A regular meeting of the City Council was called to order by
Mayor Bear at La Cresta School, 38 Crest Road West, Rolling Hills, Cali-
fornia at 7:30 P.M.

Councilman Battaglia said that alternate plans for development
of additional riding facilities are being studied, and cost estimates
dre being sought. He asked that the matter be held on the agenda for
additional information at the next meeting. The Mayor so ordered.
PUBLIC UTILITIES COMMISSION
CALIFORNIA WATER SERVICE COMPANY 14
The City Manager reported that hearings were conducted by the
Publig Utilities Commission on May 1, 2 and 3, 1973 at the Administration
Building in Rolling Hills on the application.of California Water Service
Company for an increase in rates. Mrs. Clifton said she had testified
as a representative of the City of Rolling Hills, and copies of her
testimony were provided the Councilmen for information. The matter has
been taken under advisement by the Commission, the Manager said, and
the City would be advised of any decisions.
The Mayor ordered the matter held on the agenda.

CITY OF ROLLING HILLS ESTATES 19
Copies of.a letter from Nell Mirels, Mayor of Rolling Hills
Estates, requesting support.of Councilman Art Greenberg for appointment
to the Board of the Southef°n Caiifornia Rapid Transit District were pre-
sented to the Council. The Mayor said he had been contacted by other
candidates requesting support. Councilman Battaglia suggested that the
Council review qualifications of the candidates before making a decision.

SOUTH BAY ENGINEERING CORPORATION 45
A letter dated May 9, 1973 from South Bay Engineering Corpora-
tion was presented to the Council. Mr. Robert Dedernett advised that
Tract 29723, Dr. William Ford, is due to expire on May 26, 1973, and
completion has been delayed because the owner was given.a new set of
requirements for the water system by County Waterworks. The engineer
has requested a 90 day time extension to complete the plans and paper-
work.
A motion to approve the request and grant a 90 day extension
for completion of Tract 29723 was made by Councilman Battaglia, seconded
by Councilman. Heinsheimer and carried by the following roll call vote:

CALIFORNIA CONTRACT CITIES ASSOCIATION 53
The Manager presented information received from the Contract
Cities Association following the last Council. meeting regarding a Reso=
lution on Revenue Sharing presented to the Senate Committee on Revenue
and Taxation on May 9, 1973. Mayor Bear asked the Manager to keep the
Council informed on. the matter.
PUBLIC EMPLOYEES' RETIRE; .N'V' SYSTEM 59
Mayor Bear stated that the Council is considering a retirement
plan for employees, and had discussed the matter with a representative
of the Public Employees Retirement System. In order to proceed it would
be necessary to have a study made by actuaries, and the Mayor presented
a copy of a contract between the City and PERS for the service.
A motion to authorize an expenditure not to exceed $200 for a
valuation of employees was wade by Councilman Battaglia, seconded by
Councilman Heinsheimer and carried by the following roll call vote:

Notice of a hearing scheduled for May 23, 1973 before the Board
of Supervisors to consider the Sphere of Influence for Consolidated Fire
Protection Districts was presented to the Council. Mayor Bear said he
wished the City to be represented at the hearing. Councilman Heinsheimer,
delegate, said he would be out of the country at that time, and Mayor Bear
said he would contact Councilman Pearson, alternate, and ask him to attend
the hearing and report to the Council.

Mayor Bear said he had registered.to participate in the Annual
Golf Tournament and Awards Dinner sponsored by the Palos Verdes Peninsula
Chamber of Commerce on May 24, 1973, and requested other members of the
Council who wish to participate to make reservations.

Council. Mayor Bear asked Councilman Pearson to attend if possible.
PUBLIC HEARING - PROPOSED ORDINANCE PROHIBITING MOTORCYCLES IN ROLLING

