Sli6 said that they cor- responded with the recording machine tape and made any subject easy to locate for replay. The Mayor complimented the Manager for this addition to the minutes. A motion to approve the minutes of the meeting of January 22, 1973 was made by Councilman Bear, seconded by Councilman Heinsheimer and carr .ried by the following roll call vote.: AYES: Councilmen Bear, Heinsheimer, Hesse, Mayor Pearson NOES: None - ABSENT: Councilman Battaglia CITY COUNCIL REPORTS Riding Ring at City Park 838 Mayor Pearson ordered the matter held on the agenda for a report by Councilman Battaglia. Public Utilities Commission 840 Councilman Heinsheimer reported that there was no additional in- formation'available on matters before the Public Utilities Commission. The Mayor ordered the matter held on the agenda. "911" Emergency Telephone Number 845 Councilman Heinsheimer.reported that he had received material h&' requested from Monterey County'.abo'ut their installation of the"911" Emergency number, and would distribute copies to the Council.: The Mayor ordered the -matter held -on the agenda. I February 1.3, 1973 E Cbtitinuation of Public Hearing, General..Plan for Los Angeles County The Manager reported that the revised plan for the Palos Verdes Peninsula would be discussed at a public meeting on February 16th in the Board of Supervisors Hearing Room when proposed amendments to the General -Plan for Los Angeles County would be.considered. The matter was held on the agenda. Public Hearing, Interim Open Space Plan The Manager reported that the public -hearing on February 8th was carried over to the regular meeting of'the Board of Supervisors on February 13th. The Mayor ordered the matter held on the agenda. CITY MANAGER - NEW BUSINESS Department of Countv Engineer re: Tract 28.172, Pinamonti 860 The Manager presented a 'letter dated ,January 24, 1973 from the Department of County Engineer, advising that the water main system and appurtenances for Tract 28172 had been inspected by the City Engineer and fire flow tested to the satisfaction of the Fire Chief. The City Engineer recommends that the Council find that all work _has' been completed as required by the Subdivision Water System Agree- ment and release the agreement and the bond for faithful performance No. 225243. The bond for labor and materials is to be retained until there has been full compliance with all legal requirements, and the City Clerk was requested to notify the subdivider of the Council's action. A motion to approve the water system and release the performance bond was made by Councilman Bear, seconded by Councilman Heinsheimer and carried by the following roll call vote: A .AYES: Councilmen Bear, Heinsheimer, Hesse, Mayor Pearson NOES: None ABSENT: Councilman Battaglia SOUTH BAY.CITIES ASSOCIATION Transportation Study 862 A letter dated January 30, 1973 from the South.Bay Cities Associ- ation was presented to the Council. Ed Mehler, President, advised that a Corridor or Transportation study was discussed at a regular meeting of the Association. The area discussed for study would include the northernmost end of Inglewood,, south, including the Palos Verdes Penin- sula, and from the Harbor Freeway west to the ocean. Mr. Mehler asked the City to respond with comments regarding the boundaries for the proposed study. . Councilman Heinsheimer said hewould report on the matter at the next meeting of the Council. Mayor Pearson. ordered the matter removed from the agenda Revenue Sharing Funds 876 A.letter dated January 31, 1973 from South Bay enclosing a letter dated December 21, 1972 from the pressing dissatisfaction with the inequities of the for Revenue Sharing Funds. The correspondence was received and filed, -2- Cities Association City of Downey ex - allocation formula February 13, 1973 900 Appointment to Joint Committee: City Council and Ro:l.ling Hills Community Assn The Manager reported that.the Board of Directors of the Rolling Hills Community Association had discussed the Johns Canyon Road area, and the problems that might result from extensive subdivision in the area. Mr. Clark Leonard and. Mr. Philip Battaglia had been appointed by the Board to serve on a committee to study the area, and Mr. Battag- lia, Board President, had requested that Mayor Pearson and Councilman Heinsheimer, both of whom live in the area, be asked to serve on the committee. The Manager will also serve on the Committee. The City Attorney recommended that a new subdivision ordinance be drawn, and requested authorization, to proceed, with suggestions and recommendations from Councilmen as to what should be included, Further, ___..