Building, 2 Portuguese Bend Road, Rolling Hills, California at 7:30 Y.M. Tuesday, December 14, 1971. ROLL CALL,. PRESENT: Councilmen Fay, Hesse, Pearson., Mayor Sauer Councilman Bear arrived at 8:35 P..M, ABSENT. Bay Engineering Corp, Mr. Mike Toll Resident Mrs. Florence Ziegler League of Women Voters APPROVAL OF -MINUTES ,The City Attorney requested that the words "Zoning and Subdivision" be inserted in paragraph 2,."page 3, Department of Real Estate. Councilman Hesse asked that the minutes be amended to include the following paragraph: "Councilman Bear asked wheither all members of the Council had read Councilman Hesse's memo recommending that the ordi- nance of the city be applied and no relief given. Dr. We*isenheimer stated that to do so would cost $21,000. Councilman Pearson asked what other improvements were required for the subdivision'. and the Manager . reported that Dr. Weisenheimer was required to improve a portion of Portuguese Bend Road and the drainage in the area, at a cost of approximately $1,500" between paragraphs I and 3, page 2, Subdivision No. 48. A motion to approve the minutes -as amended was made by Councilman Hesse, seconded by Councilman Fay, and carried by the following roll call vote: AYES: Councilmen Fay, Hesse, Pearson, Mayor Sauer NOES: None ABSENT: Councilman Bear CITY- MANAGER .(ITEMS. HELD OVER- FRPM -NOVEMBER 229 1971) Regional Planning Commissions, Special Permit 2136-(4) Mayor Sauer advised the Council that he had written to Supervisor Burton Chace protesting'approval, of Special Permit Case 2136-(4) and other multiple unit developments without regard to the economic, consequences of numerous units approval. A copy,of.the Mayor's letter was given to all Councilmen.. Mayor Sauer ordered the matter removed from the agenda. Regional Planning Commission, Tentative. Tract 28758 Mrs. Clifton reported that she had been advised by the Planning Advisor that the tract at Hawthorne Boulevard and Highridge Road had been approved and recorded, and that work was proceeding.- Mayor Sauer ordered the matter-femoved from the agenda. 30--B December 1.4, 1971 Regional Planning Commission, Tentative Tract 29929 The Manager said the P�' a.nning Advisor had reported that a re- vised map had been filed on the property at Seacove Drive south of Palos Verdes Drive South, and. was scheduled for hearing on December 31st, Mayor Sauer ordered the matter held on the agenda. Annexation, City of Rolling Hills Annexation, City of Rolling Hills Estates Incorporation, City of Rancho Palos Verdes Incorporation, City of San Pedro Hills Mayor Sauer ordered the matter held on the agendas Tennis Court Councilman Pearson reported that- the plans for the tennis court had been. given. to Dr, Richard Hoffman, chairman of the. tennis committee, and he was waiting for a report from the committee. Mayor Sauer ordered the matter held on the agenda. Riding Ring at City Park Councilman Pearson said he is waiting for commen.ts'from the Cab- alleros. Mrs. Clifton asked whether any consideration had been given to the De.lio property on Blackwater Canyon•Roado Councilman Pearson said it had been mentioned as a possible location for a new ring, but had not been considered by the committee; he said he would ask them to consider it. Mayor Sauer ordered the .matter held on the agenda. CITY MANAGER (NEW BUSINESS) Mrs. Clifton presented a map furnished by Regional Planning Commission, and a Notice of Public Hearing before the Zoning Board to be held on December 23, 1971 for development of a 1,571 unit resi- dential complex on a 135 acre parcel, southerly side of Palos Verdes Drive South Following discussion of the request, Councilman Hesse moved that the Rolling Hills City Council express to the Zoning Board of the Regional Planning Commission._9 the Regional Planning Commission, and if necessary, the Board of Supervisors if the matter goes that far, its protest of the proposal because of the negative impact on the Palos Verdes Peninsula the proposal would have with regard to density, traffic, schools and library requirements, and that protest be expressed by letter from the Mayor to the Chairman., and that the matter be presented not only in writing, but by oral testimony pre- sented by a member of the City Council appointed to represent the City in this matter. The motion was seconded