Hills was called to order by Mayor Hesse at the Administration Building

A motion to approve the Statement of Receipts and Expenditures
for the month of September 1970 and the Report of the City Treasurer
for the month of September 1970 was made by Councilman Pearson, seconded

Nfayor Hesse opened a discussion of Tentative Traet 29394, ,
Dr. E : J. Weisenheimer, 27 Portuguese Bend Road, � which had been
approved by the Planning Commission a� the mee.ting of A�ril 21, 1970

In reviewing the minutes of the Planning Commission, Mayor
Hesse noted that the engineer was requested to submit maps showing
the width and shoulder at various locations in the portion of Portuguese
Bend Road bounded by the tract ., A corrected map showing the widths was
presented, an.d Dr . Weisenheimer indicated his willingness to conform to
the subdivision ordinance and provide for improvements to City stand-
ards as required for Portuguese`° Bend Road, either by having the work
done or by posting a bond; whichever is required when the final map is
submittedo

SUBDIVISION NOo 49, Tract 29723, Dr. William Ford
�Iayor Hesse opened a d�scussion of Tentative Tract 29723, Dr.
William Ford, 8 Blackwater Canyon Road. At the meeting of October 13,
1970 the Council had con.side'red the subdivision and voted to hold it
on the agenda so members of the Council could make a field trip to the
site . Following discussion at the meeting of the Planning Commission
on September 15th the Commission had recommended that the tract not be
approved, as �ot 3 did not conform to the Rolling Hills Subdivision
Ordinance .
At the City Council meeting in October the engineer who rep-
resented the owner presen.ted a grading map showing that the proposed
lot could accommodate a buil:ding site in excess of the Rolling HiTls
Community Association requirements without need for additiorial modifi-
cations or variances of the Zoning Ordinance, and an additional exhib it
ind�.cating that the building s�.te on the proposed lot would be 300 -feet
from the nearest existing residenceo Members of the Planning Commission
and City Council subsequently visited the site which had been staked by
the emgineer to show the proposed location of the pad on Lot 3, and the
et�1 de sac which would terminate the proposed improvement of� Blackwater
Ganyon Road. �by the owner9 as ag�°eed to by the Rollin.g Hills Comnnunity
Association. '
In the discussi�on that followed Councilman Fay asked whether
any additional fire hydrants wou,ld be installed. The engineer explained
that a1.1 recommendatir�ns and requirements for fire hydrants and fire
flow made by the Fire Departmen.t would be complied with.
Councilman Pearson recommended that an emergen�cy access be
c�eated to connect the proposed cul de sac with the. existing portion
of lower Blackwater Canyon Roade Su�h an access, he said9 would be
extremely ben.eficial to �he city ��. an eme�°gency, and should be surfaced�
to be usable in all weather �onditions ; howe�ver, he said it should not
be available for gene�°a1, use . Counc�lman Pea�son suggested that the
City Manager consult with �the Fire Department about the required width
and appropriate bar�icade for the access , which would be removed when
Blackwater Canyon Road improveme�.ts are completed at a later dateo

made for control. of fl�od hazards on the prope�ty. Mro Kessenick ex-
pl.ained that the measures being taken were both permanent and temporary
and the temporary measures would be �e�designed to become permanent

