Adkins Cliff Bundy Fred Fuld Roy Doar APPROVAL OF MINUTES City Manager City Attorney Secretary Resident it it Guest A motion to approve the minutes of the meetings of May 14, 1973 and May 29, 1973 was made by Councilman Battaglia, seconded by Councilman Pearson and carried by the following roll call vote: AYES: Councilmen Battaglia, Hesse, Pearson, Mayor Bear NOES: None ABSENT: Councilman Heinsheimer PUBLIC HEARING, PROPOSED BUDGET, 1973-74 FISCAL YEAR 311 Mayor Bear opened the Public Hearing on the Proposed Budget for the 1973-74 Fiscal Year and welcomed Mr and Mrs. William Adkins, 13 Caballeros Road, who said they were present to hear about the budget and other matters on the agenda. The City Manager presented the proposed budget, and explained that the payroll for the Association had been shown together with the City payroll in the City budget as requested.b,y the Councilmen in January at a discussion regarding employee benefits. Mrs. Clifton said the Council is considering participating in the Public Employees Retirement System (PERS) and to do so it was her understanding that it would be necessary for the City to pay Association employees under an Administrative Services contract between the City and the Associ- ation. Following discussion Councilman Hesse moved that Counsel be direc- ted to prepare new contracts for Fiscal 1973-74 between the City and the Rolling Hills Community Association for gate services and for administrative services. The motion was seconded by Councilman Pear- son and carried by the following roll call vote: AYES: Councilmen Battaglia, NOES: None ABSENT: Councilman-Heinsheimer CITY COUNCIL REPORTS RIDING RING AT CITY PARK Hesse, Pearson, Mayor Bear Councilman Battaglia reported that a meeting had been scheduled with owners of property in the vicinity of the riding ring at the Gap to discuss possible acquisition of additional property in the area. PUBLIC UTILITIES COMMISSION APPLICATION NO. 54065, SOUTHERN CALIFORNIA GAS COMPANY A notice of filing of an application with the Public Utilities Commission of the State of California by Southern California Gas Company for authority to increase gas rates was presented to the Council. Mayor Bear ordered the matter held on the agenda for additional information from Councilman Heinsheimer. CITY MANAGER - NEW BUSINESS HARBOR PROPERTIES, LTD. - FRED FULD The Manager presented a letter dated May 21, 1973 from Mr. Fred Fuld Jr., 6 Georgeff Road, requesting that since construction of tennis courts had been completed, consideration be given to con- struction of a golf course within the City limits. Mr. Fuld stated that he would be happy to work with any interested group in explor- ing the matter. He reiterated his offer to work with any group interested in pursuing the idea, and said there would be a lot of problems and work involved, and said he had no specific area in mind when offering the suggestion. Mayor Bear thanked Mr. Fuld matter would be considered by the review of recreational --needs. PROPOSAL - NJP SPORTS, INC. 77 for his appearance, and said the Council in connection with their Mrs. Clifton presented an estimate 'from.NJP Sports, Inc,., Glen- dale, California for installation of screening on all perimeter fencing on both the old and new tennis courts, in the amount of $1,903.00. The Manager said the bid was the result of a request made at a joint meeting of theT&'inis Committee and Landscaping Com- mittee; they felt that a screen at the sides of the court will be necessary until landscaping develops enough to screen the court, and screening at the ends will always be necessary, even when the sides are screened by planting. Councilman Battaglia said that he felt the bid would be an excel- lent vehicle for pulling the tennis group together, and felt that they should be given the information so they could organize and raise the necessary funds. Since the Caballeros raise money through yearly dues for, -their projects, and the tennis courts have been open for over a month with no obligation imposed on any residents, Mr. Battaglia said the extras should be supplied by tennis players. Mrs.. Clifton introduced -Mr. Cliff Bundy, 2 Chuckwagon Road, who advised that he was present to represent Dr. Richard Hoffman, Presi- dent of the Tennis Club. Mr. Bundy said it was the understanding of the Tennis Group that the courts would be completed by the City, in- cluding lights, screening and anything else needed for play.. Individ- ual