4/26/1971MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA April 269 1971 A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Hesse at the Administration Build- ing, 2 Portuguese Bend Road, Rolling hills, California at 7:30 P.M, Monday, April 26, 1971. Taylor Resident APk6VAf­OF MINUTES A motion to approve the minutes of the meeting of April 12, 1971 as presented was made by Councilman. Bear, seconded by Councilman Pearson and carried unanimously. REORGANIZATION OF COUNCIL Mayor Hesse announced that before proceeding with the business of the meeting,, it was his wish to sibmit his resignation as Mayor. Councilman Hesse stated that he had served the City of Rolling Hills as,,Mayor for two years and had enjoyed his time in office; greatly appreciated the cooperation and support he had received from the Coun- cil and wished to express his thankso Councilman Hesse then nominated Councilman Sauer for Mayor of the City of Rolling Hills. The motion was seconded by Councilman. Pearson and carried unanimously. Councilman Bear nominated Councilman Pearson as Mayor pro tem. The motio-n was seconded by Councilman. Sauer and carried, unanimously. Councilman Pearson said he would be pleased to serve as Mayor pro tem and on behalf of the Council he thanked Mayor Hesse for his service to the City and its residents, and to the Council.. He said that Mayor Hesse had represented the City well during his two years as Mayor in all matters,aff6cting Rolling Hills and the ent-.1-re Palos Verdes'Penin- sula, and although he didn't always aggree with the Mayor,, Mr. Pearson said he felt Mr. Hesse had served very will with his representation on S.O.C. Councilman Hesse then presented the gavel to Mayor Sauer, and Mr. Sauer and Mr. Pearson were seated as Mayor and Mayor pro tem respectively. CITY MANAGER Palms Verdes Water Compaj�.,Replace _ment_ Plans 9rs - Clifton. announced, that she had given, the maps showing proposed improvements planned by California Water Service Company to Chief Paul Schneider of Los Angeles County Fire Department for -review by him and Chief Joseph Rotella of Research and Planning. Chief Schneider advised the Manager that he would review the maps anal the replacement schedule and report to the Council after he has studied the proposed improvements. The matter was held on. the agenda, `x`0'6 - Increased Insurance Coverap, #y of Rolling Fills Mayor Sauer reported that he had reviewed the insurance carried on the City of Rolling Hills by Simpson and Paul. Insurance Company, and had found evidence of adequate coverage in. all areas. A few suggestions for min.or changes could be accomplished at a work session with the.'City Manager, he said., but it was his recommendation that no major changes be considered. Mayor Sauer said he would like to review the bonds of City employees, and the Manager said she would make them available to him for review. Fire Prevention Measures Adequacy of Water Supply Amendment to Building Code Roofing _ Brush Conditions (Weed Abatement) Residence Construction (Fire Retardant Materials) The Manager said that she has been preparing a report on the subject of Fire Prevention Measures for the City Council to consider and it would be ready for presentation as soon as the Fire Department has made _its report on the replacement plans. Assembly Committee on Commerce and Public_Util.ities Miso Clifton presented excerpts from the Public Utilities Commission's Proposed Rules Changes dated April 169 1971 from the Assembly Committee on Commerce and Public Utilities, provided at her request by a member of Assemblyman Robert Beverly's staff. One of the proposed changes requires that presentation at hearings may be made only by attorneys. The committee has recommended that the proposed rule bhange be prevented by statute. Mrs. Clifton said she had brought the proposed change to the attention of the Coun- cil because of the testimony that had been presented at the hearing by.Counclman Fred. Hesse when the Palos Verdes Water Company petitioned the Public Utilities Commission for permission to increase rates. Councilman. Hesse said he thinks the proposed change is not in. the public interest, and the Council should express deep concern and strong opposition to the change. It is his opinion that public of- ficials should be given the opportunity to comment directly to the Public Utility Officials, and represent their constituents Councilman Pearson said Rolling Hills has had evidence of the importance of having a knowledgable representative testify before the Public Utilities Commission when Mr. Hesse spoke at the