2/26/1973MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA February 26, 1973 A regular meeting of the City Council was called to order by Mayor Pearson at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, Kalifornia at 7:30 P.M. Tuesday, February 26, 1973. HANS HEINSHEIMER Mayor Pearson welcomed Dr. Hans Heinsheimer, Councilman Heinsheimer's father, to the meeting. CITY COUNCIL REPORTS Riding Ring at City Park 616 Councilman Battaglia reported that he had sent detailed letter to the owner of the property being considered for an additional ring, set- ting forth all costs in connection with grading, planting and landscaping of the property. Six weeks after the letter was sent it had not been acknowledged, so Councilman Battaglia attempted to contact the owner by telephone. He has not yet heard from the owner or his attorney, and he suggested that a broker be contacted and asked to negotiate with the owners:. Mayor Pearson ordered the matter held on the agenda. Public Utilities Commission 634 Councilman Heinsheimer presented a current report on applications by various utilities before the Public Utilities Commission, also a notice of an amendment to Application No. 53563, California Water Ser- vice. Mayor Pearson ordered the matter held on the agenda. "911" Emergency Telephone Number 644 Councilman Heinsheimer presented copies of correspondence from Monterey County and asked that the material be reporduced and distri- buted to members of the Council. Mayor Pearson ordered the matter held on the agenda. 7, February 26, 1973 Continuation of Public Hearing, General Plan for Los Angeles County 646 Mayor Pearson ordered the matter held in abeyance for a report from Councilman Hesse. A notice of continuation of the hearing until Wednesday, March 21st was presented to the Council, and ordered held on the agenda. Continuation of Public Hearing, Interim Open Space Plan 651 The Manager reported that at a -meeting of the Board of Supervisors on February 13th, the Board had adopted the Environmental Development Guide as Los Angeles County's Interim Open Space Plan. Mayor Pearson commented that the designation was satisfying to Peninsula residents, and asked that the item be removed from the agenda. CITY MANAGER - NEW BUSINESS Los Angeles County Sheriff 655 A letter dated February 9, 1973 from Sheriff Peter J. Pitchess, with copies of the 1973-74 Legislative Program which the department will be endorsing and supporting was presented to the Council. After discussion of the proposed legislation, Councilman Bear moved that a letter be sent to the Office of the Sheriff, thanking him for the correspondence. Mayor Pearson agreed;.:and.seconded-the motion, and said he felt the Council should acknowledge -receipt -.of- - the correspondence. Mayor Pearson agreed, and seconded the . motion, and said he felt the Council should acknowledge recei pt of the legislation, but should not take a position on proposed legislation. California Legislature 782 A notice of hearing on Suggested Remedial•Approaches to the California Land Conservation Act of 1965 (Williamson Act) to be held on March .23, 1973.' in-:Sac.rament:o was presented, toe the Councilr. Copies of the application to submit written testimony at the hearing were also presented. Following discussion of the matter, Councilman Battaglia, legis- lative repre.sentative.•yf.or the-, C:ouncil-1. requested that the_ application: to submit testimony be completed and sent to Sacramento, and he said he would then work with -the City Manager:on_preparing testimony to be presented. The matter was held on the agenda. J City of ' Hidden Hills - -815,,.- Mrs. 815:: Mrs. Clifton presented a letter dated February 15, 1973 from the City of Hidden Hills relative to dog control. Mrs. Clifton.exp.lained that Councilman Willoughby of Hidden Hills had contacted her at one time with questions about dog control, and had sent the: letter with, results_ of their &tudy-. fore information -:'only. The letter was received and .fil.e.d. State of California, Division of Highways 1065 A letter dated February 23, 1973 from the Division.of Highways was presented to the Council The .D.ist.rict_- Enginee.r.. advised, that_ -a public hearing had been scheduled by the State of California, Division of Highways, , to. discuss• the. benefits and -impacts --of. an.,sideal access system in San Pedro. Mayor Pearson said he had read the letter and reviewed.copies of brochures., and. conclulded that Rolling Hills would _not be affected. The -2- February 26, 1973 letter was received and filed. California Contract Cities 1103 Notice of the Fourteenth Annual Municipal Seminar of California Contract