2/14/1972L 1 32 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA February 14, 1972 A regular meeting of.th.e City Council of the City of Rolling Hills was called to order by Mayor Sauer at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California at 7:30 P.M. Monday, February 14, 1972. A motion to approve them'inutes as corrected was made by Council- man Bear, seconded by Councilman Pearson and carried by the following roll call vote: .AYES: Councilmen NOES: None . ABSENT: Councilman PERSONAL APPEARANCES Bear, Fay, Pearson, Mayor Sauer Hesse Mr. and Mrs. Steven Gunnells of Torrance advised Mayor Sauer that they were present to request a badge to enable them to ride on the trails in Rolling Hills after March 1, 1972. The Mayor advised them - that the trails are under the jurisdiction of the Rolling Hills Commun- ity Association, and suggested that Mr. Gunnells contact Mrs. Clifton about trail badge procedure. CITY MANAGER (ITEMS HELD OVER FROM JANPARY 10, 1972) Regional Planning Commission, Te��taive bract 29929 The Manager advised the�.Council that the tentative map for proposed development of 90 condominium units in 21 buildings on 7.49 acres on Seacove Drive, south of Palos'`Jetdes-Drive South will'be considered by Regional Planning in August, 1972. Mayor Sauer requested that the matter be removed from the agenda until August, and returned at that time. Regional Planning Commission, Tentative Tract 27187 The Manager reported that she had attended a Subdivision Committee meeting at which Tentative Tract 27187, development of a 1,571 unit residential complex on 135 acres south of Palos Verdes Drive South was considered. 328 Mrs. Clifton, said that -the developer, Mr. S. D. Zuckerman., had purchased a strip of land 12' wide from Palos Verdes Properties for access to the beach. Additional access on the opposite side of the development will be coordinated with_the County Department of Parks and Recreation, and, both accesslocations will be accurately shown on the recorded .final map The Fire Department has required access easements for ingress and egress in, the form of 15' paved roads, and sidewalks, curbs and gutters will be required on. Paseo del Mar in the area of an existing school site. There are still. some problems with geology in the area of the golf cotirse, Mrs. Clifton said, and geologic: reports have not received final .County approval. Mayor Satter ordered the --matter held on the agenda Regional Planning Commissions Tentative Tract 27837 Mrs. Clifton advised the Council that she had also attended a meeting of the Subdivision Committee at which Tentative Tract 27187 for development of 478 townhouses on. the west side of Palos Verdes Drive West between Berry Hill Drive and Rue Beaupre was discussed. The matter of beach easements was discussed extensively, Mrs. Clifton reported, and it was noted that access could be provided from public streets. A requirement that five feet of additional land on Palos Verdes Drive West be dedicated for road purposes had not been. acted on by the Road Department, a•nd..the Manager requested that consid- eration. be given to construction. of a bicycle path in the area. Mrs. Clifton. advised further that on February 10th she wrote to Regional Planning Commission., and advised. Mr. 0. R. Christenson that it was vital that the additional space remain, a condition. of approval to ensure its availability for public use. Mayor Sauer ordered the.matter held on the agenda. lesional Planning Commissions Parcel Map #2601 The Manager advised the Council that the parcel map for the property owned by the Daughters of Mary and Joseph on Crest Road, outside the City of ,Rolling Hills, had gone to record and was now offered for sale at $20,000 per acre. The zoning is presently R -A-2-0,000. Mayor Sauer ordered the matter removed from the agenda. Regional Planning Commission, Conditional Use Permit No. 31-4 Mrs. -Clifton advised the Council that a request for a con- ditional use permit to develop three 4-plex structures on the north- easterly corner of South. Hawthorne Boulevard and South Indian Valley Road had been denied by the Regional, Planning Commission. Mayor Sauer requested that the Manager prepare a letter to the Regional Planning Commission, with a,Sopy to Supervisor Burton Chace for the Mayor's signature, thanking them for the decision denying the conditional use permit. The: matter was ordered removed from the agenda. Regional_Plannini Commission, Revised Tentative Map, Tract 27201 The Manager advised that a revised tentative map for Tract 27201, Hawthorne Boulevard and Highridge Road, was approved by Regional Planning on. January 18, 1972. Mayor Sauer ordered the matter removed. .from the agenda -2- i February 14, 1972 Tennis Court 32= Councilman Pearson reported that the plans for additional tennis facilities prepared for the City had been loaned to the Tennis Committee so.that bids could be obtained. After the bids are submitted to the City a method of financing the additions would be studied. He T explained that at present it is difficult to discuss the matter of financing, because the dol.lares required are not known. Mayor Sauer ordered the matter held on the