by Councilman. Fay and carried by the following roll call -vote: AYES: Councilmen Bear, Fay, Hesse, Pearson, Mayor Sauer NOES: Nome ABSENT: None. The Managers' advised that the matter would then be heard before the Sulbdivi..sion Committee of Regional Planning on December 31, 19710 Mayor Sauer requested Counci,l.man, Hesse to attend the Public Hearing before the Zoning Board on December 23rd and give testimony on behalf of the City Council, and said he would attend the meeting of the Sub- division Committee on December 31st. The matter was held on the agenda. -2- December 14, 1971 Mr. andMrso MarkFriedman° Motorcycle Noise Mrs. Clifton presented a letter dated November 27, 1971 from Mr..and Mrs. Mark Friedman, II..Fl.ying Mane Road, relative to increasing motorcycle noise in the vicinity of their home. They referred to 3 or 4 youngsters in particular, and requested that the matter be referred to the Traffic Committee for enforcement of the ordinance. Mrs. Clifton said she made inquiries and learned the identity of the youngsters, contacted their parents, and has been promised co- operationo She said, further, that a newsletter was being prepared, and she would make reference to Ordinance No. 85, which regulates oper- ation of motorcycles or motordriven cycles. Further, Mrs. Clifton said she plans to write a newsletter soon after the first of the year explain- ing other ordinances recently adopted. by the City Council. Mr. Hubert Toll, 1.Eastfiel.d Drive-: Underground Utilities CO The City Manager presented a letter dated December 8, 1971 Q from Harold'Weinman, Building Engineering Inspector, Los Angeles Coun- ty Department of County Engineer, advising that he had discussed Ca overhead service installation methods with Mr. Mike Toll, 1 Eastfield Drive. Mrs. Clifton.explained that Mr. -Toll was in the process of adding to his residence, and she had been advised by the City Eniineer that overhead utilities had been installed, contrary to the City s ordinance, which specifies underground utilities on all new construc- tion or residence additions. Mrs. Clifton said that in all cases where the service within the home had to 'be changed, underground in- stallation was a requirement; however, no change is required in minor construction that does not require a change of existing service. Mr. Toll addressed the Council and asked relief from -the requirement because of the hardship of digging into a slope which is not compacted, and is attractively landscaped; he stated that his request was not based on financial reasons. Following a discussion, Councilman Fay moved that Mr- Toll's' request for relief be denied, and that he be granted additional time to comply with the City's ordinance, and further, that the improvement be completed by August 1972, and that a bond covering the improvement be required of Mr. Toll. The motion was seconded by Councilman Pear- son and carried by the following roll call vote AYES: Councilmen Fay, Hesse, Pearson, Mayor Sauer NOES° None ABSENT: Councilman.Bear Councilman.Bear arrived at the meeting at 8:35 P.M. after voting on the matter had been completed. Mr. Walter Kessenick, South Baggy Egineerin� Mr. Walter Kessenick., South ;Say Engineering Corporation, presented a map showing a 1.5 acre parcel owned by.the.Daughters of Mary and.J"oseph, his clients, on which they maintain and operate a retreat and novitiate. Mr. Kessenick explained that of the 15 acres total, 2.2+ acres lie within the boundaries of the City of Rolling Hills; access to the parcel is from Crest Road "outside of the City Mr. Kessenick explained that because the land is excessive for their needs, his client wishes to dispose of approximately five acres in the rear of the property in the County area, and before approving a tentative map, the County Engineer required assurance that the City of Rolling Hills --dial n.otobject to the proposal. Following a discussion of the property, the Mayor asked Mr. Kessenick to furnish additional -information to the Council on the proposed use of the property, and held the matter on the agenda. 030 0 December 149 1971 PUBLIC HARING, Mr. Gordon Shultz Mayor Sauer opened the public hearing on the matter of the abandonment by Mr. Gordon Shultz, 10 Johns Canyon Road, of his appeal before the City Council for relief from the recommendations of the Planning Commission following the Public Hearing on September 21, 1971 on his request for a change of zone to RPD'2 for a portion of his pro- perty. The Mayor asked if there was anyone present who wished to speak for or against the meeting. Ther.