3/13/1972342 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA March 13, 1972 A regular meeting of the City Council of the City of was called to order by Mayor Sauer at the Administration 2 Portuguese Bend Road, Rolling Hills, California at 7:30 March 13, 1972. After the dicussion, the matter was referred to the City Attorney for investigation as soon as copies of tax bills of the City Council are received by him. Ordered held on the agenda. 1. Mr. Thomas Heinsheimer, 7 .Johns Canyon Road and a member of the Planning Commission of the City of Rolling Hills, requested clarification of the Council's decision on February 28, 1972 to permit access from Portuguese Bend Road to V. R. Turcotte's new residence proposed for the corner of Portuguese Bend and Wagon Lane. Mr. Heinsheimer stated that the Planning Commission had recommended, access be denied because the Commission opposes unnecessary access to major thoroughfares in the Community, and adequate access for the new residence could be via Wagon Lane. The Mayor stated that the Planning Commission would be advised by the staff as soon as possible other facts that had been brought to the attention of the Council that had not been received by the Planning commission. 2. Mr. Heinsheimer asked if the Council "ill will" that mi0 t be created among the other in the Association s levying a charge for other the trails in Rolling Hills. TENTATIVE TRACT 26964 - GORDON SHULTZ - SUBDIVISION NO. 54 Mayor Sauer opened a discussion of Tentative Tract 26964, Gordon Shultz 10 Johns Canyon Road, which had been approved by the Planning Commission at the meeting of February 15, 1972 subject to;conditions contained in the Planning Advisor's Report dated January 24°, 1972, as amended by the Planning Commission. Mr. Clark Leonard, Lanco Engineering Company, stated that the Planning Commission had approved Mr. Shultz's request to record the tract in two separate units; the first unit consisting of Lots 1, 2, 3, 4, 8 and 9 and the second unit consisting of Lots 5, 6 and 7. Mr. Pearson moved that tentative tract 26964 be approved according to Planning Advisor's Report dated January 24, 1972, as amended with the additional provision that subdivider may extend the paved road and cul-de-sac further north as far as subdivider desires. The motion was seconded by Mr. Bear and carried by the following roll call vote: AYES: Councilmen Bear, Fay, Hesse, Pearson, Mayor Sauer NOES: None ABSENT: None APPROVAL OF DEMANDS City of Rolling Hills Councilman Bear moved that Demands No. 2209 through 2217, excepting No. 2217 as Void, be paid from the general fund. William Pritchard Salary March lst. through 15/72 192.46 16,025.65 The motion was seconded by Councilman Pearson and carried by the following vote: AYES: NOES: ABSENT: Councilmen Bear, Fay, Hesse, Pearson, Mayor Sauer None None TRAFFIC -SAFETY- -MAIN GATE. Councilman Bear expressed his concern for a traffic problem occurring at the Main Gate entrance of Rolling Hills, stating that cars going south on Rolling Hills Road appear to have the option of turning left on Palos Verdes Drive North or crossing the intersection into Rolling Hills, thereby creating a dangerous situation if the right lane vehicle enters Rolling Hills also. Following the discussion, the Council requested the Manager to write a letter to the City Manager of Rolling Hills Estates, suggesting a "left turn only" arrow placed in the left turn lane and a straight arrow and right turn arrow placed in the right lane of traffic entering Rolling Hills from Rolling Hills Road. Ordered held on the agenda. (Councilman Bear left the meeting at 8:45 P.M.). CITY MANAGER Regional Planning Commission, Tentative Tract 27187 344The Manager reported that Recommendation was made for approval of a Conditional Use Permit 26--S.D. Zuckerman & Associates has been reduced from -1571 to 1225 units; to be on Regional Planning Commission 3/14/72. Mayor Sauer ordered the matter held on the agenda. Tennis Court, Plans and Specifications Mayor Sauer ordered the matter held on the agenda pending further reports from the Tennis Committee regarding bids. Riding Ring at City Park Ordered held on the agenda. Underground Utilities, Richard Colyear Ordered held on the agenda. Hillside Rubbish Company re: Rubbish Franchise The Manager reported that the City Attorney, Councilman Hesse and the Manager would be meeting with .Hillside Rubbish Company officials to go over .the Rubbish Franchise. A copy of a_letter from League of Women Voters of Palos Verdes Peninsula to 18 rubbish collectors operating in the Peninsula area was presented. The letter requests the rubbish collectors to reply with answers relating to costs in solid waste disposal in relation to separation of garbage by residents and use of recycling facilities presently existing. Mayor Sauer stated that the questions asked in