rate increase hearings of the Palos Verdes Water Company, and it was his feeling that -the Council should express opposition to the proposed rule change. Mayor Sauer asked the City Attorney to draft a letter stating the City Council's strong opposition to the rule change, and request that legislation be introduced to prevent it by statute. South Bay Engineering Corporation The Manager presented a letter dated April 199 1971 from South Bay Engineering Corporation., prodded in response to an inquiry by Cotincilmidn Pearson, as authorized by the City Council on April 12th. Mr. -Walter Kessenick advised that South Bay Engineering Corporation would prepare a preliminary study for two additional tennis courts on city property and provide a preliminary cost estimate for t'he project for a. fee of $250.00. Mrs. Betty Coffin, 14 Portuguese Bend Road, said she was at the meeting to represent the equestrian committee., and she presented a report prepared by Mrs. Joan. Saffo, Panning Commission chairman of -2- April. 269 1971. the committee for equestrian, activities. Mrs. Saffo stated in her report that at a meeting attended by Mr. Robert Fortney, Councilman Pearson and Les Phillips, grading con- tractor, it was decided that a second ring in the vicinity of the existing ring an the City park property would be feasible and practical. If possible, the committee recommended that additional property be pur- chased to provide another ring, and reported that there is a parcel of 1.7 -acres near the City park which would-be ideal for an additional ring if it could be purchased. They requested that an engineer be hired for a feasibility study to investigate utilizing the land now owned, with a cost estimate for an, additional ring based on average conditions, giving breakdown of cost of fencing, equipment, surfacing, water. The Manager presented two estimates that had been, given. to Mr. Fortney for the work, as requested by the City Council. Lanco Land O Consultants advised that for $1,000+ they would prepare a topography ZZ) map., prepare two preliminary grading studies showing possible devel- opment of a riding ring, and provide conferences as required up to three-hoursmaximum. South Bay -'Engineering Corporation advised that their ' ' 'estimate of engineering costs are as follows: Topographic map, grading study of City land only, and grading study of city land plus private land for a total, of $1,106° Councilman Pearson said he had determined that the City has funds available for such engineering studies. Councilman Hesse moved that the City Manager be authorized to initiate engineering studies not to exceed $19300 for engineering studies, $250 for tennis and $1,000+ for equestrian. The motion was seconded,by.Cour-ocilman Bear and carried by the following roll call vote: AYES: Councilmen Bear, Hesse, Pearson, Mayor Sauer None ABSENT: Councilman Fay Councilman Pears ' on suggested the engineer be hired subject to work load,, and with specific requests as to personnel assigned to the projects. Regional Planning Commission The Manager presented a tentative map for Tract 27201 showing proposed development of 86 buildings of condominiums to be built on 54 lots on 33.2 acres at -the southeasterly intersection of Hawthorne Bou­1evar,a and Highridge Road. Mrs. Clifton said the proposal will be submitted to the Subdivision Committee on, May 7th, and if there are no problems of design or zoning, will be presented to Regional Plan- ning on May Ilth. Councilman Hesse said he will attend the hearing before the Regional Planning Commission. Councilman Hesse said he had been. advised that Dayton. Realty, developer of the condominiums in Tract 27201 had al - so submitted a tentative map for Tract '27837 for development of 478 two-story town- houses on the westerly side of Palos Verdes Drive South, from approx- imately 100 feet south of Berry'Irffill Drive to its intersection with Rue Beaupre. Mrs. Clifton said maps had not been received from Regional Planning, but'would be presented to the Council as soon as possible for consideration.. Tract 26343,.