___,_ Mr. Kinley reported that a new Subdivision. Map Act will be enacted by the State of California in the Government Code or Public Resources Code in the present session of the Legislature, and suggested that it be studied for sections that would be applicable to the City of Rolling Hills. Mayor Pearson agreed that it is necessary to have a new subdiv- ision ordinance, and said he would meet with Councilman Heinsheimer and the. City Attorney on the matter. Further, he appointed Council- man Heinsheimer and himself to meet with representatives of the Board of Directors as a committee to study the needs of the Johns Canyon area as soon as possible, and requested that the Manager so notify the Board. He ordered the matter held on the agenda. CITY MANAGER - UNFINISHED BUSINESS Environmental Impact Report -,Gordon-Shultz,, Tract 30605 940 A communication dated February 13, 1973 from Councilman Heins- heimer, Traffic Committee representative, was presented to the Council. Councilman Heinsheimer reported that he had made an observation concerning the proposed construction on the extension of Johns Canyon Road, and feels it is imperative that arrangements be made for all con- °struction equipment and vehicles to come in the gate on Mr. Shultz's property at Crenshaw Boulevard. In response to a question from the Mayor, the City Attorney recommended that the City issue a permit to Mr. Shultz for use of the gate on a temporary basis, for a period of time specified by Mr. Shultz, and that an appropriate sign be placed by the Rolling Hills Community Association stating that the gate is to be used by construction vehicles only, and prohibiting use to all unauthorized vehicles, and that Mr. Shultz be required to keep the gate locked to prevent use by unauthor- ized vehicles. Further, Mr. Kinley said the City should send a letter to the Association advising them of the temporary special permit issued to Mr. Shultz, and stating that ingress and egress through the gate is by permit only, and not open .`.. °.he public. Mr. Kinley said he recom- mends issuing a permit for use of _he road during the construction of the extension of Johns Canyon Road only, and if extension of the use to cover construction of homes is desired, a separate permit should then' be issued for road use for that purpose, avoiding an indefinite use of the gate, which actually grants permissive use to cross private property to reach the newly created lots. Mr. Gordon Shultz stated that he is willing to grant access across his property for heavy equipment neces- sary for development of the subdivision following approval of the final map. -3® 1-,84, February 13,, 1973. FINAL MAP, TRACT 30605, Gordon.Shultz The City Manager presented the final .map for Tract 30605, and copies of correspondence from the following: 1. In a letter dated February 9,, 1973 the County Engineer advised that the map had been checked by the City -Engineer, and that he recom- mends approval of the map. 2. A letter dated February 1°,,. 1973 from the Los Angeles County Road Department advised that a faithful performance bond in the amount of $33,000 and a labor and materials bond in the amount of $16,500 for construction of road as required and subdivision improvements had been posted, and the Road Commissioner recommended that the map be approved for filing. 3. A letter dated January 11., .1973 from the Subdivision Committee of Los Angeles County advised that the final map complies with the re- quirements as specified by the Council in approving the tentative map on.March 13, 1972, and the Committee recommends that the Council accept the final map and title sheet for recordation.. 4. Letters from the Palos Verdes Water Company dated November 6' 1972; General Telephone Company dated September 19, 1972 and Southern California Edison Company dated February 9, 1973 advise that the div- ision and development of the property shown on the final map will not unreasonably interfere with the free and complete exercise of any utility easements within the boundaries of the tract. 5. Letters dated January 9, 1973 from Gordon,.W. Shultz advised that as subdivider of the proposed tract he had in good faith attempted to obtain signatures of John Maeno, Tomi Maeno and Mitsugi Yoshioka, alsoPalos Verdes Properties, easement holders, and had been.unable to do so. Refusal to accept the. -final map for filing would work an undue hardship on the subdivider, and he requested that the City Council accept the map without the signatures. Following review of the final map and correspondence, and --appro- val of the bonds by the City Attorney, Councilman Hesse moved that the final map be approved and that the City Clerk be instructed to sign the linen original. The motion was seconded by Councilman Bear and carried by the following roll call vote: AYES: Councilmen Bear, Heipsheimer, Hesse, Mayor Pearson NOES: None ABSENT: Councilman'Battaglia Following approval of the final map Councilman Bear moved that the City enter into an. agreement with Mr. Shultz for permission for equipment required for development of the subdivision to gain access to the property from Crenshaw Boulevard for a period of six months, and to advise the Rolling Hills C,-)-mmo:-,1Aan=y Association, so a sign can be erected for the duration ol. advising that ingress and egress through the gate is bypermi6'sive use only. and not open to the public. The motion was seconded by Councilman' Heinsheimer and carried by the following roll call vote: AYES: Councilmen Bear, Heinsheimer, Hesse, Mayor Pearson NOES: None ABSENT: Councilman Battaglia Southern California Association of dovernments 1035 Mayor Pearson