3/27/19721 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA March 27, 1972 A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Sauer at the Administration Building, 2 Portuguese Bend Road,,Rolling Hills, California at 7:30 P. M. Monday, March 27, 1972. ROLL CALL PRESENT: ABSENT: ALSO PRESENT: APPROVAL OF MINUTES. Resident A motion .to approve the minutes as read by Councilman Fay, Seconded by Councilman Bear and carried by the following Roll Call Vote: AYES: Councilmen Bear, Fay, Pearson, Mayor Sauer NOES: None ABSENT: Councilman Hesse PERSONAL APPEARANCES LEAGUE OF WOMEN VOTERS - RUBBISH FRANCHISE & TRASH DISPOSAL Mrs. Sara Sikes and Mrs. Sally Smathers, members of the League of Women Voters'.; appeared before the Council and requested them to const -der alternatives to the present, way of disposing of solid wastes. Mrs. Sikes states that a questionaire had been sent to 18 rubbish collectors in the area requesting information regarding costs to handle separated trash and what would be involved .in taking recyclables to various locations. She stated that no replies had been received to date. Mayor Sauer expressed his appreciation for the interest and research completed by the League and promised to discuss the alternatives when results have been received by them and negotiations.progressed with the renewal of the rubbish franchise. . The Manager stated that the Committee.assigned by the Council is work- ing with Hillside Rubbish Company in negotiating the new contract. Ordered held on the agenda. TAX BILL DESIGNATION -- "OTHER PURPOSES" Mrs. Patricia Worth, 4.Cinchring Rd., reported',the Manager had contacted her since the last Council meeting with' information she had reques,ted rtlat- ive to an item listed on her County Tax Bill as "other purposes". She said she had also been personally contacted by Mr. Philip Watson's Asst. with the information that the matter.had been called to his attention and would come before the State Legislature on March 4th, Assembly Bill No. 1 which made it mandatory that tax collectors identify each amount on the bill no March 27, 1972 matter how lengthy the bill became with secured property shown this year and unsecured property denoted the following year. The Manager stated that the Assessor's Office had blamed the computer in omitting - the Library District from the bill and listing the tax as "other ser- vices" and assured her the matter would be rectified. Councilman Fay thanked Mrs. Worth for her civic responsibility in -..calling the matter to the Council's attention. CITY MANAGER (ITEMS HELD,OVER FROM MARCH 13, 1972) REGIONAL PLANNING COMMISSION, TENTATIVE TRACT 27187 The Manager reported that the owners had asked for a 30 day exten- sion. Mayor Sauer ordered the matter held on-the"agenda pending further reports from the Regional Planning Commission. REGIONAL PLANNING COMMISSION, TENTATIVE TRACT 27837 Mayor Sauer ordered 'the matter held on agenda pending further reports. TENNIS COURT - PLANS AND SPECIFICATIONS Councilman Pearson reported that he had discussed the progress of the proposed tennis court construction with Dr. Richard Hoffman who related that bidding had been delayed due to one of the bidders working at Disneyworld in Florida. Ordered held on agenda. RIDING RING AT CITY PARK The Manager reported that information regarding all City property --has been accumulated but had no specific information available for new equestrian facilities at the present time. Ordered held on agenda. UNDERGROUND UTILITIES - RICHARD COL_YEAR Matter ordered field on agenda pending additional information. BOARD OF SUPERVISORS RE: PROPERTY TAX RELIEF Matter ordered held pending additional information. GENERAL TELEPHONE COMPANY OF CALIFORNIA RE: APPLICATION TO INCREASE RATES City Attorney William Kinley reported that the City of Long Beach has expressed full scale opposition to the requested rate increase in the alle- gation that the accounting methods of General Telephone do not accurately reflect the earnings. The Mana_ger..rep.o.rted that General Telephone Company Disttict Manager had informed he.r. that the increase is due to employee raises and employee demands. The Mayor directed the City Attorney to keep the Council informed of action by the City of Long Beachz. Held on agenda. CALIFORNIA CONTRACT CITIES ASSOCIATION: PROPOSED SUIT AGAINST COUNTY OF LOS ANGELES OVER ALLOCATION OF COSTS FOR SHERIFF'S SERVICES City Attorney William Kinley reported that the proposed suit'"agairi'st - Los Angeles County over allocation of costs for Sheriff's services was pri- marily instituted by the City of Lakewood and as Rolling Hills received �-.