held on the agenda.
Motorbikes and Motorcycles Within Rolling Hills
A letter from Mr. and Mrs. Theodore J. Dykzeul of 17 Cabal-
leros Road dated April 6, 1970 was presented by Mrs. Clifton.
Mr. and Mrs. Dykzeul said theywished to go on record as
approving motorbikes and motorcycles provided that they make no more
noise than a conventional passenger automobile, but the object to the
excessive noise of un-mufflered bikes.
Councilman Klein, chairman of the Motorcycle and Motorbike
Committee, suggested that a letter be sent to all residents, asking
for communication of opinions to the Chairman, and that copies of the
minutes of the meeting of the committee and copies of the ordinances,
when adopted, be included with the letter.
Councilman Nadal asked the City Attorney whether any of the
proposed actions to ban or limit the use of motorcycles and motorbikes
within the City would appl to use of such vehicles by an owner on his
property, and Mr. Kinley sid they would not.
Following discussion Councilman Nadal moved that the residents
be advised of the deliberations of the committee and asked for their
comments, and that copies of ordinances pertaining to operation of
minibikes and motorcycles be sent to all residents. The motion was
seconded by Councilman Fay and unanimously carried.
The matter was ordered held on the agenda.

Miraleste High. School Pool Proposal
Mrs. Clifton reported that Mrs. Craig Ruth had called to
request that the matter be considered at the next regular meeting
of the Council.
Mayor Hesse ordered the matter held on the agenda.
Contract Law Enforcement Charge for. Sheriff's Services
The Manager distributed copies of a bulletin issued by
Sheriff Peter J. Pitchess advising that the Board of Supervisors had
unanimously -approved the.price of contracting the services of one
patrol car at $230,000, with the monies in excess of $153,000 to be
placed in a special reserve account pending the result of an in-
depth study.
r-4 Sheriff Pitchess announced that the study would be conducted
CD by a committee consisting of representatives of the Contract Cities
0 Association, the Independent Cities, the Economy and Efficiency Commit-
tee,'the Shefiff, and the County Counsel, coordinated by the County
Auditor -Controller, and would report its findings to the Board of Super-
visors by March 1 1971. If the findings of the committee reflect a
figure less than 230,000 the funds in the reserve account would be re-
funded to the cities on a pro -rated basis prior to the end of the 1970-
71 fiscal year; if the study indicates a need for an additional increase
in the cost of contract services, the increase would be effective on
.July 1, 1971.
Mayor Hesse requested that Mrs. Clifton meet with represent-
atives of Rolling Hills Estates and Palos Verdes Estates to study the
possibility of entering a joint powers agreement for independent law
enforcement. He further stated that he wished to discuss the matter
in depth with the Manager before the meeting is scheduled.

Mayor Hesse ordered the matter held on the agenda.
Department of Housing and Urban Development re: Federal Flood Insurance
The Manager reported that she had sent copies of information
pertaining to Federal Flood Insurance Coverage to Councilman. Sauer
and Mr. Ted Bear for review.
The matter was held on the agenda.
Council - Manager Ordinance
Mrs. Clifton asked members of the Council to study the pro-
posed Council - Manager Ordinance she had circulated.
Mayor Hesse ordered the matter held on the agenda.
MATTERS FROM MEMBERS OF THE COUNCIL
Councilman Nadal address the Council and said he wanted the
other members to know that he had enjoyed his term of office on the
Rolling Hills City Council and regretted leaving.
Councilman Fay thanked Councilman Nadal for his devoted
service to his duties as Councilman, former Mayor and for his many
hours as representative of the Council on the Narcotics Coordinating
Committee. Councilman Fay also expressed the Council's appreciation

to Councilman Klein, who also had served as Mayor, and as chairman of
the Traffic Committee and Motorcycle and Motorbike Committee, and he
expressed his regret that they would no longer be serving together.
Mayor Hesse presented both retiring members of the Council
with commemorative plaques of the City of Rolling Hills, with engraved
plates showing their terms served as Mayor of the City. Mayor Hesse
thanked Councilmen Klein and Nadal for their service to the City on
various committees, and invited them to attend future Council meetings.
Councilman Klein expressed his appreciation to the Council
and said he had enjoyed serving on the City Council and would continue
to serve as a member of the Board of Directors of the Rolling Hills
Community Association.
Absence from Council Meetings
Councilman Fay advised the Council that he will be out of
the country from April 23, 1970 to May 22, 1970, and would be absent
from the Council meetings on April 27th and May 11th.
ADJOURNMENT
There being no further business to come before the meeting,
Mayor Hesse recessed the meeting to a personnel session at 9:15 P.M.
The meeting reconvened at 9:30, and on a motion made by
Councilman Klein was adjourned at 9:35 to meet again on Tuesday,
April 21, 1970 at 7:30 P.M. to declare the result of the general
election held on April 14, 1970 and such other matters as are pro-
vided by law.
Motion adjourn was made by Councilman Klein, seconded by
Councilman Nadal and unanimously carried.