advised that he had made a reservation to attend the Annual General Assembly of Southern California Association of Gov- ernments February 15th and 16th at the Sheraton -Universal Hotel. -4- r] 0 February 13, 1,973 Planning Commission 1.050 Letters of resignation from members of the Planning Commission wereaccepted, and 'Mayor Pearson_, ann.aunced that after careful consid- eration of all applications for positions on. the Planning Commission, he wished to make the following appointments: For a term of three years: James Johnston and Sidney -Morse For a term of two years: Dr. Godfrey Pernell and Joan Saffo For a term of one year, William Field A motion to approve the appointments was made by Councilman Bear,, seconded by Councilman 11einsheimer and carried by the following roll call vote: AYES: Councilmen Bear, Heinsheim.er, Hesse, Mayor Pearson NOES: None ABSENT: Councilman Battaglia The Mayor requested that all, applicatns be thanked for their interest in serving on the Planning Commission., and advised that their letters will be kept in, an active file for consideration for future City Commission or Committee appointments. WRITTEN COMMUNICATIONS West Basin Water Association, 1088 Councilman Hesse advised that he plans to attend the meeting of the West Basin Water Association. on February 22nd at the Palos Verdes Country Club. South Bay -Harbor Walk for Development 1093 Eric Yen, a Rolling Hills High School student., advised the Council that he was present at the meeting to reprdsent Chip Poulson, Palos Verdes Coordinator of the South Bay - Harbor Walk for Development, sched- uled for March 3, 1973. He explained that students representing more than 50 schools in the South Bay area will march as part of the National American Freedom from Hunger Foundation./Young World Development, and invited members of the Council to march with them. Sponsors, contacted before the walk begins, agree to donate money for each mile walked, and .Eric asked the Council to sponsor a youth if they are asked. The Manager said information about the project would be included in the Newsletter. Following the presentation. Councilman Hesse moved that the project receive a motion of support from the Rolling Hills City Council. The motion. was seconded by Councilman Bear and carried, by the following roll call vote: AYES: Councilmen Bear,, Heinsheimer, Hesse, Mayor Pearson NOES: None ABSENT: Councilman, California Contract Cities Associat-,ign. 1117 I The program for the California Contract Cities Association meeting on February 21, 1973 in Lakewood was presented to the Council. Council- man Heinsheimer said he would attend if possible. The notice was re- ceived and filed. Letter from Forrest Riegel A let -ter from Mr. Forrest. Z. Riegel, 2 Cinchring Road, dated February 7, 1973 was presented to the Council. Mr. Riegel requested -5- February 1.3, 1973 that his name be withdrawn from consideration for the vacancy on the Rolling Rills Planning Commission. Mayor Pearson directed that Mr. Riegel's request be acknowledged and the letter filed. FINANCIAL STATEMENTS A motion to approve the Report of the City Treasurer for the month of December, 1972 and the Statement of revenue and Expenditures dated December 30, 1972 was made by Councilman Heinsheimer, seconded by Coun- cilman Bear and carried by the following roll call vote: AYES: Councilmen. Battaglia CITY ATTORNEY 1190 Proposed Traffic Ordinance The City Attorney advised the Council that the ordinance has been completed, and will be presented to the Council after the City Manager and representatives of the Council meet with the Sheriff. a ORDINANCE NO. 114 Councilman Hesse moved that Ordinance No. 114 entitled: AN ORDI- NANCE OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA AMENDING ORDINANCE NO. 16 ENTITLED "AN ORDINANCE OF THE CITY OF ROLLING RILLS, CALIFORNIA, REGULATING TRAFFIC WITHIN SAID CITY AND REPEALING ORDINANCE NO, 1 AND ALL OTHER ORDINANCES IN CONFLICT THEREWITH" intro- duced on January 14th be adopted. as amended. The report was received and filed. MATTERS FROM THE AUDIENCE Mr, Eli Mitchell, 23 Georgeff 1152 Mr. Eli :vi:itchell, 23 Georgeff, advised the Council that on Saturday night at 10:00 P.M. 1.0 to 15 cars of young persons in various stages of inebriation were driving up and down both sides of the street 7 LJ 4,87. E eb rt,,- 1973 in front of his home. - Mr. ''Ziitchell he called the Main Gate to report the incident, and also called, the Sheriff's station at Lennox at 10:00 P.M. Although he heard his ,voice being recorded, Mr. Mitchell said there was no response to his c.!911 from the Sheriff, and he finally dispersed the cars himself. The Mayor directed the City -Manager to contact the Sheriff's De- partment, and report tc. the Council on the incident Day on the. Farm, Mrs Jay :Kuhn,,5_ Johns__Canyon .Road 1384 Mrs. Jay Kuhne advised the Council that the Day on the Farm had been postponed until March 25th because of inclement weather. Mayor Pearson suggested that Mrs. Kuhne contact the Palos Verdes School District office for permission to arrange for parking on.the school grounds to alleviate overcrowding on Johns Canyon Road.
