Investment Company A letter dated November 12, 1970 from the Department of County Engineer, County of Los Angeles, recommending approval of the final map for Tract No. 30678, was presented. to the Council. ' Minutes relative to requirements for approval were reviewed. Mrs. Clifton stated that the fees or bonds for improvement of Portugu6se Bend Road had not been posted with the City. Mr. Robert De Jernet of South Bay Engineering Corporation -explained that all • requirements of the Architectural Committee had been met, but all fees required by the Rolling Hills Community Association had not been paid, neither had bonds or fees been posted for road improvement. Mr. De Jernet requested that the Council approve the final map, but the linen not be signed until all conditions had been. met. The City Attorney recommended that approval not be given because conditions of approval under ARTICLE XIII, Improvements and ARTICLE XIV Bonds and Deposits of Ordinance No. 67 had not been com- plied with. The Mayor 6rd.ered the matter held on. the agenda until all �p conditions of approval. have been met. O REVISED GRADING PLAN, Tract 26343, Adams, Shaver, Johnson The Manager presented a revised grading plan, submitted by South Bay Engineering Corporation for Tentative Tract 26343. Mrs. Clifton explained that the tentative map had been approved. showing a road access to the properties. However, the owners of the properties in the subdi- vision had decided to change from a road to a drive, and the new grading plan eliminates a great deal of grading and the necessity of importing dirt, also removal and re -compaction., which would be necessary for con- struction, of a road. Mayor nesse asked whether the Council could approve the new 44 grading plan, and Councilman Pearson suggested that the plan should be referred to the Planning Commission for review, because the lot lines had been retained, but frontages on the cul de sac had been revised. Councilman Pearson said because of the change :in lot design, he thought it would be necessary for the Planning Commission to review.the map. Mayor Hesse agreed, and ordered the matter held on the agenda until further action had been taken by the Planning Commission. PERSONAL APPEARANCES The Mayor said the number of persons in the audience were evi- dence of interest in a particular matter on the agenda, and it was his wish to ask the residents which subject had 'brought them to the meeting. Mr. Barney Feldman, 5 Plying Mane Lane, stated that he is in- terested in all matters before the Planning Commission and the City Council, and wishes to volunteer his services in any way possible. He asked whether it would be possible to post an agenda on, a bulletin board accessible to all residents, so all could. be informed of all business before the Council and Commission. The Manager explained that the monthly newsletter sent to all residents contains the dates of all meeting, and all are open to residents. The City Attorney ex- plained that notices of public hearings are published in. the local newspaper in compliance with Article VIII of Zoning Ordinance No. 33 for the noticing and holding of hearings on variances and modifications of Subdivision. Ordinance No. 67, and in. addition., written. notices are sent to all owners of property located within 500 feet of the exterior 'boundaries of the subject property. The Manager said that Mr. Feldman could be advised of all such, meetings if he wished, and should direct his request to the Deputy City Clerk. Mr. Ernest Hahn, 19 Southfield; Mr. Carl Price, 1 Quail Ridge South and Mr. and Mrs. Raymond Schaefer, 69 Eastfield Drive all said -2- 1..4: O November. 23, :1.970 they were present 'because of an, interest in a proposed Amendment to 'the Building Code relative to Roofing Requirements Mr. Kinley presented cop:ie.s of a proposed ordinance amending sections of the Building Code of the City of Rolling 'Sills relating to fire retardant roofs. The proposed ordinance would be adopted as an urgency ordinance, and would. take immediate effect if adopted, he explained. The Mayor asked Mr. Kinley to explain the amendments, and he said the new ordinance would be substantially the same as the exist- ing ordinance, except that it contains a proAsion. for fire retardant roofs. Mr. Kinley said an urgency ordinance adopted by Taos Angeles County on. October 20, 1970 specified that "Requirements in Fire Zone No. 4 for the fire—resistive protection, of exterior walls and openings, as determined, by location. on property shall be the same as required for Fire Zone leo.3 in Section, 504 and Part 'V.", and that the City of Rolling Hills is :in. the same Fire