-Cinchring Road, Requirements for Road Widening The City Manager presented a recommendation from the the Los Angeles County Road Department relative to subdivision, ordinance re- quirements for widening of Cinchring Road. -3- 210, April 26, 1971 Mr. L. Bo Butler, Subdivision- Sedtion Head, advised that after a fe"1d inspection of the site and a .review of engineering data sub- mitted by South Bay Engineering Corporation, it was their recommenda- tion that the widening of Cinchring Road. within. Tract 26343 be waived. Any pavement widening on the subdivision side would require consider- able Yebuilding of the existing roadway fill slopes in order to obtain a stable 2:1 slope now required by ordinance, he said. Widening on the opposite side from the subdivision is not practical., he added, because of existing improvements such as driveways, walls, drainage structures, etc.,, and. property owners on, that side would undoubtedly object to material reconstruction of their slopes, drainage structures, bridle trails, &eiveways and other improvements. Since Cinchring Road is a cul-de-sac, and since the. tract would add only four more new lots having access to the street, the existing roadway should be adequate, Mr. Butler advised. Mrs. Clifton said the recommendation had been presented to the Board of Directors at their meeting of April 15, 1971. The recommend- ation, to ivaive widening of Cinchring Road was approved. and accepted by the Board of Directors of the Rolling Mills Community Association, and referred to the City Council for action. Councilman.. Pearson ,movedthat the requirement for widening Cinchring Road be waived by the City Council, with a provision that drainage on Cinchring Road be thoroughly reviewed and any, necessary paving relating to drainage remain a condition, including any inver- ted shoulders or berms that are not presently installed. The motion was seconded by Councilman Hesse and. carried unanimously. Safety on: Tennis Court The City Manager presented a memo from Mrs. Patricia Worth and Mrs. Barbara Stevens about safety on the tennis court. Mrs. Worth and Mrs. Stevens advised that the tennis court on City property is not maintained according to safety standards for publicly used courts be- cause of leaves, twigs and seeds that fall from eucalyptus trees that surround the court, and they requested that the trees be removed, thereby eliminating the need for constant maintenance. Mrs. Clifton reported that Mr. Robert McCarthy, owner of pro- perty adjacent to the court, has requested that the trees remain to provide"screen.ing from the court for his property. Following discussion, Co•6ncilman Hesse suggested that a broom be put on.'the court so that players could sweep the court before playing, if necessary. Mrs. Clifton reported that the court is swept before scheduled, play begins each morning, and a broom is on the court before any additional sweeping than may be required before playing. The City Attorney recommended that a sign be posted on the court advising that players entered the court at their own risk, and that leaves, seed pods, etc. should be removed before beginning play. Mayor Sayer .requested that the City Attorney prepare appropriate wording for signs to be placed on. City -owned property, both at the Tennis Court and the Caballeros Ring on. the City park SUBDIVISION NO. 47, Tract 30932 The Manager advised that Mr. Thomas Moran, 10 Packsaddle West had requested that Subdivision. The Board of Directors of the Water Replenishment District will hold a Public Hear- ing on May 20, 1971 in Downey for the purpose of ascertaining the views and opinions of water producers and users regarding alternatives avail- able in the management of ground water quality, including use of re- claimed water, Colorado River water and State Project water for replen- ishment purposes. The announcement was received and filed. Resolution 7 C,ity of Downes tD A letter dated April 15, 1,971 from the City of Downey, and a copy of a resolution. urging the enactment of a bill introduced in the State Legislature which would amend the Insurance Code of the State of California to include earthquake damage in basic property insur- ance coverage for residents of the State of California. The resolution was received and filed. Miraleste High School - Mr. William Kinley, .City Attorney, advised that he has received the Agreement Between -the City of Rolling Hills and Miraleste High School_Swim Pool Foundation for operation of a summer recreational swimming pool program by the City of Rolling Hills. Mr. Kinley advised that the contract is ready for execution after the agreement between the City of Rolling Hills and the Palos Verdes Peninsula Unified School District has been executed, and both agreements should be '.kept together. The City Manager advised that the signed copy of the contract had been sent to the School District office, and had not yet been returned. The report was received and filed. Fire Department Activity Report The' Fire Department Activity Report for the month of March 1971 was presented by the City Manager. The