agenda. Riding Ring Mayor Sauer welcomed Mr. Robert Fortney and Mr. William Corette to the meeting and thanked them for the letter from the committee that is studying the need for additional equestrian facilities. Dated January 18, 1972, and addressed to the Board of Directors of the Rolling Hills Community Association, copies of the letter had also been distri- buted to the Council. The committee recommended that all subdivisions be required. to pay a recreation tax or donate property for city recreational pur- poses, and proposed five option's for. -additional facilities. Councilman Pearson said he had worked with both the tennis and equestrian committees during the past year, and it was his opinion that the time had come when a committee composed of members of the City Council and the Board of Directors should meet with the committees of residents to finalize the needs and plans. He referred to Councilman Fred Hesse's letter dated February 4, 1972 to Vernon M. Fay, President of the Board of Direbtors, and said copies had also been sent to mem- bers of the Council. Mayor Sauer requested the Manager to contact members of the Council and Board and set up a meeting for the purpose of discussing the recommendations of the tennis and equestrian committees. He ord- ered the matter held on the agenda. CITY MANAGER. `(NEW BUSINESS) League of California Cities - City Managers Meeting A motion to approve the City Manager's attendance at the City Managers Department of the League of California Cities Spring Meeting was made by Councilman Bear. The meeting will be held March 8-10 at the Hotel del Coronado. The motion was seconded by Councilman Pearson and carried by the following roll call vote: ' AYES: Councilmen Bear, Fay, Pearson., Mayor Sauer NOES: None ABSENT: Councilman Hes45e Joint Powers Agreement,. City of Torrance The Manager advised the Council that under the Joint Powers Agreement, services and equipment could be obtained from the City of Torrance for work on trees within the City of Rolling Hills. At the request of the Rolling Hills Community Association, Mrs. Clifton had obtained estimates that were approved by the Board of Directors. She explained that the charges will include all labor, equipment and insurance charges, and the City of Rolling Hills would be billed by the City of Torrance. Assembly Bill No. 1 relating to school bus safety, specifically mandatory seat belts and padded head,r°estraints had been endorsed by Resolution of the Lomita City Council and the South Bay Councilmen's Association. The resolutions were received and noted. Southern California Association of Governments Mrs. Clifton said Councilman Nesse had advised her that he would have copies of his report on Southern California Regional Aviation Systems Study delivered to members of the Council prior to the next regular meeting of the'Councilo t Mayor Sauer ordered the -matter held on the agenda. COMMUNICATIONS Mrs. Erle R. Kelso A letter dated February 1, 1972 from Mrs. Erle R. Kelso, 68 Saddleback Road, was presented to ;the Council. Mrs. Kelso reported that her dog and cat have been attacked in her yard by large roaming dogs; she requested that the Council consider a leash law to prevent such attacks on both residents and animals, and to protect private.property. In the discussion that followed, Mayor Sauer reported that members of his family had been bitten, and the Manager reported that the number of attacks reported to the Administration Office have in- creased noticeably during the past six months. Councilman Fay said he felt that Ordinance No. 79 which provides for impounding dogs after an attack if the person who was attacked signs an affidavit took care of the matter, Mr. William Kinley, City Attorney, said that in his opinion it is unenforcable, and it was his recommendation that the only satisfactory solution would be adoption of a leash law. He explained that the District Attorney does not have the nime or man- power to enforce the ordinance of the City of Rolling Hills because of the pressure of more serious cases. On the recommendation of the City Attorney, Mayor Sauer held the matter on the agenda for study by_a Committee to review the need for a leash law. The Mayor requested that Councilman Bear chair the committee. Underground Utilities_, Southertr Cali ornia Edison Compal Mrs. Clifton presented a revised tentative map for Tract 29408, Richard Colyear, 37 Crest Road, and advised the Council that it is Mr. Colyear's wish to provide underground utilities on his property which was recently subdivided. However, the pole serving his home would have to remain, because the driveway of his neighbor, Mr. Carl Ghaormley, 2 Johns Canyon Road, is in the easement, and it would not be possible to relocate the pole without damaging the drive- way. -4- February 14, 1972 Following a discussion, the Mayor requested that the Manager contact Mr. Ghormley and ask him if he would 'be willing to provide underground utilities to the building on his property served by the pole, thereby eliminating the pole.... The matter was held on, the agenda. RESOLUTION NO. 277 Councilman Pearson moved that Resolution No. 277 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALI- FORNIA, CALLING AND GIVING NOTICE OF TUE HOLDING OF A GENERAL MUNI- CIPAL ELECTION TO BE 'HELD IN SAID CITY ON TUESDAY, THE 11TH DAY OF APRIL., 19729 FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES be adopted, and that reading in full be waived. TO THE CITY OF ROLLING HILLS RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON APRIL 11, 1972 be adopted, and that reading in full be waived. CITY ATTORNEY Proposed Ordinance, Traffic The City Attorney distrIbutecl copies of the proposed ordinance to amend the Traffic Ordinance of the City and requested that the Council members review it before the'iiext meeting of the Council. The Mayor ordered it held on the agenda. ORDINANCE NO..