the letter from the league, were excellent and ordered the matter held on the agenda pending further . reports. Board of Supervisors - Property Tax Relief Ordered held on the agenda. General Telephone Company of California: Application for Authority to Increase Certain Rates and Charges The matter was referred to City Attorney William Kinley for study. May Sauer ordered the matter held on the agenda. California Contract Cities Association: Report and Recommendations, 1972 Budget Proposals The Report and Recommendations for 1972'Budget Proposals for California Contract Cities was ordered, received and filled. CITY MANAGER (New Business) The Manager presented excerpts from minutes of the Board of Directors, Rolling Hills Council Association meeting of March 3, 1972 in which Wagon Lane was accepted into the Association Road System as existing. City Attorney William Kinley stated that the Association action completed the subdivision procedures and that release of the bond covering the road construction was in order. Councilman Pearson moved that the release of bond and agreement for the road construction be authorized for Tract 30731 The motion was seconded,by Councilman Hesse and carried by the following roll call vote: AYES: Councilmen Fay, Hesse Pearson, Mayor Sauer NOES: None ABSENT: Councilman Bear California Contract Cities Association The Manager presented a communication dated 2/25/72 from the President of Calif®rnia Contract Cities outlining procedures and costs regarding the proposed suit against the City of Los Angeles over allocation of costs for the sheriff's services and requesting the official decision of the Council as to participation in the suit as complaintants and willingness to share the legal costs.of the court action. -3- 345 March 13, 1972 The City Attorney was asked to review this matter and report to the City Council at their next meeting. COMMUNICATIONS The City Manager presented a news release from the office of Senator H. L. Richardson (R -Arcadia) regarding introduction of Senate Bill 325 calling for a minimum sentence of 25 years to life for any person convicted of a first-degree murder. City Attorney Wm. Kinley stated that no action was necessary and the matter was received for file. U.S. Department of the Interior - National Park Service The Manager presented correspondence from U.S. Department of Interior requesting the City to proclaiming the week of March 19, 1972 as National Parks Centennial Week. Correspondence ordered, received and noted. ,CITY ATTORNEY Propesed Ordinance - Traffic The City Attorney reported that he was still adding to the ordinance. Y Ordinance No. 91 - Animals and Fowl Q The Manager reported that the report from the Health Department would be considered by the Architectural Committee of the Rolling Hills Council Association at their meeting on March 20, 1972. Ordered held on the agenda. Mr. Tom Roba, Vicious Dog Complaint City Attorney was requested to review the Ordinance concerning prosecution of Vicious Dog Complaints with the County Attorney. Ordered held on the agenda. Mr. Jack Palmer, Vicious Dog Complaint The Manager reported that the registered letter with affidavit to the owner of the vicious dog had been returned unaccepted. After discussion, the matter was referred to the Manager to contact the Sheriff's Department for personal delivery.of the letter. Ordered held on the agenda. City of Rolling Hills Estates - Ordinance 257 The Manager presented copies of Ordinance No. 257 adopted March 8, 1972 by the City of Rolling Hillsa Estates. She stated that the Ordinance had been hand -carried to her office today with no other prior notice given to the City and that the ordinance amends the Rolling Hills Estates Municipal Code relating to Weight Limits for Vehicles over Palos Verdes Drive North within Rolling Hills Estates to its-, intersection with Palos Verded Drive East westerly to the City Limit in that no commercial vehicle with a gross weight in excess of 6,000 pounds may use, traverse or enter upon the road. Following the discussion, the Mayor and Vice Mayor agreed to discuss the matter with the Mayor and Vice Mayor of Rolling Hills Estates. Ordered held on the agenda. ADJOURNMENT There being no further business to come before the meeting, Councilman Pearson moved to adjourn the session to tomorrow evening at 7:30 P.M. to attend Special Meeting of Board of Directors of Rolling Hills Council Association. Mr -nesse seconded the motion and the motion did not carry the f,ollow:ing roll. call vote AYES: None NOES: Councilmen Fay, Pearson, Hesse, Mayor Sauer ABSENT: Councilman Bear -4- March 13, 1572 Mr. Hesse stated that all council members are members of the Rolling Hills Council Association and could attend the Association meeting on a personal basis. Mayor Sauer adjourned the meeting to a personnelsession at 9:45 P.M.
