CITY' OF-'r'R0tLIW- HILLS September 11, 1973 A regular meeting of the City Council was called to order by Mayor Bear at 7:30 P.M., Tuesday,, September ll; 1973 at the Adminis- tration dm nistratiQn Building, 2 Portuguese Road Rolling Hills, California. ROLL CALL PRESENT: Councilmen Battaglia, Hesse, Pearson, Mayor Bear ABSENT: ALSO PRESENT: APPROVAL OF MINUTES Councilman Heinsheimer William Kinley. Teena Clifton Marion Welch June Cunningham Mr. & Mrs. Hugh Multer City Attorney City Manager City Treasurer Secretary Residents A'motion to approve the minutes of the meeting of August 27, 1973 as corrected was madeby Councilman Hesse, seconded by Councilman Bat- taglia and carried by the following roll call vote; AYES: Councilmen, Battaglia; He.gse, Pearson; :Mayor -Bear,- 'NOES: Tone ABSENT: 'Councilman Heinsheimer PERSONAL APPEARANCE Mr. 4 Mrs. Hugh Multer, 2 Outrider Road, 72 Mayor Bear welcomed Mr. and Mrs. Multer who had been invited to attend the meeting by the Manager, after receipt of their letter com- plaining about use of the trail between 2 and 4 Outrider Road by motorcycles. Councilman Battaglia advised them that the matter had,been re- ferred to the Rolling.Hills Community Association, and at the ad- journed ed meeting of the Board on,.Monday September 10th the.matter was discussed. He advised the Multers,that they would,be contacted by a representative of the Board to discuss fencing the area. CITY COUNCIL REPORTS HITCHHIKING 90 Councilman Battaglia advised the Council that he had requested that hitchhiking be included on the age ' nda for discussion by the Council. Because of the.dangers connected with hitchhiking, as reported in the news media, Councilman Battaglia requested that the Council consider whether -the practice should be restricted or pro- hibited in the City. Councilman Hesse said he agree -s that the problem is real, will "s,11remain and.probably will become more severe. It was -his observation that although hitchhiking has been relatively safe in Rolling Hills and there is a feeling of security, it could be the basis of a dan- gerous habit pattern, and should be inhibited. Councilman.Hesse sug- gested that the Council adopt an.,ordinance prohibiting hitchhiking, and enforce it with sensitive supervision. Further) he said benches could be provided for youngsters who are picked up by pre -arrangement. Councilman Hesse provided a copyofan article from the Los Angeles 76 September 11, 1973 Times on August 30, 1973 which reported that campuses are taking steps to'halt hitchhiking, and he suggested that some of the literature re- porting the dangers of hitchhiking be circulated throughout the Com- munity, and that all cities in Los Angeles County be contacted and asked to consider legislation prohibiting hitchhiking. Councilman Pearson..said`her'agreed With Councilman Hesse.on the . dangers involved in hitchhiking; and he felt the Community should be advised i�i a manner that would advise that the Council is concerned about hitchhiking, and not about sharing rides with known residents, as is currently done. Mayor Bear directed that residents be advised in the Newsletter that the matter is being considered by the Council and youth of the community should be encouraged to attend hearings. The matter was held on the agenda. RIDING RING AT CITY PARK 185 Councilman Battaglia reported that the matter of the riding ring to be constructed on a portion of the Robert Dunn property on -. Poppytrail had been discussed at the meeting of the Rolling Hills Community Association -on September 10th. Councilmen Hesse and Pearson asked to see the maps of the area. The Manager reported that South Bay Engineering Corporation will present an estimate at the next meeting of the City Council which will include the following: engin- eering fee, preliminary and final drawing charges, estimated develop- mental cost of grading, pipe, etc., and the cost of an Environmental Impact Report prepared by South Bay Engineering Corporation. Councilman Hesse suggested that the Manager consult with Foxfield Riding Academy and with Mr. Don Burt at Diamond Bar about the proper surface for English riding. The matter was held