- 103 Councilman Fay moved that Ordinance No. 103 entitled AN ORDI- NANCE OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS AMENDING ORDI- NANCE NO. U-8 PROVIDING FOR A POUNDMASTER FOR THE LICENSING OF DOGS AND FOR THE IMPOUNDING OF DOGS AND OTHER ANIMALS, introduced at the meeting of January 24, 1972, be adopted and that reading in full be waived. -6- 3 33 February 14, 1972 The motion was seconded -by Councilman Pearson and carried by the following roll. call vote: AYES: Councilmen Bear, Fay, Pearson, Mayor Sauer NOES: None ABSENT: Councilman Hesse Ordinance No. 91, Animals and Fowl Mrs. Clifton requested that the comments by Mr. Seymour Barfield, Public Health Sanitarian for Los Angeles County, on Ordinance No. 91, Animals and Fowl, be held on the agenda. She explained that his recommendation relating to the design of manure bins had been referred to the Architectural Committee of the Rolling Hills Community Association., and she wished to have their comments for review with the City Council. ,-� Mayor Sauer ordered the matter held on the agenda. tD 0 Mr. Tom Roba, 7 Packsaddle Road West, Vicious Dog Complaint Mr. Kinley reported that Mr. Roba had advised him that, C contrary to the statement in the affidavit filed by the man bitten by the Robas' dog, the man had not been invited to come to his home, and therefore he was trespassing, when bitten. The District Attorney advised Mr. Kin.ley that he had contacted Mr. Roba, who told him essentially the same story, and in addition, said the dog had recently been returned from a veterinarian after receiving rabies immunization. Because there was no question about the rabies shot, the District At- torney advised Mr. Kinley that there would be no further action on the case. Mayor Sauer ordered the matter removed from the agenda. MATTERS FROM CITY COUNCIL SCAG Councilman Fay reported -that he had recently represented the City at the SCAG meeting. The purpose of the meeting was'to determine whether SCAG would be eliminated as an organization or would grow. Representatives of cities attending the meeting voted 48 to 24 to support SCAG because of the advantages of regional representation rather than individual city activity, Councilman Fay said. He explained that management of such projects as transportation, pollution, airports, etc. would be more effective under the direction of SCAG, because of their ability to borrow money not available to individual cities or counties. Further, he reported, there is activity in the Legislature that, if passed, would require mandatory participation by all cities in southern California. Many cities including Palos Verdes Estates are not members of the organizatirYLiz., Mr. Fay said, but would benefit from any improvements; therefore, membership in the organization would no longer 'be on a voluntary basis.. . .. Mayor Sauer thanked Couhcilman Fay for his report. CREST ROAD a Councilman Bear asked fQr a report on. progress of work on Crest Road by the California Water Service Company. Mrs. Clifton reported that at present mortar is being spun into the lines, and the excavations are being kept open to aid the drying process. She said that because of the safety hazards, a pro- fessional guard system had been hired by the water company, and men -7- 3,3 4 February 14, 1972 with walkie-talkies regulate the traffic. Although there is some inconvenience, Mrs. Clifton reported -hat there is very rigid control of the safety of the operation. She said she had been advised that it was the wish of the California Water Service Company to have the major portion. of the work completed 'by Friday, February 18th, because of the three day weekend. Paving would be done in a few weeks, Mrs. Clifton said, after a period allowed for settling and compacting. Work would be done in the Possum Ridge area in the next increment of improvements scheduling, and further work on other areas of Crest.Rd. would not be done until Fall of 1972 or Spring of 1.973, she said. MATTERS FROM CITY OFFICERS West Basin Water Association. Mrs. Clifton reported that the Basin Water Association would he held 1972 at Palos Verdes Country Club. Rabies Vaccine Clinic annual meeting of the West on. Thursday evening, February 24, Mrs. Clifton reported that theRabies Vaccine Clinic would be held on Thursday, August 23, 1972 at Dapplegray School. ADJOURNMENT There being no further business to come before the meeting, Mayor Sauer recessed the meeting to a personnel session at 10:00 P.M.