Zone No. 4 as the County territory 'because of the abundance of brush, trees,, etc. The requirements vary with the types of foliage and construction within. a fire zone, fir. Kinley said. Mr. Hahn, addressed the Council and urged study of the proposed ordina.n.ce before adopting :it. He explained, that requirements of certain. :fire zones extend 'beyond requirements for fire retardant roofing to fire retardant siding, and could lead to revision, of the building regulations if adopted hastily. He explained that he presently :is building a new residence in Rolling Hills, and is encountering constantly increasing costs of constr.uction,_and.felt that any hasty action in. revising preset en.t requirements might work an. unnecessary hardship on. potential build- ers. He plans to use a fire retardant roofing, he explained, and, :feels that most builders would. agree, but washed to avoid other, restrictions on. construction that might 'be encountered if the City of Rolling Hills adopted requirements of a specific fire zone Mayor nesse asked Fire Chief William Ware of the :loos Angeles County Fire Department for, his comments. Chief Ware directed :fire fighting operations at the recent Malibu fire, and said he felt it was an area that could 'be compared to the City of Rolling Hills. Chief Ware said the heavy losses in. the area were caused, in part by the nar- row streets, long steep driveways and no adequate turn-arounds for fire fighting equipment. He described the area as heavily planted, and said there was a heavy loss of eucalyptus and citrus. Winds at the mouth of Malibu Can.yon. were clocked at 83 miles per hour, Chief Ware said. Mr. Feldman. asked about the ad:visibi.lity of installing sprinklers on an existing shake roof, and Chief Ware said that sprinklers drain, the water supply in an. emergency, and the apparatus can.''t use the hydrants. Coun- cilman Bear said 'he is building a new home and will in,sta.11 a pump on the roof to drain. his swimming pool, and Chief Ware said that is advis- able for anyone who has a pool that could 'be drained to fight a fire in, a residence. Councilman 'Fay asked, whether the ordinance ad.opted. by Los Angeles County requ.:i.res complete re -roofing, or just fire -retardant roofs on, new construction. Chief Ware explained that fire -retardant material is required for all newu construction or additions to existing buildings; if the addition. exceeds 25% of the original. building, the entire roof must be replaced. Following the discussion Mayor nesse asked that all Councilmen, Chief Ware, Mr. Hahn. and any other's who wished. 'be given. copies of the proposed, ordinance for review anal study Mayor Nesse asked Councilman. Sauer and Mr. Hahn. to prepare a report and make recommendations on, the matter before the Council. Mr. Price asked whether the report of the committee would be pr.e.sen.te.d at the next regular meeting of the Council, and the Mayor asked that it be ready for the next meeting on. December 14th. Urgency Legislation S.B. 1.350 and A.B. 2057 Chief Ware presented a copy of urgency legislation signed by the Governor. S.B. 1,350 and, A.B. 305'7 concern expios:ive control and security 1.4 1. November 23, 1970 and require that the Forester and Fire Warden 'be designated by the Board as the authority to issue licenses relating to explosives in un.incorpor- ated areas .of the County. County Counsel has advised the Forester and Fire Warden that each City Council. may make an,.�order designating his department as the issuing authority. Mayor Hesse read the proposed motion in full, and it was adopted on. the motion of Councilman Pearson, seconded by Councilman Bear and carried unanimously. RECESS TO PERSONNEL SESSION Mayor Hesse,announced that he wished to hold all other business on the agenda until the next regular meeting date and recess to a per- sonnel er- son.ne1 session. �p The meeting reconvened at 11.:40 P.M. and the City Manager an- nounced that the bookkeeper, Patricia O'Connell, had tendered her resig- nation as an employee of the City of Rolling -Hills on November 16, 1970, and it was her recommendation that Mrs. O'Con.n.ell's resignation be accep- ted. A motion to accept the resignation, with the condition that she be given two weeks severance pay and four days accrued vaction was made by Councilman Fay, seconded by Councilman Sauer and carried by the following roll call vote: AYES: Councilmen Bear, Fay, Pearson, Sauer, Mayor Hesse NOES: None ABSENT: None ADJOURNMENT There being no further business to come before the meeting, -a motion for adjournment was made at 11:45 P.M. by Councilman Pearson,: seconded by Councilman Bear and carried unanimously.