report was received and filed MATTERS FROM THE AUDIENCE Mrs. William Taylor of 46 Eastfield Drive said she had come to the Council meeting to protest the reduction of speed limit on Crest Road. She reported that in travelling between Eastfield Drive and the Crenshaw gate at 25 miles per hour, she had found it necessary to apply the brake 18 times to remain within the speed limit. While doing so, she said,, other cars passed her; in. order to pass they had to ex- ceed the speed limit and were a hazard to other drivers and to people riding horseback. Mrs. Taylor said that she encourages her daughter to ride her horse along Crest Road where the sight distance is good, but in view of her recent observations she felt children and riders on Crest Road will be endgngered. by impatient drivers who try to pass drivers observing the new speed limit. Mrs. Taylor concluded by say- ing that she realized that the Cour+cil probably was adament in their decision, but said .she wanted to enter the protest. Councilman Hesse stated that in his five years on the City Council he found them not adament, but they attempted to approach all items with an open mind, and evaluated all: decisions thoroughly. He said, further, that the Motor Vehicle Code specified 25 mph for resi- dential areas, therefore the speed limit on Crest Road could not be considered unreasonable Councilman Bear said he had received calls from residents about the reduced speed limit, and he found that there are as many people in favor of the change as there are opposed to it. All agree that it is not easy to travel at the reduced speed, but it can be done, and he said, further, that he doesn't think increasing the speed limit to 30 or 35 mph would take care of or eliminate the problem of speeding on Crest Road. It will always remain a problem, he said; in spite of the posted speed limit, certain drivers will always exceed the limit and endanger others using the road.. Councilman Pearson agreed that the speed limit will control the law abiding residents rather than the real speeders, but he said he considers it necessary on Crest Road and Portuguese Bend Road downhill because of the foliage and blind' driveways on those roads. The total difference in. time necessary to drive the entire length of Crest Road between gates does not exceed three minutes, he said-. Before the April. 26, 1.971 decision was made, Councilman Pearson said all facts were reviewed, test drives were made by members of -the City Council. He said.the Council is not inflexible, but because of the number of accidents on Crest Road and the number of animals that have been killed or injured, he considers the decision a wise one. The City Manager stated that after the ordinance was adopted residents were advised in the newsletter of the change. Subsequently, notices were handed out at all gates advising of the changes in speed limits, and when. the ordinance became effective thirty days after adoption she requested that the sheriff rigidly enforce the lawn Many residents have called relative to the reduction, both pro and con, and she has asked thea to write or appear before the Council to protest if they wish to do so. Mayor Sauer said Councilman :Bear and the City Manager are work- ing with the Sheriff on traffic safety in. Rolling Hills, and he asked Councilman Pear to discuss the matter again with,the Sheriffo MATTERS FROM CITY OFFICERS Bicycle Paths on Palos Verdes Peninsula The City Manager advised that many resolutions have been received from organizations supporting bicycle paths ©n the Peninsula, and all information has been transmitted to Councilman Bear, who has agreed to represent. the Council on the matter. Spark Arresters Mrs. Clifton annunced that spark arresters are arresters are being installed by many residents who have either done the installation themselves or have hired Mr. Roger Vin.k, Maintenance Supervisor for the City, to do the work for them. Inspection of all homes for compliance with the ordinance will commence after the effective date, June 20, 1971 Mrs. Clifton. said. Documentary Tax Transfers The City Attorney advised the Council that.the City could, by adopting an ordinance, qualify for a portion of the documentery trans- fer tax That presently is paid to the State. A motion to authorize the City Attorney to prepare the necessary ordinance was made by Councilman, Hesse, seconded by Councilman, Bear and carried unanimouslyo ADJOURNMENT There being no further business to come before the meeting, a motion for adjournment was made at 9;25 P.M. by Councilman Hesse, seconded by Councilman.
