Wil�.iam Fox°d, 8 Blackwater Ca�.yon Road o At a meeting of the Plan,nin.g Commission on Septen�ber 15, 1970 a �equest for modif.ication of Lot Desig�.9 Section 5.04d of Ordinance �Too 67 was denied, an,d the Counc�l was ad�rised ir� a letl�ex° dated Septearaber 16th tha� members of the Planm ning Gommiss�on had visited the si�e independe�ntly, and all who made a field t�ip exp�essed the opinion that Lot 3 as submitted did not confo�m to Rolling �i11Ls stiandards , and if �,ots 2 and 3 were combined - the res�lting subdi�visio� would be mox°e aeceptable . M�. Walter Kessenick of South Bay Engineering Corporation _ represented the own.er and addressed the Council on his behal,f. Mro Kessenick advised that the P1ann�ng Advisor, Mr, Geoffrey Tay�,or, had presented a rep�rt dated Aug�st 6, 1970, in which he stated that the Planning Ad�isory Agency had. reviewed the anap, it was considered satis- factoryy and approval was recommended, with certain conditions outlinede Under DES�GN� Co�.dit�ox� 3 specified: "It �s recommended that Section 5o04d of Ordin.anee 67 be modified since these 1,ots do not have a depth at least equal to the fro�.tage abutting the street easement 1ine ." In addition.� M�°. Kessenick stated� a11 �equirements for a build- ing site on Loit 3 eould be anet without addit�o�na1 modifications of the zoning ordinance9 if the subdivision we�°e appro�ved. He presen.ted a grading map showin,g a proposed building site on. Lot 3 i�. excess of the requirements of the Architectural, Committee, and he stated that the requirement of a 12 ,000 square foot pad co�xld be exceeded, because a 17,000 square foot pad coul.d be graded on the �idge available for a sitee Y�e �further indicated that, �he grading map showed a 1.7 ,000 square � foot buildin.g site, a 3,500 square foot residence with two car garage, � swimming pool. and large lawn� area� and to accomplish this , he explained, � the requ�.�ements of a 30 ' front yard and a 50 ' rear yard could be met � without additiona� varianeeso Mro Kessenick said it was his opinion p that substantial property �°ights of the owne� would be denied if the modif�cation and approval of the tenta�ive map were denied, and he asked that the property and the property owner' s request be judged individually, a�.d tha� the tentative tract be approved. In the discussio�n that foll�wed Councilman .Fay asked about plans for improvement of Blackwate� Canyon Roada Mr. Kessenick explained that subdividers of px�perty in Ro:Lling Hi11s are required to �mprove the road on their side to City standards . In the case before the Council Mro Kessenick said that at �he req�est of the Board of Directors of the Rolling Hills Corrmnu��.ity Association he had done a study for the subdi- vider which gave a breakdown. on. costs to ixnprov� the entire undeveloped seetion of Blackwater Ganyon Road with each adjacent property owner � participatinga He f�r�her �stated that the Boar�d of Directors decided that in the in.texest of safety axid fire protec�ion �hey would req�ai.re the subdi�ider to develop Bl.ackwa�e.� Canyo�n Road, �aith his proportion- a�e share of the road costs� to pro•�ide a fu�.1. �°oad 30 feet wide, with paving of 1.5 feet from centerline to be pro•vided across the frontage of Lot l, total width of paving 30 feet across the frontage of I,ot 2 and the southerly portion of Lot 3, with a standard cul-de-sae . Coun- cilman Pearson explained that developing the road in. that manner, and extension of the water system as far as the cul de sac to serve newly created lots would constitute an �up-grading and improvement to proper- ties in the area . Co�uncilman Bear asked about flood control measures , and Mro Kessen�ielc explained that to comply with O�dinance No. 67 a stox°m drain. and rip�-rap would be �equixed. Following the discussion Co�ncilman.