Councilmen said they would be willing to subscribe personally to a fund raising program, so the burden of some of the items needed would be on those using the courts, rather than the entire populace of the City. Mayor Bear said things will be needed from time to time for the tennis court, and he agreed that inasmuch as three courts were provided by the City, anything else needed or desired -should be furnished by those using -the courts. Mr. Bundy said he would advise the Tennis Culb of the comments -2- June 11, 1973 of the City Council. Mrs. Clifton said the courts will be closed the week of June 25th for application of the surface finish on the new courts. Mayor Bear ordered the matter held on the agenda for additional information following the meeting of the Tennis Group on June 26th. MIRALESTE POOL COMMITTEE 201 A letter dated May 31, 1973 from Marion -Ruth, Chairman of the Miraleste Pool Foundation, was presented to the Council. Mrs. Ruth said the Miraleste Pool is suffering from lack of members to carry the swimming program at a profit; two years ago the foundation lost $6,000 and the last year almost $4,000. She asked that the City consider donating administrative services, for which $1,500 is charged. Mayor Bear explained that the City staff hires swimming pool employees, provides reproduction services, payroll services, orders supplies, pays billa, and provides other services required. Mrs. Clifton explained that the other services include scheduling of cllasses, preparation of a budget, maintenance of a separate bank account, providing answers in response to telephone inquiries, since the City's telephone number is provided on all material distributed. Following discussion Mayor Bear directed the Manager to advise Mrs. Ruth that the matter had been brought before the Council, and the decision was made to continue providing administrative services to the pool foundation f6r a fee of $1,500. . . CALIFORNIA CONTRACT CITIES' 258 Correspondence from California Contract Cities Association dated June 1, 1973 was presented to the Council, advising that representatives of the Association will go to Washington, D.C. on June 20th to lobby for a revenue sharing proposal. The cor- respondence was received and filed. SOUTHERN.CALIFORNIA ASSOCIATION OF GOVERNMENTS 287 Correspondence from SCAG dated May 31, 1973 was presented to the Council, with.a;Committ,ee Membership,Request. Mayor Bear, delegate to SCAG., and Councilman.Pearson, alter- nate, indicated that they would be interested in serving on the Land Use and Growth Committee and the Environmental Quality Com-. mittee. A motion to so advise SCAG was made by Councilman Pearson, seconded by Councilman Battaglia and carried by the following roll call vote: AYES: Councilmen Battaglia, Hesse, Pearson, Mayor Bear NOES: None ABSENT: Councilman Heinsheimer AMERICAN REVOLUTION BICENTENNIAL COMMISSION 282 Correspondence dated May 25, 1973 from the American Revolution, Bicentennial Commission of California was presented to the Council. The Manager said correspondence on the matter is proceeding, and suggested that the Council may wish to join with other cities on the Peninsula in an observance. Mayor Bear ordered the matter held on the agenda. ESTIMATE, ADMINISTRATION BUILDING EXTERIOR 1085 The Manager presented an estimate for painting the exterior of the Administration Building in the sum of $1100, submitted by;Lee Curry who is currently painting the new City buildings. A motion to authorize an expenditure of not to exceed $1100 -3- June 11, 1973 for painting the Administration Building was made by Councilman Pearson, seconded by.Councilman Hesse and carried by the following roll call vote: AYES: Councilmen Battaglia, Hesse, Pearson, Mayor Bear NOES: None ABSENT: Councilman Heinsheimer COUNTY OF LOS ANGELES, MANPOWER PROGRAMS DIVISION 1128 Mrs. Clifton presented a letter dated June 7, 1973 from the Office of the Director of.Personnel, Manpower Programs Division, advising.that on June 5, 1973 the County Board of Supervisors approved the extension of the Public Employment Program through June 30, 1974. A motion to authorize the City Manager to execute the agreement and sign the contract was made by Councilman Hesse, seconded by Coun- cilman Pearson and carried by the following roll call vote: AYES: Councilmen Hesse, Pearson, Mayor Bear NOES: Councilman Battaglia ABSENT: Councilman Heinsheimer COUNTY OF LOS ANGELES, DEPARTMENT OF ANIMAL CONTROL 130 