Mayor Bear opened a Public Hearing on a proposed ordinance
entitled A PROPOSED ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ROLLING HILLS, CALIFORNIA PROHIBIT14ri THE OPERATION OF MOTORCYCLES
AND MOTOR DRIVEN CYCLES IN THE CITY OF ROLLING HILLS, CALIFORNIA
Mayor Bear explained that ac present only residents are per-
mitted to operate motorcycles or motor driven cycles in Rolling Hills,
and stickers issued by the Rolling Hills Community Association must be
on all motor -driven. vehicles operated by reside n.ts . Non-residents' are
not admitted to the City on motorcycles, and the proposed ordinance would
extend the ban to residents as well as non. -residents, and would prohibit
operation of motorcycles or motorbikes within the City. The Mayor said
the proposed ordinance was being considered because of numerous complaints
from residents about other residen,ts riding motorcycles on trails in
violation of existing ordinances, and racing motorcycles and motor bikes
on streets and private property, causing excessive noise.
Mayor Bear said all who wished to speak -would be heard; however,
he requested that speakers be brief, concise and avoid repetition. The
Mayor then read letters from the following into the record: In favor of
the proposed ordinance prohibiting motorcycles: Mr. and Mrs. Mark Fried-
man, 11 Flying Mane Road; in opposition to a more restrictive ordinance:
Mr. Vic Edelbrock, 14 Roadrunner Road; Mr. Wallace Kreag, 18 Outrider
Road; Mr. E. E, Lohn, 9 Middleridge Lane; Mr. Parnelli Jones, 26 Saddle-
back Road, and Mr. Dudley Gray, attorney for Parnelli Jones. The Mayor
then opened the discussion to the floor, and said residents in favor of
the ordinance would be heard first, to be followed by residents opposed
to the ordinance.
Mr. Arthur Stribley, 8 Outrider Road, said he was opposed to
motorcycles because they are a nuisance to people, terrifying to resi-
dents and out of keeping with the surroundings.
Mr. Kenneth Watts, 1 Wrangl.er Road, presented information re-
garding decible ratings and advised that many cities have adopted noise
ordinances to combat nuisances. He offered to work with the City on the
matter if the Council wished hiar to.
Mr. James Barnard, 63 Crest Road East, said it was his opinion
that everyone has a right to enjoy his favorite hobby, but existing
rules regulating operation of motorcycles and motor driven bikes should
be enforced.
Mr. Charles 'Vary. Mote, 7 Quail Ridge Road North asked whether
residents of Rolling Hills mist be licensed to operate a motorcycle, and
the Mayor quoted from Ordinance No. 85, which stipulates that "no person
except a resident of Rolling Hills shall ride or operate a motorcycle or
motor driven cycle ----- in. the City of Rolling Hills unless the same is
licensed, registered."
Mr. Thomas Gaian, 68 Portuguese Bend Road, said that all sanc-
tioned events require muffler, and many of the motorcycles ridden in
Rolling Hills are annoying because rules regarding mufflers are not en-
forced. He suggested that bikes that do not conform be 'banned.

Mr. John Heater, 59 Eastfield Drive, said that cars with modified
exhaust systems are as noisy as motorcycles, and said the -ordinance against
riding on the trails should be enforced by implementing the following:
1) Increased Sheriff patrol; 2) Periodic 3nspection.of motorcycl6s, with a
fee charged for the inspection, 3) An -organized motorcycle club, and 4)'A
junior patrol to patrol the trails. Steve Day, 5 Ranchero Road, said
there is a need for bike trails, and agreed that an organized club should
be formed.
Mr. Fames Ziegler, 0 Open Brand Road, said there is a peninsula -
wide problem, and advised the Council, that the extension,of Crenshaw
Boulevard, although not developed, is already a dedicated street, and he
suggested that the City investigate the feasibility of developing that
section for use by motorcycle hobbyists.
Michael Bear, 7 Wagon.Lane, said that he rides his motorcycle in
Palmdale and other areas designated for motorbike enthusiasts; he said he
I.. supports use -of properly licensed motorcyc=le on, city streets.

r. -i Mr. James Brogdon, 5 Maverick Lane, said he is ambivalent on the
question, because he is "pro bike" and "anti noise". He agreed that most
.of the problems are caused by a lack of consideration by the operators
Q of motorbikes and a lack of law enforcement
Other residents who stated that they were opposed to the pro-
posed -ordinance and suggested that other meas of control be enforced
and alternative plans developed were: Paul Grubs, 1 Hackamore Road; Don
Crocker, 14 Cinchring Road; W. J. bines, 73 Eastfield Drive; Terry Mat-
thews, 59 Crest Road East and Neil Day, 5 Ranchero Road.
Mr. Don Perdew advised Mayer Bear that he is not a resident of
Rolling Hills and did not wish to speak for or against the proposal, but
as a member of -Southern California Motorcycling Association he wished to
offer some help. SCMA, an association for.the road biker, has weekend
runs throughout the year, Mr. Perdew said, and welcomes anyone with an
interest in road biking. Further, he said, members of the Los Angeles
Police Department have formed an association for the dirt biker and he
`vaggested that ahyone with an interest in dirt biking contact L PD for
information. Mr.'Perdew said he would remain for a while after the hear-
ing"to answer quesAons for anyone interested in.either association.
The Mayor thanked Mr. Perdew for coming to the meeting and providing the
information.
There being no further testi.maony to come before the Council,
Mayor Bear thereafter closed the public hearing.
Councilman Heinsheimer said he was in favor of anoran.ization
of a club nature for internal discipline, and it was his opin on. that
through such an organization inspections could be made and rules could
be enforced. Councilman Battaglia said he considered any decision
premature,'and felt that all testimony should bre considered carefully
before any decision.or course•of action was arrived at.
Ma or Bear thanked all residents who cane to the meeting and
said that thetestimony would be reviewed by members of the Council who
attended the meeting, and the recorded tape of the meeting would be made
available to Councilman -Hesse, who was absent, before any decisions were
made. The Mayor then recessed the meeting at 9:20 P0M® for a ten minute
break, to re -convene at 9:30 POM.

endeen asked the Manager 'to express his appreciation, to the Mayor and
members of the Council for their participation in enabling him to attend
tbe:Contract Cities Conference in Palm Springs.