-uch a small percentage of services, he recommended the City ,.recline to support the costs for litigation fees. After discussion, the Mayor directed the Manager to so advise the Calif. Contract Cities Association and ordered -the matter removed from the agenda. - REQUEST TO CITY OF ROLLING HILLS ESTATES FOR STREET MARKINGS AT ROLLING HILLS ROAD AND PALOS VERD_ES DRIVE NORTH Mayor Sauer ordered the matter held on the agenda. ROLLING HILLS ESTATES ORDINANCE #257 - 6,000 WEIGHT LIMIT ON PALOS VERDES DRIVE NORTH _ Mayor Pro -tem Edward Pearson stated that he and the Manager had recently met with officials of Rolling Hills. Estates in discussing Ordinance #257 -2- March.*27, 1972 imposing a 6,000 pound weight limit for trucks traveling on Palos Verde§ Drive.North to locations other than Rolling Hills Estates. He reported that the officials had suggested that they would study the Ordinance -as some of the problems- had been overlooked and access to the City of Rolling Hills had not been taken into consideration. He stated the Ordinance had been discussed for several months by their Council and was not a retalil`ory action over the annual trail permit recently enacted by the Rolling Hilrs Community Association. Ordered held on the agenda. C,IT,Y. MANAGER NEW BUS.INES.S. The Manager presented a letter from South Bay Engineering Company requesting a 12 month extension for Tentative Tract No. 29723, James W. Giacobine and W. Ford, owners. Mr. Fay moved, Mr. Pearson seconded, that the extension be granted as requested to May 26, 1973. The motion carried by the following vote: AYES: Councilmen Bear, Fay, Pearson, Mayor Sauer NOES.- None 0 ABSENT.- Councilman Hesse BOARD OF SUPERVISORS: OPPOSITION TO ASSEMBLY BILL 461 ALLOCATION OF GAS TAX FUNDS I Councilman Pearson stated that the City of Rolling Hills does not receive state gas tax funds due to .the private status of the roads but that passage of Assembly Bill #461 would assign 40% of the County's gas tax funds to the City of Los Angeles; working hardship on the development of the County-wide.Master Plan of Highways and passage of the bill would adver9bly affect other peninsula roads. He moved that the City express opposition to the, Bill. Councilman Hess The Manager was directed to contact Assemblyman Robert Beverly reflect- ing the Council's opposition to the Bill. - REGIONAL PLANNING COMMISSION FILING.- . -PALOS. VERDES BEACH CLUB The Manager reported that Palos Verdes Beach Club has filed for a var- iance with.the Regional Planning Commission fora private beach club facility. Zone R-4, involving no buildings with paddle -tennis, volleyball and re creational facilities. Ordered held on the agenda. FINANCIAL STATEMENTS Councilman Bear moved that the Statements of Receipts and Expenditures dated February29, 1972 and the Report of the City Treasurer for February, 1972 be approved and accepted. Utilities (City Hall) 112.48 $1, -80'2.31 CITY DEPARTMENTS Sheriff's Department Report The January report from the Sheriff's Department listed no traffic accidents; 12 traffic citations and 12 citations for hazardous driving. The City Council expressed their appreciation with the Sheriff's activity in the City; Mayor Sauer stating that since the speed limit was lowered in certain areas, accidents were down 38%. CITY ATTORNEY Proposed Traffic Ordinance City Attorney William Kinley reported that he was checking the proposed Traffic Ordinance with Amendments of the Motor Vehicle Code. Mayor Sauer ordered the matter held on the agenda. Ordinance No. 91 - Animals and Fowl _ The Manager presented minutes of the Architectural Committee of March 20, 1972 upon study of the specifications compiled by Seymour Bar- field, Health Department as follows "Committee recommends that manure bin design be submitted for arcrhitectural approval on an individual basis. Possibilities: gray block 35' from residence and 25' from exterior property line". Mayor Sauer ordered the matter held on the agenda. Mr. Tom Roba, 7 Packsaddle Road West - Vicious Dog Complaint The matter was ordered removed from the agenda. -4- 35 March 27, 1972, Mr. Jack Palmer, 11 Chuckwagon Road, Vicious Dog Complaint The Manager_reported that the registered letter concerning the complaint had been delivered to Mr. Palmer by the Sheriff's Department. The Council directed the City -Attorney to discuss the matter with the County Attorney's office and ordered the matter held on the agenda. MATTERS FROM THE CITY COUNCIL Councilman Bear expressed his concern for the safety of school children playing in the street while waiting for the bus at the north- east corner of Portuguese Bend and Saddleback Road. The Council directed the Manager to request the Association to study the area with regard to correcting the situation. ADJOURNMENT Mayor Sauer adjourned the meeting to a personnel session at 8:45 P.M. The meeting was reconvened at 9:30 P.