Copies of the tenta�ive map for 'Tract 29408 and the Planning °
Adv�sox°' s Report dated October 14, 1970 were presented to the Council.
The Deputy City C1erk advis�d that the P�.anning Commission had voted
to grant modifications un.der Ar�icle V, Sect:ion 5o04d� Depth of Lo�
on Lot 1 and Sections 5 .03� Frontage and 5 .04b, Width of Lots on Lot 2
at �he meetin.g dated -0ctober 20, 1970. Minutes of the meeting had not
been prepared for presentation to the Council at this time, she explained.
M�. Kessenick, engineer for the own.ers , explain.ed that Mr. Ralphs
owner of p�°operty at 35 Crest Road West had originally filed with the
Rolling Hills Comn�unity Association to subdivide his property_by dividing
it into a twa acre site fronting on Chestnut Lane, and a 3032 acre site
on which the ex:�s�ing residence is located. Subsequently he entered into
negotiations w�.th NIr. Richard. Colyear, 37 Crest Road West, and Mr. Ralphs
cancelled his application, and a nera application was filed jointly by Mr.
Ralphs and Mr. Colyear. Under terms of the new application a two acre
par�cel was created on Crest Road West from the existing Colyear property,
a two acre parcel with aecess from Chestnut Lane was ereated from the
existing Ralphs property9 and the �emainder of both percels were combined
to form a parcel of 5a27 acres that would �ventua�ly be owned by Mrs
Colyea�°:
In. the discussion that followed Counei�rnan Fay asked Mr. Colyear
whether it was his intention to create an addit�on.al building site on
the 5+ acre parcel at a future datev Mr . Colyear �aict: it is not his
intention to ever divide the remain.ir�g parcel, a�d he wished to guarantee
if possible that the p�°operty never would be divided f�xrthex°, Councilman
Pearson suggested that as a condition of the approval a note be put on
the final map limiting the proposed Lot 2 to one building site, and Mr.
Co�lyear agreed to comply with the suggestion.

contained in the P1ann.ing Adviso�'s Report dated October 14y 1970, the
recommendations of the Plann�ng Goa�mission on October 20, 1970 and the

A 1,etter from a g�°oup of tennis playing residen�s in the City
reques�ing that the Counci� con.sid.er putting in another tennis court,
an,d offering to assis� �he Plann.ing Commiss.ion was presented to the
Council . The residents also suggested that lighting on the court
� would extend the use during short win�er days, and �be especially we1-
comed by the anen who are unable to pl.ay during the daytime hours . The
residents offe�°ed to assis� the P�,anning Commission in any way possible .
In. the discuss�o�n that followed Mayor Hesse said it was his
feelin.g tha� the Plan,rning Commission shou:Ld in�vestigate expansion of
a1:1 recreationa�. faci:Li�ies, not only tenn.is . He said a study of all
� fu�ure �ecreation needs shou�d be �onducted, with atten�ion to addit=
� ional. riding facilities . It was his suggestio� that anembe�s o� the
� Planning Commissioa� and a representa�ive of Caballer�os study the needs
a of the Commun.ity, and report to the �oa�°d of Directors and the City
p Council. Niayor I�esse appointed Couneilman Sauer City Council repre-

Sheriff ' s Report
The Sheriff 's Report for the month of August 1970 was presented.
The Deputy City Clerk advised that the report was �naccurate because of
a computer error, and gave the corrected figures whieh had been supplied
by the Sheriff ' s Departmernt, °The report was received and fil�d.

The Report of the Fire Department for the month of September
1.970 was presented. 'The report was received and filed.

The Department of Animal Conrro�. Repo�t for �he third quarter

Buildin.g .,Code
,�`�Mayor Hesse requested that the staff report to the Council on
any changes in Building Codes and Ordinances adopted following the
recent fires in Southern Ca�.i,for.niaa He directed that a copy of the
emergency ordinance pertaining to roofing, adopted by Los Angeles County �,
on October 20, 1970 be obtained for reuiew by the City Council, with
clarification of the extent to which the County ordinance applies to
the City of Ro�.ling Hills .
The Nlayo� said he had been advised �hat the Architectural
�ommittee of the Rolling Hi11.s Community Association had been researcl�-
ing the matter of fire retardant r.00fing for new con.struction.,_ and he
requested that a written. report of the progress be presented at each
meetin.g of the Gity Coun.cil. In addition, the Mayor requested that
a report be prepared for presentation at the next regular meeting of
the Council defining the jurisdiction of the City relative to codes ,
requirements and inspection of requirements of the Rolling Hills Com-
m�unity Association..
Councilman. Fay said he thought consideration shou�d be given
�o the matter of replacing o1.d roofs if requirements for new roofing
material.s are adopted.
Mayor Hesse ordered the matter -i�eld on the agenda .