Cities Association in Palm Springs from April 26th through April 29th was presented to the Council. The Manager asked all members of the Council who wish to attend to advise her as soon as possible so reservations can be made. TENTATIVE MAP, TRACT 26652, RICHARD FRIEND 835 The tentative map for Tract 26652, Richard Friend, and excerpts from the minutes of the meeting of the Planning Commission on Tuesday, February 20th approving the tentative tract map were presented to the Council. In the discussion that followed the Mayor asked what modifica- tions had been granted by the Planning Commission. The Manager ex- plained that the tentativemap had been submitted to the Planning Commission by Mr. Friend in April, 1967. Subsequently, before receiv- ing Planning Comission approval, the property was sold to Mr. John Aguirre, who submitted different maps to the Planning Commission. Completion with the Planning Commission was not accomplished by Mr. Aguirre, and the property eventually reverted to Mr. Friend, who re- quested permission to proceed with the subdivision. At the meeting of the City ouncil on September 11, 1972 approval was given to a motion to permit Mr. Friend to proceed with completion of the subdiv- ision, and to pay only additional fees. The new tent mapwas presented to the Planning Commission at the meeting of January 17, 1973, and was held on the agenda to give the Planning Commissioners an opportunity to visit the site. At the meeting of February 20th the tract was ap- proved with Commissioners Saffo, Morse and Pernell voting for approval, Commissioner Johnston voting against approval, and Commissioner Field abstaining. Mrs. Clifton explained that although Commissioner Field had made the trip to the property, he had•.not.been a member of the Commission during discussion of the tract. Councilman Heinsheimer requested that a member of the Planning Commis.sion be requested to attend City Council meetings following approval or disapproval of tentative maps. Councilman Battaglia ex- pressed a concern that the size of the properties after deduction of road easements and horse trail would be substandard. Following disucssion the Mayor asked permission of the engineer to hold the matter on the agenda. Mr. Roger Meurer agreed on behalf of Mr. Richard Friend. Mayor Pearson then asked the City Manager to review the file to determine whether modifications of the subdivision ordinance would be required prior to approval of the map currently being considered. If necessary, Mayor Pearson directed the Manager to present the matter to the Planning Commission, and asked further that a member of the Planning Commission be present at the next Coun- cil _meeting at which the map is considered. He also requested that members'of the Council make a field trip to the site of the subdi- vision. The matter was held on the agenda. CITY MANAGER - UNFINISHED BUSINESS Joint Meeting - City-Council/Rolling Hills Community Association 1028 Mrs. Clifton advised that calendars sent to members of the Council and Board had been returned, and it would now be possible to set a date for the joint meeting of the Council and Board. Following discussion of available dates Monday, March 5, 1973 at 7:00 A.M. was chosen, and the Mayor announced that the Council meeting would be adjourned to that time. -3- February 26, 1973 F INANGIAL 'STATEMENT The Report of the City Treasurer dated January -31, 1973 and the Statement of Revenue and Expenditures -for the month of January 1973 were presented to the Council. A motion to approve and accept the report was made by Councilman Heinsheimer, seconded by Councilman Bear and carried by the following roll call vote: AYES: Councilmen Battaglia, Bear, Heinsheimer, Mayor Pearson NOES: None ABSENT: Councilman Hesse PAYMENT"OF BILLS - A motion to approve payment of Demands No. 2659 through 2676 from The General Fund was made by Councilman Heinsheimer, seconded by Coun- cilman Bear and carried by the following roll call vote: AYES: Councilmen Battaglia, =. NOES: None -- ABSENT: Councilman Hesse CITY ATTORNEY Proposed Traffic Ordinance . 1206 Bear, Heinsheimer, Mayor Pearson Mr. Kinley said the ordinance was ready for final review by a - and of the Sheriff's Department, -meeting with theManager and a representative of -the -Council.- Mrs. Clifton said the meeting would be held later in the week. The matter was held -on the -agenda. Proposed Subdivision Ordinance. Mr. Kinley requested that the matter be held on the agenda. The Mayor so ordered. Ordinance *No..114, Stop..Signs , -; 1424 The City Attorney reported that it had come to his -attention that Ordinance No°. -. 114, .