A fact sheet from the Department of -Animal Control, County of Los Angeles was presented to the Council. The annual rabies vaccin- ation clinic will be held from 7:00 P.M. to 8:30 P.M. on Friday, August 10th at Dapplegray School. Mayor Bear requested that the information be included in the Newsletter, and ordered the correspondence received and filed. Fear;s.on and -carried by -.the following roll call vote: -4- June 11, 1973 AYES: Councilmen Battaglia, Hesse, Pearson, Mayor Bear NOES: None ABSENT: Councilman Heinsheimer MATTERS FROM THE CITY ATTORNEY ORDINANCE NO. 115 Councilman Pearson moved that Ordinance No. 115 entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS, CALIFORNIA, AMENDING ORDI- NANCE NO. 67 ENTITLED "AN ORDINANCE OF -:THE CITY OF ROLLING HILLS REGULATING AND CONTROLLING THE DESIGN AND IMPROVEMENT OF SUBDIVIS- IONS AND OTHER DIVISIONS OF PROPERTY" be adopted, and that reading in full be waived. The motion was seconded by Councilman Battaglia and carried by the following roll call vote: AYES: Councilmen Battaglia, Hesse, Pearson, Mayor Bear NOES: None ABSENT: Councilman Heinsheimer The Manager advised that the hearing before the Planning Com- mission on Subdivision Requirements, especially consideration of requirements of net vs gross acreage for subdivisions, was very well attended and the matter.would be considred by the Board of Directors on Thursday, June 14, 1973 at a special meeting with the Planning Commission in attendance. PROPOSED TRAFFIC ORDINANCE 1035 The City Attorney presented a proposed Traffic.Ordinance, and asked that because of the length and importance of the document, the Council review it and be prepared to discuss it at the next meeting. A motion to introduce the proposed Traffic Ordinance which regulates traffic within the.City and amends Ordinances 1 and 16 and all other ordinances in conflict therewith was made by Councilman Hesse, seconded by Councilman Battaglia and carried by the following roll call vote: AYES: Councilmen NOES: None ABSENT: Councilman CITY DEPARTMENTS 1029 OFFICE OF THE SHERIFF Battaglia, Hesse, Pearson, Mayor Bear Heinsheimer The Sheriff's Department Report for the month of March 1973 was presented to the Council. The report was received and filed. LOS ANGELES COUNTY FIRE DEPARTMENT The Activity Reports of the Los Angeles County Fire Department for the months of March and April 1973 were presented to the Council. The reports were received and filed. MATTERS FROM THE COUNCIL MOTORBIKES & MOTORCYCLES 1062 In response to a question .from Councilman Battaglia,_the Mayor said a discussion of the proposed ordinance prohibiting operation of all motorbikes in the City of Rolling Hills had not been consid- ered because of the time devoted to the discussion of the proposed budget. The Mayor requested that the matter be carried on the agenda for the next Council meeting. -5- 1 1 June 11, 1973 NOISE ORDINANCE 1090 Mayor Bear stated that following the discussion about the advisability of adopting an ordinance prohibiting or limiting operation of contract equipment in the City on weekends, he ob-•,, served large equipment at work on a property adjacent to his early Sunday morning. Councilman Battaglia said he favored an absolute prohibition on operating equipment before 9:00 A.M. on Sunday, and no prohibition on Saturday. The City Attorney said the proposal submitted by Councilman Heinsheimer applied to non-residents only, but could cause a problem if operated by a resident. Coun- cilman Hesse suggested that the Council avoid adopting ordinances prescribing behaviour control, and regulate commercial enterprise in the City. The matter was held on the agenda for additional disassion when Councilman Heinsheimer returns. MATTERS FROM CITY OFFICERS 1240 Mr. William Kinley, City Attorney, reported that he had had a letter from the Attorney General stating that he had been requested to prepare an opinion of the legality of a city prohibiting use of motorcycles within its boundaries. Councilman Battaglia suggested that the CityAttorney could reply that an ordinance which is reasonable in scope, i.e. noise levels, types of bikes.with definable standards and enforcement abilities, is proper in the interest of public safety. The City Attorney said that since Rolling Hills has no public roads, it would not apply. ADJOURNMENT There being no further business to come before the meeting, the Mayor adjourned the meeting to a personnel session at 10:50 P.M.
