11/22/1971�_ i I I MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL CITY OF ROILING HILLS, CALIFORNIA November 22, 1971 A regular meeting of the City Council of the City of Rolling Rills was called to order by Mayor Sauer at the Administration Build- ing, 2 Portuguese Bend Road, Rolling Hills, California at 7030 PeM. Monday, November. 22, 1971. Ziegler League of Women Voters APPROVAL OF MINUTES A motion to approve the minutes of the meeting of November 8th as corrected was made by -Councilman Bear,_ seconded by Councilman Pear- son and carried by the following roll call vote: AYES: Councilmen.Bear, Fay, Pearson, Mayor Sauer NOES: None " ABSENT: Councilman.Hesse CITY MANAGER (ITEMS HELD OVER FROM NOVEMBER_ 8 , 1971) Regional Planning Commission, Special Permit 2116-(4) Mayor Sauer ordered the matter removed from the agenda. Regional Planning Commission, Special Permit 2136-(4) The Manager presented a copy of a letter dated November 12, 1971 from the Board of Supervisors to Mrs. Dorothy Le Conte, Co -Chairman of Save Our Coastline. The letter advised that at the meeting of November 9, 1971 the Board of Supervisors sustained the decision of the Regional Planning Commission and granted a special permit subject to 30 conditions. The developer had requested permission to develop 470 townhouse and apart- ment units on a 54 acre parcel- at the intersection of Palos Verdes Dr, West and Hawthorne Boulevard. One of the conditions specified that the total be reduced to 454 units, with the further stipulation that only 300 units be developed, with the balance of 154 being developed after a second access is provided.. Councilman Bear moved that the Council send a letter, signed by the Mayor, expressing their- disapproval of repeated granting of permission for multiple dwellings, in spite of protest from many sources. The motion was seconded by Councilman Fay, and carried 'by the following roll call vote: AYES-, Councilmen NOES: None ABSENT: Councilman Bear, Fay, Pearson, Mayor Sauer Hesse 300 Nove!�ber 22, 1971 Councilman Bear stated further that the Council should express approval when the Board of Supervisors or Regional Planning act in accordance with the wishes of the Rolling Hills City Council legional Planning Commission, Tentative Tract 28758 Mrs Clifton reported that Tentative Tract 28758 for a condo- minium development of 385 units on 31.4 acres at Highridge Road and Hawthorne Boulevard had been considered.by .the Subdivision Committee on Friday, November 5th, and was referred to the Regional Planning Commission for hearing on Tuesday, November 9th. Mrs. Clifton. said the City of Rolling Hills had not been notified of the hearing in advance, and she had protested it, and she spa i d that SOC h�3.3'protested the lack of public notification for subdivision applications for which no zone change or special permit is necessary, and requested that such items be made part of the for- mal written agenda. The Manager distributed copies of a letter dated November 9th which she had delivered to Region.a:l. Planra)in.g. Commission by messenger, protesting lack of notification of the meeting, and requesting that certain conditions be included in the tract. Mayor Sauer ordered the matter held on the agenda. Local Agency Formation Commission Annexation, City of Rolling Hills Annexation, City of Rolling Hills Estates Incorporation, City of Rancho Palos Verdes Incorporation, City of San. Pedro Hills Mayor Sauer ordered the matter held on the agenda. Tennis Court Councilman Pearson reported that the pians are essentially ready for presentation. He said he would meet with the Tennis Com- mittee and report to the Council. Mayor Sauer ordered the matter held on the agenda. Riding Ring at City Park Councilman Pearson said that he would report to the Council after he, Mayor Sauer and Mr. Coret.te, president of Caballeros, inspect the facilities at Flintridge. The Mayor ordered the matter held on the agenda. SUBDIVISION NO. 48, Tract 29394, Dr. E. J. Weisenheimer Dr. Weisenheimer advised tl. Counicil that he wished to ask relief .from conditions imposed at the Council meeting of November 8th for undergrounding the utilities on. his property. Dr. Weisenhiemer had been directed to provide for undergroun.din.g the utilities serving his horse from the residence to pole A -3355-Y, thence to pole A -3353-Y; although his service would be underground, the pones on his property would remain because they serve other homes in the area. Councilman Bear -asked whether all members of the Council had read Councilman Hesse's memo recommending that the ordinance of the city be applied and no relief given. Dr. Weisenheimer stated that to do So would cost $21,000. Councilman Pearson asked what other improve- ments were required for the subdivision, and the Manager reported that Dr. Weisenh&imer was required at o improve a portion of Portuguese Bend Road and the drainage in the area, at a cost of approximately $1,500. -2- November 22, 1971 Councilman Pearson moved that Dr. Weisenheimer be required to make the necessary financial arrangements to provide for undergrounding between pole A -3353-Y and A -3354-Y, and between pole A -3355-Y and the residence, and that a bond in the amount of $2,500 be posted with the City for a period of three years for future undergrounding between poles A -3354-Y and A -3355-Y..