` was.no one; the Mayor thereafter closed the Public Hearing. Councilman Bear moved that the City Council accept the recom- mendations of the Planning Commission following the Public Hearing on September 21, 1971 that the application of Mr. Gordon.Shultz, 10 Johns Canyon Road, requesting that a portion of his property be're-zoned to RPD -2 be denied. The motion was seconded by Councilman.Fay and carried by the following roll call vote: AYES: Councilmen NOES- None ABSENT: None COMIUNICATI:ONS League of California Cities, Bear, Fay, Hesse, Pearson, Mayor -Sauer Mrs. Clifton presented a letter dated November 29, 1971 from the League of Cal.iforni.a Cities requesting that members of the City Council review the'list ®f committees to be appointed, and volunteer for service. Councilman.Bear said he wished to serve on the Employee/Employ- er Relations Committee; Councilmen Hesse and Pearson said they wished to be on the Environmental Quality Committee; Shoreline Preservation Task Force, Councilmen Pearson and Hesse. The report was received and filed. Statistical Summarv, Sheriff's Department The Sheriff's statistical report of traffic enforcement within Rolling Hills for the month of October 1971 was presented to the Coun- cil. The report was received and filed. Chief Administrative Officer A letter dated December 13, 1971 from the Chief Administrative Officer was presented to the Council. Tiro Chapman Bone, County -City Coordinator, advised that the Animal Control Services Agreement in effect between the County of Los Angeles and the City of Rolling Hills is due to expire on June 30, 1972 unless notification is given to the County by December 31, 1971. A motion to adopt ResNo. 276 renewing the contract be- tween the City.of Rolling Halls ana the County of Los Angeles for. Animal Control Services was made by Councilman Pearson, seconded by. Councilman Bear and carried by the following roll call vote: AYES: NOES. ABSENT: CITY ATTORNEY Councilmen Bear, Fay, Hesse, Pearson, Mayor Sauer None None Vicious Dog Compain,t The City Attorney advised the Council that a complaint against a vicious dog owned by Mr. and Mrs. Tom''Roba, 7 Packsaddle Road West had been entered on November 16, 1971 by Mr. Jay Foster, inspector for -5- 309', 310 December 14, 1971 Chick's Termite Control., who was attacked by the Robas' dog when he attempted. to 'keep an appointment at their home. A certified letter advising Mr. Raba of the incident, as required by Ordinance No. 79, was returned unclaimed by the Post Office Department. The Manager reported, that she had advised Mr. Roba by telephone that the complaint had been entered and a copy of the ordinance had been sent with the certified letter. She said., also., that. Mrs, Roba was notified of the change of date of the Cou-1dil meeting. Mr. Rialey said he had discussed the matter with Mr. Roba, and he told Mr. Finley he wished to appear before the Council and categorically deny the charges in the affidavits Mayor Sauer asked if Mr. Roba was present, he was not. The Mayor then said he would accept a motion that the District Attorney not proceed with the com- plaint. There was none. The Mayor then held the matter on the agenda for action by the District Attorney. Flying 'triangle m Geology Mrs. Clifton presented, a copy of a letter dated November 23, 1971 from Robert Mo Moller, Department of County Engineer, Los Angeles advising that it is the intent of the Geology Section of the County Engineer to permit construction in the mapped Flying Triangle ancient slide area without recordation of a slide waiver. Mro William Rin.ley, City Attorney, explained that it would be necessary for the City Council to pass an ordinance amending the present Building Ordinance of the City of Rolling Hills to permit the construction referred to in Mr. Moller's letter, and he distributed copies of a proposed ordinance After discussion of the ordinance, Mayor Sauer ordered the matter held on the agenda. ADJOURNMENT There being no further business to come before the meeting, a motion for adjournment was made at 11:05 P.M. by Councilman.