on the agenda. PUBLIC UTILITIES COMMISSION The item was ordered held on the agenda. CITY MANAGER - NEW BUSINESS PUBLIC EMPLOYEES' RETIREMENT SYSTEM Copies of a letter dated August 30,..:1973 and the actuarial report prepared.to determine the contributions necessary for,participation in the Public Employees' Retirement System were presented ,to the Council., The report was referred to Mayor Bear for review with -the City Manager. The matter was held on the agenda. LEAGUE OF CALIFORNIA CITIES 309 Correspondence dated August 24, 1973 from_ the League of Califor- nia Cities was presented to the Council. The League asked that the City Council designate a voting representative and an alternate to vote at the business sessions of the annua L conference in San Fran- cisco October 21 - 24, 1973. Mayor Bear moved that Councilman Battaglia and Teena Clifton, City Manager, be authorized to represent the City at, the Conference and vote on behalf of the City of Rolling Hills. The.motion.was seconded by Councilman Hesse and carried*by.the'following roll call vote: AYES: Councilmen Battaglip, Hesse, Pearson, Mayor Bear NOES: None ABSENT: Councilman.Heinsheimer -2- 77 September '11, 1973 RAPID. TRANSIT DISTRICT 329 A schedule of locations for Community meetings to explain Rapid Transit recommendations was presented to the Council. Mayor Bear requested that Councilman.Heinsheimer or Councilman Hesse, delegates, attend a local meeting and report to the Council. COUNTY ROAD DEPARTMENT REPORTS 358 Copies of report: by the Los Angeles County Road Department on speed limits on Eastfield Road, Crest Road, Portuguese Bend -Road and Saddleback Road, and Traffic Control Measures on Eastfield Drive and on Crest Road east of Buggy Whip in the La Cresta School Zone were presented to the Council. Mayor Bear directed that copies of the reports be sent to Mrs. I- Carol Hanscom and.Mrs. Florence Ziegler, members of the Traffic 'JD Commission, for review and comment, and ordered the matter held on ,r__4 the agenda. Councilman Battaglia reported that a plan for the Southfield Q g P P -_ Gate area would be submitted to the .Board of Directors on S.eptem- -ber 20, 1973 and a final decision on whether to close the gate would be announced at that time. PAYMENT OF BILLS CITY OF ROLLING HILLS 352 Councilman Battaglia moved that Demands No. 2973 through 2981 be approved for payment from the General Fund. The motion was seconded by Councilman Hesse and carried by the following roll call vote: AYES: Councilmen NOES: None ABSENT: Councilman MIRALESTE POOL 355 Battaglia, Hesse, Pearson, Mayor Bear Heins heimer Councilman Battaglia moved that Demands No. 293 through 298 be approved for payment from the Miraleste Swim Pool Fund. The motion was seconded by Councilman Hesse and carried by the following roll call vote: AYES: Councilmen Battaglia, Hesse, Pearson, Mayor Bear NOES: None ABSENT: Councilman.Heinsheimer CITY ATTORNEY PROPOSED ORDINANCE -MOTORCYCLES & MOTORBIKES 675 The City Attorney distributed copies of a proposed ordinance which would amend Ordinance No. 116 by adding Sections 23136 and 23141, and would regulate operation.of motorcycles or motor driven cycles in the City of Rolling Hills. Following discussion, Councilman Battaglia suggested that Coun- cilman Hesse and the City Attorney meet for a working session to dis- cuss the proposed ordinance. Mayor Bear so ordered. -3- September 11,.1973 PROPOSED ORDINANCE - PROVIDING FOR ZONING Mr. Kinley presented copies of a proposed ordinance providing for zoning in the City. In discussing the proposed ordinance, Councilman Hesse moved that sub -paragraph #1 be amended to read: "The portion located within any, existing or proposed private street or road-----". The motion was seconded by Mayor Bear and carried by the following roll call vote: AYES: Councilmen Mayor Bear NOES: None ABSENT: Councilman Battaglia, Heinsheimer, Pearson Heinsheimer Councilman Pearson moved that the proposed:ordinance be amended to exclude any reference to "RAS -2 zone" and "80,000 square feet". The motion was seconded by Mayor Bear and failed to carry by the following roll call vote AYES: Councilmen Pearson, Mayor Bear