• Further, if the 8209 conversion takes place within the first year, he recommends that Dr. Weisenheimer work with the Edison Company to have the pole A -3353-Y removed at the same time. If the Edison Company does not do the conversion within the first year, Councilman Pearson said Dr. Weisenheimer should be required to provide the undergrounding between poles A -3353-Y and A -3354-Y, and between pole A -3355-Y and his home. The motion was seconded by Councilman Bear and carried by the following roll call vote: AYES: Councilmen Bear, Fay, Pearson, Mayor Sauer NOES: None ABSENT: Councilman Hesse Southern California Edison Company - Underground Distribution Facilities The Manager explained that a committee had been appointed, con- sisting of two members of the Council, the City Attorney, the City Manager and representatives of Southern California Edison Company, to consider locations within the City of Rolling Hills eligible for the 8209 Underground Conversion Funds. One of the areas meeting requirements of undergrounding utilities for a minimum of 600' is the area on Portu- guese Bend Road in the vicinity of the Hahn and Weisenheimer properties, another is Portuguese Bend Road in the vicinity of the Saffo property. Southern California Edison Company had advised the Manager that Portu- guese Bend Road in the vicinity of the Weisenheimer and Hahn properties would provide easy access and use of trenching equipment, and meets the criteria as a heavily traveled -thoroughfare used by the general public. Mayor Sauer ordered the : mat.ter he lod on3 _ the agenda.---., CITY MANAGER (NEW BUSINESS) c Martin & Chapman: Mrs. Clifton presented a letter dated November.4, 1971 from Martin.& Chapman Co., election suppliers, offering a proposal in the amount of $261.91 for the Municipal Election to beheld onApri.l 11. Mrs. Clifton said the proposal is less than the amount included in the budget, and the City has always had good service from Martin & Chapman. A motion to accept the proposal by Martin and Chapman was made by Councilman Fay, seconded by Councilman Bear and carried by the fol- lowing roll call vote: AYES: Councilmen Bear, Fay, Pearson, Mayor Sauer NOES: None ABSENT: Councilman Hesse Department of Real Estate Management, Los(Ang,eles_County A letter from the Department of Real Estate Management, Los Angeles County, giving notice of excess County -owned -property being processed for sale was presented to the Council. -,-Mrs. Clifton advised that the property affected is excess property at the Fire Department location on Crest Road West. The City Attorney advised that it -would be.contrary to City ordinance -to -dispose of a portion of the property.. Mayor Sauer_ directed°the City Attorney to write a letter -advising the Department of Real -Estate that the property could not be disposed of by them. -3- November 22, 1971 Los Angeles County Flood Control District A copy of the Supplemental Agreement to Agreement No. 18374 between the City,of Rolling Hills and the Flood Control District was presented to the City Council. The City Attorney advised that he had reviewed the agreement, and found it in good order. A motion to authorize the execution of the supplemental agree- ment was made by Councilman Pearson, seconded by Councilman Fay and carried by the following roll call vote: AYES: Councilmen Bear, Fay, Pearson, Mayor Sauer NOES: None ABSENT: Councilman Hesse COMMUNICATIONS Mr. Gordon Shultz A notice of abandonment of appeal dated November 17,'101 from Mr. Gordon Shultz, 10 Johns Canyon Road, was presented to the Council. Mr.]Shultz advised that he wished to abandon the request for appeal to the City Council from the decision of the Planning Commis- sion on Zoning Case No. 103. Mayor Sauer set Monday, December 13, 1971 as the date of the Public Hearing to dispose of the matter, and advised that it would be part of the regular business of the Council meeting on that date. The Mayor directed the Manager to advise all residents through the Newsletter of Mr. Shultz's action in abandoning the appeal, and to notify them that a public hearing would be held in compliance with the City's ordinances to routinely dispose of the matter. South Bay Councilman's Association The minutes of the meeting of October 28, 1971 of the South Bay Councilmen's Association regarding formation of the South Bay Cities Association were presented to the Council. In the several plans submitted, the cities of Palos Verdes Estates and Rolling Hills Estates remained in the 28th. Congressional District, and Rolling Hills was placed in. the 35th District. In. response to a request by Mayor -Sauer, and supported unanimously by the other Mayors in attendance, the boundaries were re -drawn and Rolling Hills remains in the 28th District, and the Peninsula is intact Mayor Sauer requested that the City Manager prepare a letter for his signature, thanking all the Mayors for their support of the request.