°Stop Signs;_.'introduced. at. -the; meeting of February 13 was not complete; and he -asked that it -be held on -the agenda until a . complete inventory of`stop"signs in the City could be compiled. CITY DEPARTMENTS . .. - Los Angeles County Fire Department 1400 The report of the Fire Department for the month of January 1973 was presented to the Council. The report was received.and filed. Department of Animal -Control 1.503 . . A letter dated February 22, 1973 from the Department of Animal Control was.presented.to.the-Council, advising that the annual Rabies Vaccination clinic will be held at Dapplegray School -on August 10th between the hours of 7:00 p.m. and 8:30 p:m. Chief Administrative Officer 1505 A letter dated February 23, 1973 from the Chief Administrative Officer, Los Angeles was_.presented3t.o:the.Council. Chapman Bone,: Chief,-Spec,ial Se.rv.ices. Division,. -advised that. the 1972-73 rates, as developed by the Auditor -Controller were tentative, and-rprovide.d::that if the cost of services changed at any time the City -4- 4'9`2. February 26,.:1.973 would be notified of such change in writing. New rates.based on salary increases granted January 1, 1973 have been re -computed by the Auditor - Controller, and would b.ecome.effective..March 12 1973. A list.of new rates .for se.ry-ices provided by the Sheriff and the new rate.s was at- tached to the letter. The Manager presented a break -down of .the cost increases prepared by the City Accountant showing the increases to the City at the new rates. - Mayor Pearson referred the matter.t.o Councilman Heinsheime:r, who is Law Enforcement representative for the Council, also Finance Officer, for review and a report to the Council. The matter was held on the agenda. MATTERS FROM THE COUNCIL Councilman Bear re: Joggers 1526 Councilman Bear mentioned that groups of joggers and dogs run in Rolling Hills every morning, and he requested .that they be asked to run in single file, as their habit of running two and three abreast creates a hazardous situation on the roads. Councilman Battaglia re: Mitchell complaint.. 655 Councilman.Battaglia.suggested_.that.a letter be.sent to Captain Kenneth Hays, Lennox Sheriff s Station, thanking him for his effort in following up on a recent complaint by Mr. Eli Mitchell, 23 Georgeff Road. Councilman Battaglia asked the Manager to ask the nature of other calls received by the Sheriff at the same time Mr. Mitchell called, in an effort to determine the Sheriff's:system for allocating priority to calls. Shelter at School Bus Stops 1535 Councilman Battaglia asked if consideration had been given to providing shelters at school bus stops, and said he had observed child- ren standing in the rain waiting for buses, or playing in the area of the bus stops in good weather. Councilman,.Bear agreed that a shelter that would encourage the children to congregate in one place would be desireable, because they play in.the'road in good weather, creating a traffic hazard. Mayor Pearson said there are many bus stops, and it, might not be practical to have ,a shelter at each; he suggested that the topic be referred to the joint meeting of the City Council and the Board of Directors of the Community Association. Motorbikes Councilman Battaglia said he wished the Council to consider adopting an ordinance prohibiting motorbikes. -in Rolling Hills. -Coun- cilman Bear and Mayor Pearson said they considered it a controversial matter; although -many residents consider motorbikes a nuisance because they are operated illegally in many cases, other residents do respect the laws regarding operation, and many young.pe.ople depend on them for transportation. Mayor -Pearson suggested that the matter be.dis- cussed at the joint meeting of the Council and Board. Mayor Pearson re: Outstanding Young Citizen 1206 Mayor Pearson presented a letter from the Palos Verdes Penin- sula Jaycees advising that the local Jaycee Chapter will honor its community's outstanding young man by presenting the Distinguished Service Award at the -banquet -on Friday, March 23, 1973, and asking for recommendations from the Council. _Mayor Pearson asked.that the correspondence containing the requirements be distributed to members of the Council. -5- t 4 !Y3- February Y - February 26, 1973 Outstanding Older American Mayor Pearson presented a letter dated February 22, 1973 from Supervisor Ernest Debs advising that the Eighth Annual County -wide Older American Recognition Day will be held Saturday, April 28, 1973. Supervisor Debs asked that recommendations be made. Mayor Pearson asked that the correspondence containing the requirements be distri- buted to members of the Council.