NOES: Councilmen Battaglia, Hesse ABSENT: Councilman Heinsheimer Councilman Pearson asked that the City Attorney be requested to clarify roadways to,more clearly identify those roadways that are access roadways, whether in the Association or out of the Association, access to flag lots, paved drives, non -dedicated roads such, as Humming- bird Lane, to differentiate from those roads which are considered per- imeter easements and are not used for access. Mayor Bear requested that the proposed ordinance, as amended, be presented to the Council at the next regular meeting. MATTERS FROM THE AUDIENCE 756 ROLLING HILLS TENNIS CLUB The Mayor welcomed members of the board of the Rolling Hills Tennis Club following adjournment of their meeting in another room of the Administration Building. Mr. Cliff Bundy, president, announces} that the club has more than 20 paying members at present, additional -memberships are coming in. Mr. Bundy said the board was surprised to,learn of the 9 P.M.._ lights -out rule initiated by the City Council, and advised that the Tennis Club has a "rules and constitution" committee which is pres- ently drafting a constitution and set of rules, among them a suggested .set of rules for reserving the court. He asked that the Council re- view the rules in draft form when prepared, and suggested that at that time the Council re -consider extending the hours of evening play. using the lighted courts. A survey.of otter courts in the area dis- closed that most close at 10 P.M., and a`few surveyed operated until 11 P.M., Mr. Bundy said. Mayor Bear explained that the last meeting of the Council was recessed at 9 P.M. to allow the Councilmen to inspect the Court, and it was the consensus of the Council that until landscaping in the -area had been completed and comments of residents in the area received, it -was better to set a limit that could be extended, rather than one that would have to be shortened. Dr. Richard Hoffman said it would be desireable to establish liaison between the Council and the Tennis Club, so that in the future tennis matters could be presented to and considered by both, even though the ultimate decision might be made by the Council. Councilman Hesse said it is his opinion that noise, as well as light, can be a -4- 1 September 11, 1973 problem, and he suggested that light screens might be insta'lled,.then the situation evaluated by discussing the noise,and light factor with' residents close to the court. It might then_.be possible to extend the evening hours, Councilman,.Hesse said. Councilman Pearson said that reason has to enter into the decision and because lights are primarily to extend the playing time to accomo- date working men who cannot play during earlier hours, a reasonable time should be arrived at to accommodate both tennis players and resi-, dents in the area of the tennis court. Councilman Battaglia reported that the Rolling Hil.1s..Community,.,,, Association is inviting bids for landscaping in the Main Gat0`-Tennis Court area, and bids will be opened at the meeting of the Board on Thursday, October 4th at 7:00 A.M. Mr. Battaglia said the'pplans wouldbe shown to the Tennis Committee. �.,. MATTERS FROM CITY OFFICERS 00 ENGINEERING SERVICE, REVISIONS TO CITY MAP, SOUTH BAY ENGINEERING' The Manager presented a proposal from South Bay Engineering Q Corporation for revisions to the city map as follows: Add all new tracts and lot splits Add new easements and quit claims Change easements in D.R. 150-A.area. Prepare easement map Prepare zoning map t Mr. Raymond Quigley advised .that the engineering services, would not exceed $2,000.00 and reporduction and photographic work is esti-,,....A._ mated at approximately $500.00. A motion to approve and accept the proposal was made by'Council- man Battaglia, seconded by Councilman Hesse and carried by the follow- ing roll call vote: AYES: Councilmen Battaglia, Hesse, Pearson, Mayor.Bear NOES: None ABSENT: Councilman Heinsheimer ADJOURNMENT There being no further business to come before the session, a`. motion for adjournment was made at 11:55 P.M. by Councilman Battaglia, seconded by Councilman Hesse and carried unanimously..