The Manager presented a :Letter from Captain. Kenneth Hays,
Lennox Sheriff's Station, advising that the Los Angeles County Sheriff's
Department is conducting an. Open House on Sa'tu'rday, May 19, 1973 from
10:00 A.M. to 4:00 P.M. The correspondence was received and filed.
MONTHLY REPORT, SHERIFF'S DEPARTMENT
The Monthly Report of the Sheriff for the mon.th of February 1973
was presented to the Council. The report was received and filed.
PUBLIC HEARING, GENERAL PLAN - CITY OF ROLLING_ HILLS 599
Mayor Bear opened a Public Hearing on the General Plan for,
the City of Rolling Hills, referred to the City Council by the Planning
Commission on May 8, 1973 following approval and, adoption by the Com-
mission. Draft copies of a General Plan compiled by Councilman. Heins-
heimer were distributed, to members of the Council. 'by the. City Manager.
Mrs. Clifton introduced Mr. Richard Anderson, Planning Advisor,
and said he had assisted in preparation of the General Plan, which was
mandated by the Stage Legislature, and must be submitted by June 30,
1973.

Following a review of both plans and discussion of individual
sections, Councilmnan. Battaglia mvoled that the General Plan be adopted
as discussed and amended, subject to the staff incorporating additions
from the plan, subrmitted by Cou-ncilA.Ln�an Hein.sh,eimer where. deemed useful
and appropriate, and subject to approval of the final. draft by legal

Mrs, day Kuhne., 5 dohnis Canyon Road, advised the Council that
she wished to :register a eo:�plain.t about heavy equipment working in. the
City early Saturday and Sunday morriinigs; on Sunday, May 13th work on
property on. Johns Canyon,. Read started at 7:.30 A.M., involving bulldozers,
JO rock crushers and earth -moving equipment. Mrs. Kihn.e requested that the
r-. Council consider adopting an. ordinance that would limit the hours and
'-D days when heavy duty commercial equipment could be used in. the City, and
said --that she considers weekday use, beginning at a reasonable hour, is
A not objectionable, act!.d operatio'.n of discin.g equipment, or hammering by
the homeowner' on, weekends should not be restricted; however, noisy com-
mercial equipiaen.t, including pressure -driven hammers, should be banned
on weekends.
Councilman, Heinshe,imer submitted a draft of a proposed ordinance
which would meet Mrs. Kuhn.e"s requests, -would limit the hours during the
week when. equipment could enter the City and be operated, and would ban,
use of such equipment on weekends and holidays
Councilman Pearson, said he agreed in principle with Councilman
Hein.sheimer; however, some details would have to be worked out. Speci-
fically, he said, exceptions would have to be made based on weather
conditions, especially where buttress cuts are concerned to strop short
of completion because of a weekend or holiday might be hazardous. In
such cases Councilman Pearson suggested that application could be made
to the City, and a special permit for a specified time period could be
granted for work under specific conditions. In some cases it is bene-
ficial for the homeowner to work closely with a contractor, and limited
operation. on Saturday within specific hours might be desireable; he
agreed that opera -tion of heavy duty equipment by non-residents should
not be permitted. on Sunday.
Mr. Mason Rose, 37 Crest Road West, said he thought a bond
would be a more effective way of enforcing 'the proposed ordinance than
a provision for $500 five or imprisonment for six months or both. Mr.
Kinley, City Attorney, said most contractors would prefer to forfeit a
bond and continue to work o
Following the discussion Cou-neilman, Battaglia suggested that
Mr. Kinley draft an ordinance based on the points discussed. Mayor Bear
requested that Mr. Kinley prepare an ordin ante. for presentation at the
next meeting.
MATTERS FROM THE COUNCIL
ABSENCE FROM COUNCIL MEETINGS
Councilman. Heiris he.imer requested permission to be absent from
the Council meetings on. May 29, June 11 and possibly dune 25, 1973

Councilman. Pearson suggested that. the Council consider adopting
a policy of acting on, ordinances only at meetings at which four members
are present to 'vote. He siad that although three members constitute a
quorum, it was his opinion, that better , ating, representation results from
a minimum 'vote of four, especially on vital. issues
